Com The View Of Ahlus Sunnah & The Murjiah Regarding The Issue Of Istihlaal (To Make Halaal) Through Action Or Statement & Istihlaal Of Belief In The Heart By Abdul Kareem Ibn Ozzie

This article has been written in order to refute the Murjiah creed and because Ahlus Sunnah of today (the salafis) are accused by some groups of Muslims as being the Neo Murjiah (the Murjiah of this era). Therefore this article should inshallah help to provide evidence that Ahlus Sunnah of today are free from the Murjiah creed and opposed to it inshallah. The Murjiah (are a deviated sect that appeared during the era of the taabieen (this was mentioned by Shaykh Uthaymeen in his introduction to his explanation of Aqeedah al Wasitiyyah), they latter split into many sub sects. The Murjiah deviated in their understanding of iman (faith). The Murjiah (or those that follow their aqeedah in this issue) claim major kufr can only occur if a Muslim believes in kufr, desires kufr, desires to leave Islam, desires to commit kufr through his action, believes in a statement of kufr he uttered istihlaal of action or statement and istihlaal of belief in the heart (i.e. to declare an action or a statement to be lawful (halaal) as a matter of belief in the heart) though it is haraam in the shariah thakdhib (Falsification) disbelieving with the tongue and heart together and juhood (Denial) which is disbelieving by the tongue but not with the heart (i.e. a person knows Islam is the truth so he therefore he believes in Islam as the true and only religion to follow in his heart however whenever he moves his tongue (speaks) about Islam he claims it is a false man made religion which should not be followed. So he believes in his heart but

disbelieves by his tongue (i.e. his speech)) (Often many scholars, students of knowledge and daaeeis (not all) refer to juhood and thakdhib as juhood only, but by this they mean disbelieving with the tongue and heart together and not disbelieving by the tongue but not with the heart as I have stated above) In this article the Murjiah belief that major only by Muslim committing, Istihlaal of action or statement and istihlaal of belief in the heart (i.e. to declare an action or a statement to be lawful (halaal) as a matter of belief in the heart) though it is haraam in the shariah, will be looked in to. This Murjiah belief is incorrect and is not held by Ahlus Sunnah of the past or present. The reason this belief is incorrect is because though major kufr can sometimes occur through istihlaal of action or statement and istihlaal of belief in the heart, major kufr can also occur through istihlaal of action or statement and no istihlaal of belief in the heart. Istihlaal of action or statement and istihlaal of belief in the heart occurs when a person performs a haraam action or a haraam statement (i.e. an action or statement of minor or major sin (which includes minor kufr, minor shirk, minor nifaaq and all other haraam actions) or major kufr) and beliefs in his heart this action or statement is halaal. Hence Istihlaal of action or statement and istihlaal of belief in the heart is always major kufr no matter whether a person makes istihlaal of an action or a statement of minor or major sin (which includes minor kufr, minor shirk, minor nifaaq and all other haraam actions) or major kufr.

An example of istihlaal of action or statement and istihlaal of belief in the heart is to believe drinking alcohol is halaal though it is haraam in the shariah. Shaykh Uthaymeen clarified what istihlaal of action or statement and istihlaal of belief in the heart in "Liqaa Baab alMaftoo" (no. 1200) he said: Istihlaal is that a person believes that something that Allaah has made unlawful is lawful. As for Istihlaal of action, then we need to observe: If this Istihlaal (is related to something) that expels from the religion then a person becomes a disbeliever and apostate by it. So for example, if a person worked with usury (i.e. took or gave usury) without believing in its lawfulness, yet he persists in working with it, then such a one does not become a disbeliever because he did not declare it to be lawful. However, if he said, "Usury is lawful" and he intends by this the usury that Allaah has declared unlawful, then he becomes a disbeliever, since he is a denier (mukaddhib) of Allaah and His Messenger. So in this circumstance, Istihlaal would be that of action and also that of belief with his heart... Istihlaal of action or statement and no istihlaal of belief in the heart refers to when a person willingly (from his own free choice (i.e. was not forced)) and knowingly (i.e. desiring and intends their actions or statements) makes lawful (halaal) for himself (i.e. he performs a action or says a certain statement) a action or says a statement which is haram, so the action or the statement is looked into. If the action or statement of the person is a minor or major sin (which includes minor kufr, minor shirk, minor nifaaq and all other haraam

actions) thus in this case istihlaal of action or statement and no istihlaal of belief in the heart is not major kufr. An example is when a person slanders another Muslim (i.e. he lies about him) he knows this action is haraam though he does it so his action is only considered as a major sin and not major kufr. But on the other hand the action or the statement of the person could be major kufr (which includes major shirk and major nifaaq) which expels the doer instantly from Islam regardless of whether the doer believes in his heart the action or statement is halaal, because the action or statement in and of itself expels from the religion. Therefore in this case istihlaal of action or statement and no istihlaal of belief in the heart is major kufr. Shaykh Uthaymeen clarified what istihlaal of action or statement and no istihlaal of belief in the heart is in "Liqaa Baab al-Maftoo" (no. 1200) he said: Istihlaal in action (or statement and no istihlaal of belief in the heart), we need to look at the action itself, is it something which in and of itself expels from the religion or not? And it is known that consuming interest does not make a person a disbeliever rather, it is one of the major sins. However if a person prostrated to an idol, then he becomes a disbeliever. Why? Because this act itself expels from the religion. This is the principle, however it is necessary for us to observe another condition, and this is that the person who made something lawful (by istihlaal) is not excused due to ignorance, for if he is excused due to ignorance then he does not become a disbeliever (other excuse include compulsion to do that act or say that

statement or an error which was accidental (i.e. the doer did not intended to do that action or say those words). So from the above it is clear that those who claim Ahlus Sunnah of today believe major kufr can only occur when it is accompanied with istihlaal of action or statement and istihlaal of belief in the heart are incorrect liars as Ahlus Sunnah believes: istihlaal of action or statement and istihlaal of belief in the heart is always major kufr And Istihlaal of action or statement and no istihlaal of belief in the heart is: a. minor or major sin in some situations b. Or in other situations it is major kufr which expels the doer from Islam unless the doer has the excuse of ignorance, compulsion to do that act or say that statement or it was an error which was accidentally (i.e. the doer did not intended to do that action or say those words).
