Brief Facts:

The complainant is P. Ramesh Reddy, Drug Inspector appointed U/s. 21 of Drugs and Cosmetics act, 1948 working in Proddatur. He is empowered to launch prosecution U/s 32 of Drug and Cosmetics act, 1948. The accused K. Sri NagaSunil Kumar is resident of house bearing door No.16-146, Vedurla Bazar, Pottir Sreeramulu Street. On credible information received during raids of UN licensed premises that the accused is stocking and selling physicians samples, the complainant on 31-12-2011 along with two other Drugs inspectors 1. Chittor 2.Tirupati, previously secured two private witness namely G. Bala Chandra and T. Srinivasulu and went to said shop at 10-25am. Searched in presence of accused and found various card board boxes in the First Room and Second Room of the House. On verification of boxes they found various drugs with additional stamping as physician samples not to be sold. Out of these drugs Complaint lifted two drugs for analysis in Form-17 and 17-A, as the shop did not have license to deal drugs and accused failed to inform source of drugs, the complainant seized the 1 variables of drugs, issued a receipt in Form-1 for seized drugs to accused and sealed drugs into 12 card board boxes with panch slips pasted on them, under the cover of pancha name. The Complainant issued a notice U/s. 18A & 22(1) (cca) for source of supply of drugs/ purchase bills to the accused under acknowledgement. On 31-12-2011 the complainant not received reply form accused stating that he does not have details of persons from whom he purchased drugs requested 5 days time.

On 31-12-2011 the complainant brought to the notice of the Honorable court of I additional Magistrate of First Class, Proddatur got produced seized properly before this Honorable Court and obtained orders for safe custody. On 02-01-2012 complainant received reply from accused stating that K.T. Reddy very known person. He have stored seized drugs in the premises for Medical camp purpose. He was expired on 17-12-2011. Accused not handed over medical camp purpose drugs to K.T.Reddy, Because of he was expired. The items seized from accused are drugs within the definition of section 3(b) of drugs and Cosmetics act. As per section 18(c) no person shall sell , stock or exhibit or offer for sale of distribute without a license and thus the accused contravened said section punishable U/s 27(b)(ii) of the act. As per section 18 Avery person shall dosclese the name. address and other particulars of the person from whom the drugs are acquired and this accused contravened said section 22(i) (cca) every person is bound to produce records/documents but the accused failed to submit hence contravened said section punishable U/s 22(3) of the act. Hence the honorable court is prayed to take the case on to the file and the accused be dealt accordingly.
