Select a topic from the list of topics below. Prepare an analytical research report on the topic/question/area outlined below. The length of the report must be no less than 7 pages and please no more than 20 pages. Make sure that you include a bibliography with your assignment. The format of the assignment should be Times New Roman (font 11 pt). YOU CAN USE YOUR TEXT BOOK TO GET CASES AND REFERENCES TO MATERIALS FOR THE PAPER, BUT YOU MUST DO OUTSIDE RESEARCH AS WELL.

LIST OF TOPICS 1. The liabilities and responsibilities of professional groups under tort law can be very high. Select one of the groups outlined in your text book in chapter 6 and research the full spectrum of legal and professional responsibility they might have under tort law. 2. What is the concept of reasonable person mean? What is the test that determines whether someone has met that test in law? Review 3- 5 cases that discuss this issue and come to some conclusions about whether this concept is upheld in law and legal cases or not?

3. What is the importance of consideration in the making of a contract? Explain the types of consideration that exist? Use legal cases to explain the format, legality and special cases of use of consideration in law. 4. When a contract is done between an adult and someone under the age of 18, what are the legal issues that need to be considered in setting that up? Review the relevant legal cases in this area of law and tell me if you think the law is adequate to protect minors in contract law.

5. Is there any reason to trust a simple contract rather than a formal one. Review the case law on the area of simple contracts and make an assessment on whether you think they are strong enough to bind parties who wish to enter into contracts with each other? 6. When a contract is unenforceable it can be due to mistake or misrepresentation, duress or undue influence. Of these four concepts which one is the most commonly occurring in your view. With the choice you have made, please review the case law on it and explain how that concept makes a contract unenforceable. 7. Explain how a contract is repudiated. What are the different forms of repudiation that exist? If a contractual relationship has broken down so badly the contract falls into another category called___________ breach? Explain the elements and case law in that category of contractual breakdown. 8. In determining what can be done once a contract breaks down or someone is found liable in negligence, the court turns to the use of remedies. Remedies are a way to ensure that the injured party feels that they have received redress. There are many types of remedies that exist, select two specific types , describe them, and explain how they are used by the courts and how effective they are in preventing further injury. 9. Write a paper on the difference between being an agent or a consultant. What are the different legal responsibilities that each of the agent or consultant has in law? How are they protected in law? What would be the better relationship for an individual to have with a company as an agent or as a consultant? 10. Does being a sole proprietor have any more benefits over being in a partnership. What are the legal descriptions, pros and cons and legal consequences of both these business arrangements? Use cases and research to illustrate your answer. 11. Are corporations able to protect shareholders from liability by changing their structure or dissolving? Use a real life example of a corporation that has been in trouble and had to dissolve. What were the legal issues that arose in that context? 12.
