This bulletin provides guidance for all users to comply with the manufacturers warranty of the Bituminous Material Paving Machine (BMPM) 8816M. Subject to the limitations, exclusions, and claims procedures set forth herein, VT LeeBoy, Inc. warrants that this product will be free from [substantial] defects in materials and workmanship during the warranty period. VT LeeBoy, Inc. will conform to design and manufacturing requirements and to all performance requirements in the contract specifications upon acceptance at origin. This Limited Warranty extends only to the first retail purchaser and is not transferrable. The warranty period will begin on the initial start-up, training, and delivery of the unit by VT LeeBoy, Inc. to the customer and will expire after twelve (12) DISTRIBUTION STATEMENT A: Approved for public release; distribution is unlimited. 1

months following the delivery of the BMPM to the first retail purchaser. In the event any portion of this Limited Warranty shall be determined to be invalid under any applicable law, such provision shall be deemed null and void and the remainder of the Limited Warranty shall continue in full force and effect. The foregoing warranty is exclusive and in lieu of all other expressed, statutory, and implied warranties applicable to units, engines, or parts including, without limitation, all implied warranties of merchantability or fitness for any particular use or purpose or against infringement. In no event, whether as a result of breach of contract or warranty or alleged negligence or liability without fault, shall VT LeeBoy, Inc. be liable for special, incidental, or consequential damages, including, without limitation, loss of profit or revenue, cost of capital, cost of substituted equipment, facilities, or services, downtime costs, labor costs, or claims of customers, purchasers, or lessees for such damages. In no event will warranty compensation, or other damages available from VT LeeBoy, Inc., exceed the purchase price of the product. The Cummins, Inc. warranty covers any failures of the engine, under normal use and service, which result from a defect in material or factory workmanship. The Extended Major Components Warranty covers warrantable failures of the engine cylinder block, camshaft, crankshaft, and connecting rods. Bushing and bearing failures are not covered under this warranty. For additional warranty information, on the BMPM or any U.S. Army Tank-Automotive Command (TACOM) equipment, contact TACOM. The number to call is DSN 786-8869, Commercial (586) 282-8869. The caller should be prepared to provide: (1) name, (2) DSN and commercial telephone numbers, (3) complete unit designation, (4) identification of the vehicle to include serial number(s), (5) a brief description of the problem, and (6) the contract number. 1. Explanation of Terms. a. Abuse. The improper use, repair, or handling of warranted items such that the warranty may become void. b. Alterations/Modifications. Any alteration after production such as retrofit, conversion, remanufacture, design change, engineering change, and the like. c. Failed Item. A part, component, or end item that fails to perform its intended use.

d. False Claim. The return of suspected defective warranty items to the manufacturer that are eventually determined to be serviceable. e. Prime Contractor. A party that enters into an agreement directly with the United States to furnish part or all of a weapon system.

f. Reimbursement. A written provision in a warranty contract whereby the user may make the necessary repairs with or without prior approval of the contractor and the Government will be reimbursed for the repair parts and/or labor costs.

g. Repair. To restore an item to serviceable condition without affecting the warranty. h. Serviceable. The condition of an item which may be new or used that meets all the requirements and performs the functions for which it was originally intended. i. Warranty. A promise or statement of fact from a seller to a purchaser on the nature, usefulness, or condition of the supplies or performance of services to be furnished. The main purposes of a warranty in a government contract are to outline the rights and obligations of the contractor and the government for defective items and services. It also serves to foster quality performance by the contractor but is not a substitute for an adequate quality assurance program. Warranty Claim. Action started by the equipment user for authorized warranty repair, replacement, or reimbursement made from the local dealer or manufacturer. Warranty Period. Time during which the warranty is in effect. Normally measured as the maximum number of years, months, days, miles, or hours used. Warranty Start Date. The date the warranty is put into effect.

2. Coverages Specific. Table 1 identifies the BMPM and its components that are covered by the Warranty Technical Bulletin. The warranty period will begin on the initial start-up, training, and delivery of the unit by VT LeeBoy, Inc. to the customer and will expire after twelve (12) months following the delivery of the BMPM to the first retail purchaser. VT LeeBoy, Inc. may have support agreements with some engine manufacturers for warranty and parts support. However, VT LeeBoy, Inc. does not warrant the engine. The warranty on all engines rests with the manufacturer of the engine, which is Cummins, Inc.

This limited warranty sets forth your sole remedy in connection with the sale or use of VT LeeBoy, Inc. product covered by this Limited Warranty. All used units or used parts of any kind are not covered. The warranty start date for the Cummins, Inc. engine is the date of delivery of the engine to the first retail purchaser, or the first use of the engine as a leased, rented, or loaned unit, or when the engine has operated 50 hours, whichever of the three (3) occurs first. The warranty on all extended major components (engine cylinder block, camshaft, crankshaft, and connecting rod) begins with the expiration of the Base Engine Warranty. These items will be covered for three (3) years or ten thousand (10,000) hours of operation from the date of delivery of the engine to the first retail purchaser.

LeeBoy, Inc. will train the personnel on that list how to use the website claim service. The website to access the online warranty claim submittal program is http://www.leeboy.com/. c. Extent of coverage involved. If a defect in material or workmanship is found, VT LeeBoy, Inc. is to be notified during the warranty period. VT LeeBoy, Inc. will repair or replace any part or component of the unit or part that fails to conform to the warranty during the warranty period. Engines are warranted by their manufacturers and may have warranty coverage that differs from that of VT LeeBoy, Inc. VT LeeBoy, Inc. does not warrant any engine. Replacement parts furnished by VT LeeBoy, Inc. are covered for the remainder of the warranty period applicable to the unit or component in which such parts are installed. VT LeeBoy, Inc. has the right to repair any component or part before replacing it with a new one. VT LeeBoy, Inc. is not responsible for attachments not manufactured or installed by VT LeeBoy, Inc. VT LeeBoy, Inc. is not responsible for liability for incidental or consequential damages of any type including, but not limited to, lost profits or expenses of acquiring replacement equipment. This includes all miscellaneous charges. d. Transportation Cost. VT LeeBoy, Inc. is not responsible for charges related to transporting the product to and from the place at which warranty work is performed. VT LeeBoy, Inc. is not responsible for airfreight charges related to transporting repair parts to the place at which warranty work is performed. e. Time allowed for contractor to settle legitimate claims. Legitimate claims will be processed within five (5) working days of receiving the warranty claim. VT LeeBoy, Inc. has no obligation for unreasonable delay, as established by VT LeeBoy, Inc., in making the applicable units or parts available upon notification of a service notice ordered by the same. 4. Cummins Responsibilities. a. Covered repairs to Cummins products must be made by Cummins authorized repair locations. These locations are limited to: i. Cummins Distributor or Distributor Branch. ii. Warranty Dealers approved by a Cummins Distributor. Dealers are approved based on qualification criteria of Cummins. iii. Other repair shops authorized by a Cummins Distributor or Distributor Branch. b. Explain to the customer what portion of the repair cost is covered by a Cummins Program.

c. If the customer wants to have the repair performed under the terms as explained, begin the repair before the coverage expires.

d. Explain repairs and conclusion to the customer. 5. Government Responsibilities. The Major Subordinate Command for BMPM is the U.S. Army TACOM, Warren, MI 48397-5000. TACOM is responsible for managing and implementing the warranty. BMPM warranty claims shall be reported to the TACOM BMPM Program Manager: U.S. Army TACOM-LCMC PM-CE/MHE ATTN: SFAE-CSS-FP-C MAILSTOP:401 6501 East 11 Mile Road Warren, MI 48391-5000 Telephone: (DSN) 786-6983/6982 Commercial: (586) 282-6983/6982 a. TACOM Responsibilities: i. Verify, review, and process warranty claim actions. ii. Act as a liaison between the equipment owning unit and VT LeeBoy, Inc. iii. Reject claims that are deemed not valid and send them back to the equipment owning unit with a short explanation of why the claim is rejected. iv. Request additional information for claims that are incomplete. v. Supervise contractor to ensure contractor performs in accordance with the terms of the contract. b. Equipment-Owning Unit Responsibilities: i. Identify defects/failures and verify these defects/failures are covered under the warranty. ii. Submit warranty claims using DA Form 2407 to TACOM. iii. Notify VT LeeBoy, Inc. within 30 days of any alleged defect or failure of equipment. iv. Maintain an operating odometer or hourmeter. If the odometer/hourmeter is not operational, engine usage will be estimated at 12,000 MI/19,312 KM/400 HR per month, whichever is applicable. v. Before the expiration of the applicable coverage:

1. Notify a Cummins-authorized repair location of any covered failure, and 2. Provide documentation, if necessary, to verify product warranty start date, and 3. Deliver the engine to a repair facility, if required, or make the product available for repair during the valid coverage period. c. Alterations/Modifications. No alterations or modifications shall be applied unless authorized by the TACOM BMPM Program Manager in conjunction with VT LeeBoy, Inc.

6. Nullification. a. Identifies any action taken by the Government that may nullify the warranty. VT LeeBoy, Inc. has no obligation under this warranty for any defects caused by misuse, misapplication, negligence, accident, or failure to maintain or use in accordance with the operating instructions found in TM 5-3895-385-10. Defects or failures caused by any replacement parts or attachments not manufactured by or approved by VT LeeBoy, Inc. are not covered under this warranty. This includes all unauthorized alterations. b. Provide actions that must be taken to keep warranty in effect or prevent warranty from becoming void. Failure to conduct normal maintenance and operating service including, without limitation, providing lubricants, coolant, fuel, tune-ups, inspections, or adjustments will result in this warranty becoming null. VT LeeBoy, Inc. is not responsible for repairs due to normal wear and tear or brought about by abuse or lack of maintenance of the BMPM. Reference the Preventive Maintenance Checks and Services (PMCS) Work Package (WP) in TM 5-3895-385-10 for preventive maintenance procedures. c. Abuse Determination.

Any operation that is performed outside of the design intent of the unit and causes failure of any component is considered to be abuse of the system and will terminate the warranty. Cummins Inc. defines abuse of the engine and all of its components as, but not limited to, operating without adequate coolants or lubricants, overfueling, overspeeding, lack of maintenance of lubricating, cooling, or intake systems, improper storage, starting, warm-up, run-in or shutdown practices, and unauthorized modification of the engine.

7. Claim Procedures. The following procedures for reporting warranty claims are found in DA PAM 738-750, Functional Users Manual for the Army Maintenance Management System (TAMMS). For all levels of maintenance operating under the Standard Army Maintenance System (SAMS), warranty claim actions should be processed on DA Form 2407. The command hotline is DSN 786-6983/6982 or Commercial (586) 282-6983/6982. a. Identification of Failed Items. i. Identify failure and determine if the failure can be completed by the trained field maintainer. If it is determined that the failure cannot be corrected by a field maintainer, VT LeeBoy, Inc. will assist in any means deemed necessary for the failure to be corrected. ii. BMPMs and/or their components that experience a warranty failure shall be tagged/identified to prevent improper repair or use. Reference DA Form 2407 Maintenance Request and DA Form 2402 Exchange Tag. Items requiring special handling, storage, or shipment during the claim process shall be identified. b. Disposition. Upon notification by TACOM that the item is to be returned to VT LeeBoy, Inc., the using activity will package and return the item directly to the address noted in the disposition instructions. c. Invalid Warranty Claims. When parts inspected by the contractor are found to be non-warrantable due to abuse or improper maintenance, the repair activity submitting the claim will be required to make reimbursement for contractor services. All failed items returned for warranty claim action will be monitored by the TACOM BMPM Program Manager.

d. Receipts/Verification of Contractor Repairs. Upon receipt of the repaired components, the Warranty claimant activity will inspect the returned item and its accompanying documentation and verify that the warranty repair has been satisfactorily performed. If the repair is unsatisfactory, the activity should notify TACOM and the claim will be reopened. e. Claim Denials/Disputes. All denials or disputes will be handled by the TACOM BMPM Program Manager. 8. Reporting. Reporting or recording action on a failed item shall be as specified in DA PAM 738-750 or DA PAM 738-751. Contractor unique forms shall not be used. 9. Storage/Shipment/Handling. a. Storage. VT LeeBoy, Inc. is not responsible for any storage costs.

b. Shipment. VT LeeBoy, Inc. is not responsible for any shipment costs. VT LeeBoy, Inc. will invoice for replacement parts that are shipped. Once VT LeeBoy, Inc. receives item that needs repaired and claim is found to be legitimate, a credit will be applied to account. c. Handling. VT LeeBoy, Inc. is not responsible for any handling costs.
