Deed of Acquiescence

This Deed of Acquiescence made and executed at Pune on this _____ day of November 2011

BETWEEN

1. Shri Arvind Kashinath Wagholikar, Age 70 years, Occ. Retired, Residing At 27-C, Budhwar Peth, Appa Balwant Chowk, Pune 411 002

2. Shri Balasaheb Bapurao Wale, Age 65 years, Occ. Retired, Residing at Shangrila Apartment, behind Jog Hospital, Paud Road, Pune

Hereinafter referred to as the PARTY OF THE FIRST PART

AND

Shri Ashok Yashwantrao Shinde, Age 60 years, Occ. Service Residing at Shastri Nagar, Kothrud, Pune Hereinafter referred to as the PARTY OF THE SECOND PART

(The expression the party of the first and second part shall unless it be repugnant to the context or meaning thereof be deed to include their respective legal heirs, assigns, executor, agents, administrators etc. )

WHEREAS, the party of the first and second part are the purchasers of land bearing S. No. 9, Hissa No. 1/1/1, Ambegaon Bk., Tal. Haveli, District Pune more particularly described the schedule hereunder ( hereinafter referred to as the said property).

AND WHEREAS, the said property was purchased by the party of the first part to the present deed from one Shri Subhash Giridharilal Sharma, by a sale deed dated 25th May 1992, which is registered in the office of the Sub Registrar Haveli No. 9, at Sr. No. 1880 / 92;however at the time of the execution of the Sale Deed the parties by mistake mentioned the S. no. of the property as S. no. 9/1/1 instead of S. no. 9/1/1/1, the said mistake was carried forwarded in the sale deed executed in favour of Sundarban Cooperative Housing Society Ltd. dated 14/12/1999, which is registered in the office of the Sub Registrar Haveli No. 9 at Sr. No. 10005/99;

AND WHEREAS, the said deed was corrected by a deed of correction dated 24/9/2008, which is registered in the office of the Sub Registrar Haveli No. 2, at Sr. No. 3482/2008. The said correction deed was signed by the Vendor Shri Subhash G. Sharma and the Party of the First Part except for the party of the second part. However, the Correction Deed came to be registered at the above mentioned serial number;

AND WHEREAS, there were disputes about the said land between the party of the first part and party of the second part, wherein a civil suit was filed in the

court of Civil Judge Sr. Divn. Pune at Pune bearing No. 1192/2009 and the Civil Judge was pleased to grant injunction against the defendants i.e. party of the second part.

AND WHEREAS, the said suit came to be compromised by a Compromise Purshis passed between the plaintiff Sundarban Co-op. Housing Society Ltd. and the defendant i.e. Party of the Second Part. In the said compromise

purshis the party of the second part agreed to acquiesce the correction deed executed on 24/9/2008. As such the party of the second part by this deed of acquiescence acquiesces the aforesaid correction and recognizes the said transaction on the terms mentioned below. NOW THIS DEED WITNESSES AS UNDER :-

1. That the party of the second part acquiesces the deed of correction
executed between the vendor Shri Subhash Giridharilal Sharma & the party of the first part; and recognizes and reiterates that the sale deed dated 24/5/92 was wrong as far as the survey number of the captioned property is concerned the said mistake was carried forwarded in the sale deed executed in favour of Sundarban Cooperative Housing Society Ltd. dated 14/12/1999, which is registered in the office of the Sub Registrar Haveli No. 9 at Sr. No. 10005/99 and hereby also recognizes the correction deed dated 24/9/2008 and also states that the survey No. 9/1/1 Ambegaon Bk is to be read as S. No. 9/1/1/1, Ambegaon Bk. Tal. Haveli, Dist. Pune

2. The party of the second part also states that he has sold his share in the society and shall have no claim, against the society hereinafter.

SCHEDULE

All that piece and parcel of the land with in the limits of village Ambegaon Bk, Tal. Haveli, Dist. Pune admeasuring 0 H 20 Ars bearing S. No. 9 Hissa No. 1/1/1 situated with in the registration district Pune and Sub District Taluka Haveli which is bounded as under
