JUDGMENT COME NOW, Clarence G. Hansen and Kelly L. Hansen (³DEFENDANTS´), Pro
Se, andpursuant to K.S.A. 60-256 and Supreme Court Rule 141, move this honorable
Court for SummaryJudgment against MetLife Home Loans1, a Division of MetLife
Bank, N.A. (³PLAINTIFF.´)For its legal basis DEFENDANT¶S state a foreclosing
PLAINTIFF, to prevail, mustestablish several ultimate fact elements existed at
the time it filed its foreclosure action: that it wasthe owner or the holder in
due course of the DEFENDANT¶S Note with rights to enforce the Noteand Mortgage;
that the DEFENDANT¶S default has caused them harm; and a claim of damages, tobe
admissible as evidence, must incorporate records such as a general ledger and an
accounting of an alleged unpaid promissory note. The individual(s) responsible
for preparing and maintainingthe account general ledgers for each servicer that
serviced the mortgage over the life of the loan 1DEFENDANTS have
contemporaneously filed a MOTION TO STRIKEPLAINTIFF¶SMOTION TOSUBSTITUTE
PARTYPLAINTIFFAND AMOTION FOR SANCTIONS AGAINSTPLAINTIFFFOR TRANSFERRING³ITS
INTEREST ´ONJULY26, 2010TO FANNIE MAE.

complete accounting of the loan in the form of an affidavitwhich must besworn
to, signed, and dated by each person.The PLAINTIFF, after an adequate period of
discovery, has not been able to produce, andwill not be able to produce,
evidence sufficient to allow the Trier of fact to find the PLAINTIFFwas the
owner of the DEFENDANT¶S Note, with a right to foreclose the Note and Mortgage,
atthe time it filed its Petition. The PLAINTIFF has not submitted the necessary
affidavits and sworn testimony into therecord. DEFENDANT is entitled to
judgment as a matter of law, as more fully set forth in theMemorandum in Support
of the Motion for Summary Judgment, (³Memorandum´) filedcontemporaneously
herewith and incorporated herein by this reference for all purposes.Wherefore,
for the reasons set forth above and in the Memorandum, the Court should grantthe
