PRE-EMPLOYMENT AGREEMENT

This Agreement is made this <date>, by and between:

KEYTANA BUSINESS PROCESSING, INC. (“the Company”), a corporation duly


organized and existing under the laws in the Philippines with principal address at
________________________________________________________________

- and -

<Applicant name> (“the Applicant”), of legal age and a resident of <address>

WHEREAS, the Company, is incorporated to provide customer service programs


including but not limited to protection membership programs; support services and
assistance on third party administration of repair, replacement, trade-in, and buy back
services; provision of technical support services; provision of data protection services; and
engagement in marketing activities in relation to the foregoing for consumer electronics
and mobile services;

WHEREAS, the Applicant, guarantees to abide with learning objectives provided


the Company in order to achieve the assessment program completer status as further
requirement for Probationary employment.

WHEREAS, the Applicant, agrees to abide with terms and conditions set forth in
this Pre-Employment Agreement;

NOW, THEREFORE, the Company and the Applicant hereby agree as follows:

I. POSITION: Sales Agent

II. COMMENCEMENT DATE: 19th August 2019

III. SALARY: The Pre-Employment Agreement entails NO


employee-employer relationship and thus, no compensation shall be given, but only
training allowance which is stipulated on article IV.

IV. Allowance: FIFTY pesos (50 PHP) allowance only per day which will
be given upon termination of this PRE-EMPLOYMENT AGREEMENT.
V. COMMENCEMENT:

The Agreement shall commence from day one (1) of the Assessment program course
which shall continue for five (5) days from commencement date.

VI. ATTENDANCE:

Applicants are required to report for Assessment Program for a total of eight (8) hours
from 9:00 AM to 6:00 PM including a one (1) hour meal break period in between.
Short break periods in between is already included in the regular assessment hours.
You are expected to be in the reporting venue fifteen (15) minutes ahead of time.

Attendance policy applies, to wit:

i. 100% attendance compliance which further translates to 0% tardiness and 0%


absence;
ii. First occurrence of tardiness will be subject to written warning;
iii. Subsequent occurrences of tardiness will be a ground for termination.

VII. PREMIUM PAY:

Applicants are NOT entitled for premium pay such as overtime, holiday pay, etc. Rest
of the period applied for Assessment Program will be applied as learning period.

VIII. LEARNING OBJECTIVES:

i. Company overview, policies, and procedures


ii. Sales Agent Job Description
iii. Product and Process Training
iv. Standard Operations – tasks, reports, duties, and responsibilities
v. Sales and Coaching Skills Training.

IX. ASSESSMENT PROGRAM:

i. Medium of Instruction

Assessment Program materials will be prepared in Filipino Language. However,


trainings will be conducted in local dialect.

ii. House Rules

1. Provision for module and learning materials.


2. End-of-Training (EOT) Assessment plus assessment by TEAM
LEADER (TL).
3. Strict adherence to learning and assessment program policy.
X. TERMINATION:

Any form of loss of interest, behavioural issues such as gross misconduct or willful
disobedience, fraud, negligence, crime, unprofessionalism and non-compliance will
result to the termination of the assessment program. After five (5) days of assessment
period, the Applicant will be evaluated for final screening.

The period of engagement is co-terminus with Pre-Employment Agreement for


Applicants who fail to qualify with End-of-Training (EOT) Assessment. Furthermore,
either party can terminate the Agreement by providing a written notice at least a day
prior to effectivity of such termination.

XI. NON-DISCLOSURE OF INFORMATION

The Applicant agrees not to disclose, at any time during engagement or after Pre-
Employment Agreement with the Company, any information or document relating to
the practice, business dealing or affairs of the Company or any of its customers or
clients, to any person and for any purpose.

XII. NON-COMPETITION

The Applicant agrees with the Company that he or she will not, for the period of two
(2) years after end of Pre-Employment Agreement to be employed with the Company,
either alone or jointly with any person or as a manager, agent, consultant or employee
of any person or firm, be directly or indirectly involved or engaged in any activity or
business which shall be in competition with the business of providing insurance
coverage for mobile phones.

XIII. NON-SOLICITATION

The Applicant agrees with the Company that he or she will not, for the period of two
(2) years after end of Pre-Employment Agreement to be employed with the Company,
directly or indirectly attempt to solicit any customers or business opportunities or
recruit any employees from the Company either on his or her own behalf or on behalf
of another person or firm. Nothing in this clause shall however prohibit the seeking or
procuring of orders or business that is unrelated to the businesses of Company.

XIV. CONDUCT AND DISCIPLINE


 
The Applicant is expected to observe discipline and conduct himself in the manner that
will project a good image of the Company at all times. Acts of misconduct which are
likely to result in the termination of the Applicant’s service without notice include
dishonesty, absent without official leave or permission, persistent tardiness, and such
others which may bring the company or the company's employees into disrepute.
XV. GENERAL RULES & REGULATIONS:
 
The Applicant will be required to comply with any general rules, procedures,
regulations, and agreements currently in force or that which may hereafter be
introduced / made by the company covering terms and conditions of service, discipline,
misconduct, security, and any such matters which affect your assessment at the end of
program.

XVI. OTHER TERMS AND CONDITIONS:

The terms of this Agreement may vary from time to time. Such variances shall be given
in writing. By signing this letter, the Applicant hereby agrees to the terms and
conditions set forth herein.

Please sign and return the duplicate copy of this Pre-Employment Agreement to
signify your acceptance.
