a. Certificate Proceedings of Inquiry Committee comprising of 03 pages assembled at K-2 Project Office Karachi on January 10, 2012 by order of Authorized Officer (Project Director, K-2) vide Office Order No. 07/12 dated March 03, 2012 to enquire the Accident of K-2 Projects Vehicle No. AME-928 took place near Kannup Colony.

Admin Officer, K-2 visited the site where accident was occurred and saw both the affected vehicles standing over there in an undisturbing position. After inspecting the site he moved towards the Local Police Station alongwith the owner of the Truck. As an outcome of compromise with the owner of Truck through arbitration, a compensation of Rs.85,000/- against the estimated loss of Rs.150,000/- was agreed while further addition in compensation was refused despite repeated and forcible efforts taken against the owner. The Project Director, K-2 appointed an inquiry committee to probe into the matter and submit report for further necessary action.

The inquiry committee through initiating its first proceeding conducted the hearing of driver. He appeared and produced his contentions / statement in his defence.

who was on board in the vehicle got his statement recorded before the inquiry committee. He stated that he was reading newspaper when the vehicle met an accident thus he could not locate the guilt from either side but to say that our vehicle could not escape from the accident due to heavy speed upto 100 KPH.

Mr. Mohammad Younus, DCE the 2nd person who was on board in the vehicle appeared before the inquiry committee and submitted his statement. He was, unfortunately, injured in this accident sitting in the front seat. He stated that our vehicle was traveling on his own route and suddenly we saw a truck appeared on our road. It spread on the entire breadth of our road happened to take U-turn without observing precautionary measures and our vehicle due to heavy speed upto 100 kph found no option of crossing or safety measures came in collision with the front tyre of the truck. Our driver applied breaks but all invain due to heavy speed.

C. Findings / Grounds and Conclusion:

The case was investigated on the basis of following grounds:

Telephone call received by A.O (K-2) from driver immediately after the accident; Details of incident narrated by driver before inquiry committee (Flag B). Statement of Syed Fahimuddin, DCE, the boarded person in the vehicle. Statement of Mr. Mohammad Younus, DCE, the other boarded person in the vehicle who got injury. NCA Transport Rules 2010; Government Servants Efficiency and Discipline Rules 1973.

This accident occurred on 27th December, 2011 at 8:15 am when vehicle No.AME-928 suzuki liana car was on official duty carrying its routine pick towards the plant. On that day, the two officers of K-2 Project were on board in the affected vehicle namely Mr. Muhammad Younus, DCE and Syed Fahimuddin, DCE. The vehicle was coming towards the plant being driven on its own route when it met a truck taking over U-Turn on its route extended on the entire breadth of the road without observing per-cautionary measures and there was no option of escape hence it hit the front tyre of the truck. The undersigned was informed on mobile phone by Mr. Muhammad Razi, Driver of K-2 Project that the vehicle under his official duty met an accident with a Truck bearing No.TAA-688 at Hawksbay Raod near CANUPP Colony Karachi. The undersigned at the very moment moved towards the site with Mr. Talha, Transport Supervisor and found both the affected vehicles still standing over there in the same position. From the view of damage caused to the vehicles it was quite easy to imagine that the collision was so dreadful which happened due to over speed. Mr. Muhammad Razi, Driver who was driving K-2 vehicle No.AME-928 (Suzuki Liana Car) stated that he was driving on his own path when the truck driver without alerting him brought his truck extended on the entire breadth of the road while taking U-turn and he could not find any option to save his vehicle so collision was occurred. He further stated that the truck driver had taken wrong track for his U-turn which was not his proper way to take over while the particular path of his U-turn was away at

the distance of approximately half kilometer as such. He took the wrong track for his U-turn which resulted in collision. However, the driver of the truck informed that the vehicle No. AME-928 Suzuki Liana came to their sight suddenly due to heavy speed. The conductor of the truck showed cautions to the coming vehicle but they could not make safety measures to avoid this collision. The affected truck and his driver were taken under custody by the local police station. The talks were initiated with the owner of the truck about the loss caused to Suzuki Liana. He was agreed to pay an amount to the maximum of Rs.85,000/- against the estimated damage of Rs.150,000/-. Wherein the owner was forced to pay the total estimated expenditure but he refused to pay an extra peny except Rs.85,000/-. Hence, he offered every kind of legal action to be initiated against him in case of failure in compromise as offered. From overall view of the incident, it was thus realized that the truck driver cant be held entirely responsible for this incident but his mistake was that he didnt take the proper path of his U-turn and he didnt make pre-cautionary measures to bring his truck on the road of opposite side which is otherwise prerequisite for the same. However, K-2 driver Mr. Muhammad Razi shall also not be held entirely responsible for this tragedy except he was driving very fast approximately 100 KPH. He must have kept his speed under control while passing through the U-turn path and he didnt care of it which led him to meet this accident. As a general view, over speed on the road where this accident occurred is liable to be condemned in every aspect because this road has no feasibility of over speed possessing many cuts / u-turns, grassy plants and trees at its central part as well as side part.

Recommendations: M. Imtiaz is performing his duty quite well at K-2 since last three years as per his ACR record and no such allegation is found from his record. Driver was not found responsible for damage to vehicle; however this damage has been caused due to his personal clash with his relatives. 1. it is decided by the Committee that the accused party shall pay for damage of the vehicle. Further to this Mr. M. Imtiaz shall

be responsible for collecting the subject amount from the accused party (as witnessed by him that the responsibility has been fixed on the accused) and will make repair of vehicle within 15 days after issuance of these instructions.

2. In the view of above, Mr. M. Imtiaz is clear and there is no need to frame the charge against him, However, he may be issued Warning to refrain himself from any such actions or family matters that may cause harm to his official duty and vehicle in future.
