ORDINANCE NO. _______ AN ORDINANCE AMENDING ARTICLE 8C OF TITLE 1 OF THE ISLAND LAKE VILLAGE CODE ________________________________________________________________ WHEREAS, the Village of Island Lake, Lake and McHenry Counties, Illinois, is an Illinois municipal corporation; and WHEREAS, from time-to-time, the Village reviews its ordinances to determine whether the provisions are consistent with Illinois statutes and Village ordinances and regulations; and WHEREAS, the Mayor and Board of Trustees find that it is in the best interest of the Village to amend Article 8C of Title 1 of the Village Code, as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE Mayor and Board of Trustees of the Village of Island Lake, Lake and McHenry Counties, Illinois, as follows: Section 1. Section 2. hereby repealed. Section 3. The above stated recitals are incorporated herein by reference. The Ordinance amending Section 1-8C adopted on March 31, 2011, is Article 8C of Title 1 of the Village Code is hereby amended as follows: ARTICLE C. VILLAGE ATTORNEY; OTHER ATTORNEYS 1-8C A. APPOINTMENT; RETENTION; DUTIES In accordance with 65 ILCS 5/3.1-30-5(a), the Mayor with the advice and consent of the Board of Trsutees may appoint an attorney to the Office of Village Attorney. The Village Attorney has such duties as required by law and such other duties as determined from time to time by the corporate authorities. The corporate authorities may from time to time contract with other attorneys acting as independent consultants for legal advice or representation and these consultants shall have such duties as required by law and such other duties as determined from time to time by the corporate authorities.

1-8C-1: CREATION; APPOINTMENT: There is hereby created the office of Village Attorney, an executive office of the Village. The Village Attorney shall be appointed by the Mayor, by and with the advice and consent of the Board of Trustees. 1-8C-2: SPECIAL COUNSEL: The Mayor, with the consent of the Board of Trustees may, from time

to time, retain an attorney to represent or advise the Village on legal matters if no Village Attorney has been appointed. The Mayor may likewise retain special counsel to advise or represent the Village on special matters or to assist the Village Attorney. 1-8C-3: POWERS AND DUTIES: A. Suits and Actions: The Village Attorney shall prosecute or defend any and all suits or actions at law or equity to which the Village may be a party, or in which it may be interested, or which may be brought against, or by, any officer of the Village on behalf of the Village or in the capacity of such person as an officer of the Village. Judgments: It shall be the duty of the Village Attorney to see to the full enforcement of all judgments or decrees entered in favor of the Village, and of all similar interlocutory orders. Advice: The Village Attorney shall be the legal advisor of the Village and shall render advice on all legal questions affecting it, whenever requested to do so by any Village official. Upon request by the mayor or a majority of the board of trustees, the Attorney shall reduce any such opinion to writing.

Section 4: In the event a conflict exists between the terms of this Ordinance and any other ordinance of the Village, the terms of this Ordinance shall govern. Section 5: In the event that any term or provision hereof is found or determined to be invalid, the invalid portion shall be deemed stricken herefrom and the remainder shall be in full force and effect.
