JOINT PACIFIC ACP FISHERIES AND TRADE OFFICIALS MEETING 25 January 2010 The Melanesian Port Vila, Vanuatu

OUTCOMES DOCUMENT The Joint Pacific ACP Fisheries and Trade Officials Meeting (JFTOM) was held at the Melanesian Hotel, Port Vila Vanuatu, on 25 January 2010. Fisheries and/or trade officials from the following PACP States (PACPs) were present at the JFTOM: Cook Islands, Federated States of Micronesia (FSM), Fiji, Kiribati, Nauru, Niue, Palau, Papua New Guinea (PNG), Republic of the Marshall Islands, Samoa, Solomon Islands, Tonga, Tuvalu and Vanuatu. The High Commissioner, Honourable Peter Eafeare, from PNG was present at the meeting as well as representative from the Forum Fisheries Agency (FFA) and the Secretariat of the Pacific Community (SPC). The newly appointed Legal Consultant to the PACPs on the PACP-EU Economic Partnership Agreement (EPA) negotiations, Mr Michael Hathaway, was also present at the JFTOM. The meeting was chaired by Mr James Movick, of the FSM. A list of participants is provided in Annex 1. 2. The objective of the JFTOM was for the fisheries and trade officials to consider various fisheries-related issues arising out of the EPA negotiations between the PACPs and the European Union (EU). In particular, discussions focused on Part III of the draft comprehensive PACP-EU EPA as well as on Article 6.6 on fisheries-related rules of origin with a view to progressing the PACP position on these issues. The FFA provided specific technical input at the meeting. 3. In her opening remarks, Dr Chakriya Bowman, Director Economic Governance (DEG) at the PIFS, reminded the JFTOM of the importance of the fisheries sector to the PACPs, and the need for the EPA negotiations to also take into account issues of interest to the PACPs, particularly issues surrounding improved Rules of Origin (ROO) and access to PACP fisheries resources, as well as the Sanitary and Phyto-Sanitary (SPS) measures and the impact of the EC Council regulation on Illegal, Unreported and Unregulated fishing on the PACPs. 4. The Chair of the JFTOM, Mr James Movick reminded the meeting that the ultimate end goal for the PACPs is to create a competitive tuna industry in the region. He further highlighted the importance of the JFTOM to discuss issues of relevance to the PACP-EU EPA negotiations and the need for the officials to determine the best approach to narrowing the differences in the fisheries-related outstanding issues.

STATE OF PLAY OF FISHERIES ISSUES IN THE EPA NEGOTIATIONS 5. The Secretariat presented an update on the state of play of fisheries issues (PIFS(10)PACP.JFTOM.01.1) in the EPA Negotiations which focused on recent developments on fisheries issues in the EPA negotiations. PACP-EU DRAFT LEGAL TEXT: PART III, FISHERIES 6. The FFA representative presented to the JFTOM the Issues Paper PIFS (10)PACP.JFTOM.01.2 on Part III of the PACP-EU Draft Legal Text relating to fisheries, particularly focusing the EC position and the PACP Proposal on Article 6. 7. The JFTOM considered the options proposed to narrow the differences between PACPs and the EU on Article 6, including a third option which is to retain the text in brackets for further consideration. 8. The JFTOM took note of the options available to the PACPs and suggested that further consultation on these issues with the private sector and relevant officials at the national level is needed. The Meeting further noted that the forthcoming meeting of the Parties to Nauru Agreement (PNA) in February may be an opportunity to discuss the PACP-EU EPA fisheries issues in detail to guide the trade officials in their negotiations. The PACPs not parties to the Nauru Agreement would also undertake national consultations on these issues. In order to ensure appropriate fisheries consideration of these issues, including that of the non-PNA members, every effort should be made to hold a Forum Fisheries Committee (FFC) meeting prior to the next PACP Trade Ministers Meeting being convened. 9. The JFTOM noted that the trade-offs being discussed in the fisheries sector should be looked at in the broader context of what could be achieved through the comprehensive EPA as well as possible flexibilities in the negotiations that may be available to the PACPs in other parts of the EPA. FISHERIES-RELATED RULES OF ORIGIN 10. The JFTOM considered Issues Paper PIFS(10)PACP.JFTOM.01.3 on FisheriesRelated Rules of Origin providing general overview of fisheries-related rules of origin (Article 6.6), as well as the EC and PACP position on the rules of origin. DEVELOPMENT IMPACT OF THE EC COUNCIL REGULATION ON ILLEGAL, UNREPORTED AND UNREGULATED (IUU) FISHING ON ACP STATES, ADOPTED ON 22 OCTOBER 2009 11. The JFTOM discussed the implications of the EC Council regulation on IUU on Duty Free Quota Free Market Access Arrangements and Applicable RoO for PACP-EU EPA, particularly those relating to the development impact of the regulations as contained in the issues paper PIFS(10)PACP.JFTOM.01.4. -2-

WAY FORWARD 12. As a way forward, the JFTOM agreed that the PACPs need to undertake further consultations with relevant stakeholders at the national level on fisheries-related issues discussed at this meeting. The Meeting further agreed that a paper be prepared for consideration by the PNA at their meeting on 22-25 February and every effort is to be made to hold a FFC meeting prior to the PACP Trade Ministers Meeting (PACPTMM) and the PACP-EC Joint Technical Working Group Meeting (JTWG). The paper will be prepared jointly by the Secretariat and the FFA, based on the outcomes of the Technical Working Group meeting of 29 January. 13. There were a range of options discussed at the meeting that merited further consideration. Subsequent discussions with stakeholders may identify additional options. 14. The JFTOM agreed that representatives from the JFTOM with the assistance of the PACP Legal Adviser on EPA prepare draft text as suggested for the options discussed for further consideration by the Technical Working Group on Legal, Institutional and Capacity Building (TWG-LICB) meeting on 29 January. 15. The PACP Trade Officials Meeting (PACPTOM) tentatively scheduled for March 2010 will discuss the feedback from FFA, the PACPs and the PNA Meeting on fisheries issues relating to the EPA negotiations. The PACPTMM tentatively scheduled for June 2010, will consider the PACP position on fisheries-related issues and provide directions for further negotiations with the EC at the PACP-EC JTWG Meeting, also scheduled for June 2010. 16. The Chair thanked the participants and the resource people for their contribution to the Meeting.
