2012/01 Illegal Arrest and Inhuman Torture Kiniyavala Police.

Ranepura Hewage Sampath Deshapriya is a 24 years old unmarried youth. He is a resident of Mananahena, Thalgaspe. On 25.12.2011, his mother Agnas Gunawardena came to know that his son was arrested by Kiniyavala police. However, the arrest had taken place several days before she came to know of it. After receiving information, his mother went every day to see him at the Kiniyavala police. She saw her son was being tortured inhumanly by police officers of Kiniyavala police. Marks of beatings were very visible on his body and his soles were turned into pale. Sampath talked to his mother with much difficulty. Whenever she spoke to her son, a police officer was closer to them and watching. On 31.01.2011, when she was at the police station, a group of police officers came there in a jeep. They warned her and said not to complain it to anybody and if she did so then, she would not be permitted to see him. They further said her to bring a card of panadol-painkiller tablets and leave in the police station. Sampaths mother believes that her son is being detained in this manner to provide enough time for injuries of inhuman torture cures and his condition changes. She fears that if he tortured further, then his life will be in danger. According, to her Sampath does not take food. She requests to hold an inquiry immediately, make her son access medical treatment and ensure safety of his life. Sampaths mother Ms.Agnas Gunawardena made written complaints on 02.02.2012, to the Human Rights Commission, Inspector General of Police, Deputy Inspector General of Police, Kalutara and the Senior Superintendent of Police, Kalutara.

2012/02 Illegal Arrest and Torture Boossa Army Camp. VIjitha Weerakkody is a 47 years old married mother with five children. She resides in Godagama, Kosgoda. Kaludeva Pathma Kumara De Soysa is her 22 years old son. Earlier he had served in the Sinha Regiment of Sri Lanka Army and after returned home in 2010, he did not report to service. Now he works as a painter. On 28.01.2012, her daughter took a phone call to her son to invite him for lunch. Then, some unknown person answered her in loud voice that if she wanted to see her younger brother, she should come to Kosgoda police.

After that she, her daughter, her husband and some of their relatives visited Kosgoda police to see Pathma Kumara. At the police station they came to know that he was arrested by officers of Boossa Army Camp. So they went there and asked about him. One army officer told them that the arrest order was received from Colombo and they could not be allowed to see him. After that they gave food which they brought for Pathma Kumara to the officer telling him to give it to Pathma Kumara. Then the officer gave the mobile phone of Pathma Kumara . They received it and came home. On 29.01.2012, around 5.30 in the evening Pathma Kumara gave a call to her sisters mobile phone and said that there was a weapon (galkatas) in the yard and asked to keep it there. He also told her that two persons would come at night. But nobody came on that night. On 30.01.2012 around 9 in the morning Pathma Kumaras mother and other relatives went to the Boossa army camp to see him. At around 11 in the morning six officers wearing red colored uniforms came to their house in a jeep. Her son was inside the jeep. But the officers did not allow her son to speak with them. There were black dots on his face and the face was swollen. He was seated there in difficult. After that the officers took a gun from their yard. These officers took photos of the gun by their mobile phones. Before leaving these officers told Pathmas family members not to disclose about their arrival to any place including the police. After sometime her daughter said over the phone that she met and spoke to her brother on her way home. Her daughter had got a telephone number of an officer on her visits to Boossa army camp. On 31.01.2012 around 9 at night her daughter gave a call to that telephone number and asked about her brother. The officer replied to it said that their son was ready to go Polhengoda at around 12 at night. Again when she took a telephone call to that number they were informed Pathma was taken to Polhengoda. On 01.02.2012 Pathmas mother and his relatives went to the Polhengoda army camp. There they were allowed to see him. His face was swollen and his finger nails were turned in to blue color. His one eye was also turned red. He cried and said them that only one weapon was in his possession and no any other, but they are torturing him demanding other weapons. He said them to rescue him and also mentioned that he could not eat. His mother Vijitha Weerakkody made written complaints to relevant authorities including Army Commander and the Attorney General to take legal actions against all army officers who illegally arrested and detained her son and torturing. She also requests to produce him before a magistrate and give medical treatment by admitting him in a hospital.
