Narrow scope of ruling may deter Supreme Court from taking case

In a two-to-one decision, a panel of the Ninth Circuit Court of Appeals ruled this week that Proposition 8 is unconstitutional in a federal case challenging Californias same-sex marriage ban. The opinion, authored by Judge Stephen Reinhardt, afrms Judge Vaughn Walkers 2010 ruling that the law approved by California voters at the ballot violates the Equal Protection clause of the 14th Amendment to the U.S. Constitution because it serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to ofcially reclassify their relationships and families as inferior to those of opposite-sex couples.

More than 200 people turned out for a candlelight vigil Tuesday night at the site of a Northeast Washington bus stop where transgender woman Deoni Jones, 23, was fatally stabbed on Feb. 2 while waiting for a bus. Surrounded by family members and friends, Jones stepfather, Alvin Bethea, made an emotional appeal for witnesses to come forward to identify a male suspect that police believe stabbed Jones in the face about 8:15 p.m. at the bus stop at East Capitol Street and Sycamore Road, N.E. We suspect that the person who did this lives in this community or hangs out in this community, Bethea said. Help the Metropolitan Police Department out If anybody knows anything, please contact them. for at least eight hours of testimony in Annapolis on Friday by witnesses for and against a bill to legalize same-sex marriage. In a scheduled joint hearing, the House Judiciary Committee and the Health and Government Operations Committee were also to hear testimony on a proposed state constitutional amendment to ban same-sex marriage. The hearing was to take place 10 days after nearly 100 witnesses testied on the marriage bill before a hearing of the Maryland Senates Judicial Proceedings Committee. Sources familiar with that committee said it was expected to vote to approve the same-sex marriage bill, known as the Civil Marriage Protection Act, on Thursday, Feb. 9. We think it will come up for a vote on that day, but were not absolutely certain, said one knowledgeable source familiar with the committee. Most political observers believe supporters of the same-sex marriage bill have the votes to pass in committee and in the full Senate. They say the vote in the House was expected to be close and its passage there was uncertain. Observers say the proposed constitutional ban on same-sex marriage would likely be killed in committee. Earlier this week, Rev. Al Sharpton, the nationally known civil rights leader from New York, became the latest public gure to record a video expressing support for same-sex marriage in Maryland. As a Baptist minister, I dont have the right to impose my beliefs on anyone else, Sharpton said in the video, which can be viewed on YouTube. So if committed gay and lesbian couples want to marry, thats their business. None of us should stand in their way, he said. Among the committee members expected to attend and ask questions at the joint House hearing on Friday were gay Dels. Luke Clippinger (D-Baltimore) and Bonnie Cullison (D-Montgomery County). members Sam Arora (D-Montgomery County), Tiffany Alston (D-Prince Georges County) and Jill Carter (D-Baltimore City). All three startled LGBT advocates last year when they announced they were changing their position from supporters to opponents of the marriage bill. Arora, who shares the same legislative district as Cullison, drew expressions of outrage from some LGBT activists when he announced he would vote against the marriage measure on the House oor. The activists noted that he ran for his seat in the 2010 election on a platform in support of the marriage bill and signed on as one of its co-sponsors. Arora, who has not responded to requests from the Blade for an interview, has said his newfound opposition to the bill is based on his religious beliefs.

Clark Ray named athletics director for D.C. schools

Gay Democratic activist Clark Ray, who served as director of the D.C. Department of Parks and Recreation during the administration of former Mayor Adrian Fenty, has been named statewide athletics director for the citys Ofce of the State Superintendent of Education. According to Jeffrey Richardson, director of Mayor Vincent Grays Ofce of GLBT Affairs, Ray will work on policyrelated matters and federal funding guidelines associated with the D.C. public school systems sports and athletic programs. Ray could not be immediately reached for comment by press time this week. A spokesperson for the Ofce of the State Superintendent of Education did not return a call by press time. Ray ran unsuccessfully in 2010 for the seat on the D.C. City Council held by Phil Mendelson (D-At-Large), who won reelection by a lopsided margin.
Gay marriage opponent is consultant for Orange

One of the leading advocates for overturning D.C.s same-sex marriage law through a voter referendum has served as a paid campaign consultant for At-Large City Council member Vincent Oranges reelection campaign, according to records led with the Ofce of Campaign Finance. Estell Mathis-Lloyd, chief of staff for Oranges Council ofce, said the decision by the Orange campaign to retain Ward 5 ANC Commissioner Robert King as a consultant is absolutely not a signal that Orange may be backing away from his support for the marriage equality law, which the Council passed in 2009. He does continue to support marriage equality, Mathis-Lloyd said of Orange. OCF records show that the Orange campaign paid King $750 as a consulting fee on Dec. 11, 2011. Orange, a former Ward 5 Council member, came out against same-sex marriage when he ran unsuccessfully for mayor in 2006. He said he changed his position shortly before he ran for the atlarge Council seat in a special election in 2011 and now strongly supports the city law that legalized same-sex marriage. He says he has been a longtime supporter of other LGBT issues. Through his consulting rm King & Associates, King received more than $60,000 in 2010 from the anti-gay National Organization for Marriage to organize a campaign to overturn the citys samesex marriage law through a referendum. When the citys board of elections and the D.C. Court of Appeals ruled that such a referendum could not be held because it would violate the citys Human Rights
Law, King joined anti-gay minister Harry Jackson in appealing the court ruling to the U.S. Supreme Court. The Supreme Court upheld the appeals court decision, ending efforts to kill the gay marriage law through a referendum. Mathis-Lloyd said the Orange campaign retained King as a consultant because of his knowledge of Ward 5 issues. Orange, a Democrat, is running in the April 3 D.C. Democratic primary for a full, four-year term for a Council seat he won last year in a special election. The seat became vacant after the 2010 election, in which Council member Kwame Brown, who held the seat, won election to the post of Council chair. Orange is being challenged in the primary by Democrat Sekou Biddle, who ran against him in 2010; D.C. political newcomer Peter Shapiro, a former Prince Georges County Council member; and community activist E. Gail Anderson Holness. According to the Jan. 31 ling with the Ofce of Campaign Finance, Orange was ahead in campaign funds raised, with $145,220. OCF records show Shapiro was in second place in money raised, with $90,291, followed by Biddle, who raised $45,686; and Holness, who raised $2,944 as of Jan. 31. OCF records show that $50,000 in the total amount raised by Shapiro came from loans.

On Feb. 5 in the 3500 block of 4th Street, S.E., a woman reported that she was involved in an argument with her sister over a computer. The complainant took the computer from her sister and the sister punched the victim in the face. The suspect is a juvenile and was arrested on Feb. 7. On Feb. 3 in the 1200 block of New Hampshire Avenue, N.W., two complainants got into a verbal argument after one of them didnt come home as expected. There was no ghting but neighbors called the police. The complainants have been in a three-month relationship and they live together at the location. A report was taken. On Jan. 27 at 4th and Massachusetts Avenue, N.E., a driver suffered a medical emergency and crashed his vehicle. The driver died due to the vehicle crash.

Virginia set to approve anti-gay adoption bill

White House expresses reservations over discriminatory policies

Strong objections by LGBT rights advocates and reservations expressed by a White House spokesperson were brushed aside by the Virginia Legislature this week as it cleared for approval a bill that allows state-funded agencies to deny adoptions based on religious or moral grounds. State Sen. Adam Ebbin (D-Alexandria), who is gay, said that although the words sexual orientation and gay or lesbian are not in Senate Bill 349, lawmakers clearly understand that its aimed at justifying the denial of adoptions or foster child placement for gay people. Supporters dubbed the measure the conscience clause bill, saying it would allow faith-based adoption agencies to exercise their conscience in deciding whether granting an adoption for certain individuals would violate their religious or moral beliefs. This would put into the law that they can be turned away, Ebbin said in discussing potential gay or lesbian adoptive parents The issue is simple whether or not state dollars should be used or taxpayers funds should be used to fund discrimination in adoption and foster care. The Republican-controlled Virginia House of Delegates voted 71-28 last week to approve the bill. A Senate committee approved the measure on Feb. 3, and the full Senate, which is also controlled by Republicans, was expected to approve the bill on Thursday. Republican Gov. Robert McDonnell has said he plans to sign the bill if it reaches his desk. The conscience clause adoption measure, introduced by Sen. Jeffrey McWaters (R-Virginia Beach), doesnt ban gay people from adopting or becoming foster parents. Ebbin and others familiar with the bill said it would not change existing state law that allows private agencies to approve gay adoptions and gay foster care placement if they wish to do so. The legislation instead provides a state seal of approval to state-funded agencies that refuse to approve adoptions and foster care placement to a gay person or to other individuals based on religious or moral grounds, Ebbin said. White House spokesperson Shin Inouye, when asked about the adoption measure by the Washington Blade, said President Obama believes adoption placement shouldnt be based on discrimination. Although the president does not weigh in on every single action taken by legislative bodies in our country, he has long believed that we must ensure adoption rights for all couples and individuals based on their interest in offering a loving home, not based on discriminatory and irrelevant factors, Inouye said. He recognizes that adoptive families come in many forms, and that we must do all we can to break down barriers to ensure that all qualied caregivers have the ability

Maryland high school distributes ex-gay ier

Mont. Co. parent objects after son brings home anti-gay literature

Students at a Montgomery County high school have received materials from an ex-gay organization that promotes the discredited theory that sexual orientation is changeable. Fox 5 TV reported that students at Einstein High School in Rockville, Md., received the materials along with their report cards during homeroom last week. The ier publicizes the work of the ex-gay organization, known as PFOX (Parents and Friends of Ex-Gays), which claims it promotes diversity for the ex-gay community. According to their mission statement, the organization asserts ex-gays demonstrate that those with unwanted same-sex attraction can seek help and information, in order to transition out of a homosexual identity. According to district policy, any organization that can prove that it is a non-prot community entity can send materials home with students quarterly when report cards are distributed. According to Fox 5, licensed clinical social worker and Einstein High School parent Karen Yount-Merrell complained to the Montgomery County school district administration after she found the ier among others when her son brought home his quarterly report card. I dont like it, Yount-Merrell told Fox 5. Everything in this ier make it sound like the goal is to be [an] EX-gay, [or an EX]lesbian. It is not embracing of a different orientation. It reiterates a societal view that theres something wrong with you, if youre not in the norm. If you arent heterosexual. And teenagers have a hard enough time dealing with who they are and feeling good about themselves. After Yount-Merrells complaint, Montgomery County public schools issued a response saying, the board of education policy allows materials and announcements from non-prot community organizations to be distributed at four designated times during the school year. Wayne Besen, executive director of ex-gay watchdog group Truth Wins Out, said hes appalled that a school district would allow the PFOX materials to be distributed. I follow a lot of these groups, and PFOX is by far the most extreme of all of them, Besen told the Blade. Theyre pretending that theyre experts when theyre just extremists. He continued, I think its always dangerous when you have a group with no credentials to do so handing out junk science to young people telling them there is something wrong with them. I think theyre begging for a lawsuit by even allowing this organization near them. Besen says PFOX was established by a collective of anti-gay groups as a foil to the pro-gay PFLAG, but that the group is inappropriate for the school setting. The school district is grossly irresponsible, derelict in its duty to protect students from harm by allowing this organization to distribute these materials, Besen told the Blade. PFOX told Fox 5 that the ier calls for tolerance. If people were to actually read the content of the ier that were distributing, they will see there is nothing in here that is insulting or even critical of homosexuals, PFOX board member Peter Sprigg told Fox 5. All it is telling kids [is] that you dont have to be gay if you dont want to be. According to Right Wing Watch, PFOX tells gay youth to transition out of a homosexual identity even though the American Medical Association, the American Psychological Association, the American Academy of Pediatrics, the National Association of Social Workers and the American Psychiatric Association all deny the effectiveness, safety and ethics of reparative therapy.

Wash. House poised to pass marriage bill

The Washington State House of Representatives on Wednesday was poised to pass a bill legalizing same-sex marriage, which the governor has promised to sign. The Senate passed the bill 28-21 last week and oor debate on the bill was scheduled for Wednesday afternoon in the lower house where the bill was expected to nd wide support, according to media reports. After the bills success in the Senate, Gov. Christine Gregoire declared, tonight Washington State stood up for what is right and told all families in our state that they are equal and that the state cannot be in the business of discrimination. Jewish paper under attack for pro-gay piece

BURLINGTON, Vt. Watchdog group Truth Wins Out has taken to the Change. org petition platform to enlist support for The Jewish Press, which has been under attack for publishing an op-ed critical of ex-gay therapy. After publishing an editorial written by Orthodox Jewish former ex-gay therapy recipient, Chaim Levin, proponents of reparative therapy allegedly pushed the papers advertisers to pull ads from the publication. The Jewish Press responded by publishing an editorial board piece defending Levins piece titled The Jewish Press Wont Be Silenced. Following the publication of this op-ed, a number of Jewish Press advertisers were approached and threatened, the editors wrote. The Jewish Press wont give in to threats and we wont be silenced. We thank our advertisers who have notied us that they plan to continue with us despite the threatening letters and that they wont give into threats either, particularly when an article like this one may have very well have saved a Jewish life.
Santorum sweeps Minn., Mo., Colo. contests

Anti-gay candidate shows signs of life as Romney falters

Republican presidential candidate Rick Santorum showed his campaign still has life by sweeping Tuesdays GOP contests in Minnesota, Missouri and Colorado. In Minnesota, Santorum captured 45 percent of the vote, with Rep. Ron Paul in second at 27 percent and former Massachusetts Gov. Mitt Romney a distant third with 17 percent. In Missouri, Santorum won 55 percent of the vote to Romneys 25 percent. In the Colorado caucuses, Santorum beat Romney by ve points. In his victory speech in Missouri, Santorum declared, Conservatism is alive and well in Missouri and Minnesota, and took a dig at Republican frontrunner Mitt Romney. Your votes today were not just heard loud and wide across the state of Missouri and Minnesota, but they were heard loud and louder all across this country, and particularly in a place that I suspect may be in Massachusetts they were heard particularly loud tonight, Santorum said. He added that he is not the conservative alternative to Romney, but the conservative alternative to Barack Obama. Jerame Davis, executive director of the National Stonewall Democrats, said Santorums wins are evidence the nonRomney wing of the GOP is still the dominant force in the party and yet more proof that Republicans cant stand Mitt Romney. Conservative Republicans may love Rick Santorums unwavering sanctimony and seething anti-intellectualism, but his narrow, regressive brand of politics will turn off independents and even many moderate Republicans, Davis said. R. Clarke Cooper, executive director of the Log Cabin Republicans, dismissed Santorums wins because he said the candidate cant unify the Republican Party. As former RNC chairman Gov. Haley Barbour has observed, purity is the enemy of victory, Cooper said The ability to secure the vote of the general electorate is necessary to succeeding as the Republican nominee. The divisive Rick Santorum is not capable of winning a general election and will not be the Republican nominee. The wins for Santorum in Minnesota and Missouri are largely symbolic. Missouri isnt awarding any delegates at the Republican National Convention. Minnesota and Colorado will award their delegates at a later date. Still, Santorums victory is sure to be a thorn in the side of frontrunner Romney, who last week seemed poised to claim the Republican nomination after his victory in the Nevada caucuses. Observers say Tuesdays results raise questions about whether Romney can close the deal and win the Republican nomination. GOProud Executive Director Jimmy LaSalvia, who endorsed Romney, declined to comment on the Santorum wins. Stonewalls Davis expressed amusement about the prospects of gay conservatives having to rally around Santorum as the Republican presidential candidate. Hell never be the nominee, but it would denitely be fun to watch gay conservatives contort themselves to nd a way to support a Santorum candidacy, wouldnt it? Santorum incorporated anti-gay rhetoric at a Missouri campaign stop. Last week, a gay man in Fulton, Missouri, asked Santorum why he thinks gays should face discrimination and not have either marriage or adoption rights. Who are you, or any individual to tell me that I dont have the same rights as anybody else in this country and to put me in a group that Im discriminated against in the workplace ... and in other situations? the man asked, drawing applause from the audience. Santorum initially told the questioner he shouldnt be discriminated against and is entitled to equal treatment under the law. But Santorum continued that the questioner isnt entitled to special treatment under the law, eliciting even greater applause from those in attendance at the event. The results for the next contest will be announced Saturday, when Maine will nish its weeklong caucus. Observers have said Rep. Ron Paul (R-Texas), who has yet to win a contest, may pull off a win in the state.

Paul Harris, respected gay journalist, dies

FORT LAUDERDALE, Fla. Freelance writer and publisher of a guide to gay media and publications, Paul Harris, died last month, according to South Florida Gay News. He was 53. The actor and writer was born and raised in England, and educated at the London School of Economics. Harris veered from a trajectory in the business and politics eld in favor of the arts. He studied at the Guildhall School of Music and Drama in London, before immigrating to the United States where he split his time between South Florida and New York City, operating his own publishing company, Upstart Press. You cant overestimate Paul Harris contribution to our community. He was out before it was cool, he quietly mentored many writers, myself included, writer Paul Gallotta told the South Florida Gay News upon Harris death.

Gay House, Senate candidates running strong

Numbers show Baldwin, others winning fundraising battles
Gay and lesbian candidates for the U.S. House and Senate are competitive with and in some cases besting their straight opponents when it comes to raising money. Fundraising numbers for the fourth quarter of 2011 and the year in total became public earlier this month after candidates submitted their campaign lings in accordance with federal election law. Rep. Tammy Baldwin, whos seeking to become the rst openly gay U.S. senator, made a particularly impressive showing in the nal quarter in her bid to represent Wisconsin in the Senate by taking in $1.16 million. The fourth quarter haul means the Democrat and seven-term House member raised $2.5 million last year for her Senate campaign. She has $1.8 million in cash on hand. Phillip Walzak, a Baldwin spokesperson, said the number demonstrates the strength of her campaign. These gures demonstrate the strength of Tammys grassroots campaign, and the depth of support for her message to stand up for our shared values, and put the people ahead of right-wing radicals and corporate special interests, Walzak said. Nathan Gonzales, editor of the Rothenberg Political Report, said Baldwin wont lose the Senate race because she doesnt have enough money, although it remains a toss-up and could be one the top general elections in the country. Gonzales added he doesnt think Baldwins sexual orientation will factor into the race heading into the general election. I see Republicans talking about her just being from Madison and how being a liberal Democrat from Madison puts her out of touch with the rest of the state rather than making her sexuality an issue, Gonzales said. Republican candidates in the race dont come close to Baldwin in fundraising. Former Wisconsin Gov. Tommy Thompson raised $657,000 and has $544,000 in cash on hand. Former congressman and gubernatorial candidate Mark Neumann raised $826,000 and has $552,000 in cash on hand. Denis Dison, spokesperson for the Gay & Lesbian Victory Fund, said Baldwin has lapped everybody in the eld of Republicans. Theyre going to be spending that money in the primary, Dison said. This is going to be a pretty ugly primary on the Republican side. Theyre really going to have to spend all the way to win their nomination. on top in fundraising for the race to represent Californias newly created 41st congressional district although by a much slimmer margin. Takano has raised $288,000 in total and has $212,000 in cash on hand. The Republican in the race, Riverside County Supervisor John Tavaglione has raised $275,000 and has $177,000 in cash on hand. Gonzales said he thinks the race will be competitive in the general election, but added that Takano has the advantage. I think Republicans looking at numbers think there may be an opportunity there in a mid-term election, Gonzales said. In the presidential race where the president is going to do very well in the state, overall, I think, Takano has the edge. Rep. David Cicilline, whom many thought would face a tough re-election campaign because of his unpopularity in the polls, is also outraising his Republican opponents and faces no Democratic challenger. The Rhode Island Democrat has raised a total of $949,000 and has $518,000 in cash on hand. Republican businessman and former law enforcement ofcial Brendan Doherty has raised $617,000 and has $482,000 in cash on hand. Cicilline nose-dived in the polls last year because he was seen as less than forthcoming about the troubled nances of Providence, R.I., during his tenure as mayor prior to his election to the U.S. House. The city of 178,000 faced a $110 million projected budget decit and the rainyday fund diminished from more than $22.3 million three years ago to less than $221,000, according to a report last year from Politico. Gonzales said Cicillines problem in the general election wont be money, but his approval rating, and predicted the race will be competitive even though Rhode Island is considered a Democratic state. If voters are focused on Cicillines record in Congress, then hell probably be ne for re-election, if theyre focused on his time as mayor and how they feel about how he
described his tenure when he was running for Congress, then his re-election becomes a much dicier proposition, Gonzales said. Dison said he thinks Cicilline will do better than expected in the fall because his district was altered during the redistricting process to become even more Democratic. It would be very tough for a Republican to win that seat, unless there is a Republican wave out there, Dison said. But even in the last election, which was obviously a Republican wave, he won the district pretty handily. Other gay candidates arent ahead in fundraising, but are still doing well enough to remain competitive in their races. Democrat Mark Pocan, a gay member of the State Assembly seeking the U.S. House seat Baldwin is vacating at the end of the year, has raised $274,000 and has $204,000 in cash on hand. But its less money than David Worzala, another Democrat and the Dane County Treasurer. The candidate has raised $278,000 and has $252,196 in cash on hand. Dison said Worzalas lead in fundraising is misleading because the candidate loaned himself $170,000 and Pocan actually doubled and tripled what the other candidate raised. In terms of fundraising, hes not doing very well raising money from individual donors, whereas Pocan is doing very well both from political action committees and individuals, Dison said. Dison added that Pocans endorsements are overwhelming and said every major Democrat and union has backed the gay candidate in the race. Both candidates in this race are ahead of Kelda Roys, another Democratic member of the State Assembly, whos raised $147,000 and has $128,828 in cash on hand. In Massachusetts, gay Republican Richard Tisei, a former member of the Massachusetts Legislature and former candidate for lieutenant governor, is behind
in his bid to unseat Rep. John Tierney (D-Mass.), but still has sizable funds. Tisei has raised $311,559 and has $260,000 in cash on hand, but the incumbent Tierney, running in the strongly Democratic state, raised $577,545 and has $546,000 in cash on hand. But looking just at the fourth quarter, Tisei bested Tierney in terms of fundraising. The Republican raised $311,558, almost all the fundraising for his campaign, in that quarter, while Tierney raised $161,105. Another Republican in the race, attorney and businessman Bill Hudak, dropped out of the race after the fundraising totals were announced. Gonzales said the Democrat is favored and that it will be tough for any Republican, but said there may be a chance to do better than expected in the race. Its still a Democratic district, but because of questions, ethical questions surrounding Tierney, or more specically, his family, I think theres an opportunity, Gonzales said. Dison said the seat became more winnable for a Republican with redistricting and the major question in the race is the extent to which the Republican Party rallies behind Tisei in the general election. The question will be whether the Republican committees here in town see that as a possible pick up, and if they do, then theyre going to get behind him and spend a lot of money there, Dison said. According to Politico, Tierneys brotherin-law, Daniel Eremian, was convicted of federal racketeering charges related to his operation of an illegal offshore casino. Additionally, Patrice Tierney, the lawmakers wife and Eremians sister, last year was sentenced to one month in prison and ve months of house arrest after pleading guilty to charges that she aided in the ling of her brothers false tax returns. Gay Rep. Jared Polis (D-Colo.) has raised $353,ooo and has $166,000 in cash on hand. Hes not expected to face serious competition in his heavily Democratic district.

New report examines proposed policy for federal contractors
An executive order requiring federal contractors to have LGBT-inclusive nondiscrimination policies would cover up to 16 million workers, according to a new study. The report, published Monday by the Williams Institute at the University of California of Los Angeles, discusses the implications of a directive prohibiting federal dollars from going to companies without LGBT-inclusive non-discrimination protections as well as a policy requiring them to provide health insurance to samesex partners of employees. M.V. Lee Badgett, the author of the report and the Williams Institutes research director, said in a statement the study highlights the powerful impact of federal policy prohibiting LGBT discrimination and continued progress already made toward protecting LGBT workers through state law and voluntary corporate policies. The study nds state laws or company policies already in place at federal contractors protect 61 percent of employees from discrimination based on sexual orientation and 41 percent from discrimination based on gender identity. But an executive order from President Obama spelling out that companies receiving federal money cant discriminate 400,000 and 600,000. The report also nds that a nondiscrimination directive wouldnt disproportionately impact defense contractors. According to the report, state law or company policy already covers 95 percent of employees at the companies from discrimination based on sexual orientation, while 69 percent of workers are protected based on gender identity. Additionally, the study says the order wouldnt place a heavier burden on small businesses because existing nondiscrimination policies already equally cover employees in small, medium and large federal contractors although Fortune 1000 employees have higher rates of coverage. Tico Almeida, president of Freedom to Work, said the report is important because it shows millions would gain non-discrimination protections once President Obama puts pen to paper and signs the document that is now sitting in the White House ready to go. With an LGBT fairness record as impressive as Mr. Obamas, I cant think of a single legitimate reason he might not sign the order that two of his cabinet agencies have already recommended he sign, Almeida said. Multiple sources have told the Blade that the Labor and Justice Departments have cleared an administrative measure that would bar federal dollars from going to companies without LGBT-inclusive nondiscrimination protections and have sent their recommendation to the White House for nal approval. The White House hasnt said whether Obama will issue the directive. The measure is sometimes known as the ENDA executive order because it would accomplish the same goals as the Employment Non-Discrimination Act, legislation that has stalled in Congress that would bar job bias against LGBT people in the public and private workforce. The executive order would only apply to companies doing business with the federal government. The study also nds an order mandating that contractors provide domestic partner health benets would have an impact, but come at little cost to companies. Should the U.S. government require contractors to provide domestic partner benets, between 14.3 million and 15.3 million more employees would have access to same-sex partner coverage. However, the study estimates between only 40,000 and 136,000 employees would sign up for coverage because not all of these employees are likely to have a same-sex partner, and even those that have them may not elect to receive benets. Given the small number of employees who would take advantage of domestic partnership benets across the tens of thousands of federal contractors, the ultimate burden on business for providing these benets would be minimal, Badgett concluded in a statement. Findings in the study are based on 2009 data from the Equal Employment Opportunities Commissions EEO-1 reports, which are required for federal contractors with 50 or more employees that contract for at least $50,000, and for non-contractor employers with 100 or more workers.

Healthcare.gov enables users to nd insurance plans
The Department of Health & Human Services announced on Tuesday it has altered its website promoting the health care reform law to enable users to search for plans that provide benets to same-sex partners. The website, HealthCare.gov, now enables individuals searching for health insurance to narrow their results to nd plans offering domestic partner coverage or same-sex coverage. Secretary of Health & Human Services Kathleen Sebelius touted the change in a statement as a way to make health care more readily available to LGBT people. Last year, as part of our commitment to work with the LGBT community and be more responsive to the needs of these populations, we promised to improve the Health Plan Finder tool to give LGBT individuals the ability to search for health plans that provide same-sex partner benets, Sebelius said. Today we have delivered on that promise. Other filters through which individuals can search for health care plans include categories based on enrollment or out-of-pocket expenses. According to HHS, studies have shown LGBT people are disproportionately uninsured and the new filter helps address that issue by linking samesex couples to carriers that provide benefits for their partners. The website had previously enabled small businesses to search for plans that would provide partner benets to their employees in same-sex relationships. The change that HHS announced on Tuesday is the next step in the process of upgrading the website. Steve Larsen, director of the Center for Consumer Information and Insurance Oversight, said the change will help same-sex couples overcome difculties in nding health care plans. In the past, many same-sex couples have faced challenges searching for health coverage that suited their needs, Larsen said. This tool will eliminate the guesswork, providing an enhanced resource for exploring insurance coverage. Michael Cole-Schwarz, spokesperson for the Human Rights Campaign, said the change demonstrates the administrations interests in providing health care to all Americans. This is an important step that further demonstrates the departments commitment to ensuring all Americans including LGBT people have better access to quality and inclusive health care, Cole-Schwartz said. As the Affordable Care Act is implemented, we look forward to continuing to work with the administration so that our communitys interests are addressed.

Slain trans woman remembered at vigil

Police said this week that a video they released last Friday showing the suspect crossing a street from a distance prompted several people to contact investigators with information that is helping the departments Homicide Branch in its investigation of the murder. The video, which has been posted on YouTube, doesnt clearly show the suspects face. But police said they were hopeful that someone who knows the person in question would recognize him in the video and reveal his identity to police homicide investigators. In an interview with the Blade on the day police released the video, Lt. Robert Adler of the Homicide Branch described the suspect as a black male, 30-40 years old, about 5 feet, 9 inches-to-6 feet tall, with a medium build and medium complexion and sporting a beard. At the time of the incident the person was wearing a black jacket with a grey hooded sweatshirt underneath it and a pair of what we believe is jeans, Adler said. He said investigators obtained the description of the suspect from a variety of different sources. Asked whether evidence exists to indicate the killing was a hate crime, Adler said, At this time we are still investigating if it is or is not a hate crime. And as the investigation proceeds we should probably get a better idea of whether that was a factor in the assault. Police issued a statement on Feb. 3 saying a citizen agged down a Metro transit police ofcer about 8:15 p.m. on Feb. 2 to report an assault at a bus stop on the 4900 block of East Capitol Street, N.E. Upon arrival, the ofcer located a transgender female who was unconscious and unresponsive suffering from a stab wound, the statement said. Units from the Sixth District and D.C. Fire and Emergency Medical Services personnel responded to the scene. The victim was transported to a local hospital and admitted in critical condition, the statement said. On Friday, Feb. 3, 2012, at 2:35 a.m., the victim was pronounced dead, the statement said. Adler said Jones had no identication in her possession when police found her unconscious at the bus stop. He said investigators later identied her through ngerprints. The D.C. Trans Coalition released a statement on Feb. 3 saying it had learned through its own sources that a third person was at the bus stop when the stabbing took place and chased after the attacker. The statement said the attacker escaped when the witness realized that Jones was in need of immediate medical attention and abandoned his pursuit of the attacker. serve your community and you ght for people like Deoni who lived a good life, who helped people, who made people smile every day, he told the gathering. One male friend of Jones, who didnt identify himself at the vigil, described her as one of his closest friends and said her death has been devastating for him. This is a person who I hung out with like every day, he said. I watched this girl graduate. I helped her with her homework. I watched her grow from JaParker to Deoni, and that was a big step for her, he said. If youre going to do that you have to be a brave person, the friend said. She said she was ready. And thats what she did, she just transformed. She was so beautiful. In his emotional appeal for witnesses to come forward, Bethea described how he interacted with Jones at their home minutes before her death. I was sitting in the house just surng the Internet on the laptop when JaParker asked to check the bus schedule to see what time the bus was going to arrive at this stop here, he said. I turned the
laptop so he could check it. He checked it and walked out the door to hang out with one of the friends that he grew up with, Bethea said. Ever since JaParker came into my life about 18 years ago he brought nothing but joy, he said. Thats all he ever did. In speculating on why the suspect attacked Jones, Bethea said he was certain that Jones would not have started a confrontation. I dont know exactly whether they exchanged words or what but JaParker didnt have a violent bone in his body, he said. And he was just confronted by the devil. He was simply sitting at this bus stop. Thats all. Police are offering a reward of up to $25,000 to anyone providing information leading to the arrest and conviction of the person or persons wanted for any homicide committee in D.C., police said in a statement. Court declares Calif.s Prop 8 unconstitutional

The court also rejected the argument that Judge Walker should have recused himself from the case because of his sexual orientation and relationship status. Legal experts began to weigh in on the meaning of the decision immediately. I think the biggest story is how narrow [the majority decision] really is, Douglas NeJaime, associate professor at Loyola Law School, Los Angeles, told the Blade Tuesday. In some ways, I think that might disappoint some folks who were hoping it would expand to more states, but I think in terms of setting it up for a Supreme Court review either the Supreme Court not taking it, or approving it for supporters of same-sex marriage, this is actually the most strategically sound way for the case to proceed. Legal experts agree that the decision represents a big win for same-sex couples in California, even though it was a narrow decision limited to California. The Ninth Circuit encompasses eight other Western states and some Prop 8 opponents had hoped the courts decision would impact a wider swath of the country. Attorney Ted Olson, who along with David Boies is spearheading the case, held a news conference Tuesday in Los Angeles and declared, The time is now for gay couples to win the right to marry. From the beginning, weve been planning to be in the U.S. Supreme Court, he added. But the path to the Supreme Court remains uncertain. The decision is a very narrow decision striking down Proposition 8 on grounds that are very unique to California, NeJaime told the Blade. What this doesnt do is directly affect the laws of the majority of states that dont allow same-sex couples to marry. It doesnt announce that samesex couples have a right to marry under the federal Constitution, and it doesnt engage the question of whether sexual orientation-based classications should be subjected to some heightened form of scrutiny under the federal Constitution. So its a very narrow ruling that only directly impacts the law in California. If left to stand, however, what the decision would do, NeJaime says, is allow same-sex couples to marry in California. What you would likely have happen is a bunch of other people would le cases in other states, and you would have more litigation, and the states that have a system most directly related to the courts ruling here, would be states that have domestic partnership or civil union statues that allow same-sex couples to have all of the same rights and benets of different-sex couples, NeJaime said. So Washington, Nevada, Oregon, Hawaii, Delaware, Illinois, Rhode Island, New Jersey, those states laws would probably be the rst to be challenged. Though the court sided with the plaintiffs, the ruling is stayed until the decision goes into effect, in what is called a mandate. This means that same-sex couples will not be able
to marry in California until the Ninth Circuit lifts the stay, the Supreme Court decides to uphold the ruling or pass on the case, or state voters decide to overturn the law at the ballot. Proponents of Prop 8 now have 15 days to ask for what is called an en banc decision by a larger random panel of 11 of the courts 24 judges a crap shoot for proponents of the law who could not guarantee the judges assigned to the panel are sympathetic. Proponents also have 90 days to appeal directly to the Supreme Court, if they so choose to skip the en banc rehearing. Though at the onset of the case, gay rights advocates were excited about the prospect of the case advancing to the Supreme Court where they hoped it could be used to strike down same-sex marriage bans across the nation, some legal experts say its not so simple. Everyone thought this case was going to Supreme Court, but given how narrow this ruling is, the Supreme Court might very likely just not take the case, NeJaime told the Blade. The Supreme Court does not have to take the case. And they might decide this only affects California. Well let it stand. And well take a case down the road. If they take the case, then the decision by the Ninth Circuit has really set it up so that the Supreme Court can afrm the decision, meaning strike down Proposition 8, by not having to reach very far. NeJaime said that the Reinhardt opinion, much like the Walker opinion, borrows heavily from the case law history of swing vote Supreme Court Justice Anthony Kennedy, whom NeJaime says the opinion aims for. Kennedy wrote the majority opinion in the Romer v. Evans case that struck down an anti-gay constitutional amendment in Colorados Constitution nearly 20 years ago, but that doesnt mean the justice will help the plaintiffs change the law across the land. So basically because its a narrow ruling, and because the court applied the lowest form of scrutiny for equal protection purposes, the Supreme Court could afrm the decision without having to expand much on its current case law, and without having to comment on the laws of the other states. It could issue a ruling that would allow same-sex marriage in California but doesnt affect anything else directly. Thats the preferred course of the court, is to issue narrow, incremental, case-by-case rulings, rather than broad sweeping rulings, that invalidate the majority of states laws in one decision. In 2008, more than 18,000 same-sex couples were married in California during a brief period following the decision by the California Supreme Court that barring samesex couples from marriage violated the California Constitution. The weddings were halted by the November 2008 voter-enacted law, but the court ruled that the 18,000 marriages performed should remain valid. For now, same-sex couples in California who did not get married during the narrow
2008 window are in legal limbo, waiting for the stay on the original Judge Walker decision to be lifted once and for all, but that could take some time. The mandate would issue seven days after the time for ling a petition for rehearing expires, or seven days after the denial of a petition for a rehearing, NeJaime told the Blade. They have 14 days to le the petition, so technically, it
could issue as soon as 21 days. But more likely it will be later than that, and if they take it for a rehearing, it would be even later than that, so the soonest would be within three weeks. But in the meantime, theres probably going to be additional motions to stay, so that doesnt mean that once the mandate is issued, same-sex couples can marry, NeJaime added.

White House Press Secretary Jay Carney faced a urry of questions Tuesday about President Obamas evolving position on same-sex marriage and his reaction to the court decision that Californias Proposition 8 is unconstitutional. In response to the questioning, Carney said he didnt have a comment on the decision, although he noted the president has long opposed divisive and discriminatory efforts that deny rights and benets to same-sex couples. A total of six news outlets asked Carney about marriage and the Proposition 8 decision: Reuters, the Wall Street Journal, NBC News, the Hufngton Post, American Urban Radio and the Washington Blade. Under questioning from the Blade, Carney dodged an inquiry about whether Obama who came out against Prop 8 when it was on the ballot in 2008 and called it unnecessary also believes the measure is unconstitutional. Im not going to comment on litigation particularly as here where we are not party to it, but the presidents positions on these issues writ large are well known, and hes long opposed divisive and discriminatory efforts to deny right and benets to same-sex couples, Carney said. Pressed by the Blade further on whether Obamas lack of support for marriage equality but opposition to divisive and discriminatory efforts such as Proposition 8, a ban on same-sex marriage, represents an inconsistency, Carney said he didnt have an update on the presidents position on same-sex marriage, but explained the distinction. I can tell you that divisive and discriminatory efforts to deny rights and benets is something this president has long opposed, Carney said. And I think thats an important point to make. These are proactive and deliberate efforts to deny benets and to be discriminatory. Asked by NBC News whether the Ninth Circuit court decision will inform Obamas evolution on marriage, Carney said the ruling had come out too recently for him to provide an answer. Meanwhile, GOP presidential front-runner Mitt Romney condemned the Prop 8 court ruling. Today, unelected judges cast aside the will of the people of California who voted to protect traditional marriage, Romneys statement said. This decision does not end this ght, and I expect it to go to the Supreme Court. That prospect underscores the vital importance of this election and the movement to preserve our values. I believe marriage is between a man and a woman and, as president, I will protect traditional marriage and appoint judges who interpret the Constitution as it is written and not according to their own politics and prejudices.

Lobby Day set for Monday

Marylands annual pro-LGBT Lobby Day, which many believe will be critical for proponents of marriage equality and gender identity nondiscrimination legislation in Maryland, will take place on Monday in Annapolis. The event kicks off with a rally at Lawyers Mall at 6 p.m. that typically draws hundreds of supporters. Following the rally, and in some cases prior to its end, groups form to visit their respective delegates and senators to persuade them to support the pertinent bills. Through the years, personal stories presented by LGBT residents and allies have proven to be a successful method to win over these legislators. A complete list of speakers for the rally had not been set at press time. However, Candace and Rebecca Jones-Gingrich as well as Sen. Kittleman are conrmed to participate. Kittleman broke ranks with the Republican caucus last year to become a public supporter of marriage equality. This years Lobby Day will be unique in two respects. For the rst time, it will be run by Marylanders for Marriage Equality, a coalition of various progressive organizations that was formed in July of last year. Equality Maryland, one of the coalition member organizations, had previously organized the event by itself. In addition, a new group, Gender Rights Maryland, will take the lead in attempting to pass gender identity protections. Opponents of the freedom to marry for same-sex couples showed up in full force on Jan. 30, Carrie Evans, executive director of Equality Maryland told the Blade. All of us on the side of fairness for all Maryland families must do the same. The Maryland Legislature must see and hear from us. Hearings for two House committees on the Civil Marriage Protection Act were set for Feb. 10.

OMalley pushes marriage bill in address

One day after testifying before the Senate Judicial Proceedings Committee, Gov. Martin OMalley called for a bill to extend marriage rights to same-sex couples during his State of the State address. Its not right and its not just that children of gay couples should have less protection than the children of other families in the state, he said. At the committee hearing on Jan. 31, OMalley was among several prominent elected ofcials to testify on behalf of the bill. This bill balances an individuals civil marriage rights with the important protections of religious freedoms for all, OMalley said. And because it protects both of these inalienable rights, it is supported by a broad coalition of Marylanders, which includes clergy, community leaders, faith-based organizations, civil rights groups and those who hold the most important title of all in our democracy, and that title is citizen. Baltimore Mayor Stephanie Rawlings-Blake, Maryland Attorney General Douglas F. Gansler, Sens. Richard Madaleno, Jamie Raskin and Robert Garagiola all Democrats and Sen. Allan H. Food truck ght result of city incompetence

D.C. regulatory agency misses the mark on proposed new rules
and some new food trucks originate with RAMW members. DCFTAs conict-oriented campaign may motivate their Twitter-connected customer base to express deserved yet merely feelgood generic support. However, it belies the fact that the citys rulemaking draft doesnt solve the issues confronting them and creates new obstacles. If adopted, even with revisions they propose, food trucks will face tougher times ahead on D.C.s streets. A stunningly botched effort by the citys Department of Consumer and Regulatory Affairs (DCRA) to offer up a long-delayed second version of proposed new regulations for D.C. Council review reects a combination of a stark lack of competence and city planning naivet. These poorly thought-out regulations opposed in their details by food truck operators, restaurants and other stakeholders do not provide practical or effective street-side solutions. Add to the mix a startling misstep by DCRA in ignoring a 2009 D.C. law requiring that vendors operate from designated street locations assigned for use renders the agencys proposed rulemaking legislatively defective. On that score alone, the public admonition last week by RAMW that the city start over in constructing regulations makes sense. When the colorful Fojol Bros. Traveling Culinary Carnival became the citys rst modern food truck on Inauguration Day 2009, most residents knew only the longtime hot dog carts downtown and near the National Mall relegated to spots on sidewalks and which are not the focus of the current debate. A proliferation of more than 100 food trucks has since resulted in an unregulated Wild West environment. The explosive growth in food trucks requires new considerations regarding location, geographic curbside concentration and rules of operation including the cost of largescale trash collection borne by in-line businesses. Desiring to perpetuate their rogue renegade status on crowded city streets and relying on conict-free haggling for parking spaces among trucks is no longer sustainable. While the city proposal allows most food trucks to utilize public parking spaces for the posted meter time before moving on, this limitation is neither realistic nor current practice. Snagging prime spaces in heavily trafcked areas requires that trucks poach them long before beginning operation to guarantee spots, overstaying the limit during street service. When the city recently began cracking down on parking violations the food trucks cried foul, but without assigned designated spots this problem will only worsen. Fairness requires that food trucks collect local sales tax instead of paying a at fee under rules instituted 30 years ago for neighborhood ice cream trucks a $1,500 annual rate is inappropriate for high volume businesses selling $15 lobster rolls. Accepting credit card payments on mobile devices is commonplace, as should be playing by the same rules. Food trucks can learn a thing or two from restaurateurs about the citys plan to establish Vending Development Zones that will subject them to the notorious labyrinth of neighborhood approval delays and denials. Restaurants with patio licenses must maneuver an arduous and lengthy permitting process involving 18 entities, including Advisory Neighborhood Commissions (ANCs) and small gangs of license opponents, and must close much earlier outdoors. If food trucks think they can trade on their novelty to circumvent regulation and neighborhood licensing, you must be new here is an apt retort. They should call a truce and work with their hospitality colleagues.

Public perception that a pitched battle is being waged between local food truck vendors and District restaurants is unfortunate and unproductive. The D.C. Food Truck Association (DCFTA) led by new executive director and gay food truck operator Che Ruddell-Tabisola, who co-owns the popular BBQ Bus launched last April with his partner Tadd Ruddell-Tabisola continues to characterize regulatory issues as a ght with the Restaurant Association Metropolitan Washington (RAMW) and propagates a false claim that brick-and-mortar restaurants desire to shut them down altogether. Its an untrue but heavily hyped broadside designed to create a David v. Goliath dichotomy in the context of the citys proposed regulations governing food truck operation. After all, several restaurants plan to or have launched mobile vending trucks, and a number of food truck operators have opened or are in the process of moving toward opening storefront businesses. The restaurant association clearly enunciates support for local food truck entrepreneurs,

Childrens book list shows LGBT (and Q) diversity

A welcome move from American Library Association

A new American Library Association (ALA) list of recommended LGBTQ-inclusive books for children and young adults shows that characters who are transgender, bisexual, and of ambiguous identity are taking their place solidly beside more traditional gay and lesbian ones. Wisconsin high school librarian Lynn Evarts, who chairs the ALA committee that chooses the annual Rainbow Bibliography, said she is very happy that the fth annual version of the list, announced Jan. 22, is so diverse. The Bibliographys Top 10 books, selected for special recognition out of the full list of 32, include four titles with characters outside gay and lesbian labels. In Steve Brezenoffs teen punk romance Brooklyn Burning, readers never know the gender of the protagonists Kid and Scout. In Patrick Ryans Gemini Bites, a girl and her twin brother each fall in love with a young man of ambiguous sexuality and who may also be a vampire. Libba Brays Beauty Queens includes a transgender character. And Cris Beams I Am J tells the story of a transgender boy growing up in New York City, informed by Beams years of volunteering with transgender youth and her experience as foster mother to a transgender girl. Not in the top 10, but also reecting this mix of sexuality and gender are Lili Wilkinsons Pink and Alex Sanchez Boyfriends with Girlfriends, which have bisexual leading characters, and Shimura Takakos graphic novel Wandering Son, which has a gender variant girl and boy as protagonists. Evarts said she was also thrilled to see Jennifer Carrs Be Who You Are, about a child born biologically male who knows she is really a girl. The book is a rare example of a book for elementary school children that has a gender variant protagonist. Carr is herself the mother of a gender variant child, and takes us through a ctional but realistic account of what she and other families with gender variant children have experienced, such as seeking support, dealing with schools, and retraining themselves parents and siblings to use the childs preferred name and pronouns. Although it is self-published, Evarts said the book is quite high quality and she hopes its presence on the list might get it noticed by a larger publisher. Other books on the list do have gay and lesbian characters, including the Top 10 titles Sister Mischief, Laura Goodes tale of an all-girl hip-hop crew in Minnesota; Huntress, Malinda Los fantasy romance; Shine, Lauren Myracles wrenching tale of an anti-gay hate crime; She Loves You, She Loves You Not, a romance by the prolic Julie Ann Peters; and Putting Makeup on the Fat Boy, by Bil Wright, which also won the ALAs Stonewall Book Award for exceptional merit in LGBTQ childrens and young adult literature. But books for younger children were sadly lacking this year. Aside from Be Who You Are, the only other title for that age group (and a Top 10 pick) is the picture book Donovans Big Day, by Lesla Newman, author of the classic Heather Has Two Mommies. Unlike Heather, Donovan does not preach about acceptance, but simply and joyfully shows a boy preparing for the wedding of his two moms. For middle readers, beyond picture books but not yet ready for young adult fare, there was not a darn thing, Evarts said, except possibly Wandering Son, which shows its protagonists at the end of fth grade. On the other end of the age bracket, several books not specically for youth made the list, including actor Jane Lynchs biography Happy Accidents and Scott Paselds photographic survey Gay in America: portraits. Evarts called Gay In America, one of the most fabulous books I have seen in years. . . . one of those books kids are going to look at and say, hey, wow, cool. Other non-ction books include It Gets Better, a collection of transcripts and original essays from the online anti-bullying project launched by Dan Savage and Terry Miller; Dear Bully: Seventy Authors Tell Their Stories, edited by Megan Kelly Hall and Carrie Jones; and Queer: The Ultimate Guide for Teens, by Kathy Belge and Marke Bieschke. Evarts said the Bibliography can be a valuable tool for librarians needing to support their purchases of LGBTQ-inclusive books, especially in schools. They feel far more comfortable purchasing these books, having them on their shelves, giving them to their students, when they have an ALA-sanctioned list to back them up, she explained. Parents or others may still ask for LGBTQinclusive books to be removed or restricted in some way, Evarts said, but the Bibliography makes it a little bit easier to put a book on our shelves, knowing there is something out there that we can wave in peoples faces when they get sassy about it. And while the ALA recognizes a few of the very top LGBTQ books through its Stonewall Awards, the longer list provided by the Bibliography can help librarians purchase several different titles that serve different needs, she explained. Downton Abbey makes for deliciously dastardly TV

Gay villain spices up PBS hit show
ated a complex world of villainy, drama, romance, characters and style. Its wit, design and costumes are a special treat. Most surprising, given that the rst two seasons of Downton take place from 1912-1919 in England, where being queer was illegal (not long after gay writer Oscar Wilde was imprisoned for gross indecency), the show features a gay character: Thomas Barrow, a footman who is a soldier in World War I (played brilliantly by Rob James-Collier). Thomas, though closeted and a servant, is far from shy or servile. He lustily kisses a duke and hits on a Turkish diplomat. Hes smart, alert, and, heres the kicker, a villain. Downton Abbey is the story of the Crawley family and their servants (from the footmen to the chauffeur). The upstairs people (the Earl and Countess of Grantham, their daughters, and the inimitable Dowager Countess, played by Maggie Smith) and the downstairs folk (including the ladies maid Sarah OBrien, the butler Charles Carson and the housekeeper Mrs. Hughes) form a tight-knit community. The underpaid servants do exhausting work for long hours and the Crawleys endure woes from losing their cousin (and heir) on the Titanic to being jilted in love. Despite these class divisions, theyre a family, working to preserve the estate and to serve their country in World War I. Each family (at least in a riveting TV series) needs a black sheep. Thomas (often acting in cahoots with OBrien) splendidly fulls this role. Hes everything you wouldnt want your son, lover, father or brother to be manipulative, untrustworthy and mostly unfeeling. Im sure Id loathe him in real life. Yet its a guilty pleasure to admit this as a ctional character, Ive come to like the cad. Here are just a few of Thomas dastardly deeds. He blackmails a duke who visits the Crawleys. Thomas threatens to expose some compromising letters because the duke, an aristocrat with whom hes had a dalliance, wouldnt promise to give him a job. One swallow doesnt make a summer, the duke says to Thomas, throwing him over. Thomas falsely accuses Mr. Bates, Lord Granthams valet, of stealing bottles of wine because he feels unjustly passed over for Bates position. When Downton Abbey becomes a convalescent home for wounded soldiers, Thomas, as manager of the facility, is rude and imperious to everyone. I want tea right away! he snaps at Daisy, the young kitchen maid (who, not knowing hes gay, has a crush on him). Why do I like Thomas even though hes often so cruel? Because when the class system in England was entrenched, and you could go to jail if you spoke gay loves name, Thomas dares to ght class restrictions and express his sexuality. As Downton Abbey creator Julian Fellowes said of Thomas in The New York Times, Hes not just horrible. To get any kind of emotional life going, hes got to take his own life in his hands every time. Occasionally, Thomas, perhaps, because hes queer, is empathetic. Hes teary-eyed when blinded vets are discharged from the hospital. Im different like you, he tells a disabled soldier. Thankfully, weve reached a point where not all LGBT TV characters have to be saints. I cant wait to see what happens next.

Why isnt Del. Norton supporting GOP bill to benet D.C. residents?

Nobody deserves tyranny, but we get it in the form of taxation without representation when we do not hold our elected representatives accountable.
On Dec. 19, Rep. Louie Gohmert (RTexas) introduced H.R. 3731, the No Taxation Without Representation Act. Gohmert also introduced it in the previous Congress to address this injustice. But listening to our locally elected ofcials, you wouldnt know it. Perhaps they were too busy seeking congressional support to kick out the Occupy protesters from McPherson Square, or perhaps they were making travel arrangements to visit each of the 50 state capitals to lobby for D.C. statehood. How could the taxpayers $4,000 have been better spent than on a daytrip to the Granite State? Speaking of Congress, where is our esteemed delegate, Eleanor Holmes Norton? She has been conspicuously quiet about this bill, which stems from another bill Norton introduced back in 2001, during the 107th Congress. That bill would have amended the Internal Revenue Code to provide a tax exemption to District of Columbia residents for years during which such residents did not have full voting representation in the Congress. It seems that, given the choice between helping her constituents by co-sponsoring a bill with a Republican, or abandoning them, shell abandon them. Gohmerts bill has attempted to steer clear of anything that might alienate the D.C. citizenry or local politicians. The Gohmert bill only deals with the non-taxable status on D.C. residents no poison pills regarding abortion, gun control or needle exchanges setting aside any issue of D.C. statehood or congressional representation. Is this really the only reason she or Mayor Gray can give to withhold their support? Its not everything we want? Over the last three years, President Obama has often been quick to say, Dont let the perfect be the enemy of the good. That would apply here as well. There is only one local candidate who is talking about this bill: Republican Nelson Rimensnyder, who is running for U.S. Shadow Senator. A veteran of D.C. politics, Rimensnyder is making his support for this bill the cornerstone of his campaign. And like us, he doesnt understand why Norton isnt behind a proposition she once championed. Nelson Rimensynder may not be a household name in the District, and the concept of a U.S. Shadow Senator may be foreign to many if not most, but hes an advocate who is working to help the citizens of D.C. Rimensnyder, unlike Norton or Mayor Gray, will work with both parties in Congress to improve the lot of ordinary Washingtonians. The slogan predates America herself: No taxation without representation. Every child should learn about it in history class, stemming from the Stamp Act of 1765 and, more famously, the Boston Tea Party. James Otis argued, Taxation without representation is tyranny. Concerned about tyrannys temptations and giving the seat of the federal government too much power, the founders didnt give it an elected representative, with the unintended consequence that the citizens of Washington, D.C., were taxed without a representative. This was partially rectied with the ratication of the 23rd amendment, but the residents of D.C. are still taxed and still lack a representative whose votes count. Fortunately we have congressmen who are trying to x the taxation-without-representation problem.

As a grownup, you are responsible for your needs, which include food, clothing and shelter. Your partner may help with your wants (such as sex, soothing and emotional support), but there may be times when she is unable or unwilling to do so. When this occurs, its best to nd ways to take care of yourself. Avoid using threats, anger, silence or retaliation to get what you want; doing so will make the two of you adversaries rather

A new Phase

Lesbian bar Phase 1 has been just steps from the Eastern Market Metro stop since it opened in 1970, but as of Friday night, there will be a second location in Dupont Circle. Apex closed its doors in July without advance notice. Owner Glen Thompson, who also owns the nearby gay bar Omega, sold Apex to Alan Carroll, the owner of the D.C. gay clubs Ziegfelds/Secrets and the lesbian club Phase 1. This weekend, Carroll opens a new club in the Apex building at 22nd and P streets, N.W., that will cater to a mostly lesbian clientele. The club will open in the space that formerly housed Badlands and Apex with a renished dance oor, updated sound system, new lights and bright pink paint on the walls in the back. It has been a long-term goal of Carrolls to open a larger venue, according to Angela Lombardi, longtime manager of the original Phase 1, and with Apex closing, it just seemed right. its a popular gay part of town, Lombardi says of the Dupont area. The new location will feature much more space than the original and is being touted as the East Coasts largest lesbian bar. Size isnt the only difference between the two locations. The vibe will be a little different too. Phase 1 ... is the kind of place where you can sit down and have a conversation with the bartender, Lombardi says of the vibe. Phase 1 Dupont, were going to be more super-high volume, louder music, more dancing and just straight-up partying as opposed to just chilling ... like at old school Phase. The grand opening weekend will feature a lineup of DJs including DJs Rosie and Natty Boom on Friday and DJs Ri-Mix and Joshua on Saturday. The club will most likely have rotating DJs with a possible regular DJ in the back bar once it nds its footing. We want to keep people interested

WHATS WASHINGTONS BEST NIGHTSPOT, PAST OR PRESENT? Past, Id say The Edge circa 2000-2002, I was a big raver back then and that club picked up where Tracks left off. Present, the 9:30 club, Ive seen shows in there that have literally changed me as a person. DESCRIBE YOUR DREAM WEDDING. I dont really think Ill ever get married, but if I did, it would be an 80s-themed wedding with drag queen ushers dressed as 80s icons like Molly Ringwald, 80s Madonna and Boy George! WHAT NON-LGBT ISSUE ARE YOU MOST PASSIONATE ABOUT Agriculture and food processing/ labeling in America. I think we should tax junk food, soda and fast food and it should be illegal to sell those items in the public school system. WHAT HISTORICAL OUTCOME WOULD YOU CHANGE? The birth of Jesus. While I think all religions begin with the best intentions, as a gay person I also believe that religion has done far more harm than good to our community. I understand that most of the time its the extremists who are misinterpreting the context, however I think society as a whole would be far more evolved if we put our faith into science and art. WHATS BEEN THE MOST MEMORABLE POP CULTURE MOMENT OF YOUR LIFETIME? The acquittal of Michael Jackson in 2005. I was working as a bartender at a chain restaurant at the time and all the TVs were on when it was announced. All the black people in the bar cheered while most of the white people protested and sneered. It was the rst time Id seen such direct and unapologetic racism. ON WHAT DO YOU INSIST? Good manners and punctuality. WHAT WAS YOUR LAST FACEBOOK POST OR TWEET? Back from Vegas, Id tell you all about it, but you know what they say! IF YOUR LIFE WERE A BOOK, WHAT WOULD THE TITLE BE? I think to be creative is the closest you can get to really understanding God. I also believe that morality is a personal issue not a spiritual one. I dont think any spiritual person has the right to tell you having sex or doing drugs is wrong. WHATS YOUR ADVICE FOR LGBT MOVEMENT LEADERS? To stop being afraid of offending some people. There are some great LGBT leaders out there, but most of them seem to be walking on political eggshells. Were so worried about being seen as normal, the Human Rights Campaign wants the right wing to see us as heteronormative, monogamous white-picket fence-type families. I think its great that those types of gay families are out there, but we shouldnt have to adapt to that ideal to get equal rights. There are plenty of successful non-monogamous couples, triads, open relationships, non-traditional families that are probably more normal and well adjusted than most straight families. WHAT WOULD YOU WALK ACROSS HOT COALS FOR? The chance to go into space! WHAT LGBT STEREOTYPE ANNOYS YOU MOST? When someone thinks that because Im gay I wont ght back when you call me fag. Im from P.G. County, Im not afraid to stand up for myself. WHATS YOUR FAVORITE LGBT MOVIE? The Trip. I love how they weave in footage from critical moments in gay history. WHATS THE MOST OVERRATED SOCIAL CUSTOM? Saying bless you when someone sneezes. Just say Shut up! WHAT TROPHY OR PRIZE DO YOU MOST COVET? Not really a prize, but Id love to go on tour with my band and see the world while entertaining people. WHAT DO YOU WISH YOUD KNOWN AT 18? Nothing. I think that everything happens for a reason and if youre happy with where you are, you cant bitch about how you got there! WHY WASHINGTON? The more I travel, the more I realize how great D.C. is! We have so much history but also constantly evolving culture. In one day you can see the monuments, eat amazing Ethiopian food and see a great drag show! I love all the culture here, how you can meet people from all backgrounds and everyone has a story.

Mikey Torres and his boyfriend of ve years Dan Sherwood are both into music, albeit of wildly different varieties Torres is the front man of local band Glitterlust, a queer outt he says is a cross between Marilyn Manson and Scissor Sisters. Sherwood is an opera singer. We dont perform together or collaborate musically, Torres says with a laugh. He tries to educate me on things whereas I taught myself every instrument I know. Hes much more a musician. I see myself as an entertainer where its all about music, sets and costumes. In the band, we dont take ourselves too seriously. Glitterlust, which formed last April and debuted at last years Phase Fest, is Torres, lesbian guitarist Liz Wooley and bi bassist Chris Roudiez. They perform mostly Torres originals but occasionally do covers. They have two upcoming appearances look for them at Homopolitan at Velvet Lounge (915 U St., N.W.) on Feb. 18 where theyll co-headline with burlesque outt D.C. Gurley Show and lesbian R&B group the CooLots (Doors at 8, show at 9; $8 tickets available at the door, 21 and up). And on Thursday theyll open 80s night at Chief Ikes Mambo Room (1725 Columbia Rd., N.W.) at 8 p.m. Torres says he likes to explore the nuances of gay life, especially sex, from a queer perspective. I think its an artists job to question whats put out there for us, he says. Ultimately art is not a statement, its a question mark. You cant close everybody in the heteronormative bubble. The band put out an EP last year called Beautiful Noise on Band Camp. Theyre working on an indie album tentatively called Chaos Magic for release this year. All three members work day jobs Torres is sous chef at Dupont Circle hotel The Beacon. They play in the region about three times per month. If success comes, we certainly wont turn it down but I think were really lucky to live in a time when the record contract is not the ultimate goal, he says. Torres and Sherwood live together in Oxon Hill, Md. Torres enjoys music, cooking, sewing, crafts and anything creative, he says. Im sort of a punk rock Martha Stewart.

Gay-themed play explores prickly subjects with humor

Sex and spirituality or the lack thereof intersect in thought-provoking ways in the awed-but-worthy play Next Fall, a 2009 piece thats enjoying a postBroadway local run at Round House Theatre in Bethesda, Md. Luke (Chris Dinolfo) and Adam (Tom Story) meet when the former gives the latter the Heimlich maneuver to ease a panic attack at a party. He later admits it was just an excuse to get his arms around Adam, whos older (he reluctantly admits to 40), a neurotic hypochondriac drifting through life. Luke is young and cute, a promising actor whose career is about to take off. Opposites attract, of course, and a one-night stand turns into a long-term committed relationship. The premise may sound like a Hollywood screwball comedy, but playwright Geoffrey Nauffts (whos played Adam in previous productions) soon dives into more serious territory. Theres another serious difference between the two men Lukes a devout fundamentalist Christian and Adams a committed agnostic. And unlike a typical screwball comedy, Nauffts fascinating script focuses not so much on what brings the characters together in the rst place, but on what keeps them together over the years. The play opens in a hospital. Luke has been struck by a taxi and his anxious family and friends keep vigil in the hospital waiting room. They have been summoned by the tightly wound Brandon (Alexander Strain in a somewhat underwritten role), Lukes estranged friend whos a thriving real estate mogul who is also struggling with Christianity and homosexuality. Adams friend Holly (Dawn Ursula) runs the candle shop where both Luke and Adam work at various times and who searches for meaning (and men) in a variety of New Age activities. Lukes divorced parents have arrived from Tallahassee, Fla. Arlene (Kathryn Kelley) is ghting her own demons and the ruggedly pious Butch (Kevin Cutts) willfully ignores the signs that his son is gay. As the present-day medical drama unfolds, ashbacks move uidly through time, tracing how the two men meet, move in together and negotiate the many compromises necessary in any relationship. Unfortunately, the heavy-handed production at Round House Theatre frequently tramples on Nauffts nely wrought structure and delicately crafted language. Where the scenes should ow seamlessly together, director Mark Ramont and his design team stop the action cold after every scene with slow fades, overwrought music and awkward set changes. These painful transitions stop the play in its tracks, leaving the actors to struggle to regain their momentum when the action resumes. This fumbling treatment also extends to some of the acting. Kelley struggles unsuccessfully with the role of Lukes troubled hardscrabble mother Arlene who abandoned Luke when he was a toddler. She never nds her way through the complex vocal and emotional shadings of the character, missing the potent combination of desperation and guilt and anger that fuel the character and ghting against the complex rhythms of the dialogue. Luckily, Story and Dinolfo bring passion and electricity to the central characters. The openly gay actors display an easy physicality in their onstage relationship. We see the deep physical and emotional bonds that pull them together and we also see the tense spiritual doubts that push them apart. Luke desperately and sincerely wishes that Adam could nd faith so they can spend eternity together. Adam hates the fact that Luke prays for forgiveness after they have sex and refuses to come out to his parents. Story and Dinolfo make these tensions palpable and draw us into their compelling story.

The Our City Film Festival, started by Yachad, a D.C. non-prot committed to affordable housing and community development, is Saturday and Sunday. Paris is apparently a lucky name for singer Chris Willis. The Ohio-born singer/songwriter had a great run in contemporary Christian music in the 90s; one of his biggest gigs was working as a backup singer for gospel legend Twila Paris on her seminal 1993 Beyond a Dream Tour, though later he established himself as a go-to session singer and had his own gospel album out. Later in Paris, France he collaborated with French producer/DJ David Guetta and the two enjoyed an unusually rich partnership that resulted in the No. 1 dance hits Love is Gone, Give it All You Got (both 2007) and Gettin Over You, a 2010 collaboration with Fergie and LMFAO. Now Willis, who essentially rebuilt his music career from scratch after coming out around the new millennium, is branching out solo once again. His hit Louder (Put Your Hands Up) was a No. 1 hit in 2010 on the Billboard dance chart. Last years Too Much in Love went to No. 4. Last month it went to No. 1 on the DJ Times Dance/ Crossover chart. Theyre both on his latest EP Premium: Songs From the Love Ship, vol. 1, which dropped in November. Hes planning two more installments and spends about three weekends a month on the road, performing 30-minute sets in dance clubs all over the world. Hell be in Washington on Feb. 21 for a media blitz, though no performances are planned. He remembers a pivotal turning point during a break in performing on a cruise ship in the late 90s the feelings are eerily similar to those shared by many other gays who grew up in evangelical Christianity. I was always thinking, How do I
reconcile this with what I hear in sermons and what I read in the Bible, Willis, 43, says during a phone interview from his Atlanta home. All those years living in the closet I tried to pray it away and lived with all this doubt, guilt and shame. I couldnt reconcile the process either. It felt odd in a way because to a degree, I always had a certain sense of peace in my soul. I had to really learn to adopt a philosophy that there are no mistakes and for whatever reason, this is the hand Ive been dealt. I started to realize that nothing positive was ever going to happen unless I accepted it. Despite the inner struggle, Willis says he enjoyed his years in Nashville working with gospel acts like Paris, Mark Lowry, Amy Grant and others (hes also cut vocals for Dusty Springeld, Ricky Martin, Kelly Rowland and Quincy Jones). He considers several of Grants former back-up singers such as Donna McElroy, Vickie Hampton and Kim Fleming, dear friends who helped him network wildly in the 90s. I have such respect for those years and that time, he says. It was a great grooming period for me and though it was tough personally and internally, I learned to take the good with the odd and bad and embrace and appreciate the whole pie. After moving to New York, he started to rebuild his career almost from scratch. He had almost no contact with people from his Nashville years and says theres almost zero crossover between the gospel and electro/dance industry brass. Never mind that the industry paradigm was, of course, crumbling around him he did one album for Warner Brothers that was shelved. His second, an eponymous 1996 release, did modestly well on Star Song, an imprint eventually bought by EMI. Willis met Guetta in Miami in 2000. They clicked musically and Willis is featured on the title cut to Guettas 2002 debut, Just a Little More Love. It was only a modest international hit but it was the start of the second major phase of Williss career.

D.C. tradition continues with Wednesdays Love Letters event

When John Arundels 9-year-old recently mentioned plans to follow in his fathers journalistic footsteps, the Washington Life Magazine associate publisher didnt tell the precocious reporter to pick up a pen. He told him to grab a book. I told him he couldnt be a journalist unless he stepped up his reading and read every day, says Arundel, an LGBT community ally and one of three local journalists who will read from literary works they love at an event to raise adult illiteracy awareness in Washington. The Washington Literacy Council hosts its annual Love Letters for Literacy fundraiser Wednesday. Now in its 19th year, the fundraiser and reception showcases the areas top broadcasters, journalists and authors: Arundel will join Andrea Roane, an anchor at WUSA 9, and Washington Post writer Ruth Marcus. Proceeds will help the nonprot relocate and launch a branding campaign aimed at raising its prole and connecting more Washingtonians with reading help. The group estimates roughly 38 percent of the citys adults have very poor reading skills. About 200 attended last years dinner. The need is great and we want to raise our capacity to help meet it, says Helen Dalton, president of the board of directors at the council. The event will include a dinner, a silent auction and an award ceremony recognizing champions of literacy. But the highlight is arguably getting to hear local celebrities share some of the literature that shaped their careers and lives. For Arundel, the book choice was obvious. The New York Times veteran will read from The Kingdom and the Power: Behind the Scenes at the New York Times: The Institution That Inuences the World, a journalism classic by Gay Talese. Like Talese, I came to the New York Times in 1989 fresh out of college as an entry-level copy boy and spent two years covering the gritty underbelly of New York, Arundel says. It was a great education. The experience marked a seminal point in a journalism career that began with a kids column in the Fauquier TimesDemocrat in Warrenton, Va. I wrote about skateboarding and all the things that kids like to read about, he said and has taken him through stints at The Miami Herald and The Washington Post. He now covers the philanthropic world at Washington Life, a publication he says has ties to the Human Rights Campaign. Over the years, Arundel has watched as the rise in online media has dimmed the fortunes of larger publications like the Times. Nonetheless, Arundel believes the online revolution will ultimately prove to be a good thing. The positive side of all these blogs and this move toward self publishing is that there are more voices out there, so denitely its more of an opportunity for the LGBT community to expand its voice, he says. The Washington Literacy Council wants to ensure that more people can understand that voice. The councils 100 volunteers provide one-on-one and group tutoring, computer training and job coaching to roughly 140 students each year, Dalton says. This years Love Letters event, sponsored by the Washington Blade, coincides with a revamp of the group. The nonprot will move from a location in Adams Morgan to a spot along 12th Street. Group leaders also will announce plans to change the groups name to the Washington Literacy Center and unveil a new motto playing off their initials: Where Lives Change.

Give it to me Straight
Notions of human sexuality came in Victorian era
who needed to be weeded out. Suddenly, what others were doing in the bedroom became a big deal. Serious names for every sexual activity, as well as judgments for them, were topics of hushed conversation and extreme care had to be taken to remain on the good side of gossip. Anything other than normal sexual relationships were considered immoral, though it was extremely common for same-sex couples to share a bed and nobody gave it a thought. Freud weighed in with his ideas. Other scientists followed suit, and by the 1950s, heterosexuals were everywhere, many ushered into marriage because it was expected of them. After all, wedded bliss was the only respectable allowance for having sex, and sex was only for procreation. And then came The Pill. But all this history begs a modern question: because we know now that there are more than two categories of human sexuality on the spectrum, does anyones sexual identity really matter to anybody but that individual? Who cares anymore? Blank says that, of course, it depends on who asks. Straight is, well, its pretty straight, and probably not the kind of book youd pick up on a lark, although author Hanne Blank does occasionally employ a sense of the absurd in her accounting of the history of heterosexuality and everything it wasnt. For casual, time-starved readers, though, that might not be enough. What Blank says runs somewhat deep and semiphilosophical, with solidly based research and biographical examples. These things are tempered by Blanks sharp-as-an-ax wit, but that doesnt lessen the fact that this book begs to be pondered. Still, if youve ever wondered how we got to this point in our bedrooms, you really cant miss it. If youre heterosexual (or know one), reading Straight is a good decision.

For most of your life, people have been making decisions without you. When you were born, for instance, they decided whether you were a boy or a girl (based on obvious visual clues). Because of that, they hung a gender-specic moniker on you, dressed you in pink or blue, cuddled you more or less and gave you certain toys accordingly. Consequently, people presumed your sexuality before you were able to conrm or deny it. But contemporary notions of sexuality and gender identity which seem so entrenched to us here in the early throes of the 21st century are actually a rather recent phenomenon, as explained in the new book Straight: The Surprisingly Short History of Heterosexuality by Hanne Blank. For most of human history, people were just people, un-pigeonholed. There were no heterosexuals prior to about 150 years ago, nor were there homosexuals. Love existed, of course, as did various sexual desires and behaviors, but terms and categories describing humans themselves did not. In 1868, a Victorian-era writer coined the word heterosexual and there we are. Those Victorians, says Blank, were a randy bunch who loved to be titillated so we shouldnt be too surprised at their prurient interests, especially that which concerned the maintenance of manly virtues and the dening of deviant behavior of the lower class. Local gay outt enjoys learning ballroom steps

Just like many of us who have competed in the Gay Games, Terry Chasteen, founder of Lambda DanceSPORT DC, experienced a life-changing moment at his rst Games experience. Chasteen headed to Amsterdam in 1998 to compete in same-gender dancesport which was being contested for the rst time in the history of the gay games. I went there with no dance partner, says Chasteen, but they ended up pairing me with a gentleman from South Africa. Without much practice, the duo was able to dance their way into the seminals in Latin dance. Dancesport is huge in Europe and there many same-gender dance organizations such as Equality dance, Chasteen says. The ovations the crowds were giving us and the other dancers were amazing and it was denitely a life-dening moment. At the Gay Games, dancesport is contested in three different dance disciplines, country, Latin and ballroom. The duos place themselves in one of the ve skill levels and are then graded before the competition begins to ensure proper placement. Chasteens path to dancing began through an elective dance class at Ohio State University. That led to giving dance lessons at Fred Astaire Dance Studios outside of Columbus, Ohio. He has taught lessons in the D.C. area for the last 17 years and founded Lambda DanceSPORT DC in 1996. The group offers training in ballroom, Latin, country western, hustle, Argentine salsa and many more. Dancers meet for lessons every Wednesday and Sunday from 3 to 11 p.m. along with an assortment of other days. Same-gender dancesport is different from the conventional version, Chasteen says. The same-gender dancers have to learn both roles as they switch leads throughout the dance. It really makes you a better dancer knowing both sides. The group moved its dance training from the Chevy Chase Ballroom to The Church of the Pilgrims near Dupont Circle in October after the Ballroom came under new ownership. The new venue is just perfect for us, he says. We even have the ability to serve refreshments and desserts during our special events. Recently the group offered social dances on Thanksgiving, Christmas and New Years with more to come this year. On the competitive side, Chasteen is hoping to send as many as 20 dancers to Cleveland in 2014 for the next Gay Games. In the meantime, there are possibilities of going to Houston for a country western event and Philadelphia for a ballroom event. The popularity of Dancing With the Stars has affected the Lambda group positively. It gets a new wave of members each season. Some call asking to take lessons in the varieties they see on the show. And the group can be a subtle form of activism members enjoy performing at straight venues where they often wow observers with their ability to dance both parts. Coming up this year for Lambda DanceSPORT DC is a 12-hour Learn-ToDance-athon with all proceeds being donated to each dancers designated charity. It will include different workshops by different teachers in all dance styles. Following the workshops there will be open dancing and practice in that style for 30-45 minutes before the next session begins. So, you think you can dance? and have a bunch of variety, Lombardi says. Were going to try to do some more indie queer stuff and some more off-thewall events in that back bar too. They are also working on getting the D.C. Kings and the D.C. Gurly Show performing at the new location. All the people that have supported us at the old Phase ... we would love for them to come to the new venue, Lombardi says of the performance groups. They might have some monthly events, but for the most part, the club will only be open on Thursdays, Fridays and Saturdays. One new weekly event is already planned. Steve Dellerba, longtime manager and one of the part owners of Ziegfelds/Secrets, which Carroll owns as well, will be running Jock U, an event that will cater to men. It will be open to everybody, but it is a mens night, Dellerba says. With the club being predominately for women the other night, we wanted one night geared toward the men and give something back to them. The weekly event will feature a rotation of DJs including Randy White, DJ Wess, Joey O and more and the bartenders will be wearing athletic attire such as wrestling, football and soccer gear. For the kickoff party on Thursday, DJ Steven Henderson from Chicago will be in the main room and there will be an amateur DJ competition in the video room, the winner of which will win a free night at Secrets on the main oor. We wanted to nd some new talent, Dellerba says. We had ... a lot of guys coming out who wanted to play so we said, why dont we just let everyone play a little bit and well see whos the best. The night will also feature go-go boys, Absolut shot boys and a few special
surprises throughout the night. The kickoff will be sponsored by Universal Gear, Absolut, Red Bull and Cherry 2012. For the most part, Phases Jell-O wrestling events will remain at the original location, except during Pride season. It was so insane this year at the old location, that we probably will take it to the new location, Lombardi says. The new location will probably bring some changes to PhaseFest, the bars annual indie queer music fest, this year as well. The rst night will most likely stay at the original location but then Friday and Saturday night will be at Dupont. Were kind of already talking about it, Lombardi says. Having such a higher capacity venue really opens up the door to having some really big names. It should give us a lot more wiggle room and more options to really see how big we can take it this year. Like the original, the Dupont location will be a 21-and-older club. I feel their pain, Lombardi says of the younger lesbians without their own place to party. I know that Apex successfully did it, but its just not something [Carroll] really wants to take on. Lombardi will be co-managing the new location with Dellerba and says she will miss the original location. Ive been there for seven years, Lombardi says. Basically, everyone who works there is my family on some level. I like being behind the bar. Its going to be kind of weird and different managing a club of this size. The Dupont location doesnt mean she wont be at the original Phase. Lombardi will still be found there every Thursday night and on Sundays for special events. Those two days back ... are gonna keep me grounded, she says.

By Pablo Lopez and Jennifer Farley Living in Washington, DC, one cant help but notice the impressive history all around you. From the imposing monuments to the brilliant Federal buildings, residents and visitors alike have the chance to journey back in time and be inspired. Walking the streets of DC, a singular, evident feature of our Nations Capital is the breathtaking array of historic homes throughout our City each with a different story to tell. We, at Apache Design Build, LLC, believe that preserving our city and its history is very important, and knowing the history behind a property makes the restoration process all the more meaningful and enjoyable. This is the first of a series of six articles in The Washington Blade focusing on historical restoration presented as a way of introducing proper historic standards, our practices and philosophy, and the company itself. This series will briefly explain two of our more interesting restoration projects, and will contain some historical facts, as well. himself above the level of builder.1 Fleming did not simply copy fashionable houses, but his designs came from a combination of traditional and contemporary influences.2 Despite his lack of formal training as an architect, Fleming created unique plans by a type of cut and paste method.3 Flemings hands on knowledge helped him to design more cost effective homes in a unique way. The skill is exemplified in 1525 O Street and five other row houses, built in 1884 on speculation for Curtis J Hillyer, Fleming positioned the stair in the hall as was customary, but used an L shaped stair allowing a much wider parlor.4 The scope of work for this restoration project was as follows: Restore brick faade, point up brick, remove old windows, build new window replicas with slight modification to width to allow for true divided lights and double pane argon gassed filled glass, remove interior case work, mill new replica casing, install new window replicas, install new window casing, remove front doors, build new door replicas out of mahogany, install new door replicas, restore door jamb in place. The window replacement portion of this project was done in phases, since the owners wished to occupy the home during the restoration process; we agreed to execute the project in phases. We first removed one window in order to strip it down and determine the precise joinery and layout used to construct the originals. We drafted prints of the windows and sent them to our woodshop, located in Cumberland, MD. Unlike some of Flemings more traditional designs, the front windows were systematically constructed to frame the viewers gaze. The upper sash makes an attempt to direct the residents sight through a central pane, while surrounding it with sixteen individual rectangles. This quadrangle pattern builds up on itself until the resident can see an infinite number of geometric layouts in the framing. Comparative to the art of stained glass, these windows are inlayed with wood mullions instead of lead, and the apparition of beauty is achieved through shape instead of color. The original windows had single pane glass, so, some slight modifications had to be made to accommodate a more efficient low-e argon filled glass. We decided to use a stronger wood than the original yellow poplar. Spanish cedar, which has very high sap content is very resistant to weathering and is a very strong. Because Spanish cedar weighs more than Yellow Poplar, we were not able to reuse the weights used to counter balance the sashes. A properly balanced window will stay in which ever position the operator places it, and should glide up and down with great ease. The pulleys used to carry the weights were originally steel; we upgraded them to solid brass pulley with brass chains. In the shop we built and assembled all of the wood components of the windows, once this was complete we began to mortise, drill, and cut all necessary pieces to accommodate the hardware and glass. When all components were fabricated correctly, we then disassemble the windows and begin the finishing process. Most builders would finish the units once they are assembled; disregarding the fact that it is a very low quality procedure. We would never allow this on any of our projects. If you finish a piece while it is assembled, then all of the areas of the wood not visible to the eye remain unfinished and unsealed. This allows moisture to seep into the wood once a caulk joint fails, or the paint cracks. We always make sure that all surfaces are sealed before assembling any woodworking. The original windows where finished with an oil based paint. Due to its durability and smooth finish, oil base is the most desirable finish for this project. Because oil base is harmful to the environment, and toxic as well, we used special water based paint called a DTM. This paint finishes just like oil based paint. It dries hard and lays down smooth. Only a trained eye could tell the difference. Once the components where properly sanded, primed, and painted with two coats, we then began to set all the panes of glass one by one, using a special silicone with a mold resisting agent. The silicone is applied to the wood face of the stop where the glass will make contact. The glass is dropped into place and the wood stop is pressed against the glass, ejecting the excess silicone, ensuring a proper bond. The wood stop is pin nailed into place in order to temporarily hold the glass in place while the silicone sets up. The bond is so strong that once the silicone is dry, you would have to break the glass in order to remove it. Wacky shades or blah and boring? Sometimes it makes sense to paint before selling even if youre moving out

When I grow up I want to be the person who names paint colors. Did you ever wonder whose fertile imagination came up with shades like volcanic blast or ddle leaf? And what was going through the mind of the men or women who coined American anthem, grandiose and mythical? Was soulful music the outcome of an evening spent with old Billie Holliday LPs? Real estate agents have been advising sellers to neutralize their homes for years. In many parts of the country, this still means painting your walls builder beige or winter snow, but in the D.C. market where beige equals boring, the infusion of color in a room can be a critical aspect of preparing a home for sale. D.C. is a city of transients, where many people accept their government and corporate transfers and move on to their next location before their home is sold. My out-of-town buyers are always surprised to nd that so many of the homes we tour are vacant. While homeowners tend to paint their walls to complement their furnishings, once those items are removed the home can look disjointed. A prospective buyer may never know how fashionable the original room looked and will focus only on a color that no longer makes sense in an empty setting and may even appear garish on its own. Fresh paint gives a buyer the impression that a home is clean and well cared for, but beige and white are frequently considered pass. Decorators and television hosts now insist that our homes be painted in sophisticated neutrals with names like moleskin and wheat germ. Stealth jet is the new black. Imagine you have been asked by your agent to repaint the living room in a nice, neutral color. What the heck is a neutral, you ask? Arent the Victorian and Hunt Club palettes more sophisticated? Must I now avoid the bold sangria that promotes a healthy appetite in the dining room or eschew the calming effects of fresh guacamole in the kitchen? What a conundrum! You go to the local home improvement or paint store and are immediately engulfed by a dizzying array of colors, shades, tints and manufacturers. Overwhelmed and frustrated, you buy a couple of tester-sized bottles that line the counter and spend the rest of the afternoon painting nail polish-like stripes on the living room wall, babbling softly to yourself. Need help? Well, let me suggest a few color combinations I have used that have received positive reviews from sellers, buyers and stagers. An Earth tone like Gliddens whispering wheat is very popular. Deeper and warmer than beige, it serves as a calming color for hallways and bedrooms. Pair it with warm caramel, a slightly darker shade, in the living room for a striking contrast. Are your kitchen cabinets white? Then take the walls a step darker with gentle fawn and watch your cabinets pop. For a slightly cooler tone, try Durons simplify beige in darker rooms, graduating to sand dune in lighter rooms, then to

trusty tan in the brightest or largest room. Want something dramatic to set off that red sofa and those stainless steel light xtures? Take a look at McCormicks ice age (light), platinum plate (medium) and cast in stone (darker). These are also great colors to offset an exposed brick wall for an industrial look. Keep things simple by painting ceilings and trim white. Use semi-gloss paint on trim, satin or eggshell on kitchen and bathroom walls and at paint everywhere else for a professional look. Remember that green tones will make you look jaundiced in the bathroom mirror
and that decorative paint treatments such as Venetian plaster, marbleizing and rag rolling are best left for your new home. Need more suggestions? Talk to your agent, decorator or home stager. Exploring nuances of home ownership

Married couples have legal provisions that can protect property

Valentines Day makes most people think of intimate evenings for two. It makes the lawyer in me think of the different legal status of couples as compared to individuals. Romantic, right? Maybe not, but there are important differences under the law between married couples and individuals. With the District having recognized same-sex marriages and Maryland considering proposed legislation to do the same, the rights of married couples is taking center stage throughout the community. While the legal implications of marriage are many and varied, there is one that is important to anybody who is concerned about losing to litigation what he or she has earned through hard work and effort. Under the laws of Maryland and the District, married couples, and only married couples, can own property as tenants by the entireties. While the ner legal implications and details of owning property as tenants by the entireties can get extremely complicated (my rm recently won a case before D.C.s highest Court where one of the main issues concerned this form of ownership), the broader picture is clear. With respect to creditors, the married couple owns property together and concurrently. Unique to property owned in this way, the ownership cannot be divided as long as the couple remains married and wants to continue to hold the property as tenants by the entireties. It is based on the legal ction that a married couple is a single unit, not two individuals (and they say romance is dead in the law). Why is this important? With other forms of ownership the interest of each party can be separated and the interest of one party liquidated to pay debts. For example, imagine two unmarried people each of whom owns half of a home they live in together. If one is sued and loses, the party who won the lawsuit can often force the sale of the family home and keep half of the proceeds. The other half of the proceeds from the home would then go to the original owner who was not sued. With tenants by the entireties, this is not so because the interest of the two cannot be divided. If the couple from above were married and owned the house as tenants by the entireties, the family home would be safe from creditors of either of the two. It would only be at risk if both were liable on a debt because then the creditor could take the marital units undivided interest from the marital unit. Thus if one of the owners were sued and lost, the family home would remain with the couple. This is an extremely valuable tool in asset protection and we recommend to many of our married clients that they title their possessions as tenants by the entireties. Unfortunately, many people do not understand the implications. I have had many clients come to me after they had transferred property that they had owned as tenants by the entireties to one of the two spouses because the other had been sued. Their reasoning was that the property would be safe from the new creditor because the one being sued no longer owned it. However because of the implications of ownership as tenants by the entireties, the property had already been safe. The transfer only raised red ags about fraudulent transfers and actually put the property at greater risk. Is ownership as tenants by the entireties a silver bullet that will protect all your assets from everybody? No. It will not protect your assets from certain debts, like taxes, or joint debts. And certain property is more difcult than others to protect in this way. In the same-sex marriage community, there are other issues, such as what happens to property held in states that do not recognize same sex marriages. At least one court has ruled that a same-sex couple cannot protect property as tenants by the entireties, even though the couple were lawfully married in a state that did recognize their marriage. Despite these issues, owning property as tenants by the entireties can be a powerful tool in asset protection. Not romantic, but worth thinking about.
