Official Rules for the Making the Grade Viewing Contest: Rules for Contest: By participating in this Contest,

Participants agree to be bound by these Official Rules and the final decision of the Contest. Decisions by Americans for Prosperity Foundation (AFP Foundation) are binding and final in every respect. Eligibility: Americans for Prosperity Foundations Contest is open to all legal U.S. residents physically residing in the state of Georgia. Participants must be at least the age of majority at the time of participation. This Contest is subject to all applicable federal, state and local laws. Void where prohibited. A Participant is limited to one prize from AFP Foundation. Employees, contractors, subcontractors, agents, board members, and any other individuals otherwise compensated by AFP Foundation or any of its affiliates or subsidiaries are not eligible to participate in this AFP Foundation contest. There is no purchase necessary to participate in this Contest. All polling forms submitted within one week of completion and otherwise qualified will be eligible for consideration for the Contest prize. In no event will Sponsors be liable for more prizes than outlined in the Contest Details. Prizes are non-transferable and non-negotiable. Contest Period: The Contest Period begins at the time of announcement and ends at 11:59 p.m. Eastern Time on April 15, 2012. Contest Details: Americans for Prosperity Foundation is hosting a Making the Grade viewing contest. Participants must order a FREE copy of the Making the Grade documentary and by April 15, 2012, show the film in its entirety to Georgia residents who have not yet seen the film. Participants may show the film to others individually or in a group setting. Participants must then collect fully completed polling forms, provided on the Making the Grade website, from each viewer and return those to AFP Foundation within one week of completion. Participants may return the polling forms either by scanning and emailing them to cgarcia@afphq.org or by mailing them to AFP Foundation, 44 Darbys Crossing Drive, Suite 102-G, Hiram, Georgia 30141. Polling forms submitted later than one week after completion and for viewings held after April 15, 2012 will not be eligible for the prize. AFP Foundation will tally all of the qualified polling forms submitted by Participants and the top two Participants, those submitting the greatest number of qualified polling forms, will each be eligible to receive a Kindle Fire tablet from AFP Foundation and will be recognized in AFP Foundations weekly electronic newsletter. Sponsor is not responsible for any problems, bugs, or malfunctions Participants encounter when seeking to enter this Contest or download the film or forms. Publicity: Sponsor reserves the right to use for publicity purposes prior to, during, or after the Contest Period, in any media, the Participants name, likeness, and city name throughout the world, in perpetuity, without any compensation or prior review, unless specifically prohibited by law. Taxes: It is the sole responsibility of the winning Participant to pay all federal, state, and local taxes in connection with the prize. Limitation of Liability, Governing Law, and Venue: Participant agrees to indemnify, defend, and hold harmless Sponsor from any loss, liability, damage, or costs, including court costs and legal fees, which result from the Participants involvement and participation in the Contest or Participants receipt or use of the prize. In no event shall AFP Foundation be liable to Participant for special, indirect, incidental, or consequential damages, including without limitation, loss of use of profits, regardless of whether such damages are caused or allegedly caused by breach of contract, tort or otherwise (including negligent or willful act or omission, warranty, indemnity, or strict liability). This agreement shall be governed by the laws of the Commonwealth of Virginia without regard for conflict of laws doctrine. Participants agree that any legal action arising in connection with the Contest, whether in tort, contract, or otherwise, shall be heard exclusively in the courts of the Commonwealth of Virginia. Waiver of Jury: As a condition of participating in this contest, each Participant hereby irrevocably and perpetually waives any right that Participant may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with the contest, any document or agreement entered into in connection with the contest, any prize available through the contest, and any of the transactions contemplated related to the contest. Termination: Sponsor reserves the right, in their sole discretion, to cancel, modify, or suspend the any of AFP Foundations contests at any time.
