Calmwater Shores CTS 30203 Parking Infringement Policy.

This policy is formed as a result of the approved motion under item 15 of the Calmwater Shores Body Corporate Committee meeting held on 24 Feb 2010 which voted to introduce a policy to enforce by-law 6 as listed in schedule C of the Community Management Statement for the Calmwater Shores Community Title Scheme 30203. This policy is consistent with those employed by other similar estates. OCI Security will have the task of enforcing this policy on behalf of the Body Corporate. The owner of any vehicle found to be regularly (3 or more occasions) contravening by-law 6 in any 7 day period will be issued a written infringement notice either personally or by placing the notice on the vehicle. The infringement notice will record the vehicle registration and the date of issue. It will also contain information on the offence and ask the owner to move their vehicle. The infringement notice will also contain a warning that failure to comply may result in their vehicle being towed and subject to a release fee. Three (3) such warnings will be issued to continuing offenders and labelled as First Notice, Second Notice and Third Notice. Following the Third Notice within a 3 month period the offender will receive a letter on OCI letterhead warning that as they have received three warnings a repeat offence will result in their vehicle being towed by Queensland Parking Technologies and subject to a release fee (currently $330) for which they will be responsible. After repeated offences and having been issued the three warnings OCI Security will contact the QPT duty manager on 0432 301130 to arrange removal of the offending vehicle.

OCI Security will keep a record of offending vehicles and details of notices issued. The intent of this policy is to keep the roadways within the Calmwater Shores estate as clear as possible to allow the safe flow of traffic, improve visibility for drivers of hazards, ensure safety of pedestrians and children and to maintain a tidy appearance within the estate. It is not the intent of the policy to target ad-hoc visitor parking or the occasional vehicle left parked on the roadway. As all dwellings within the estate contain at least one double garage and all driveways are capable of accommodating 2-4 vehicles it is not considered that compliance with this policy would be difficult however the committee may consider extenuating circumstances on application.
