National Insurance Company Limited is India’s Oldest General Insurance Company. It
was incorporated in Kolkata, West Bengal on December 5, 1906 to fulfil the
nationalist aspiration for Swaraj. 66 years later, after passing of General
Insurance Business Nationalisation Act in 1972, it was merged along with 21 foreign
and 11 Indian companies to form National insurance Company Limited, one of the four
subsidiaries of the General Insurance Corporation of India, fully owned by Govt. of

d) In respect of compromise/negotiated settlement arrived under Common Mechanism
for Compromise Settlement of Third Party Claims (CMCSTPC) Scheme, financial

Cases in which Pay And Recover awards are being passed:-

While the pay and recover awards are being accepted by Insurance Company in the
case of 1, 2 & 3; in other cases i.e. 4 to 8 the position of law is well settled
that the insurance company can’t be held liable to pay compensation and as such the
pay and recover awards in such cases needs to be appealed against based on the
merit of each case and after meticulously perusing the efforts made at the trial
stage and cost benefit analysis.
 
 
MOTOR THIRD PARTY CLAIMS MANUAL
 
 
STEPS TO BE TAKEN DURING TRIAL STAGE:
 
 To analyse the case as soon as summons with claim petition copy and/or
investigation report is received as to whether the case falls in the ambit of Pay
and Recover
 And if so, a separate investigation should also be made simultaneously preferably
by a senior investigator to ascertain the details as follows:-
o To make general inquiries of the personal details of the insured (social status,
place of residence, near kith and kin etc.)
 
o To ascertain the details of his earnings i.e. trade, business, industry, service,
professional career etc.
 
o Details of movable property and their values in the name of the insured and his
family members
 
o Details of Immovable property and their values in the name of the insured and his
family members
 
o IT returns filed by the insured for the last three years.
 
o Details of bank account of the insured/shop/firm/company.
 
o Any other relevant information regarding the financial condition of the insured.
 
 
 The material information and documents collected along with investigator’s report
should be supplied to our counsel for dealing of the case and for putting up
effective defense so that exoneration can be procured in company’s favour.
 
 Separate miscellaneous petition has to be filed before the Trial Court for
issuing direction to the RTO or to the revenue authorities for not transferring the
assets in the name of the insured without the permission of the Court
 
 
 A plea should be taken before the Tribunal to the effect that copy of the pay and
recover order should be served on the concerned RTA and property registration
authority so that the vehicle owner is prevented from disposing the vehicle and/or
is immovable property until the realization of recovery amount.
 
 The Endeavour of the advocate should be to procure exoneration and cite relevant
case laws.
 
 
STEPS TO BE TAKEN AFTER THE AWARD:
 
 The recovery petition under section 174 r/w 149(4) of M.V. Act, should be filed
before the same tribunal which passed the pay and recover order.
 
 The petition should be filed for direction to RTA against transfer of the insured
vehicle.
 
 Registered AD letter should also be sent to the concerned RTA informing about
such recovery proceeding and not to allow any application for transfer of the
insured vehicle.
 While satisfying the pay and recovery order, separate petition is to be filed
along with recovery petition with the prayer to issue notice to the insured or
vehicle owner to furnish security and till such time the amount deposited should
not be released to the claimants as per the decision of Hon’ble Supreme Court in
the case of Oriental Insurance Company vs. Shri Nanjappan and Ors., 2004(2) TAC 12
(SC)
 
The decision to file appeal in the case where recovery right is granted will depend
on case to case basis on merits, after meticulously perusing the efforts mad
SECTION 66: NECESSITY OF PERMIT
 
General Rule: For all transport vehicles used or intended to be used at public
place shall be required to obtain permit from the transport authority.
 
Exception: It shall not apply-
 
1) to any transport vehicle owned by the Central Government or a State Government
and used for Government purposes unconnected with any commercial enterprise;
 
2) to any transport vehicle owned by a local authority or by a person acting under
contract with a local authority and used solely for road cleansing, road watering
or conservancy purposes;
 
3) to any transport vehicle used solely for police, fire brigade or ambulance
purposes;
4) to any transport vehicle used solely for the conveyance of corpses and the
mourners accompanying the corpses;
5) to any transport vehicle used for towing a disabled vehicle or for removing
goods from a disabled vehicle to a place of safety;
6) to any transport vehicle used for any other public purposes as may be prescribed
by the State Government in this behalf;
7) to any transport vehicle used by a person who manufactures or deals in motor
vehicles or builds bodies for attachment to chassis, solely for
8) such purposes and in accordance with such conditions as the Central Government
may, by notification in the Official Gazette, specify in this behalf;
 
9) to any goods vehicle, the gross vehicle weight of which does not exceed 3,000
kilograms;
 
 
10) subject to such conditions as the Central Government may, by notification in
the Official Gazette, specify, to any transport vehicle purchased in one State and
proceeding to a place, situated in that State or in any other State, without
carrying any passenger or goods;
11) to any transport vehicle which has been temporarily registered under section 43
while proceeding empty to any place for the purpose of registration of the vehicle;
12) to any transport vehicle which, owing to flood, earthquake or any other natural
calamity, obstruction on road, or unforeseen circumstances, is required to be
diverted through any other route, whether within or outside the State, with a view
to enabling it to reach its destination;
13) to any transport vehicle used for such purposes as the Central or State
Government may, by order, specify;
 
14) to any transport vehicle which is subject to a hire-purchase, lease
hypothecation agreement and which owning to the default of the owner has been taken
possession of by or on behalf of, the person with whom the owner has entered into
such agreement, to enable such motor vehicle to reach its destination; or
 
15) to any transport vehicle while proceeding empty to any place for purpose of
repair;

of the deceased provided employment to the widow on compassionate ground—Award was
passed by Tribunal and upheld by High Court— Appeal before Apex Court by Insurance
Co. contending that benefits which the claimant has received because of
compassionate job, should have been deducted while computing compensation—Held: the
High Court lost sight of the fact that the benefits which the claimant receives on
account of the death or injury have to be duly considered while fixing compensation
. The award passed for Rs.8,48,106/- was reduced to Rs.500000

In Master Mallikarjun Vs. NIC AIR 2014 SC 736

Apex  court  is  that  in  addition  to  the  actual

expenditure  for  treatment,  attendant,  etc.,  the


compensation should be, if the disability is above
10% and upto 30% to the whole body, Rs.3 lakhs;
upto 60%, Rs.4 lakhs; upto 90%, Rs.5 lakhs and
above 90%, it should be Rs.6 lakhs.
S. Manickam Vs. Metropolitan Transport Corp.
Ltd., (2013)ACJ1935SC: Whether compensation
in a motor vehicle accident case is payable to a
claimant   for   both   heads,   viz.,   loss   of
earning/earning  capacity  as  well  as  permanent
disability.  Held  –  in  addition  to  the  amount
determined by the High Court, we grant a sum of
Rs. 1,00,000/- as awarded by the Tribunal, towards
85% permanent disability

If the Claim Petition does not disclose any Policy particulars or particulars
disclosed are not sufficient for locating the Policy issuing office, then the
Advocate should be instructed to file a petition before the MACT u/s 169(2) of the
M.V. Act, 1988 with a prayer for disclosing better Policy particulars by the
Claimants / Vehicle Owner in the mean time the claim to be registered as orphan
claim17 with adequate provision i.e. for the first year 1/3rd of the expected
liability and after one year if the claim is still identified as orphan, then 100%.

If O/s Provision is more than Rs.25 lacs & upto 50 lacs, approval to be sought for
Advocate's appointment in prescribed format from Regional Office.
 
ii. If O/s Provision is more than Rs. 50 lacs, approval to be sought for Advocate's
appointment in prescribed format from Head Office through R Registration of claim
by the servicing office within 24 hours of receipt of the summon & petition.
 
2. Appointment of the Advocate & Investigators within 2 working days of the receipt
of the court summon.
 
3. Documenting with Policy copy & Section 64VB within 3 working days of receipt of

10. The Written Statement & the Written Arguments for High Value Tribunal Cases

Department, which will be approved by HO & communicated to ROs within 2 working
days.
