We lobby and educate the government and the general public to promote motorcycling in a safe and positive image. We endeavor to enlist the cooperation and participation of all organizations and individuals that share a similar interest in preserving our American tradition of FREEDOM. We promote motorcycle safety, training, & political awareness. We ARE NOT A CLUB OR A GANG. We fund our work through toy runs, poker runs, campouts, and other motorcycle activities. We are your neighbors & friends who work, pay taxes, and get involved with our community. We serve and support our country and believe in freedom. We use all legal means to protect our rights without infringing on the rights of others. OUR GOALS To become a powerful and viable political force in legislative matters concerning the motorcyclist. Hello Brothers and Sisters,

Cooler dryer weather coming up and more riding time for everyone. The Chapter birthday party went off well although not much participation by chapter members. A big thank you to Kelly Rogers at Gear Head Tattoo for hosting the event as well as Alan Smith of Old Skool, Tony Allen of Hot Rods and Hogs and Nick Lees World Burnout Tour, as well as all the participants of the car and bike show and of course the public who showed up. This month starts with Cape Bike Night followed by the next weekend with our State meeting up in Brooksville, home of Spooks and Scoots hosted by Peace River and West Coast Chapters. Our second meeting at Anthonys went well and seems to be just what we were looking for. Pam Cook, Legislative rep for Estero River, Mark Williams, President of Estero River Chapter and myself attended a meeting with Rep. Matt Caldwell as we asked for him to join us and help with the stiffer penalties bill. Rep Caldwell welcomed the meeting and has been informed

of our plight. I look forward to an update soon. Rep Trudy Williams will be speaking at our November meeting and all members are encouraged to attend and show their support. Tuesday nights at the Joint at Cape Harbour is turning out new members and we are selling many shirts as Ken and Keith set up a weekly table for safety and membership each week. DEAR FELLOW ABATE MEMBERS

Coming Up! Please begin to look for the fliers of two upcoming events. Biker Bible Caf - will be held in our home on December 2nd, starting at 7:30 PM. This will be our Christmas gathering and all bikers are invited. As we celebrate the greatest gift ever given to man (John 3:16), we will have a fun Chinese-style gift exchange, value under $10.00. You can bring something new , something used, or some "white elephant." There will be lots of seasonal treats to eat and drink! On January 22nd, we be having the 13th Annual Lee County Church Crash and Slow Race Championship of the Universe. The evening before will be the Run for Ribs. As the Holiday season (Thanksgiving and Christmas) approaches, it reminds of the thanks we owe to God, for all He has provided and, for the gift of His precious Son. It kind of brings to mind, a story, told by a preacher named Tony Evans. He tells of a child who wanted his parents to pay for the things this child did

around the house. The child wanted money for mowing the lawn, cleaning the windows, picking up its own clothes and several other things. The child went as far as writing up a bill, totaling a few dollars and submitting it to the parents. The parents set the money on the dining room table. However, they left their own invoice saying, "For your mother carrying you for nine months and being sick as a dog every morning, NO CHARGE. For picking up your clothes when you forgot, NO CHARGE. For your dad mowing the lawn, when you wanted to go and play with your friends, NO CHARGE. For staying up at night with you when you were sick, NO CHARGE. For the special clothes you wanted and we had to work overtime to pay for, NO CHARGE. Like the child who lost sight of his parents love and tried to turn it into a business relationship, we sometimes lose sight of the love of God and all he has given us. And, sometimes it's most apparent during hard times. Our favorite scripture, during this time is John 3:16 -17 "For God so loved the world that He gave His only begotten Son, that whoever believes in Him should not perish but have everlasting life. For God did not send His Son into the world to condemn the world, but that the world through Him might be saved." Nothing can beat His love. Nothing can beat His grace. He promised that He would never leave us nor forsake us. All at, NO CHARGE... Special thanks to Ken (Diesel) Coons and Keith Baker for working our 2 weekly bike nights. ILLINOIS GOVERNOR SEEKS CHANGES TO RED LIGHT BILL

Illinois motorcyclists who get stuck at red lights will remain stuck a while longer, as Governor Pat Quinn has vetoed legislation that would have made it legal to proceed through a red light that does not detect motorcycles. However, the bill may yet become law if legislators agree to make some changes. Illinois has what is called an Amendatory Veto, wherein the governor can reject a bill as presented for signing, but with changes requested that, if met, will win his signature. As written, House Bill 2860 sponsored by Senator Gary Forby (D-Benton) and Representative Daniel Beiser (D-Alton), specifies that motorcyclists could run red lights "after a reasonable period of time." Quinn objected that such wording is too subjective and its interpretation could vary from individual to individual and county to county." He asked that the bill be changed to specify that the motorcyclist must wait two minutes. Quinn also asked for clarification that motorcyclists would still have to obey signs prohibiting right or left turns on red and would still have to yield to oncoming traffic. ABATE of Illinois supported the measure when it passed the legislature in May, which is similar to laws enacted in 11 other states. I was kind of disappointed with what the governor done, said Sen. Forby. ABATEs going to have to make a decision on whether they want to negotiate with the governors office or try to override his veto. The Illinois Legislature has placed the amendatory veto on its calendar for action on October 19.

PENNSYLVANIA MEASURE WOULD LIMIT LEARNER PERMITS

ABATE of Pennsylvania is supporting legislation to limit the number of motorcycle learners permits allowed before a rider must get a license. All too often those involved in serious accidents have no motorcycle endorsement on their license, lobbyist Charles Umbenhauer of BikePAC told the National Coalition of Motorcyclists (NCOM), adding that In most cases this also means they have had no formal motorcycle rider training. State Representative Seth Grove (R-Dover Township) has introduced legislation aimed at increasing motorcycle safety by requiring riders to get a motorcycle license rather than continuously reapplying for a motorcycle learner's permit. Currently, an aspiring rider can get a permit after passing a written test, which is good for a year to allow motorcyclists to legally ride and gain experience until they get their motorcycle license. However, some riders reapply to renew the permit year after year rather than getting a full license, Rep. Grove said. Under Grove's proposal, a rider would only be allowed to reapply for a learner's permit three times in 10 years. "The purpose is to make people get the license," stated Grove, adding that more motorcyclists taking the skills tests or enrolling in the states rider training program would mean more trained riders on the road. If a rider doesn't get a license within 10 years of receiving the first permit, he or she wouldn't be able to get another permit for seven years. The bill was referred to the transportation committee earlier this

MOTORCYCLE-ONLY CHECKPOINTS CHALLENGED IN NEW YORK

On Monday, August 29, 2011, Robert "Prospector" Boellner, State Legislative Coordinator for ABATE of New York, Inc., and NCOM Region VIII Director, met with a representative from the New York State Attorney General's office to discuss the ongoing motorcycle-only vehicle checkpoints. Since May 2008, ABATE has publicly expressed its

opposition to New York State's tactic of conducting highway roadblocks which divert only motorcyclists from the state's roadways for the purpose of conducting "safety checks". Because motorcycles operated in New York State are already required to pass annual safety inspections, the ongoing New York State Police initiative serves only to harass, intimidate and inconvenience motorcyclists traveling upon the state's roadways. Further, motorcycle-only roadblocks conducted in the name of "safety checks" are a discriminatory and unconstitutional infringement upon an individual's right to travel without interference, and an abuse of discretionary power as acknowledged by the New York State Court of Appeals. The Office of the Attorney General was reportedly receptive to Prospector's request of an investigation into the actions of the New York State Police, and a reporting mechanism has now been implemented for direct complaints of motorcyclist profiling. 6 MILLIONTH MOTORCYCLIST GRADUATES FROM RIDER TRAINING

The Motorcycle Safety Foundation recently graduated its six millionth RiderCourse student, a milestone reached through the ongoing efforts of nearly 10,000 RiderCoaches at more than 2,000 training sites worldwide. "We have RiderCourses across the nation and around the globe, often during weekdays, and virtually every weekend of the year," said Robert Gladden, vice president of the Motorcycle Safety Foundation, adding that a wide variety of MSF RiderCourses are available in every state to provide motorcyclists everywhere with lifelong learning opportunities. "From the Basic RiderCourse to a much more advanced day on the track, from standard motorcycles to scooters to three-wheel motorcycles, from small bikes to large, we cover it all," said Dr. Ray Ochs, MSF director of training systems. In addition, the MSF collaborates with safety professionals worldwide. For example, the MSF is currently helping establish rider training in the Hashemite Kingdom of Jordan. The MSF works with all branches of the U.S. Armed Services to support riders in the military. And the Foundation also works with world champion road racers on track-based programs that improve rider safety everywhere. FLORIDA COPS USE SECRET FILES ON BIKERS TO LOBBY AGAINST GUN LAW
Florida law-enforcement officials dipped into secret intelligence files to lobby against legislation that would have allowed holders of concealed-weapons permits to carry their guns openly. Newly released records show that a staff lobbyist for the Orange County Sheriffs Office handed out restricted photos of bikers with valid concealed weapons permits to lawmakers as examples of the sort of people who might scare away tourists if they displayed their pistols. "I actually stopped by every one of you guy's office this morning and dropped off photographs of some biker outlaw gang guys that have concealed firearm permits. Those are the ones we're worried about carrying," sheriff's Capt. Mike Fewless told the state Senate Judiciary Committee on April 12, 2011. "Please defeat this terrible bill." After the provision allowing open carry of firearms was removed from the bill, the state Senate voted against the measure, prompting accusations of fearmongering by law-enforcement officials and raising concerns about police misuse of confidential files for political goals. All together, Fewless obtained photographs and other information for 17 "outlaw bikers" from the Orange sheriffs Intelligence Squad, an undercover unit that investigates "motorcycle gangs, white supremacy groups and organized crime, specifically asking for pictures of "One Percenters", state attorney's records show. Seven of the eight photos of members of the Mongols, Outcasts, Outlaws, Pagans and Warlocks motorcycle clubs came originally from the state Driver and Vehicle Identification (DAVID) system, which Federal law classifies as highly restricted personal information." None of the bikers had felony records and all were eligible for concealed-weapon permits recognized by Florida and 34 other states. The motorcyclists are now represented by Aid to In-

DRIVING WHILE BIKER

Chief of Staff Gunny Hutcheson, members of the Henchmen MC have hired a lawyer to put the San Jose Police department on notice that harassment is not going to be tolerated without a fight. They've filed an official complaint with the city's Office of the Independent Police Auditor alleging that the police are illegally profiling them, and the city's code enforcement unit is digging up zoning beefs to run them out of town. They say officers routinely pull them over, sometimes photographing their tattoos, based solely on their bad-boy reputations. The Henchmen's complaint is not the first time a motorcycle club in San Jose has fought the law using the law. Five years ago, the Hells Angels won $1.8 million after suing police and sheriff's deputies for illegally raiding the club's headquarters and members' homes to link a bouncer, charged with killing a drunken bar patron, to the biker club. A jury acquitted the bouncer and a federal court sided with the Hells Angels. This kind of thing has come to a halt in Washington with their recent biker anti-profiling law, thanks to the Washington Confederation of Clubs and A.I.M. Good Morning Freedom Fighters: Hey everyone, here is a small list of what will be happening this coming week up at Tally. The Legislature returns to town, finally ending the doldrums of summer, and they picked a week when things are picking up politically as well. But the focus on Tallahassee will also be on legislative committees, which return in full swing. There are redistricting committees, budget committees and policy committees. The first bills of the new legislative year will be heard by a Senate committee Senate Military Affairs on Tuesday afternoon. Still, most of the committees hear overviews, though some of them will get agency presentations, including legislative agendas for the year, which often prove newsworthy. MONDAY, SEPT. 19, 2011 HOUSE REDISTRICTING COMMITTEE: The House Redistricting Committee meets to begin its work drawing maps for the state's legislative and Congressional districts. Members are set to hear remarks from Chairman Will Weatherford, R-Wesley Chapel, and look at public information on the process. (Monday, 12 p.m., 404 House Office Building, The Capitol). HOUSE SUBCOMMITTEE ON HOUSE REDISTRICTING: The subcommittee gets started on the once-a-decade redistricting process as it affects their own chamber. NEXT WEEK IN TALLY: HIGHWAY SAFETY FEES: The Revenue Estimating Conference turns its attention to highway safety fees as it updates forecasts for collections from traffic fines, vehicle registrations and other fees. Of interest will be the effect red light cameras are having on collections. Revenue anticipated coming in last year did not, prompting economists in March to change red light collection forecasts for the 2011/12 fiscal year. INCREASES IN TOLLS FOR INFLATION COMING The Florida Department of Transportation is proposing to implement the indexing of toll rates for all FDOT toll roads and bridges, including the Florida Turnpike. Lawmakers in 2007 voted to require such an index to the Consumer Price Index or other inflation indicators at least once every five years starting no later than June of next year. Cars will typically see a 25-cent increase at each plaza. The agency recently held one rule development workshop on the proposal, during which officials said SunPass rates will go up from 6 to 7 cents per mile, and cash rates will be raised from 7.5 to 8.5 cents per mile. The FDOT is basing the increase on the Consumer Price Indexs rate of 11.7 percent inflation over the past five years. DHSMV WANTS ENHANCED DRIVER LICENSES The state Department of Highway Safety and Motor Vehicles wants to offer drivers an "enhanced driver license," which would have security features allowing the card to be used instead of a passport when crossing some land or sea international borders. Several other states have such cards, particularly states that border Canada. That allows drivers to go back and forth across the border without having to carry a passport. In Michigan, the licenses even have technology in the card that allow them to be scanned from a distance, speeding up border crossings. Drivers can simply hold up their card. One reason they could be useful in Florida is that re-entry into the United States from several Caribbean countries could be made with just the driver's license, allowing travelers to go on Caribbean cruises without the expense of

having to get a passport, said Steven Fielder, legislative affairs director for DHSMV. Fielder mentioned that the agency is exploring the concept, and wants to offer the licenses, when he presented the department's legislative agenda Tuesday to the House Transportation and Highway Safety Subcommittee. The agency is still studying how much it would cost, but Fielder said officials think they could offer the card for around $75. In Michigan, the enhanced licenses are $45. HOUSE HIGHWAY SAFETY CHAIR: PANEL WILL LOOK AT TEXTING WHILE DRIVING The chairman of the House subcommittee that deals with highway safety pledged Tuesday that the panel will take up legislation aimed at reducing distracted driving. Rep. Brad Drake, REucheeanna, said that he was open to considering a change in the law, or at least looking at the problem of driving while texting or doing other things. Drake's comments came after Rep. Irv Slosberg, a longtime advocate for more stringent driving safety laws, used the appearance in the committee of an official from the Department of Highway Safety and Motor Vehicles to raise the point that it remains legal to text and drive. Slosberg, who often says he went into politics to make roads safer because of the death in a car crash of one of his daughters, asked HSMV legislative affairs director Stephen Fielder how many distracted driving tickets are given in a year by the Highway Patrol, which is overseen by the agency. "None, because there is not a law prohibiting distracted driving," Fielder acknowledged. Slosberg, D-Boca Raton, said afterward that he intends to file legislation this year that would make it illegal for minors to text and drive, but probably not adults. Scribe's Comment.... Disabled Parking, No More Free Rides From the News Service of Florida, A pair of South Florida Democrats wants to put the bite on ablebodied motorists who take advantage of disabled parking permits. Tired of seeing spry drivers leaping out of vehicles adorned with the signature blue permit tag dangling for the mirror, Sen. Gwen Margolis, D-Miami, and Rep. John Julien, D-North Miami Beach, have filed bills to require local officials to more frequently check the rolls of permit holders to make sure they are still among the living and in need of the free parking pass. Margolis' bill, SB 226 was filed Wednesday and is similar to a measure, HB 27, Julien filed in June. The bills require motorists to renew their permits in person. The bills also require random audits including a search of county death records -- every six months and bolster penalties for drivers who abuse the privilege. Federal Judge Bars Enforcement of Gun Gag Bill This is from The News Service of Florida by Michael Peltier A new state law prohibiting health care providers from asking patients about guns cannot be enforced while the merits of the new law are being litigated, a federal judge in Miami ruled Wednesday in a temporary victory for physicians in the battle between the First and Second Amendments. U.S. District Judge Marcia Cooke granted a temporary injunction to a group of physicians who filed suit over the Firearm Owners Protection Act, which was passed by lawmakers in May and signed into law by Gov. Rick Scott. In a 22-page ruling, Cooke dismissed the argument that allowing health care providers to query their patients on gun ownership violated the patient's Second Amendment right to bear arms under the U.S. Constitution. "A practitioner who counsels a patient on firearm safety, even when entirely irrelevant to medical care or safety, does not affect

nor interfere with the patient's right to continue to own or use firearms," Cooke wrote. Trike vs. Motorcycle Endorsements in Florida September 20, 2011 - There has been some confusion expressed lately regarding Florida trike only vs. motorcycle endorsements. After confirming with the Florida Department of Highway Safety and Motor Vehicles, it has been learned that you may legally operate a trike with just a motorcycle endorsement. However, if you only ride a trike and cannot physically operate a two wheeled motorcycle, you must get the Florida trike endorsement. 2010 DHSMV Crash Report Out The DHSMV has released their 2010 crash report and the good news is that motorcyclist and passenger fatalities have decreased between 2009 and 2010 by 4.7% from 402 to 383 respectively. Additionally, taken from the report Scribe sent you all, Table 1B on page 8 shows that only 36.8% of those killed while riding were not wearing a helmet, vs. 51.2% killed WERE WEARING A HELMET, again showing that the statistics do not support the mandatory helmet use argument. To view these reports go to: www.flhsmv.gov. Proposed Amendment Would Ban Near-Shore Drilling A proposed amendment (SJR 90), filed Tuesday by Sen. Arthenia Joyner, matches a House version (HJR 23) filed earlier this year by Rep. Rick Kriseman, It would ask voters to put into the constitution a ban on exploration, drilling, extraction or production of oil in Florida waters. "There are people still suffering from the big spill," Joyner said Wednesday. "Do you want to expose Florida to the possibility of another spill but closer to our shore? I just can't believe people want to bring it that close, after seeing what happens when it's farther out. "To open up our shoreline to the possibility of oil is ludicrous," Joyner said. The move, which would need three-fifths approval of both chambers to get the proposal before voters, comes as backers of drilling have begun again raising the prospect of new exploration for both oil and gas to combat high energy prices, as well as and reducing American dependence on foreign sources of energy. Senate President Mike Haridopolos has said he has no intention of pushing for new drilling in Florida waters this year. Haridopolos, R-Merritt Island, was a backer of a bill in 2010 that would have removed a moratorium on drilling in Florida waters, but changed his stance after the BP oil spill began in April of that

year. Since then, Haridopolos has said there is a need for new drilling in American waters, but has given assurances that Florida waters which extend about 10 miles in the Gulf, and closer in the Atlantic - would remain off the agenda in the coming year. FLORIDA LAWMAKERS OFFER DREAM ACT BILL Two state lawmakers have offered a bill for the 2012 legislative session that would create a pathway for students brought to the country illegally to get in-state tuition. The bill (HB 81, SB 106) allows an immigrant brought here illegally who has spent three years at a Florida high school to be eligible for in-state tuition at a Florida college or university. A similar bill at the national level called the DREAM Act has been offered for years, but has yet to be approved by Congress. The measure has been proposed in Florida before as well, but hasn't passed. Civic Leader Changes His Plea to Guilty Tavares, FL, September 20, 2011 While riding back home from Biketoberfest on October 17, 2009, Herbert Steve Muller was hit and killed by Lake County civic leader Bruce Duncan. Duncans Blood Alcohol was twice the legal limit in addition to the empty bottle of vodka FHP found in his truck. In court today, Duncan did not dispute these facts. After many hearings in this case, on September 19 & 20, 2011 Mr. Duncan changed his plea to Guilty of DUI Manslaughter. This case took on a life of its own when Duncans defense team began lining up figures such as Florida State Representative H. Marlene O'Toole (R-Lady Lake), two Circuit Court Judges, President of Lake-Sumter Community College Dr. Charles Mojock, Tavares City Administrator John Drury, as well as fifteen other community leaders to be defense witnesses in Duncans hearing. Although there were several hours of testimony from family and friends on both sides, not all the defense witnesses had the opportunity to testify. ABATE of Florida, Inc. State President, James Doc Reichenbach II, did testify for the prosecution, asking that the Court not depart from the recommended sentencing guidelines, and how drivers killing motorcyclists are getting away with insignificant fines. Asst. State Attorney Sue Purdy recommended that Circuit Judge Michael Takac impose a 12 year prison sentence and a permanent license suspension. The state sentencing guidelines recommend a sentence of 10 years and a few months, but the defense attorneys have asked the Court to depart from these guidelines and sentence Duncan to only 4 years, the absolute minimum sentence allowed by law. The defense also motioned to suppress the testimony of Doc Reichenbach, claiming prejudice and that ABATE is not an affiliate. Judge Takac denied this motion, stating that he allowed numerous testimonies from defense witnesses that could very well be deemed prejudice as well. On September 30, 2011 at 8:30 am Judge Takac will sentence Bruce Duncan at the Fifth Judicial Courthouse, Lake County, on 550 W Main St. Tavares, FL. TEA Extension The Motorcycle Riders Foundation (MRF) has learned that, with current authorizations set to expire in the next couple of weeks, the U.S. Congress passed legislation that would authorize surface transportation programs for several more months. By voice vote, the House passed a bill (HR 2887) that would extend surface transportation programs through March 31, 2012. The bill also would extend certain highway-related taxes, including the gas tax, which is set to expire on September 30 under the most recent long-term surface transportation reauthorization. The Senate also passed the extension late on Thursday, September 15. This bill has been the vehicle for numerous motorcycle-related laws. HR 2887 is expected to be signed into law very soon. "The extension keeps the current motorcycle awareness and education grants flowing. So far the gov-

ernment has returned $49 million dollars to the motorcycle riders in the country; I call that a good start," said Jeff Hennie, MRF Vice President of Government Relations. The bill, which should be the most bipartisan bill in the entire Congress, has been stymied for a number of legislative and political reasons so much so that is now linked to the Federal Aviation Administration funding bill which is on its 22nd extension going back to 2007. House Transportation and Infrastructure Committee Chairman John Mica (R-FL) said the short extension represented a "bipartisan, bicameral agreement to move forward," but warned that it should not be a "temporary Band-Aid."
