A MESSAGE FROM JOHN MUSUMECI - TO ALL UNION BROTHERS AND SISTERS

PLEASE READ VERY CAREFULLY


If you do not understand the rules, how will you know when your rights are being violated?

On November 15, President DʼErrico, used trickery and violated the UBC Constitution in an effort to
intentionally hinder your rights and prevent YOU from voting on a motion for a copy of the meeting minutes.

I want to be very clear so there is no misunderstanding, It is not the meeting minutes at issue here, it is your
trust, democratic rights, and the constitution continuing to be violated at issue here.

The membership is entitled to respect and all manner of information about the union, collective bargaining,
minutes, expenditures, the carpenters market share in the industry, corruption, and Benefit Funds.

We should be able to “ask important questions, get complete answers, debate the real issues affecting our
future and not run the risk of being knocked senseless by some “tough guy” as we leave the premises.”

The membership is fed up with the legions of leaders who give us “little or no meaningful information” and
who see union service as a means to enrich themselves.

The duties of the president are spelled out, among other things, he is to be the presiding officer at all
meetings, enforce and be knowledgeable in the constitution and laws of the Brotherhood, decide all
questions of order, subject to appeal, facilitate (make easier) the meeting, not to dictate what happens in the
meeting, be honest, fair and remain neutral from partisan politics.

President DʼErrico faces potential union charges for allegedly violating his duties, your rights and the
constitution. Our new Inspector General has been made aware of the violations and we call upon him to
investigate and if warranted penalized those that violate our trust, rights and the rules and regulations.

In light of the corruption and sentencing of Mike Forde to 11 years in prison, carpenters have been abused in
the most egregious ways over a 10-year period. If our union is to survive and overcome corruption, court
orders and monitoring, it's vitally important that leaders be held not to the lowest standard, but to a higher
standard. It's also vitally important that members have full faith in the integrity of their leaders.

The “damage caused by Mr. Forde's conduct has been and is, in a word, devastating, if not irreparable.”

Our beleaguered membership isnʼt just mad as hell. We want those who defraud and continue to abuse our
rights to face justice. Leaders must abide by all UBC and District Council rules and regulations.

We are tired of the double standard and will no longer tolerate leaders breaking the rules and laws of the
Brotherhood.

Laws and rules cannot just mean something to some of us. They must mean the same to all of us.

We are furious because for too long our union operates in a parallel universe, where the people elected and
hire to represent us too often believe they rule us.

They enforce the laws, then demand exemption for themselves.

President Lawrence DʼErrico has become the latest example of this double standard, by continuing to
abused and violate our rights and fail to abide by the Constitution and Laws of the Brotherhood.

Fortunately we have a new ally in Review Officer, Dennis Walsh. Finally, and clearly, the rules are changing
before our eyes. A new reform era is beginning in our union and justice will be served!

Review Officer, Walsh, has issued his first “Interim Report,” which is posted on local157.blogspot.com.
The report is riveting, there is no stone being left unturned, and is a must read for all members.

COUNT ONE: VIOLATION OF RULE 5 BY NOT FOLLOWING ROBERTS RULES OF ORDER

On November 15, a new motion was made for a copy of the meeting minutes. The motion for the meeting
minutes was previously defeated at the October 15, meeting. The new motion was denied, and ruled and
instructed, to be stated as a "motion to reconsider."

Rule 5 states, "all questions of a parliamentary nature shall be decided by Roberts Rules of Order."

According to Roberts, a motion that has been previously defeated, can be brought up again at the next
meeting, as new, if the meeting is a different session, which is the normal situation.

COUNT TWO: VIOLATION RULE 31 BY GIVING INCORRECT INSTRUCTIONS

Rule 31 states, "a motion to reconsider must be made and seconded by two members who voted with the
prevailing side."

In other words only a member who voted to defeat the motion at the October 15, meeting can make and
second the "motion to reconsider." Rule 31 was violated by giving incorrect instructions to state the "motion
to reconsider."

COUNT THREE: VIOLATION RULE 31 BY ACCEPTING MOTION TO RECONSIDER

Only a member who voted to defeat the motion could make the "motion to reconsider."

COUNT FOUR: VIOLATION RULE 17 BY DENYING AN APPEAL

A point of order was raised, stating the membership has been intentionally misled by trickery. An appeal
from the decision of the chair was raised, which was denied.

Rule 17 states, The president must relinquishing the Chair to the Vice President and stating the appeal
to the meeting in these words: "Shall the decision of the Chair be sustained as the decision of the Union?"

COUNT FIVE: VIOLATION RULE 4 BY ENGAGING IN PARTISAN POLITICS

Rule 4 states, Partisan politics shall not be permitted in the meeting under any circumstances.

COUNT SIX: VIOLATION SECTION 51A(6) DEFRAUDING THE BROTHERHOOD

By use of trickery in an effort to intentionally mislead and misinform members, you hinder members rights
and prevented members from voting on a motion for a copy of the meeting minutes. You defrauded
members in an effort to obstruct members right to make motions and participate fully in the meeting.

COUNT SEVEN: VIOLATION SECTION 51A(13) VIOLATING THE OBLIGATION

You breached your promise as stated in the Obligation of the United Brotherhood and Joiners of America
by failing to abide by the Constitution and Laws of said organization.

To wit: as set forth in Counts One through Six. By denying an appeal you made it apparent that you have
shown yourself to be a dictator, not a facilitator when presiding over meetings. You have engaged in
partisan politics and failed to remain neutral. You failed the oath to execute the duties of your office to the
best of your ability, and to preserve protect and defend the UBC Constitution.
