    EndUserLicenseAgreement

    YOUSHOULDCAREFULLYREADTHEFOLLOWINGLICENSEAGREEMENTBEFOREINSTALLINGTHIS SOFTWAREPROGRAM. Withtheuse/installationoftheCDyouagreetothefollowinglicenseagreement: ThisLicenseAgreementisalegalbindingcontractbetweenyouandMatrixGamesand/orits subsidiariesfortheabovementionedsoftwareproduct,consistingofthecomputersoftwareand possiblerelevantmedia,printingmaterialandelectronicoperatinginstructions(the"software product").Byinstallingthesoftwareproduct,copyingitorusingitinanyotherway,youareagreeingto accepttheconditionsofthisLicenseAgreementwithoutchange.Shouldyounotagreetotheconditions ofthisLicenseAgreement,donotinstallthissoftwareproduct,butreturnittowhereyoupurchasedit accordingtotheirreturnpolicy.

    Softwareproductlicense
    Thissoftwareproductiscopyrighted(bynationallawandinternationalcontracts.)Thissoftwareproduct hasnotbeensoldtoyou,butisonlylicensedtoyou.

    Licensewarranty.
    ThisLicenseAgreementwarrantsyoualicensewiththefollowingrights:Useofthedeliveredsoftware. Thissoftwareproductmayonlybeusedbyyou.Youareallowedtoinstallthissoftwareproductanduse itonanycomputerinyourhomeonly.

    Descriptionoffurtherrightsandrestrictions.
    RestrictionsconcerningReverseEngineering,DecompilationandDisassembling. Youarenotallowedtochangethesoftwareproduct,subjectittoareverseengineering,decompilize,or disassembleit.Thesoftwareproductislicensedinwhole.Itspartsmaynotbeseparated,amaynotbe usedonmorethanonecomputer.

    Hiringout.
    Youmaynotlease,rentorlendthesoftwareproducttoanyone.

    Softwarenegotiation
    YouarepermittedtorelinquishallrightsyouareentitledtounderthisLicenseAgreementcompletely anddurablytoanotherparty,aslongasyou (a)donotretainanycopies(ofthewholesoftwareproductorsinglepartsofit), (b)relinquishthewholesoftwareproduct(includingallcoveringmaterial(inmediaorform),upgrades, andtheLicenseAgreementdurableandcompletelytotheconsignee.

    Responsibilities/Restrictions.
    ThesoftwareproductmaycontainanEditorthatallowsyoutocreatecustomlevels,scenariosorother materialsforyourpersonaluseinconnectionwiththesoftwareproduct("newmaterials").Youwillnot beentitledtouseorallowthirdpartiestousetheEditorand/orthenewmaterialscreatedtherebyfor commercialpurposesincluding,butnotlimitedto,distributionofnewmaterialsonastandalonebasis orpackagedwithothersoftwareorhardwarethroughanyandalldistributionchannels,including,but notlimitedto,retailsalesandonlineelectronicdistributionwithouttheexpresspriorwrittenconsent ofMatrixGamesanditssubsidiaries.Youareexpresslyprohibitedfromsellingand/orotherwise profitingfromanyEditor,addonpacks,sequelsorotheritemsbaseduponorrelatedtothesoftware productand/orthenewmaterialswithouttheexpresswrittenconsentofMatrixGamesand/orits subsidiaries.Youmayfreelydistributedbyemailoronlineelectronicdistribution,howeverMatrix Gamesspecificallywithholdsanylicensetotheauthorofanysuchcreatedcustomlevels,scenariosor othermaterialstodistributecopiesthereofinanyfixedmediaformat.Anypersonsdoingsoshallbe guiltyofcopyrightviolationandwillbesubjecttoappropriatecivilorcriminalactionatthediscretionof thecopyrightholder.

    Copyrightandtrademarkrights.
    (1)Thesoftwareproduct(inclusiveallillustrations,photos,animationsequences,video,audio,music andtextparts,whichwereembeddedinthesoftwareproduct),aswellasalltheconnectedtrademark andrightsofusage,thepackaging,printedmaterialsandallcopiesofthesoftwareproductsare propertyofMatrixGamesand/oritslicenseesand/orlicensor's. (2)Thesoftwareproductisprotectedbycopyrightandtrademarkbynationallaw,internationallawand internationalcontractstipulations. (3)Withregardtoarchivepurposes,youmayhandlethesoftwareproductlikeanyotherbycopyright protectedwork,andyoumaynotmakecopiesoftheprintedmaterials,whichareincludedwiththe softwareproduct,includingthepackaging. (4)Youmaynotremove,modifyorchangethestatementsaboutcopyrightsandtrademarksfromthe softwareproduct.Thisparticularlyreferstostatementsandmarksonthepackingandthedatamedia, atstatementswhicharepublishedonthewebsiteorwhichareaccessiblebyInternet,orotherswhich areincludedinthesoftwareproductorarecreatedfromthis.

    LimitedWarranty.
    MatrixGamesand/oritssubsidiarieswarrantthatthesoftwareproductessentiallyworksinagreement withthewrittenstatementsbeingsuppliedwiththesoftwareproductfromMatrixGamesand/orits subsidiaries.Thiswarrantycovers30days,beginningwiththedatestatedonthereceipt.

    Legalremedyoftheconsumer:
    TheresponsibilityofMatrixGamesand/oritssubsidiariesanditssuppliersislimitedtooneofthe following,bychoiceofMatrixGamesand/oritssubsidiaries

    (a)thepaybackofthelicensefeeyoupaid,nottoexceedthepurchasedprice,or (b)repairorreplacementofthepart,orthepartsofthesoftwareproductifreturneddirectlytoMatrix Gamesand/oritssubsidiariesincludingacopyofyourreceipt.Thislimitedwarrantyisnotvalid,ifthe defectisbasedonanaccidentormisusedorfaultyhandling.Foreachreplacedsoftwareproduct,the guaranteewillbeforaperiodofanadditional30daysfromtheexpirationoftheoriginalwarranty,as longasMatrixGamesand/oritssubsidiariesdeterminesthatthesoftwareproductwasobtainedlegally.

    Nofurtherwarranties.
    MatrixGamesand/oritssubsidiariesanditssuppliersdomake,asfarasthisispermittedbypracticable law,anyfurtherwarranty,aswellastheliabilityforoccurringorfailureofanexplicitortacitlyagreed condition.Thisincludesespeciallythelegalwarrantyformarketablequality,forthesuitabilityfora specialaim,forproperty,forthenonviolation,concerningthesoftwareproductandthestipulation, whichassignsserviceactivities,respectiveforshortcomingsinthefieldofserviceactivities.

    LimitedLiability.
    (1)Asfarasthisispermittedbypracticablelaw,MatrixGamesand/oritssubsidiariesanditssuppliers arenotliableforspecialdamagesbeingbasedonaccident,ormediatedamages,foranyfollowing damages,includingcompensationforthelossofbusiness,fortheinterruptionofbusinessoperation,for thelossofbusinessinformationoranyotherfinancialdamages,arisingfromtheuseoranimpossibility oftheuseofthesoftwareproduct,orfromtheguaranteeorabstainedguaranteeofserviceactivities. Thisevenapplies,ifMatrixGamesand/oritssubsidiariesproductweredirectlyresponsibleforsuch damages. (2)Inanycase,MatrixGamesand/oritssubsidiariesentireliabilitywillbe,byinstructionofthisLicense Agreement,limitedtotheamountthepurchaseractuallypaidforthesoftwareproduct.Allofthese restrictionsarenotvalid,ifMatrixGamesand/oritssubsidiariescausedthedamagewillfully.

    FinalRestrictions.
    (1)Shouldrestrictionsofthiscontractbenotlegallybindinginwholeorinpart,and/ornotpracticable, and/orlosetheirlegalforcelater,thevalidityoftheremainingrestrictionsofthecontractsshallremain inforce.Thisalsoapplies,ifitshouldbeproved,thatthecontractincludesanunenforceableclause. (2)Insteadoftheineffectiveand/orimpracticablerestrictionbecauseofthatclause,anadequate agreementshallbevalid,which,asfaraslegallypossible,approachesbesttotheintendedclause. USEOFTHISPRODUCTISSUBJECTTOTHEACCEPTANCEOFTHELICENSEAGREEMENT.
