The Alabama Department of Agriculture and Industries has a Food Safety Program that issues food safety permits to business retailers that sell Class A Food Products such as infant formula, baby food and/or potentially hazardous foods that must be properly refrigerated at all times. The Alabama Department of Agriculture and Industries issues these food safety permits pursuant to Administrative Code, Chapter 80-1-22-.31. Chapter 80-1-22-.31 states: "It shall be unlawful for any person to operate a food sales establishment that sells or offers for sale any Class A Food (i.e. baby food, infant formula, or potentially hazardous foods) unless such person possesses a valid food safety permit issued by the Commissioner of Agriculture and Industries. If the established retailer that you are buying these type foods from does not have a valid food safety permit, please contact the Alabama Department of Agriculture and Industries at (334) 240-7100, and ask for the Food Safety Program.
