TERMS & CONDITIONS


1. These terms form the contract between the User and the Bank. By applying for Internet Banking and accessing the service the User acknowledges and accepts these terms. These terms will be in addition and not in derogation of the terms and conditions relating to an account of the User. 2. The user shall not or permit others to attempt accessing the account information stored in the Banks computers through any means other than Internet Banking .The User shall not attempt or permit others to attempt accessing the account information stored in the banks computers which does not relate to his or its accounts and/or for illegal or improper purposes which, if done and proved so, will be liable for action under the appropriate law and withdrawal of the facility enjoyed. 3. In case of joint accounts, facility of financial transactions, will be made available only if the mode of operation is Either or Survivor .The User desirous of availing Internet Banking should either be the account holder or authorized to act independently in case of a joint account. For such accounts, one User ID and password will be issued to each of the account holders when requested. The other joint account holders shall expressly give their consent for Internet Banking. In case of joint accounts operated by more than one User Bank shall act on instructions received first and any subsequent instructions shall be ignored. All correspondence will be addressed to the mailing address provided in the Application Form. All transactions arising from the use of Internet Banking in the joint accounts shall be binding on all the joint account holders, jointly and severally. The bank shall be in no way liable for any loss/damage whatsoever that may be incurred or alleged to be incurred by the other joint account holder in such event. 4. In case of accounts opened for and on behalf of the minors, the natural guardian shall undertake to give all instructions relating to the operation of the account and further undertake not to reveal the User ID and Password to the minor, which if done so will be at the risk and consequences of the guardian and the Bank shall not be liable for any loss on that account. In case if that account is operated by the minor, in such an event the transaction will be deemed to have been undertaken by the guardian 5. On accessing Internet Banking for the first time /the User shall change the password assigned by the Bank through the relevant option. The User is at liberty to change the password as many times as desired at his risk and consequences. The User will be solely responsible for maintaining secrecy of the User ID and the Password and the Bank in no way shall be responsible for the misuse of the said User ID or the Password by any person other than the authorized User.

6. The Bank does not assume any responsibility in this behalf including against loss incurred by the User as a result of misuse / unauthorized use of the User ID/ Password. 7. In case the User forgets the password, the Bank against a written request may obtain a new password. Such replacements shall not be construed /deemed as the commencement of a new contract. 8. The Bank reserves the right to charge and recover from the User, charges, if any, fixed for providing any service under Internet Banking. The User hereby authorizes the Bank to recover the service charges by debiting one of the accounts of the User or by sending a bill to the User who will be liable to make the payment within a specified period. Failure to do so shall result in recovery of the service charges by the Bank in a manner deemed fit along with interest, if any, and/or withdrawal of Internet Banking facility without any liability to the Bank. 9. A customer can request for issue of a Chequebook and opt for either collecting it himself in person from the concerned branch or have the Chequebook mailed to the address given in the registration form. The courier charges will be borne by the customer. 10. Demand draft will be issued on the locations where the Bank either has a branch or has an agreement with its correspondent bank at that location. 11. All the requests for instantaneous financial transactions will be given effect instantaneously. 12. All the requests like issue of drafts, opening of Fixed Deposit Account will be carried out at the end of the day on first come first serve basis subject to availability of clear balance in the account authorized for debit. In case requests for effecting any transactions are received on weekly off/holiday/public holidays, they shall be effected on the immediately succeeding working day on the terms and conditions prevailing on that day. 13. The User shall not hold the Bank responsible for processing/ effecting any transactions in case the bank does not receive instructions to this effect even though the customer has forwarded the same. 14. The User shall not use or attempt to use Internet Banking for Funds transfer without sufficient funds in the relative account or without a pre-existing arrangement with the Bank for the grant of an overdraft. The Bank will endeavour to effect such funds transfer transactions received through Internet Banking provided there are sufficient funds available in the Users account. The Bank shall not liable for commission to make all or any of the payments or, for late payments due to circumstances beyond the reasonable control of the Bank.

15. The display or printed output that is produced by the user at the time of the operation of Internet Banking is a record of the operation of the Internet and shall not be construed as the Banks record of relative transactions. The Banks own record of transaction maintained through computer systems or otherwise shall be accepted as conclusive or binding for all purposes unless any discrepancy is pointed out within one week from the date of access of his/her/their/its account by the user or from the date of sending the periodical statement to the User whichever is earlier. 16. The Bank accepts no liability for the consequence arising out of erroneous information supplied by the User. 17. All outputs of statement are duplicate statement of accounts, and will be prepared by electronic means and the information contained therein shall be extracted from a computerized backup system maintained by the Bank. While the Bank will take all reasonable steps to ensure the accuracy of the statement, the Bank is not liable for any error. The User shall hold the Bank harmless against any loss, damages, etc that may be incurred/ suffered by the User if the information contained in the above said outputs turns out to be inaccurate/incorrect. 18. The Bank shall be under no circumstances be held liable by the user if the internet access is not available in the desired manner for reasons including but not limited to natural calamity, floods, fire, and other natural disasters of any kind, legal restraints, faults in the telecommunication network or internet or network failure, power breakdown or UPS breakdown, software or hardware failures and or error or any other reason beyond the reasonable control of the Bank. The Bank shall not be liable for any loss or damage that may occur due to hacking of the account by the persons other than the Users, which fits in the definitions of a Cyber related Crime as accepted internationally. The Bank shall under no circumstances be liable for any damages whatsoever whether such damages are direct, indirect, incidental, consequential and irrespective of whether a claim is based on loss of revenue, investment, production, goodwill, profit, interruption of business or any other loss of any character or nature whatsoever and whether sustained by the User or any other person. 19. The facilities And services like Electronic Bill Payments and presentment, Shopping Mail, online Trading etc., which are provided by the J&K Bank through its site exclusively for its Internet Banking customers/Users, by way of URL links to the empanelled

list of portals by J&K Bank are only in its capacity as a facilitator for enabling payments and J&K Bank does not directly or indirectly vouch for the genuineness of all or any averment or promises given therein and the User desirous of availing or using or enjoying such facilities and services on one or more portals using the Banks site as a platform ,shall fulfill all the necessary registration formalities, terms and conditions and /or other incidental formalities as may be required by such portal(s), who shall reserve the right to determine the eligibility for any product or service. Further as a condition for the User for the use/enjoyment of such facilities or services on the site the User is deemed to have guaranteed that he will not use the site for any that is unlawful, or do any act of misfeasance or mischief of unauthorized use or misuse or breach of these terms and conditions or an act of what so ever kind in relation to the aforesaid facilities and/or services offered on the site which is prohibited under laws of the country. The user further agrees to indemnify the Bank and shall continue to keep the Bank indemnified against all the claims or losses including but not limited to any damages for loss of revenues or profits, loss of business or loss of data what so ever nature or kind, arising out of or in a way related to the use of such facilities and/or services on the site, attributed to any act or omission of the User, who may whether knowingly or unknowingly get direct or indirect access, to any portal(s) for which he is applying fro the purpose of availing or enjoying or using such facilities and/or service. 20. User shall indemnify and hold the Bank harmless against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses what so ever which the Bank may at any time incur, sustain, suffer or be put to as a consequence of or by reason arising out of providing Internet facility or by reason of the Bank in good faith taking or refusing to take or omitting to take action on any instruction given by the User. 21. The Bank shall have the right of set-off and lien or charge, present as well as future on the deposits held in the Users account whether in single name or joint name(s), to the extent of all outstanding dues, what so ever, arising as a result of the Internet Banking service extended to and/or used by the User. 22. The User acknowledges that the software underlying the Internet Banking service as well as other Internet related which are required for accessing Internet banking are the legal property of the respective vendors. The permission given by the Bank to access Internet Banking will not convey or confer any proprietary

or ownership rights in the above software. The User shall in no way try to alter/tamper or experiment with the said programme. Any breach on the part of the User will be dealt under the appropriate law and User shall be liable for damages that may be incurred by the Bank. 23. The User shall not attempt to modify, translate, dissemble, decompile or reverse engineer the software underlying Internet banking or create any derivative product based on the software. 24. The bank has the absolute discretion to amend or supplement any of the terms at any time without the prior notice and will endeavor to give prior notice of fifteen days for such changes where ever feasible except for changes to interest rates and/or other variations that are subject to market changes. The Bank may introduce new services within Internet Banking from time to time. The existence and availability of new functions will be notified to the User as and when they become available. The changed terms and conditions applicable to the new Internet Banking services shall be communicated to the User. By using these new services, the User agrees to be bound by the Terms and conditions applicable. 25. The grant of facility of Internet Banking to a User is not transferable under any circumstances and shall be used only by the User. 26. The terms and conditions and/or the operations in the accounts of the User maintained by the Bank and/or the use of the services provided through Internet Banking shall be governed by the appropriate laws of the Republic of India and no other nation. The User and the Bank agree to submit to the exclusive jurisdiction of the courts located in J&K, India as regards any claims or matter arising under these terms and conditions. 27. The User may request for termination of the Internet Banking facility anytime by giving a written notice of at least 15 days to the Bank. The User will remain responsible for any transactions made on his/her Internet Banking account(s) through internet Banking prior to the time of such cancellation of internet Banking facility. 28. The closure of all Internet Banking accounts by the user will automatically terminate the facility. 29. The Bank without assigning any reason shall be entitled to withdraw from any of its Customers Electronic Banking facility or

any one or more of them without prejudice to the foregoing , the Bank shall also be entitled to withdraw such facility if: I. The minimum balance requirement in respect of the customer/user accounts is not met with/fulfilled and / or II. The service charges remain unpaid and /or III. For any other or reason. In event the Electronic Banking is withdrawn, it shall neither be obligation for the Bank to give any notice to the customer nor shall the Bank incur any liability whatever by reason of withdrawal of Electronic Banking. 30. The User shall not assign this agreement to anybody else. The Bank may subcontract and employ agents to carry out any of its obligations under this contract. 31. The Bank may revise these Terms & Conditions and/or introduce additional term s& conditions at any time and from time to time. Any revise and/or addition to these terms & conditions shall become effective subject to the Banks notice which may be given to the Customers by posting it on the Internet site or by display, advertisement or other means as the Bank thinks fit and shall be binding on the Customer if the customer continues to maintain or use the services on or after the effective date of variation.
