MANIFESTATION
COMES now the petitioner through the undersigned counsel and to this Honorable Court, most respectfully manifests, that...: 1) The above-entitled petition was filed on October 28, 2010 and was subsequently raffled to this Branch; 2) Two (2) weeks after the filing of this case, the petitioner herein aforenamed was called by his manning agency in Manila, being a seafarer to return to work immediately; 3) The herein petitioner is, at present, abroad and on board on vessel for the duration of his contract; 4) Because of the nature of the work of the petitioner, the undersigned counsel do hereby respectfully pray the Honorable Court to set the aboveentitled petition for hearing preferably for the month of October 2011 as petititioners contract for employment as seafarer will be terminated and is available on that date to testify in Court regarding on his petition.

5) This manifestation is hereby submitted for the information of the Honorable Court and is not intended to delay the proceedings of this case.
