I understand that there is a South Australia Senator seeking to pursue that confidentiality of confessions to priest is to be abolished. Why not then do the same with lawyers when they defend an accused and at times get them off despite well aware from their client that their client committed hideous a crime? As a CONSTITUTIONALIST I remind you to that the Commonwealth has no legislative powers to deal with religious issues as the Framers of the Constitution made clear that any unlawful conduct involving a religion was to be dealt with by the State. I am not a Catholic and myself have the personal view that confession has no value but for those who practice the catholic Religion are entitled to exercise their faith without fear or favour and I view the Commonwealth would have no constitutional power to interfere with this. See also section 116 of the constitution. You cannot make the practice of religion unconstitutional as to force a ;priest to disclose something that he/she has no way of knowing if the person making the alleged disclosure actually did at all commit such a crime. I have since 1982 conducted a special lifeline service under the motto MAY JUSTICE ALWAYS PREVAIL and never would report anything what is stated to me in confidence because I found that I was the best person dealing with matters and to disclose matters could more than likely work adverse as then the very person who disclosed the matter may then close up[ and other then the

allegation I would have no evidence as such and would rather lose the trust of the person and by this prevent me to assist the person to acknowledge any wrongdoing. Where a person gave me the understanding wanting to kill his child I simply avoided raising any objections and worked with him over a period of time and this resulted to him recognizing that his child had rights also. To report such matter could have ended up that he could have done the deed nevertheless and then the very reporting would have been the reason such hideous crime would have eventuated. Politicians would do better to conduct themselves within the framework of the law before trying to hold others accountable, after all if not every parliamentarians is to be considered to be a criminal because some may be then the same with citizens and you cannot interfere with the CIVIL RIGHTS of every person who seeks to exercise their religious practices as after all lawyers having made an oath to act in accordance to the law themselves even if their client admitted to them having committed a hideous crime still will front the court,. And any jury, seeking to get his client of without disclosing his clients admission to the guilt of the crime charged with. Leave religion alone as the priest is not committing any crime when hearing a religious confession not concealment of a confession turning into some crime! It may very well be that a priest may wrongly assume a hideous crime was confessed only to find out afterwards he misconceived it all. Any legislation specifically targeting a religion would be unconstitutional; this the Framers of the Constitution made very clear. It would be great if you as a lawyer and PM would actually bother to become a true constitutionalist as to be aware what is constitutionally applicable and you may then also do the job you are being paid for! .
