AGREEMENT OF PAYING GUEST THIS ARTICLE OF AGREEMENT is made and entered into at Mumbai on __ June 2011 BETWEEN MR.

JITENDRA KUMAR SHRIVASTAV, adult, Indian Inhabitant, having address at Flat No.1501, 15th floor, Lavender Building, Mantri Park, C.T.S. No.827 D, Near New Mhada, Dindoshi, Near Film City Road, Goregaon (E.), Mumbai 400 065, hereinafter called the OWNER/ LICENSOR (which expression shall mean and include his heirs, executors, administrators and assigns) of the FIRST PART; AND MR. ___________________________ Son of Mr. ___________________, adult, Indian Inhabitant, having his address_______________________________________________________ _ and having his Office Address : _____________________________________________________________ __ hereinafter called the PAYING GUEST/LICENSEE (which expression shall mean and include his heirs, executors, administrators and assigns) of the SECOND PART ;

-2WHEREAS the OWNER is absolutely seized and possessed or otherwise well and sufficiently entitled to Flat No.1501, 15th floor, Lavender Building, Mantri Park, C.T.S. No.827 D, Near New MHADA, Dindoshi, Near Film City Road, Goregaon (E.), Mumbai 400 065, hereinafter called and referred to as the said flat which is in his exclusive possession AND WHEREAS the PAYING GUEST approached through agent the OWNER and made a request to allow Paying Guest to use and occupy the said flat for residential purpose to which the OWNER has agreed but strictly on the following terms and conditions: NOW THESE PRESENTS WITNESSETH AS FOLLOWS:

That the OWNER hereby allows the PAYING GUEST to use and occupy the said flat for a period of 11(Eleven) months commencing from 26/06/2011 to 25/05/2012 (both days inclusive) on the terms and conditions herein mentioned. The PAYING GUEST HAS PAID A SUM OF Rs. 12,000/-(Rupees Twelve Thousand Only) towards SECURITY DEPOSIT without interest towards the use and occupation of said flat. The Deposit will be refunded only after peaceful possession /hand over of the said flat by the Paying Guest to the Owner under this agreement. 3. That the PAYING GUEST shall pay to the owner the rent/ compensation of Rs.6,000/- (Rupees Six Thousand Only) per month in advance for the use and occupation of the flat. The compensation is to be paid in advance for every month. The compensation is exclusive of electricity charges or other outgoings, if any. That the said flat is giving on leave and license for the purpose of residence only to the Paying Guest and no business, commercial activity and agency or such type work shall be conducted. The Paying Guest hereby covenants with the Owner as follows: a) The PAYING GUEST shall pay to the owner for any additional amount over and above Rs. 1000/- of the electricity bill of the premises. b) The day to day repairs such as electrical repairs, leakages of water taps and maintenance, cable TV charges, Internet connection etc. to be done and paid by the Paying Guest at his own cost. c) The Paying Guest shall not claim any right or interest of any kind or nature whatsoever in the said premises or any part thereof save and expect to the use of same as a bare Paying Guest for a period of 11 (Eleven) months and that the PAYING GUEST can not create any rights title and sub-tenancy or otherwise. The license granted by the Owner is a revocable and non-transferable one which is to be terminated on the terms and condition herein stated.

d) OWNER and his agent shall have right at all times to enter in the said premises for inspection after giving advance intimation. e) The Paying Guest shall use and occupy the flat only for the purpose mentioned in clause No.4 above and not to use the same for other purpose or as public house in any part thereof anything which may become nuisance or annoyance or cause damage to the owner or the adjoining owners or occupiers or neighboring properties. f) The PAYING GUEST shall himself use the said flat and shall not transfer in any manner the benefits under this agreement to any nor shall part with the possession of the said flat or any part thereof in favor of any one and if he does so it shall be at his risk, cost and consequences.

In case the Paying Guest desires to handover the said flat to the OWNER due to unavoidable circumstance before the completion of the term of eleven months the Paying Guest will have to give ONE MONTH NOTICE for termination in writing to the owner otherwise ONE MONTH RENT will be deducted from the SECURITY DEPOSIT in lieu of notice and also other outgoing charges like ( light bill, parking charges, cable charges, paper charges, milk charges etc) which are concerned to the said flat shall be deducted from the security deposit. That if the PAYING GUEST fails to vacate the said flat as per the clause above or on expiry of the Paying Guest period due to any reason the PAYING GUEST willingly authorizes the Owner and or his agents to remove Paying Guests belonging and possessions, in the presences of any two witnesses to any warehouse and the rent of warehouse labor, transport charges and other incidental charges shall be recovered from the PAYING GUEST and or shall be deducted from the deposit amount. Such PAYING GUESTS belongings will be lying at the warehouse or passage of the building on entire risk and cost of the Paying Guest and the Owner will not be responsible in any way whatsoever. Escalation of rent: The agreement can be renewed after 11 months with increase of rent by 10% of the existing rent amount.

9. The Paying Guest is advised to ensure the following points:


a) No consumption of alcoholic beverages in the premises during the

currency of this agreement. b) Smoking of cigarette is prohibited in the premises.


c) No female visitors allowed in premises at any point of time.

d) The visitors/friends/family members of Paying Guest are not allowed to stay over night in the premises.
e) Entry to other Paying Guests rooms in the premises is strictly

prohibited without permission of the occupants of that room.


f) If any contravention of the above point(s) is done then the Paying

Guest will have to evict within 24 hours and the security deposit will NOT be refunded.

10. The Paying Gust is advised to take care of his food, groceries and personal care items as the owner would not be responsible for any health hazard or loss of life arises out of it. 11. Utmost care has to be taken by Paying Guest while using Furniture, Fixtures, Wooden Flooring, Electronic Equipments, Utensils & Kitchen items provided by the Owner. The cost of any damage to these items will have to be compensated by the Paying Guest. The Paying Guest must not indulge in any kind of dispute/fight with the occupants/visitors in the premises which may result in any extreme situation. The owner shall not be liable for any damage, injury or loss of life during such incidents. That in the event of the PAYING GUEST not vacating the said premises as per clause above on expiry or earlier termination of this agreement the Paying Guest shall pay a sum of Rs.500/- per day as compensation and other charges will be recovered from the SECURITY DEPOSIT. The Owner shall not be responsible for any damage or loss of the belongings of the Paying Guest in any manner, during his tenancy in the premises by any external / internal means or person(s).

The Paying Guest will be given possession of the said flat immediately on payment of SECURITY DEPOSIT, one month advance Paying Guest Fee and brokerage to the agent.
