A. STATUTORY NUMBERS
1. This bulletin summarizes the availability of
immigrant numbers during January. Consular
officers are required to report to the Depart-
ment of State documentarily qualified appli-
cants for numerically limited visas; the Bureau
of Citizenship and Immigration Services in the
Department of Homeland Security reports ap-
plicants for adjustment of status. Allocations
were made, to the extent possible under the nu-
merical limitations, for the demand received by
December 8th in the chronological order of the
reported priority dates. If the demand could not

demand was excessive was deemed oversub-
scribed. The cut-off date for an oversubscribed
category is the priority date of the first appli-
cant who could not be reached within the nu-
merical limits.
Only applicants who have a priority date
earlier than the cut-off date may be allotted a
number. Immediately that it becomes neces-
sary during the monthly allocation process to
retrogress a cut-off date, supplemental requests
for numbers will be honored only if the priority
date falls within the new cut-off date which has
been announced in this bulletin.

2. Section 201 of the Immigration and Nation-
ality Act (INA) sets an annual minimum fami-
ly-sponsored preference limit of 226,000. The
worldwide level for annual employment-based
preference immigrants is at least 140,000.
Section 202 prescribes that the per-country
limit for preference immigrants is set at 7% of
the total annual family-sponsored and employ-
ment-based preference limits, i.e., 25,620. The
dependent area limit is set at 2%, or 7,320.
3. Section 203 of the INA prescribes prefer-
ence classes for allotment of immigrant visas
as follows:

gray seat belts. Richard
started the car and drove

thing to his wife. He knew
she was upset by the things
she’d heard at Ngozi’s
place. He was upset too.
Who wouldn’t be? He
didn’t bother to look at
Tammy. She was probably
crying as she usually did
when someone brought up
the issue of their childless-
ness. He drove on silently,
both of them busy with
their thoughts, handling
their emotional pains.
Why had Tammy not con-
ceived a child? God, are
we missing it somewhere?
Richard silently asked
God as he had been doing
since they began to go for
medical tests and treat-
ments, and seeing fertility
experts. It was Tammy who
first expressed concern and
went to see their family
doctor when she found
she was not yet pregnant
six months after wedding.
The doctor had told her
that she should not worry
and that there was no cause
for alarm until if twelve
months of regular sexual
relations with her husband
failed to result in concep-
tion. She relaxed a little,
praying harder.
But when another six
months passed and it had
not happened, Tammy
went back to the hospital.
This time, he accompanied
her to hear what the doctor
would say. Since then, she
had been frequenting dif-
ferent hospitals for tests
and treatments, and some
of the doctors insisted on
seeing him too for exami-
nations, yet, they were still
without a child.
Lord, we are not living in
sin, and we are praying
and serving You. We didn’t
mess around before we
got married. Our family
members are also praying
with us. Why have You not
given us a child? Tell me
what we need to do, Lord?
Richard’s heart cried out.
When he stopped at a traffic
light, he glanced briefly
at his wife. He saw tears
dripping down beneath her
closed eyes as her head laid
on the head rest. He knew
it. He drew in a deep breath
as he returned his gaze to

powerless or not praying
enough just because the
senior pastor had one child
and the other didn’t have
any child yet?
Richard shook his head
in thought. If the man’s
mother could make chil-
dren or knew how they
could have children, why
then had she not given them
children before they joined
the church? Moreover,
even if he talked to the
man, he might not return to
the church as it seemed the
mother had a strong control
over him. Well, he would
think more about the matter
later, Richard decided.
He shook his head sadly
again. This life! He used
his right thumb nail to tap
his two front teeth impa-
tiently.
The light changed to green
and he drove on. He caught
up with the white car in
front of him. He flicked on
the signal light and over-
took the car.
Tammy opened her eyes,
pulled a Kleenex tissue
from the box on the dash-
board and wiped her face.
Richard looked at her
briefly and back at the
road. He replaced the right
hand on the steering wheel
with the left hand, and took
Tammy’s hand with his free
hand, placing it on his thigh
silently.
That act seemed to loosen
her tongue. She cried,
“God, why?” as she re-
membered the scene in her
office.
He squeezed her hand
gently.
She closed her eyes again
as she thought about their
situation. This was not
what she expected. She
continued to think of some
people’s looks and com-
ments about her childless-
ness.
Richard’s voice interrupted
her thoughts as he sighed
and called her full name,
“Oluwatamilore?”
He usually called his wife
‘honey’ or ‘Tammy’, an
abbreviation of the last
eight letters of her name
‘Tamilore’. He called her
full name ‘Oluwatamilore’
which meant God gave me
a gift, when he wanted to
win her over or plead with
her.
He hadn’t called her full
name in a long while,
Tammy thought, but this
was not the time to analyze
or ask why. She remained
silent.
Richard looked at her
briefly. There was no sign
that she’d heard him. Her
eyes remained closed, the
tears still coming. It was
obvious Tammy was not
happy but crying would not
solve the problem, would
it? He sighed.
“You don’t need to cry.” He
told her confidently.
That confidence again,
Tammy thought. But it
couldn’t give her what she
wanted, a child.
“You know very well that
what the woman said is not
true. You shouldn’t weep
when you hear such talks.”
Richard said.
The words he said seemed
as if he was scolding
her which upset Tammy
further. When he talked
to other people, he used
a voice that told them he
understood them but when
talking to her he used a
voice that said he expected
her to know better. Should
she not be concerned about
their childlessness after
almost seven years of mar-
riage? And should he not be
more understanding?
She didn’t respond as she
compressed her lips.
He continued, “They don’t
matter. We both know they
are wrong and that we will
have kids someday. Delay
is not necessarily denial.”
She didn’t respond still as
she silently asked the ques-
tion, ‘But when?’
“I understand how you
feel.” He said.
How could he understand
how she felt? She thought.
He was a man, not a woman.
How could he know how
much people’s thoughtless
comments hurt her? She
was the one people usually
pointed at, not him. It was
her tummy they looked
at for signs of pregnancy,
not his. How could he un-
derstand the pain and the
shame she faced regularly?
She remembered a time
when one of his relatives
had come from their home-
town and asked her, “Are
you now pregnant?”
Tammy had replied
angrily “Only God makes
babies,” and went inside
the bedroom. She knew the
comment and her action
had angered the woman,
more so as the woman was
an older in-law but that
was the third time during
the course of their then
three year old marriage
that the woman would be
asking her such a question
and Tammy was tired of
it. The woman had called
Richard immediately and
complained to him. He’d
defended Tammy but still
advised her to apologize
to the woman for walking
out on her. The woman had
not bothered Tammy again,
though.
How could he know how
hurt and embarrassed she
was by the comments of
Pat in her office? And how
could he know how bad
she felt afterwards at her
own reaction to the com-
ments? Tammy could still
remember the sorry look on
Pat’s face and the pity look
Mercy had given her.

Cancellation of Removal

s we approach

and are still basking in
their victories at the poll
in November 2010. They
are poised to take over the
House of Representatives
with a mandate to make
life difficult for all illegal
immigrants in the United
States.
As immigrants, we are in a
desperate moment requir-
ing a very desperate deci-
sion. The U.S. Immigra-
tion News will highlight
on a monthly basis some
of the available avenues
to obtain permanent resi-
dent status in the United
States without any need to
wait for the passage of the
Comprehensive Immigra-
tion Reform which might
not materialize under
President Obama’s presi-
dency.
Let me add these caveats
from the onset; some of
these unconventional
avenues of obtaining per-
manent resident status
are not straight forward.
It is imperative that you
consult with a qualified
immigration attorney to
know the risks and gains
involved in seeking any
particular form of relief,
otherwise, you could end
up being deported while
trying to gain status in the
U.S.
Cancellation of removal
is a form of relief avail-
able to immigrants in the
United States who meet
certain conditions. This
form of relief is gener-
ally available before the
immigration court. For
those who are already
before the court due to
one reason or the other,
the decision to apply for
cancellation of removal is
easy because they have no
choice, but for those who
are not before the court a
careful review of the re-
quirements must be done
with an attorney before
embarking on the journey.
It is important that every
immigrant learn to ask
pointed questions from
their attorney about how
he/she intends to satisfy

There are two types of
cancellation of removal
as a form of relief. The
first one is for immigrants
who are already green
card holders who are on
the verge of losing their
permanent resident status
because of one reason or
the other usually criminal
conviction. Some of these
aliens are in immigration
detentions under manda-
tory detention rules even
though they have been
green card holders for
many years. I recently
rescued one from a New
Jersey Immigration Court
after about 6months of
incarceration. I was able
to secure the return of
his green card through
the use of cancellation of
removal.
The second type of can-
cellation of removal is
meant for aliens in the
United States who are
without any legal status.

inspection while some

situation is not totally hopeless. As long as you attend all
court hearings, you will not be deported if you are apply-
ing for relief. Usually, you should get the letter informing
of the court date in about two months. What you need to do is to simply fol-
low my advice in the article you read. You will need to retain a qualified im-
migration attorney immediately. Let the attorney try to buy you enough time
to obtain the divorce and get set to marry again. From the information you
provided, marriage might be the only way for you to rescue yourself from
the immigration court at the moment. Let me assure you also that you did the
right thing by not going to the second interview with uncooperative spouse. If
you had attended that interview and denied, your situation would have been

lives in Antigua. She has a B1 visa. Could we get married and I petition for
her as a green card holder? If this is possible, would it be better for me to
petition for her while she lives in Antigua or have her come here; marry her
then do the petition for her here? I’ll be extremely grateful if you can reply to
these questions as soon as possible.
I want to believe you consulted with an immigration
attorney after reading about the opportunity rather than
stop at just writing a letter to seek advice. If you did not,
you just missed a golden opportunity to help your son. I
expected you to be more serious and desperate especially
because your son will soon be heading to college and also will age out in
a few years. It appears that you have not even filed I-130 petition for alien
relative for him. My simple advice at this time is that you file the petition
immediately to retain a priority date. As for the opportunity, you will need to
become a U.S. citizen now for your son to be eligible to adjust his status in
the U.S. Please start the process with your green card and upgrade when you
become a citizen. Let me ask you, how did you obtain your green card? If
through marriage, I hope you reported having a son during the process other-
wise you could loose your green card too for not telling the truth. As per your
girlfriend, please consult with an immigration attorney before making any

Your approach is a winning approach. It is good
to be prepared and ahead of things. The Diversity
Visa lottery result will be released on or about April
2011. The requirements for claiming your green
card still remain the same. The facts of your case is highly unusual, it
does not appear that the U.S. Citizenship & Immigration Services will
accept incomplete result. Assuming you win, the winning notice will
be given to about 100,000 applicants, but only about 55,000 will actu-
ally get their green cards from the process. Any little error is a ground
for denial. So you will need to deal with the authorities in your country
to secure your full result. Let me also note that since you reside in the
United States, you will need a pre-April 30, 2001 petition that was filed
for your benefit to adjust your status if you win. I want to assume that
the approved I-130 in your hand meets this requirement. Good luck.

I don’t know the person who advised you, but you
really messed up badly. How can you leave an em-
ployer who was willing to petition for you in this
current state of things in the U.S. for an employer
not willing to help you? More importantly, you were
almost getting to the finish line of the 5years ordeal, only to abandon the
process as you said for a better paid job. Another one year of patience
could have solved your problem and you will live to make the money in
the future. As of this month, the priority for nurses is March 22, 2005. I
do not know the full details of your case, but it appears that you missed
the ball. Marriage might be what is left.
