MIMAROPA REGIONAL TRIPARTITE MONITORING BODY (RTMB)

RESOLUTION NO. 01-20

A RESOLUTION INSURING CONTINEOUS MONITORING AND


SUBMISSION OF STATUS REPORT BY THE RTMB

WHEREAS, a Memorandum was issued by the Bureau of Labor Relations


of the Department of Labor and Employment requesting for updates on cases
identified by the International Trade Union Confederation (ITUC) of alleged extra-
judicial killings, harassment and persecution of trade unionists most of whom are
members of the Alliance of Concerned Teachers (ACT);

WHEREAS, for Region IV-B MIMAROPA, the case involves harassment


allegedly committed by members of the Philippine Army against Mrs. Maria Cristy R.
Borbe, the Secretary General of ACT MIMAROPA and Deped school teacher;

WHEREAS, Ms. Borbe reported the incident to the Officials of Barangay


Sto. Nino, Calapan City having jurisdiction of the place where the alleged
harassment was committed, to the Division Office of the Department of Education
and to the Alliance of Concerned Teachers National Level;

WHEREAS, the Armed Forces of the Philippines through Col. Jose Augusto

Villareal the Brigade Commander of the 203 Brigade Infantry Battalion Philippine Army
based in Bansud, Oriental Mindoro denied the involvement of any member of the
Philippine Army under his command. The leadership of the Philippine Army has
maintained its professionalism with the aim to develop a world class Army and a
source of national pride and will not tolerate any of its members to commit such acts
of human rights violations. The comment is hereto attached to form part hereof;

WHEREAS, according to Col. Villareal, the two personalities who allegedly


harassed Ms. Borbe were not yet identified as member of any unit in the Philippine
Army and maybe an act of the CPP-NPA to discredit the good name of the AFP and
considered as deceptive tactics of the terrorist group to gather information for their
future terrorist activities.

WHEREAS, no formal complaint was filed by the alleged victim of


harassment, Ms. Maria Cristy Borbe despite ample opportunity to do so;

WHEREAS, the RTMB will continue to monitor the alleged harassment and
submit status report as the need arises;

all members of the RTIPC and its sub Committees including the RTMB is tasked to
report in any manner such information or situation of potential and actual violations
on the right to association and organization in MIMAROPA;

WHEREAS, all members of the RTMB will fully cooperate in the conduct of
verification, documentation, evidence and data gathering, monitoring and processing
of information, complaint and cases involving violations of workers right to
association and organization pursuant to AO 32 series of 2018;

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY


RESOLVED, insuring continuous monitoring of the alleged harassment and
submission of status report by the RTMB.

RESOLVED FURTHER, to furnish copies of this Resolution to the


National Tripartite Industrial Peace Council Monitoring Board through the Bureau of
Labor Relations.

Approved during the RTMB Meeting, as reflected in the Minutes of the


Meeting held on 14th day of October 2020 via videoconference.
