I have received a copy of the Outside Contractors Safety Agreement Rules, the Boat Owners License Agreement, and the posted Marina Rules, and have read them completely. I have been given the opportunity to ask questions, and understand the requirements. I agree to abide by all laws and regulations, to properly dispose of waste materials, to protect against spills, to report any spills that happen at the Marina, and to bear the total clean-up cost of any spills that occur. I further agree to reimburse the Marina for any utilities consumed, parking fees, tool storage, and work area clean-up charges if the Marina must clean up after the Contractor. I further agree to pay any and all environmental impact fees which may at times be required to offset the Marinas cost of regulation compliance due to the nature of the work performed. I further agree to forever and for all time indemnify and hold harmless Marina, its employees, agents, officers, directors, shareholders, successors and assigns from and against any and all claims, suits, damages, losses or action of any kind, whether for personal injury or property damage, with respect to any work performed on any vessel in the Marina. _________________________________________ (Contractor Signature) _________________________________________ (Title) ____________ (Date)

These rules apply to ALL individuals working at JAMES CREEK MARINA including Boat Owners, Outside Contractors* and Subcontractors, Service and Repair Companies, Vendors, Boat Dealers and Brokers, Marine Surveyors, and Charter Captains (All henceforth to be deemed as Contractors). Companies and individuals who are not employed by this Marina are welcome to work on boats at our Marina as long as they understand and comply with all JAMES CREEK MARINA agreements, licenses, rules and regulations. Outside professionals help us provide the full service that boaters expect of quality marinas by complimenting those services available from the Marina staff, but they must follow the same rules we work with, for security, safety and environmental reasons. (*Outside Contractors is defined as anyone providing materials and/or services for compensation in any form).

To keep this Marina operating in a safe, clean and professional manner, all individuals and companies MUST comply with the provisions of our Outside Contractors Safety Agreement, including:

1. All Contractors must sign-in with and receive approval from the Marina before beginning any work on Marina property on a daily
basis. Contractor Keys are issued and must be returned no later than 5:00pm. All Contractors must comply with the Marinas environmental best management practices and insurance requirements, and may be required to pay an environmental impact fee.

Before starting work in this Marina, Contractors must provide the Marina office with copies of the following: A. Current city/state Sales Tax Registration/ID numbers (W-9). B. Current Certificate of Public Liability Insurance (minimum $1,000,000) with companies reasonably acceptable to this
Marina. The policy/policies shall name this Marina as additional insured. The Marina office shall be provided with copies of such policy/policies, which shall contain a provision that cancellation or reduction in coverage thereof shall not be effective as to this Marina except upon 30 days advance written notice to the Marina office. C. Current Workmans Compensation Insurance Certificate, if applicable. D. Current Letter of Consent/Repair Order signed and dated by the Boat Owner or Agent of record if they are not present. The Marina may contact owner, using currently Marina listed means, to obtain authorization if neither of the above requirements are met. However, work may not be commenced until that authorization is given to the Marina by those means. E. The Outside Contractors Safety Agreement signed by an authorized member of management for your company. F. Copies of all chemical Material Safety Data Sheets for any such materials to be used by the contractor.

2. Owners may undertake boat projects as needed to maintain their vessels safety, appearance and utility, however, ANY
EXTERIOR REPAIRS OR WORK OF THE HULL OR SUPERSTRUCTURE SURFACE MUST BE REVIEWED BY THE MARINA MANAGER PRIOR TO COMMENCEMENT OF WORK.

3. At the end of the day, all tools, materials, supplies, etc. shall be neatly stored upon the vessel or taken off site. Work areas shall
be covered with tarps, in order to maintain a neat appearance. Under no circumstances shall items be left on docks or finger piers. Visible projects must not extend beyond 7-day duration from start to finish.

4. The Marina reserves the right to charge the boater/Contractor for the removal of debris, tools, materials, or refuse left on Marina
grounds or docks. Marina will not be held responsible for any such debris, tools, materials, or refuse removed.

5. Power tools (GFCI required) may be used only with prior Marina approval. Work may only be conducted during the following
hours: Monday Friday Saturday Sunday & Holidays 7:00a.m. 5:00p.m. 10:00a.m. 5:00p.m. Prohibited at ALL times.

6. No work may be conducted prior to Dock Office being open or after Dock Office closes.

7. Oil must be disposed of under the supervision of Marina personnel. Contact the Dockmaster for assistance. The Federal Water
Pollution Control Act forbids the discharge of oil or oil waste into or upon navigable waters of the United States if such causes a film or sheen upon or discoloring of the surface of the water, or causes a sludge or emulsion beneath the surface of the water. Violators are subject to a fine of $5,000.00 dollars. Paint and other chemicals must be disposed of properly. Ask the Dockmaster for assistance, if needed.

8. Marina management requires all vessel owners, contractors, vendors and helpers to adhere to the following best management
practices. Any violation of the following may immediately terminate the right to perform work in the marina. ENGINES AND BILGES Use absorbent bilge pads to soak up oil and fuel. Do not discharge bilge water if there is a sheen to it. Recycle oil, fuel, batteries, and antifreeze properly. Dispose of oil filters and other hazardous materials properly. Contact Marina management for nearest recycling and disposal locations. Do not dispose of any fuels, used oil or filters, batteries, or any other hazardous materials in the Marinas dumpsters. PAINTING AND VARNISHING No paint, varnish, or other like treatment may be applied exteriorly at any time while on the docks. No open solvents or paints are permitted on the dock or on the exterior of the boat. Always mix paints and epoxy over a tarp and on land. Always use a drip pan and drop cloth. Spray painting is not allowed in the Marina. Use up remaining bits of paint by spreading on an old board or drying additives. Let empty paint cans dry thoroughly before disposing in the trash. Do not dispose of paints or solvents in the Marinas dumpsters. Contact Marina management for nearest recycling and disposal locations. SURFACE PREPARATION Use environmentally safe biodegradable cleansers and teak cleaners. DO NOT CONDUCT ANY EXTERIOR PREPARATION THAT PRODUCES DEBRIS. Reverse the boat in the slip to work on the far side. SEWAGE Sewage, whether treated or untreated, should NEVER be discharged directly overboard. Store sewage in holding tanks and dispose of properly at pumpout stations. Ensure that MSD Type 1 systems work properly. Use shore-side facilities as often as possible. Mobile pumpout service is available (For a fee). Contact the Dock Office. SOLID WASTE DISPOSAL Take all garbage and work related refuse with you when you leave. Recycle tin and aluminum cans, newspapers, and glass and plastic beverage containers. See instructions on recycling bins at each pier-head. Any construction debris, old furniture, or other bulky items must be removed from the Marina by the boater or contractor. Shrink Wrap can be recycled using Dr. Shrink recycling bags ($25.00 for pre-paid UPS shipping bag) CHEMICAL STORAGE Do not store fuels, solvents, or other hazardous materials on docks, finger piers, or vessels.
