NAME TheAssociationshallbeknownastheNanaimoDistrictTeachers'Association,alocalassociation bycharteroftheBritishColumbiaTeachers'Federation,hereinafterreferredtoasthe "Association".

2.

OBJECTIVES TheobjectivesoftheAssociationshallbe: a. Tofosterandpromotethecauseofeducation. b. Toraisethestatusoftheteachingprofession. c. Topromotetheprofessionaldevelopmentofmembers. d. Topromotethewelfareofmembers. e. Torepresentitsmembersandtoregulaterelationswiththeemployerthroughcollective bargainingoftermsandconditionsofemployment.

MEMBERSHIPS a. b. AssociatemembershipintheAssociationmaybegrantedtoanypersonwhoisanassociate memberoftheBritishColumbiaTeacher'sFederation.Associatemembersmaynotvote andmaynotholdoffice,butmayparticipateinanyserviceoftheAssociationexceptin mattersrelatingtocollectivebargaining. c. i. ii. iii. iv. toretiringmemberswhohavebeenmembersforatleast10years, tomembersforpublicservice,suchmembershiptoexpireattheendofthe individual'stermofoffice, tomemberswhomtheAssociationwishestohonourontheoccasionoftheirleaving theprofession,or toanyoneelsewhomtheAssociationwishestohonour,providingtheindividualhasa teachingcertificate. HonoraryAssociatemembership,withoutfee,maybegrantedbytheAssociationina GeneralMeetingAssembly; ActivemembershipintheAssociationshallbeinaccordancewiththeBCTFConstitution& ByLaws.Activemembersshallbetheonlypersonsentitledtovoteandholdoffice.

HonorarymembersmaynotvoteandmaynotholdofficeintheAssociation.

ORGANIZATION a. TheNanaimoDistrictTeachers'AssociationisaLocaloftheBritishColumbiaTeachers' FederationandobservesthatnoclauseofthisConstitution&ByLawsandPolicy StatementsshallbeinanywayatvariancewiththeConstitution&ByLawsoftheBritish ColumbiaTeachers'Federation. DelegatestotheAnnualGeneralMeetingoftheBritishColumbiaTeachers'Federationshall beelectedataGeneralMeetingoftheAssociation. WhenamemberiselectedasamemberoftheBCTFExecutiveCommittee,thatindividual shallbeconsideredanonvotingmemberoftheBCTFRepresentativeAssemblyforlocal purposes.

FEES a. TheannualAssociationfeeshallbedeterminedattheAnnualGeneralMeetingandshallbe continuinguntilchangedatanAnnualGeneralMeeting.Thisfeetogetherwiththefeeof theBritishColumbiaTeachers'Federationshallbedeductedfromsalarychequesona monthlybasisorasarrangedbytheAssociationfromtimetotime. EachActiveorAssociateMembershallpaythecurrentannualfee.

EXECUTIVE COMMITTEE a. b. c. i. ii. OfficersoftheAssociation; Chairperson(orCoChairperson)oftheseStandingCommittees; AboriginalEducationAdvisory, BargainingandWorkingandLearningConditions(BWLC), Health&Safety, PublicEducationAdvocacy, TheOfficersoftheAssociationshallconsistofaPresident,1stVicePresident,2ndVice President,Secretary,Treasurer,andImmediatePastPresident. IntheeventthatthePresidentiselectedtoanadditionalyearofoffice,thepositionof ImmediatePastPresidentshallbevacated. TheExecutiveCommitteeoftheAssociationshallconsistofthe:

ProfessionalDevelopment(ProD), Social, SocialJustice,and TeachersonCall(TTOC).

LocalRepresentativestoBCTF(LR's);and, {totalnumberpursuanttoBCTFProcedure25.B.02} MembersatLarge(2elementaryand2secondaryrepresentatives).

ELECTION OF OFFICERS, COMMITTEES, AND LOCAL REPRESENTATIVES TO BCTF a. b. c. TheExecutiveCommitteeoftheAssociationandmembersofStandingCommitteesshallbe electedattheAnnualGeneralMeeting. Allnominationsshallbemadeinanopenmeeting,orbyaNominatingCommittee appointedbytheExecutiveCommittee,orboth. i.

NomembershalllettheirnamestandforelectiontotheExecutiveCommitteeorto theBargainingCommitteeifthememberhasaconcurrentapplicationtoan AdministrativeOfficerorExcludedStaffposition. NomembershallbeelectedanOfficer,oramemberofanycommitteeatany meetingatwhichthememberisnotpresent,unlessthememberhaspreviously indicatedtheirwillingnesstoaccepttheappointmentifelected.

Members,whohaveteachingassignmentsatboththeelementaryandsecondarylevels, maystandforposition(s)ateitherlevel.

Allnomineesinattendanceshallbeintroducedtothemeetingatthecloseof nominations. ElectionofExecutiveCommitteemembersshallbeconductedbysecretballot. Ballotsshallbedistributedtomembersatthetimeandplacedesignatedbythe agenda.Noreplacementballotsshallbepermittedandnoballotsshallbedistributed atanyothertimeorplacethanthatspecifiedbytheagenda. Shouldthevalidityofanyballotbequestionedbyanypersonassignedtocountthe ballots,itshallbethesoleresponsibilityofthechairpersonoftheNominating Committeetodecidewhetherornotthatballotisvalid.IntheabsenceoftheChair oftheNominatingCommittee,theChairpersonoftheAnnualGeneralMeetingshall makethatdecision. OnthecompletionofeachballotthechairpersonoftheNominatingCommitteeshall reporttothemeetingthenumberofvotesreceivedbyeachcandidate,without attachingnamestothenumbers.Followinganindecisiveballot,andbeforeattaching namestothenumbers,thecandidatereceivingthefewestvotesshallbedropped fromtheballot.Atthistimethemeetingmayatitsdiscretionorderthedroppingof additionalcandidatesfromthenextballot. Nocandidateshallbedeclaredelectedunlessthatcandidatereceivesamajorityof thenumberofvalidballotscast.Blankballotsandanyballotsdeclaredbythe chairpersonoftheNominatingCommitteetobespoiledshallnotbevalidballots. Candidatesdefeatedinanelectionforanyofficerpositionshallbedeemedtohave beennominatedforthenextofficetobefilled.Atanytimepriortotheconductingof aballotanycandidatemay,bygivingnoticetothemeeting,withdrawfromthatvote.

f. WheneveravacancyoccursinCommittees,thevacancyshallbefilledeitherbyelectionata GeneralMeetingorbyappointmentbytheExecutiveCommitteesubjecttoratificationat thenextGeneralMeeting.AnyStandingCommitteevacanciesexistingafterthelastschool dayinSeptembermaybefilledwithoutregardtowhetheramemberisanelementaryor secondaryteacher. TheExecutiveCommitteemayappointacommitteetodealwithanemergentsituationand willseekratificationoftheappointmentatthenextGeneralMeeting. NocandidateforofficeshallbeamemberoftheNominatingCommittee. MembersservingasChairpersonsofStandingCommitteesmaynotholdanOfficerposition ontheExecutiveCommitteeconcurrently.

TERMS OF OFFICE a. b. ThePresidentandmembersoftheExecutiveCommitteeandStandingCommitteesshall takeofficeonthefirstdayofJulyaftertheirelection. ThetermofofficeoftheExecutiveCommitteeoftheAssociationshallcontinueuntiltheir successorshavebeenelectedinaccordancewiththeConstitution&ByLawsandPolicy Statements. TheTermofOfficeofmembersofStandingCommitteesshallcontinueuntiltheirsuccessors areappointedoruntilthecommitteeisdischarged. NooneExecutivepositionshallbeoccupiedbythesameindividualformorethanfour consecutivetermswithoutnotificationtoandapprovaloftheAGMoratthegeneral meetingpriortotheAGM.InextraordinarycircumstancesanAGMcouldvarythepolicy. When,bydecisionofthemembership,aStandingCommitteebecomesunnecessary,the chairofthatcommitteeshallnotbefilleduntilagainneeded. ShouldanymemberoftheExecutiveCommitteesubmitoractivateanapplicationforan AdministrativeOfficerorExcludedStaffposition,themembershallnotifytheExecutive Committeeandvacatetheirseatforthwith.Thevacancyshallthenbefilledinaccordance withtheConstitution&ByLawsandPolicyStatements. ThepositionsofPresidentand1stVicePresidentshallbefulltimeequivalentpositions. Thepositionof2ndVicePresidentshallbe0.2fulltimeequivalentpositions. TheProfessionalDevelopmentChairpersonshallbe0.2fulltimeequivalentpositions.

DUTIES OF EXECUTIVE COMMITTEE


a.

TheExecutiveCommitteeshall,subjecttothedirectionoftheAssociation, i. directandsuperviseAssociationbusiness; ii. ensurethatthepoliciesandproceduresofeachcommitteearefunctionaland operative;and iii. interprettheCollectiveAgreement. iv. appointanindividualtoactaschairpersonoftheNominatingCommittee. TheExecutiveshallrecommendtoeachAnnualGeneralMeetingthenamesofmembersto

TheExecutiveCommitteemayauthorizedonationsfromestablishedbudgetcategoriesto otherBCTFlocalstoassistthemduringstrikesorlockouts.Informationregardingsuch donationsshallbecirculatedtoStaffRepresentativesfordistributioninschoolsandshallbe reportedtothenextGeneralMeeting. AllmotionsdulymovedandsecondedatanExecutivemeetingshallbevotedonbythe ExecutiveCommitteepresent.Thereshallbeone(1)voteeachfromtheTableOfficers, CommitteeChairs,LocalRepresentativestoBCTF.InthecaseofCoChairsinaCommittee, onlyone(1)memberisentitledtoavote. Inthecaseofillness,injury,oremergency,thetableofficerscantemporarilyfillinavacancy ontheExecutiveCommittee,preferablywithapastofficerifavailable. ThePresidentorExecutiveCommitteemaytemporarilydelegateauthoritytoactas Associationspokespersontoanothermember(s)onaspecificissue. IfanymemberoftheExecutiveCommitteeresigns,orwithoutreasonableexcuse,isabsent fromthreeconsecutivemeetings,theExecutiveCommitteeshalldeclaretheposition vacated. TheExecutiveCommitteeshallberesponsibleformatterspertainingtotheConstitution& ByLawsandPolicyStatementsoftheAssociation. DutiesofOfficers ThedutiesoftheOfficersshallbeasdefinedinthisConstitution&ByLawsandPolicy StatementsandasgenerallydefinedintheBCTFMembers'Guide. i. President{RestructuredforClarity} ThePresidentshall: (1) bethepresidingOfficeroftheAssociation; (2) beamember,exofficio,ofallcommittees; (3) chair,orappointachairto,theExecutiveCommitteeandPersonnel/Grievance

(5) (6) betheofficialspokespersonfortheAssociation;and, IntheabsenceordisabilityofthePresident,dutiesshallbeperformedbytheVice Presidents,orinturn,throughabsenceordisability,asdeterminedbytheExecutive Committee. ii. VicePresidents TheVicePresidentsshall: (1) beresponsibleforgrievances,membercommunications,policy,andother dutiesasassignedbytheExecutiveCommittee; (2) beresponsibletomonitorpolicyimplementationandtotakealeadershiprole inpolicyreview;and, (3) beresponsibletoensurethatpolicyandrevisionstopolicyarecirculatedto NDTAStaffRepresentativesassoonaspossibleafterratification. iii. ImmediatePastPresident ThepositionofImmediatePastPresidentmaybeoccupiedbythepreviousyears President,shouldtheyremainamemberoftheBargainingUnit. TheImmediatePastPresidentshallfillaMemberatLargepositionforoneyear. Secretary TheSecretaryshall: (1) (2) (3) recordminutesofExecutiveCommitteemeetings,StaffRepresentative meetings,andGeneralMeetings; provideallmembersaccesstoacopyoftheConstitution&ByLawsandPolicy StatementsoftheAssociationbypostingsameintheNDTAStaffHandbook; attendtosuchoutgoingcorrespondenceasdirectedbytheExecutive Committee;and,

TheTreasurershall: (1) (2) (3) (4) collectanddisbursemoneyreceivedbytheAssociationexceptforthe ProfessionalDevelopmentFund; makeafinancialreporttoeachExecutiveandGeneralMeeting; depositallmoneyreceived; overseethebooksofaccountoftheAssociationandsubmitthemforauditat theendofJuneeachyearorwhencalledupontodosobythePresident, ExecutiveCommittee,orbyresolutionataGeneralMeetingoftheAssociation; assisttheExecutiveCommitteeindraftinganannualbudgetfortheAssociation andinpresentingsameatthefirstGeneralMeetingoftheschoolyear;and Treasurer maintainthearchivesoftheAssociation.

DEFINITION, RESPONSIBILITIES AND LIST OF STANDING COMMITTEES a. AStandingCommittee; i. isacommitteethathasanelectedChairandMembersasdeterminedattheAnnual GeneralMeeting, ii. managesitsownCommitteebudget, iii. holdsregularmeetingsthroughouttheschoolyear,and iv. hasaChairwhositson,andreportsto,theExecutiveCommittee. Committeesshallbemindfulthattheinterestsofindividualmembersorgroupsof membersshallnotprejudiceinanywaytheinterestsofthemembershipasawhole.

AboriginalEducationAdvisoryCommittee BargainingandWorkingandLearningConditionsCommittee(BWLC) HealthandSafetyCommittee PublicEducationAdvocacyCommittee ProfessionalDevelopmentCommittee SocialCommittee SocialJusticeCommittee TeacheronCallCommittee(TTOC) Forcommitteemakeup,districtstaffmaybeconsideredeitherelementaryorsecondary. TheStandingCommitteesoftheAssociationshallbethe:

DUTIES AND COMPOSITION OF STANDING COMMITTEES

AboriginalEducationCommittee i. TheAboriginalEducationCommitteeshall: (1) beresponsibleformatterspertainingtotheestablishment,promotion,and maintenanceofNDTAinitiativesandactivitiesrelatedtoaboriginaleducation, educators,studentprograms,andliaisonbothwithinthecommunityand beyond.TheCommitteeshallalsobeusedtoprovideNDTAinputintothe AboriginalEnhancementAgreement;and, consistofaChairpersonandten(10)othermembers.

TheAboriginalEducationCommitteemayconveneameetingofmemberstodiscuss AboriginalEducationconcern(s),whichpertainspecificallytothatgroup. Amember,oragroupofmembers,withaconcern(s)regardingAboriginalEducation issues,mayrequestameetingwiththeAboriginalEducationCommittee.The AboriginalEducationCommitteeshallcallandconductanymeeting(s)toaddressthe concern(s).

TheBargainingandWorkingandLearningConditions(BWLC)Committee,in combinationwiththeBCTFNegotiatingTeam,shallconstitutethesolebargaining agentforthemembersoftheAssociationinallmatterspertainingtotheCollective Agreement. TheBWLCCommitteeshall: (1) beresponsiblefornegotiatinganyLocalalterationstotheCollective Agreementandshall,uponinstructionbythemembershipataGeneral Meeting,prepareandpresentcase(s)totheBoardofSchoolTrustees; beresponsibleformatterspertainingtotheworkingconditionsofmembers andthelearningconditionsofstudents; consistofaChairpersonandten(10)othermembers.Five(5)elected membersshallbeelementaryteachersandfive(5)electedmembersshallbe secondaryteachers.Theten(10)electedmembersoftheBWLCCommittee andtheChairpersonshallbeelectedattheAnnualGeneralMeeting;and, selectfromitselectedmembersonemembertobeamemberofthe Personnel/GrievanceCommittee. BargainingandWorkingandLearningConditionsCommittee(BWLC)

TheNegotiatingTeamshallconsistoftheBWLCCommitteeChairpersonandthree otherBWLCCommitteemembersasselectedbytheBWLCCommittee.These membersshouldhaveatleastoneyear'sexperienceontheBWLCCommitteeand thereshouldberepresentationfromboththeelementaryandsecondarylevel. ShouldanymemberoftheBWLCCommitteesubmitoractivateanapplicationforan AdministrativeOfficerorExcludedStaffposition,themembershallnotifythe ExecutiveCommitteeandBWLCCommitteeandvacatetheirseatforthwith.The vacancyshallthenbefilledinaccordancewiththeConstitution&ByLawsandPolicy Statements. TheBWLCCommitteemayconveneameetingofmemberstodiscussabargaining concern(s)whichpertain(s)specificallytothatgroup. Amember,agroupofmembersoraStandingCommitteewithaconcern(s)regarding bargainingorworkingandlearningconditionsmayrequestameetingwiththeBWLC Committee.TheBWLCCommitteeChairpersonshallcallandconductanymeeting(s) thatmayberequiredtoaddresstheconcern(s).

(2) (3) (4) (5) ii. iii. consistofaChairpersonandsix(6)othermembers.Three(3)membersshall beelementaryteachersandthree(3)membersshallbesecondaryteachers. facilitatetheoperationoftheSchoolsHealthandSafetyCommittees;and, monitorcompliancewiththeWorkers'CompensationBoard(WCB)Regulations andguidelines; haveamembersitontheCentralSafetyCommitteeoftheDistrict; TheHealth&Safety(H&S)Committeeshall: (1) beresponsibleforallmattersrelatingtohealthandsafety; HealthandSafetyCommittee(H&S)

TheH&SCommitteemayconveneameetingofmemberstodiscusshealthand safetyconcern(s)whichpertainspecificallytothatgroup. Amember,orgroupofmembers,withaconcern(s)regardingHealthandSafety issue(s)mayrequestameetingwiththeHealthandSafetyCommittee.TheH&S Committeeshallcallandconductanymeetingstoaddresstheconcern(s).

PROFESSIONALDEVELOPMENT SeeseparatebookletProfessionalDevelopmentPoliciesandProcedures. PRIVACYPOLICYFORMEMBERS 1. TheNanaimoDistrictTeachers'(NDTA)iscommittedtoprotectingtheprivacyandconfidentialityofour memberspersonalinformation. 2. TheNDTAiscommittedtocomplyingwiththeBritishColumbiaPersonalInformationProtectionAct,S.B.C. 2003,C.63(PIPA).Thisincludesmanagingthecollection,use,disclosure,storage,andultimatedisposition ofourmemberspersonalinformationinwaysthatsafeguardtheprivacyofourmembers. 3. Definitions a.
