New Legislative Framework


New Approach is ending. New Legislative New Approach ending Framework begins 1st January 2010. Current New Approach Directives must be implemented by the nation state.

Under the NLF these Directives will become Regulations, directly implemented! Aims to strengthen enforcement procedures and activity across EU. Seeks further harmonisation and consistency across directives- conformity procedures.

Machinery Directive will become 2006/42/EC on 29th December 2009. EMC Directive 2004/108/EC came into force 29th July 2009. LV Directive 2006/95/EC came into force 16th January 2009 Old directives no longer applicable; check your Declarations of Conformity!

Essential Requirements or Essential Provisions

Technical Documentation

Declaration of Conformity
The declaration of conformity must be signed by y g y a responsible person Keep DoC in Community at disposal of authorities Can be one document for all directives Use community language UK Manf. English Name & address of Manufacturer and Authorised Representative established within the Community

Who is a Responsible Person?


The Responsible Person would be a senior person in the Company (typically the MD or Technical Director) who is able to ensure that the documentation will be retained for at least 10 years after manufacture or the withdrawal of production of series manufacture. They must be satisfied that the documentation is y correct, the apparatus is legally CE Marked and every effort has been made to ensure the safety of the equipment.

What if we dont comply?


Up to three months imprisonment and/or a fine. GPSD states max 20,000 fine. The authorities have the power to force manufacturers to recall or replace faulty products or forfeit them them. HSW Act is significantly worse- Higher court unlimited fine and/or 2 years imprisonment.

The conformity assessment procedure for apparatus has been simplified to a single procedure. There is no compulsory involvement of a third party,
the option of presenting a technical documentation to a Notified Body for assessment;

When deviating from the European harmonised standards or not applying them fully,
the manufacturer has to perform an EMC assessment provide detailed documentary evidence that the apparatus complies with the protection requirements of the EMC Directive;

Fixed installations, although they must comply installations with the protection requirements, require neither an EC Declaration of Conformity (DofC) nor CE marking;
Responsible Person for Fixed Installations required Large Machines are considered apparatus; g pp ; Mobile installations are considered apparatus;

For apparatus, there are changes in the documentation and information requirements;

Apparatus intended for a given fixed installation and not otherwise commercially available may be exempt from the requirements and procedures for apparatus (e.g. EC Declaration of Conformity and CE marking),
provided that certain documentation requirements are p q met precautions to be taken in order not to compromise the EMC characteristics of the fixed installation

EMC Transitional Arrangement 1


Apparatus When following the TCF route to compliance before 20th July 2007 can continue to be manufactured and placed on the market up to 20th July 2009 This has now passed. The new directive must be met in full.

CAUTION! - EU Guidance Notes The term fixed installation also applies to large machines if they meet the definition given for fixed installations, such as production lines. However: Large machines, in the usual sense of this term, are normally apparatus and have to be treated as such.

CAUTION! Directive Conformity Assessment If neither the manufacturer nor his authorised representative is established within the Community, the obligation to hold the EC declaration of conformity AND the technical documentation at the disposal of the competent authorities shall lie with the person who places the apparatus on the Community market.

MD Major Changes
Manufacturers of electrical machinery will no longer need to determine from the results of their risk assessment whether a machine falls under the LV Directive, or the new Machinery Directive. Clear differentiation between the two directives in the form of a list.

MD Major Changes
The requirements for Risk Assessment have been made more explicit. Ergonomic requirements & Requirements on emissions have been made more precise.
Noise, EM fields, Exhaust, Substances.

Requirements like those concerning seating & lightning, have been moved to the general part of Annex I and thus apply to all machinery.

Once the existing tractors directive 2003/37/EC has been amended to extend its coverage to the risks presently covered by the machinery directive, then the machinery directive should no longer apply at all to agricultural and forestry tractors.
