The undersigned private prosecutor, by the authority of the esteemed Provincial Prosecutor, unto this Honorable Court most respectfully manifests: 1. On July 12, 2005 the instant cases were provisionally dismissed with notice to the complainant and the express consent of the accused; 2. To this day, however, the accused has failed to fulfill his commitments upon which the provisional dismissal was founded; 3. Henceforth, the instant cases may still be revived pursuant to Section 8, Rule 117 of the Revised Rules of Criminal Procedure. WHEREFORE, it is most respectfully prayed that the instant cases be revived and placed in the active calendar of the Honorable Court.
