Normas relativas a la Administracin y Fiscalizacin de los riesgos relacionados con los delitos de Legitimacin de Capitales y Financiamiento al Terrorismo.

En la Gaceta Oficial N 39.691, de fecha 8 de junio de 2011, fue publicada la Resolucin mediante la cual se establecen las Normas relativas a la Administracin y Fiscalizacin de los riesgos relacionados con los delitos de Legitimacin de Capitales y Financiamiento al Terrorismo aplicables a las Instituciones reguladas por la Superintendencia Nacional de Valores. Los sujetos obligados segn esta Resolucin son: a) b) Las personas cuyos valores sean objeto de oferta pbica. Las entidades de inversin colectiva y las personas que intervengan directa o indirectamente en la oferta de los ttulos emitidos por esas entidades. Los operadores de valores autorizados, sean personas naturales o jurdicas. Los asesores de inversin. Las bolsas de valores. Las bolsas de productos e insumos agrcolas. Las cajas de valores. Los agentes de traspasos. Las sociedades titularizadoras. Las cmaras de compensacin de opciones y futuros y otros productos derivados. Las sociedades calificadoras de riesgo. Todas las dems personas que participen directa o indirectamente en la oferta pblica de los valores regulada en la Ley de Mercado de Valores. Las personas jurdicas que la Superintendencia de Valores califique como relacionadas a alguno de los sujetos regulados por la Ley de Mercado de Valores.

Publication of Norms relating to the Administration and Inspection of risks associated with Money Laundering crimes and Financing of Terrorism
Resolution providing for the Norms relating to the Administration and Inspection of risks associated with Money Laundering crimes and Financing of Terrorism was published in Official Gazette N 39,691 of June 8, 2011. Such Norms are applicable to institutions ruled by the Office of the National Securities Superintendent. Individuals or corporations subject to this Resolution include: a) b) Individuals whose securities be subject to public offering. Collective investment entities and individuals directly or indirectly involved in the offering of securities issued by such entities. Authorized securities brokers, be them individuals or corporations. Investment advisors. Securities exchanges. Agricultural products and supplies exchanges. Securities depositories Cession agents. Securitization agencies. Clearance houses and forwards, put options and other byproducts. Risk rating agencies. All other individuals or corporations directly or indirectly engaged in public offerings of securities regulated under the Securities Market Law. Corporations rated by the Office of the Securities Superintendent as related companies of any entity subject to the Securities Market Law.

Dicha Resolucin deroga las Normas relativas a la Administracin y Fiscalizacin de los riesgos relacionados con los delitos de Legitimacin de Capitales y Financiamiento al Terrorismo aplicables a las Instituciones reguladas por la Superintendencia Nacional de Valores dictadas mediante Resolucin N 025/2011 de fecha 11 de febrero de 2011, publicadas en Gaceta Oficial N 39.616 de fecha 15 de febrero de 2011. La nueva Resolucin entr en vigencia a partir de su publicacin en Gaceta Oficial.

Such Resolution derogates the Norms relating to the Administration and Inspection of risks associated with Money Laundering crimes and Financing of Terrorism, applicable to institutions ruled by the Office of the National Securities Superintendent, established in Resolution N 025/2011 of February 11, 2011, published in Official Gazette N 39,616 of February 15, 2011. The new Resolution came into effect upon its publication in Official Gazette.
