The Ministry of Public Safety and Solicitor General works to maintain and enhance public safety
in every community across the province. The Ministry's portfolio includes crime prevention; law
enforcement; adult custody and community corrections; restorative justice; victim services;
addressing violence against women; road safety; emergency prevention, preparedness,
response and recovery; fire prevention, life safety and property protection; the BC Coroners
Service; and consumer protection policy, including oversight of the administration of consumer
protection legislation by Consumer Protection BC and the Motor Vehicle Sales Authority of
British Columbia. In October 2010, the mandate of the Ministry was expanded to include
gaming policy and enforcement; liquor distribution, licensing and control; and the Office of
Housing and Construction Standards, including housing policy; building and safety standards;
and residential tenancy.

Program

The Gaming Policy and Enforcement Branch regulates all gaming in British Columbia, ensures
the integrity of people and equipment involved in the gaming industry, and investigates
allegations of wrongdoing. This includes regulatory oversight of the British Columbia Lottery
Corporation, all gaming service providers, BC's horse racing industry, and licensed gaming
events.

In excess of 10,000 licenses are issued a year as well as 6,000 gaming grants representing
$130 million/annum. 20,000 employees and 200 plus major companies are involved in the
industry. 80% of BC’s population currently engages in some form of gambling, regulated by the
Branch. The Branch manages a $4 million annual fund to deliver a comprehensive Responsible
Gambling Strategy and Problem Gambling Program.

Purpose of Position

The Assistant Deputy Minister is the executive responsible for oversight of the gambling
industry, which encompasses regulating every method of delivery through the development,
operation and enforcement of innovative government policy and programs that control the scale
and scope of gaming in the Province. This includes legislation, policy and standards, licensing
and grants, racing, registration, audit and compliance, investigation and management services.

This position is accountable for a gaming strategy that successfully minimizes organized crime
and diminishing the negative impacts of gambling on the justice, health and social welfare
systems of the Province while balancing consumer access to gambling and supporting the
growth and vitality of the industry. The ADM is accountable for protecting the public interest
through standards, programs and practices that address public security and responsible

gambling, including public education and appropriate related messaging issued by the Branch
on behalf of the BC Government.

Nature of Work

The Assistant Deputy Minister (ADM) is a full member of the Ministry Executive and exercises
the Deputy Minister’s decision-making authority with respect to all gaming policy and
enforcement programs, which significantly impact the hospitality and gambling industries as well
as the public interest. The ADM influences the strategic direction of the provincial gambling
program to achieve the broad objectives determined by the Minister and Cabinet and defines
the broad regulatory structure and provincial policies for gaming in BC. The position is directly
accountable for the results and impacts of all government gaming policy and enforcement
programs and activities, including the resources employed in achieving these results.

The position is an active advocate for change, leading the development of innovative legislation,
policy, regulations and programs for the Province that have a national impact, and establishing
precedent setting provincial and national standards. The ADM advises the Deputy Minister,
Minister and Cabinet on creative strategies to increase and improve revenue streams and on
controversial/sensitive issues impacting the public as well as industry stakeholders.

A major goal is to develop and implement effective strategies to address the negative public
impacts associated with the conduct and management of gaming, through the development,
implementation and management of a comprehensive responsible gambling strategy. The ADM
is accountable for the success of the registration system, which ensures the integrity of all
individuals and companies employed in the gaming industry. All equipment associated with
gaming is owned by the Province and is certified by the Branch.

The ADM leads a comprehensive, community based province-wide program to audit compliance
and has broad discretion under the Criminal Code of Canada, the Gaming Control Act and the
Police Act to authorize investigations and enforcement action, and decide whether to impose
major administrative sanctions, such as revocation of registration or licensing, or refer matters
for criminal prosecution.

The position is the final decision-maker for appeals of fines, and registration and license denials,
suspensions and revocations, subject only to judicial review. The ADM advises the Deputy
Minister and the Minister on priority strategies to minimize and to respond to illegal gambling
(estimated currently $2-20 billion/year), which often involves highly confidential and sensitive
law enforcement and intelligence issues and activities. Decisions can have profound economic
effects on the industry, government gaming revenues, protection of public assets, the economy
of municipalities where gaming operations are located, as well as public safety and security.

President of the BC Lottery Corporation: to resolve funding, policy, program operations, and
accountability issues.

Gaming and horse racing industry organizations and companies, providers of gaming addiction
programs and charity umbrella organizations: to build relationships, consult on public policy and
a wide variety of other matters.

The Deputy Attorney General and senior representatives of the Criminal Justice Branch:
regarding the planning of highly sensitive/confidential law enforcement strategies and
operations.

Senior representatives of law enforcement organizations provincially, nationally and


internationally: to work collaboratively toward targeting criminal gaming operations and
exchange intelligence.

Elected officials and staff of local governments and municipalities: regarding issues pertaining
to community based gaming operations and to negotiate revenue sharing agreements and local
economic development grants.

Senior representatives of other government ministries and social welfare agencies and
advocacy groups: to initiate on behalf of the Province, and to lead a comprehensive
Responsible Gambling Strategy and Problem Gambling Program.

Union of BC Municipalities: to act as primary contact on behalf of the BC Government, on


gaming policy and enforcement matters.

Industry: initiating and leading liaison to advance strategic goals of government.

Legal representatives of government and of applicants, licensees, registrants and other groups
and agencies (e.g. First Nations): regarding licensing and registration issues, including
enforcement actions and appeals.

Treasury Board and other central agencies: regarding estimates and budgets, federal-provincial
agreements and new initiatives.

Accountabilities / Responsibilities

1. Provides oversight to promote progressive, socially responsible gambling legislation,


policies and practices in BC by providing overall leadership to the seven divisions of the
Branch, and ensuring the achievement of strategic objectives to reduce the incidence of
illegal gambling in the province and establish a comprehensive regulatory framework:

• development and implementation of legislation, policy and public interest standards to


ensure a rigorous, transparent and business-like policy and regulatory environment for
gaming and horse racing in B.C., which balances the fiscal and economic policy priorities of
government with the associated social issues and deters illegal gambling, while keeping
pace with innovations in gaming activity and supporting public safety

• issuance of gaming event licenses to charitable and religious organizations in a manner


consistent with gaming legislation, directives and policies and the distribution of gaming
grants (representing $130 million/year) and event licenses to community organization
through the Direct Access and Bingo Affiliation programs

• regulation of horse racing in B.C. through the development of fair and appropriate rules of
horse racing, effective management of events, and ensuring the competency of suitable
employees and animals

• registration of gaming services providers and gaming workers to ensure the integrity of the
organizations, employees and equipment in the BC gaming industry, and the approval and
certification of gaming equipment and lottery schemes

• development and maintenance of a comprehensive audit strategy for commercial gaming


(including horse racing), licensed gaming, and community organizations’ use of gaming
proceeds (from licensed gaming events or gaming grants) to ensure compliance with all
applicable gaming legislation, regulation, policies and directives

• investigation of, and collaboration with law enforcement agencies in the investigation of, all
alleged contraventions of relevant sections of Canada’s Criminal Code and complaints or
allegations of criminal or regulatory wrongdoing in gaming and horse racing in the province

• provision of sound financial advice to Ministry executive, effective administration of the


branch budget and recoveries, provision of effective and efficient systems,
telecommunications and information support, and management of all branch facilities,
vehicles and records

2. Leads the Province's comprehensive Responsible Gambling Strategy and Problem


Gambling Program which engages government, the gaming industry, health and social
agencies as well as individuals who gamble in a collaborative approach to achieve
government’s goals of:

• reducing the incidence of problem gambling,

• reducing the harmful impacts of excessive gambling,

• ensuring the delivery of gambling in a manner that encourages responsible gambling and
healthy choices

The program provides community-based counselling services, provided under contract by


funded agencies and qualified counsellors, a 24-hour toll free help line, province-wide education
and awareness activities, advertising and marketing standards, research and education
initiatives and training of addiction counsellors (600 to date) throughout the Province.

3. Leads the development of innovative legislation, policy, regulations and programs for the
Province that have a national impact, and establishes precedent setting provincial and
national standards:

• seeking changes to the legal and governance structure for gaming (e.g. by proposing
amendments to the Criminal Code of Canada and/or addressing issues raised by
committees of the Federal government)

• seeking more coordinated policy approaches among the provinces (e.g. a common
approach to gaming activities provided over the Internet)

• chairing or otherwise representing the Province of BC (and specifically the Minister) on the
Inter-Provincial Lottery Corporation which focuses on the conduct and management of
nationwide lotteries (e.g. 649, Super 7) and provides a forum for discussing inter-provincial
and national issues in all forms of gaming

4. As a member of the Ministry Executive, contributes to the strategic direction and policies of
the Ministry and advises the Deputy Minister and Minister on broad policy, standards and
regulatory issues affecting the integrity and efficacy of gaming in the province and the
achievement of the government’s social, economic and fiscal policy priorities for gaming.

5. Ensures successful relationships with a broad range of stakeholders including licensees and
grant recipients, elected officials and staff of local governments, such as municipalities,
where casinos are located, law enforcement agencies, advocacy groups, public agencies,
government agencies including Aboriginal Relations and others.

6. Adjudicates complex licensing appeals and renders final decisions regarding registration
and licence denials, suspensions and revocations, subject only to judicial review.

7. Represents the Province, on behalf of the Deputy Minister and the Minister, in public and
media forums to communicate on provincial gaming policy.

8. Directly responds to questions in the Legislature regarding annual estimates and matters
pertaining to legislative reform.

9. Leads the development of improved information technology systems and innovative human
resource management strategies; represents the employer at Step 3 of the resolution of
grievances.

Qualifications

A combination of relevant post-secondary education and extensive, progressively more


responsible leadership experience in strategic, business and operational planning. Experience
must include leading a large and diverse staff; developing, evaluating and implementing
strategic and operational policy and procedures; managing large operational and capital
budgets and developing successful working relationships with key internal and external
stakeholders/partners/contacts

A record of inspiring confidence in your leadership; a background enhanced by negotiation,


consensus-building and influencing skills, and the ability to maintain positive relationships
across a spectrum of stakeholders; experience representing the organization and in exercising
sound judgement, diplomacy and discretion in all relationships and interactions.
