d. False Claim. The return of suspected defective warranty items to the manufacturer that are eventually determined to be serviceable. e. Prime Contractor. A party that enters into an agreement directly with the United States to furnish part or all of a weapon system.
g. Repair. To restore an item to serviceable condition without affecting the warranty. h. Serviceable. The condition of an item which may be new or used that meets all the requirements and performs the functions for which it was originally intended. i. Warranty. A promise or statement of fact from a seller to a purchaser on the nature, usefulness, or condition of the supplies or performance of services to be furnished. The main purposes of a warranty in a government contract are to outline the rights and obligations of the contractor and the government for defective items and services. It also serves to foster quality performance by the contractor but is not a substitute for an adequate quality assurance program. Warranty Claim. Action started by the equipment user for authorized warranty repair, replacement, or reimbursement made from the local dealer or manufacturer. Warranty Period. Time during which the warranty is in effect. Normally measured as the maximum number of years, months, days, miles, or hours used. Warranty Start Date. The date the warranty is put into effect.

2. Coverages Specific. Table 1 identifies the BMPM and its components that are covered by the Warranty Technical Bulletin. The warranty period will begin on the initial start-up, training, and delivery of the unit by VT LeeBoy, Inc. to the customer and will expire after twelve (12) months following the delivery of the BMPM to the first retail purchaser. VT LeeBoy, Inc. may have support agreements with some engine manufacturers for warranty and parts support. However, VT LeeBoy, Inc. does not warrant the engine. The warranty on all engines rests with the manufacturer of the engine, which is Cummins, Inc.

This limited warranty sets forth your sole remedy in connection with the sale or use of VT LeeBoy, Inc. product covered by this Limited Warranty. All used units or used parts of any kind are not covered. The warranty start date for the Cummins, Inc. engine is the date of delivery of the engine to the first retail purchaser, or the first use of the engine as a leased, rented, or loaned unit, or when the engine has operated 50 hours, whichever of the three (3) occurs first. TACOM is responsible for managing and implementing the warranty. TACOM Responsibilities: i. Verify, review, and process warranty claim actions. ii. Act as a liaison between the equipment owning unit and VT LeeBoy, Inc. iii. Reject claims that are deemed not valid and send them back to the equipment owning unit with a short explanation of why the claim is rejected. iv. Request additional information for claims that are incomplete. v. Supervise contractor to ensure contractor performs in accordance with the terms of the contract. b. Equipment-Owning Unit Responsibilities: i. Identify defects/failures and verify these defects/failures are covered under the warranty. ii. Submit warranty claims using DA Form 2407 to TACOM. iii. Notify VT LeeBoy, Inc. within 30 days of any alleged defect or failure of equipment. iv. Maintain an operating odometer or hourmeter. If the odometer/hourmeter is not operational, engine usage will be estimated at 12,000 MI/19,312 KM/400 HR per month, whichever is applicable. v. Before the expiration of the applicable coverage:
6. Nullification. a. Identifies any action taken by the Government that may nullify the warranty. VT LeeBoy, Inc. has no obligation under this warranty for any defects caused by misuse, misapplication, negligence, accident, or failure to maintain or use in accordance with the operating instructions found in TM 5-3895-385-10. Defects or failures caused by any replacement parts or attachments not manufactured by or approved by VT LeeBoy, Inc. are not covered under this warranty. This includes all unauthorized alterations. b. Provide actions that must be taken to keep warranty in effect or prevent warranty from becoming void. Failure to conduct normal maintenance and operating service including, without limitation, providing lubricants, coolant, fuel, tune-ups, inspections, or adjustments will result in this warranty becoming null. VT LeeBoy, Inc. is not responsible for repairs due to normal wear and tear or brought about by abuse or lack of maintenance of the BMPM. Reference the Preventive Maintenance Checks and Services (PMCS) Work Package (WP) in TM 5-3895-385-10 for preventive maintenance procedures. c. Abuse Determination.
Any operation that is performed outside of the design intent of the unit and causes failure of any component is considered to be abuse of the system and will terminate the warranty. Cummins Inc. defines abuse of the engine and all of its components as, but not limited to, operating without adequate coolants or lubricants, overfueling, overspeeding, lack of maintenance of lubricating, cooling, or intake systems, improper storage, starting, warm-up, run-in or shutdown practices, and unauthorized modification of the engine.
d. Receipts/Verification of Contractor Repairs. Upon receipt of the repaired components, the Warranty claimant activity will inspect the returned item and its accompanying documentation and verify that the warranty repair has been satisfactorily performed. If the repair is unsatisfactory, the activity should notify TACOM and the claim will be reopened. e. Claim Denials/Disputes. All denials or disputes will be handled by the TACOM BMPM Program Manager. 8. Reporting. Reporting or recording action on a failed item shall be as specified in DA PAM 738-750 or DA PAM 738-751. Contractor unique forms shall not be used. 9. Storage/Shipment/Handling. a. Storage. VT LeeBoy, Inc. is not responsible for any storage costs.
