You see, the United States government is the largest publisher in the world, producing
thousands upon thousands of “products” on a daily basis and by law, works prepared by
the US federal government officers or employees as part of their official duties are not
copyrightable. What does that mean to you?
Before we go any further you may be wondering what the heck does public domain
mean. Well here is a brief definition...
A public domain work is a creative work that is not protected by copyright and
which may be freely used by everyone. The reasons that the work is not protected
include:
The term of copyright for the work has expired; the author failed to satisfy statutory
formalities to protect the copyright or the work is a work of the U.S. Government.
Although the vast majority of government created works are in the public domain there
are those cases when a work created by the US Government is not public domain.
Here is an example.
Let’s pretend the US government hires a writer to produce a publication. Since the
writer is an independent contractor, the writer will own the copyright in their work
unless the writer assigns it to the government. In which case the US government will
then hold the copyright on the produced work making it available to the general public.
However, the independent contractor may decide to keep the copyright which means
you have no rights to claim that work.
On a side note, be careful when dealing with works produced by individual states,
although the majority of US government works are public domain, works
produced by individual states usually hold a copyright by said state meaning you
cannot use them as your own.
• Take small reports on the same subject and create one massive report, using each
individual report as a chapter and create a mini-site around this subject and sell
the report to your email subscribers and site visitors.
• Create foreign language courses. You could deliver these lessons by subscription,
make them part of a paid membership site, provide them as a free bonus for travel
products and so on.
• The US government routinely releases information on taxes, health care and other
government policies into the public domain. If you are involved in providing
consulting services in any of these areas, using the public domain as an important
resource for your website will help build trust and more importantly, increase
both your traffic and your conversion rates.
• Government agencies are constantly churning out information guides, and people
are hungry for information. Identify an information need, then compile and
repackage the government report to create your own unique product.
The possibilities are quite endless and I can go on and on with product ideas. Put on
your thinking cap and I'm sure you can come up with over a dozen ways to profit from
US government public domain works yourself.
