WHEREAS:

I, Mr/Mrs……………………………………… am unable to attend to my affairs as I am


always remain out of India.

AND WHEREAS I am desirous of purchasing Flat/Property in …………..

AND WHEREAS it is not possible for me to attend the Office of Sub-Registrar


personally every time for sake of convenience and I hereby appoint
Mr/Mrs………………………………………, as my true and lawful Attorney to act for
on my behalf and manage and look after my said business.

AND WHEREAS I am approaching for the Housing Loan from the State Bank of India.

AND WHEREAS I am unable to attend to and look after the said matter and/or for
attending to the formalities of borrowing of monies from State Bank of India for such
purpose and in these circumstances I am desirous of appointing a fit proper person to
attend to the same.

AND WHEREAS it is not possible for me to attend the Bank personally every time for
sake of convenience and I hereby appoint my husband/wife (relation) as my true and
lawful Attorney to act for me on my behalf and should be able to sign on behalf of me for
any matter related to the said ‘Housing Loan’. I confer upon her the certain powers, acts,
deeds, matters and things herein below stated.

NOW KNOW YOU ALL AND THESE PRESENTS WITNESSES THAT I, MR/MRS.
………………………………… hereby appoint and constitute
Mr/Mrs………………………….. to be my true and lawful attorney with full power of
authority to do and execute the following acts, deeds and things in my name on my behalf
and for me viz:
1) TO SIGN part payment Agreement/Sale Deed for and on my behalf.

2) TO REPRESENT me before Sub- Registrar of Assurance and also write letters


and acknowledge Receipt thereof.

3) TO LODGE submit documents, Agreements, Deeds, Declaration executed by us


before the Sub-Registrar of Assurances and admit the execution of such
Agreement, Deed, Declaration or document before such Authority, sign for me,
produce any document and comply with the requisition of the Registration
Authority, to complete the Registration of such document under the Registration
Act, pay the Registration Fees and also represent me before the Stamp Authority
for the purpose of determination of Stamp Duty and to produce such document for
the purpose of determination of Stamp Duty of any document and pay the Stamp
Duty.

4) To exchange such correspondence as my attorney deems fit with the Appropriate


Authorities and to sign and execute such applications, declaration and indemnities
as the Appropriate Authorities may require and as may be deemed fit by my
Attorney.

5) To exchange correspondence as my Attorney deems fit with the such person or


persons, local bodies, Government, Semi-government Authorities or such other
authorities/officers as may be required and as may be deemed fit by my Attorney.

6) To appoint and engage Advocates, Solicitors, Counsels and Chartered


Accountants for drafting of the documents and to settle and pay their fees.

7) To borrow such sums of money from the State Bank of India on such terms and
with or without security as the Attorney may think fit for any of the purpose of
these presences.

8) I hereby authorized my Attorney to execute to make applications, carry on


correspondence, sign and execute all such forms, applications, agreements for
creating charge or other securities in favour Bank whether against the security of
the properties proposed or otherwise, term loan agreement and such other
agreement or otherwise, and documents as may be required by the Bank for grant
of the various loan facilities and give such declarations and sign and give such
Indemnities as may be required by the said Housing Loan facility proposed to be
taken by me.

9) To apply for a loan under the various schemes of the State Bank of India as also
further or additional loan to the Bank for such amount as the Attorney may deem
fit and for that purpose to pay the upfront processing and other charges and sign
the loan application/s in my name and or my behalf and to furnish all the details
and information required by the Bank and to give any statement, letter,
clarification or any other writing required or necessary for availing of the said
loan/s from the Bank and time to time to follow up the said loan application/s and
do such other things and Deeds as may be necessary in relation thereto.

10) To accept the loan sanction letter/s and sign the acceptance/s thereof in token of
my acceptance of the terms and conditions therein contained and to pay on my
behalf other charges in respect of the said loan.

11) To receive the disbursement of the said loan and for that purpose give effectual
discharge and give all the necessary information and documents to assist the
Technical & Legal Appraisal of the property to be mortgaged for the said Housing
Loan.

12) To mortgage property on my behalf with the Bank and for the said purpose
deposit the Title Deeds pertaining to the said property with the Bank as security
for the repayment of the loan granted/to be granted by the Bank.

13) He is further authorized to make any other statement necessary to create Equitable
Mortgage by deposit of Title Deeds and also to execute any
writing/undertaking/indemnities etc on my behalf in respect of mortgaged of the
said property.

14) He is also authorized to execute Promissory Notes, loan Agreements or any such
other documents as may be required by the Bank in respect of the said Housing
Loan.

15) To accept any change or modification in the loan amount/s, rate/s, of interest,
period of repayment of loan/s or any other terms and conditions in relation to the
loan/s at any time or from time to time.
16) He is also authorized to pledge with the Bank any Share Certificate, Debentures,
Bonds, Unit issued by the Unit Trust of India, National Saving Certificate, Fixed
Deposits or any other security owned by me in favour of the Bank by way of
security for the said loan/s and to sign any document, transfer forms or papers that
may be required by the Bank in connection therewith.

17) To open and/or operate Bank Accounts in any Bank in India in my name both
resident and non-resident. The Account may be operated in Indian Currency or
Foreign Currency to be remitted by me time to time.

18) To accept the monies lent and advanced by the Bank and to acknowledge receipts
of the monies received and to give valid and effectual receipts and discharges
thereof and to pay such monies to the Institution.

19) TO APPOINT Lawyers, Advocates, as and when required for advise or for
conducting any matter or litigation or dispute in which I am involved and to pay
their fees.

20) AND GENERALLY to do and execute and perform all such acts, deeds, matters
and/or things relating to or concerning or touching the said Housing Loan thereof
as my said Attorney may deem fit and proper expedient as fully and effectually as
ourselves could effectually do, execute and perform in personally present.

21) To appear and represent me before the authorities appointed under the Foreign
Exchange Regulation Act, Income Tax Act and such other Acts, Rules
Regulations etc.

22) To make sign and file Income Tax Returns and/or Returns for Capital Gains,
Investments, T.D.S for the income or loss, bear and pay the Tax, interest, penalty
as may be applicable, accept summons, process, orders submits or context the
same.
23) AND I HERBEY AGREE TO RATIFY AND CONFIRM all and whatsoever my
said Attorney or substitute or substitutes appointed by them shall lawfully in the
manner herein referred do or purport to do by virtue of these presents.
