JEFFERSONCOUNTYPERSONNELRULESApril14,2011Section7:EmployeeConductpage27Section7: EmployeeConductA.Harassment1.TheCountystrivestomaintainaworkingenvironmentthat encouragesmutualrespectandpromotesprofessionalandcongenialworkrelationships.Allemployees areexpectedtoberespectfulofothersandrefrainfromconductthatisinappropriateintheworkplace. Harassmentisexpresslyprohibitedandwillnotbetolerated. 2.Definition a.Harassmentisdefinedasverbalorphysicalconductthatdenigratesorshowshostilityoranaversion toanindividualbecauseofhisorherrace,nationalorigin,religion,gender,age,sexualorientation,or disabilityandthat: *Createsanintimidating,hostile,oroffensiveworkenvironment, *Unreasonablyinterfereswithanindividual'sworkperformance,or *Adverselyaffectsanindividual'semploymentopportunities. b.

Sexualharassmentisdefinedasunwelcomegenderbasedverbalorphysicalconduct,includingsexual advancesandrequestsforsexualfavors,where: *Submissiontosuchconductisanexplicitorimplicittermorconditionofemployment; *Employmentdecisionsarebasedonsubmissiontoorrejectionofsuchconduct;or *Suchconductunreasonablyinterfereswithanindividual'sworkperformanceorcreatesan intimidating,hostileoroffensiveworkingenvironment. 3.Reporting a.Allemployeesareresponsibleforreportinganysuspectedharassmentorretaliation. b.Anemployeewhobelievesthatheorshehasbeensubjectedtoharassmentshouldreportthematter promptlytohisorhersupervisor,orifthesupervisorisinvolved,anyothersupervisorinthe Department,DivisionorOfficeordirectlytoHumanResources.Thosewhoreceiveareportmustrefer thecomplainttoHumanResourcesattheearliestopportunity.Ifthecomplaintisdirectedtowardan employeeinHumanResources,thecomplaintshouldbereferredtotheCountyAdministratororthe CountyAttorney. c.Thereportmaybemadeverbally,viaemail,orinwritingandshouldincludeallfacts. d.Informationaboutharassmentcomplaintswillbesharedonlyasnecessarytoinvestigatethematter, totakeanyappropriateaction,orasotherwiserequiredbylaw. Investigationa.Allreportedoccurrencesofharassmentasdefinedabovewillbepromptlyand thoroughlyinvestigated. b.Thenatureandlengthoftheinvestigationwillvarydependinguponthedetailsofthereportandthe circumstances.Theinvestigationmayincludeinterviewswithinvolvedemployees,includingthealleged harasserandthoseemployeeswhomayhaveknowledgeoftherelevantfacts. c.Managementwilltakepromptandappropriatecorrectiveactionifitisdeterminedthatanemployee hasengagedinharassmentinviolationofthispolicy. 5.Nonretaliation Adversetreatmentofanyemployeethatisinretaliationfortheemployee'sreportofharassmentor provisionofinformationrelatedtoaharassmentcomplaintwillnotbetolerated.Employeeswho believetheyaresufferingadversetreatmentbecausetheyreportedharassmentorprovided informationrelatedtoaharassmentcomplaintshouldimmediatelyreportthemattertoasupervisorin theirDepartment,Division,Office,ortoHumanResources. B.ViolenceintheWorkplace TheCountywillnottolerateanyintimidation,threatsof,ordirectviolencebyanemployeetowardany employeeorotherinternalandexternalcustomers.Thisprovisiondoesnotapplytolawenforcement professionalsinthecourseoftheiremployment.

C.OutsideEmploymentandBusinessInterests1.NoCountyemployeeshallengageinanyoutside employmentorotheractivityincompatiblewiththeproperdischargeoftheemployee'sofficeor position.EmploymentwithanemployerotherthantheCountyrequirestheapprovaloftheappropriate Department/DivisionDirector,CountyAdministrator,ElectedOfficial,AppointedOfficial,orBoard. 2.ItshallbeaconflictofinterestforaCountyemployeeoramemberoftheemployee'simmediate familytohaveapersonalinterestinanybusinesstransactionwithintheemployee'sareaofinfluencein Countygovernment.Intheeventofsuchaconflict,theemployeeshallimmediatelydisclosetheinterest tohisorhersupervisor,Department/DivisionDirector,CountyAdministrator,ElectedOfficial,Appointed Official,orBoardandimmediatelydisqualifyhimself/herselffrommakinganydecisionsinvolvingsuch businesstransactionorrelationship. JEFFERSONCOUNTYPERSONNELRULESApril14,2011Section7:EmployeeConductpage29D.Multiple CountyPositions1.NoCountyemployeeshallholdmorethanonepositionconcurrentlywithinthe County'spersonnelsystem. 2.Exception:AnynonClerkandRecorderemployeeoftheCountymayactasanelectionworkerfor electionsheldondayswhentheemployeeisnototherwiserequiredtowork.Employeeswhoworkas anelectionworkershallreceiveforsuchservicesonlythepayauthorizedforallelectionworkers, togetherwithanyholiday,vacationorotherpaytowhichtheemployeewouldotherwisebeeligible. E.ConflictofInterestPerceivedandActual1.Employeesshallnotbeinvolvedinaconflictofinterest norcreatetheappearanceofaconflictofinterest. a.Employeesmustreporttotheirsupervisoranysituationwheretheremaybeaconflictofinterestor theappearanceofaconflictofinterest. b.Aconflictofinterestoccurswhenemployeesusetheirpositiontosecureadvantageorfavorfor themselves,theirfamily,orfriends;orwhereanemployee'sprivateinterestsinterfereorcouldbe perceivedtointerferewiththeemployee'sdutiesandresponsibilitiesasanemployee. 2.RelativeEmployees a.ArelativeisdefinedasanyonerelatedtoacurrentCountyemployeeregardlessofposition/status,by blood,adoption,domesticpartnershipormarriage,includingspouses,domesticpartners,children, parents,grandparents,siblings,aunts,uncles,nieces,nephewsoranysimilarsteprelations. b.Itisaconflictofinteresttohavetworelativesinpositionswhere: (l)Arelativedirectlyorindirectlythroughoneormoresubordinatesupervisors,hassupervisory, appointment,ordismissalauthorityoveranotherrelative;or (2)Arelativeaudits,verifies,receivesorisentrustedwithmoneysreceivedorhandledbyanother relative;or (3)Arelativehasaccesstotheemployer'sconfidentialinformationincludingpayrollandpersonnel records. c.EmployeeshaveadutytonotifyHumanResourcesiftheyareawarethattheirrelativeisseeking employmentthatmayleadtosuchaconflictofinterest. JEFFERSONCOUNTYPERSONNELRULESApril14,2011Section7:EmployeeConductpage30d.An employeemayrequestvoluntarytransferofpositiontoavoidoreliminatesuchaconflictorthe Department/DivisionDirector,CountyAdministrator,ElectedOfficial,AppointedOfficial,orBoardmay determinewhatactionisnecessarytoavoidoreliminatetheconflict. e.Exceptions:Thisruledoesnotapplytoanyconflictofinterestbetweenrelativeemployeesthat existedbeforeOctober1,2009andtotemporaryoremergencyemployeeswhoarehiredanddeputized bytheClerkandRecordertoperformworkrelatedtoanelection. 3.CompensationandGifts Allemployeesandanymemberoftheemployee'simmediatefamilyshallcomplywithArticleXXIXofthe Coloradoconstitution.Employeesareresponsibleforensuringthatanygifts,meals,travelexpenses,or otherthingsofvaluethattheyacceptareincompliancewithColoradolaw.

Employeeswhohavequestionsaboutwhattheymayacceptshouldcontacttheirsupervisororthe CountyAttorney'sOffice. 4.PurchasingStandards Employeesshallnotparticipateinselection,award,oradministrationofcontractsifaconflictof interest,realorapparent,isinvolvedasoutlinedinthePurchasingPolicy.(CrossReference: PurchasingPolicy,JeffersonCountyPolicyManual.)F.UseofCountyPropertyEmployeesshallnotuse Countypropertyorequipmentfortheemployee'sprivateuseorforanyotherusenotintheinterestof theCountyexceptasotherwiseprovidedbytheCounty'sPolicyManualortheRules.Employeesare responsibleforknowingandcomplyingwithallapplicableCountypolicies,includingtheUseof InformationTechnologyServicesPolicy.(CrossReference:JeffersonCountyPolicyManual.)G. ConfidentialInformationEmployeesshallnotdisclose,norusefortheirbenefitorthatofanyother person,confidentialinformationthatisnotavailabletothepublic,acquiredbyreasonoftheir employmentwiththeCounty. Thisappliestoanyformofcommunication,includinginformationpostedonsocialnetworkingsites. H.DrugFreeWorkplace 1.TheCountycomplieswiththeDrugFreeWorkplaceActof1988,asamended.TheCountywillmakea goodfaithefforttomaintainadrugfreeworkplace.TheCountyprohibitstheunlawfulmanufacture, distribution,dispensing,possessionoruseofcontrolledsubstancesintheworkplace. 2.EmployeeResponsibilities: a.ItisthedutyofeveryCountyemployeetoreportanycriminalconvictionsfordrugrelatedactivityon personaltimeorCountytimenolaterthan5daysafteraconviction.Thisrequirementismandatedby theDrugFreeWorkplaceActof1988.Uponnotification,theCountywilltakeactionincompliancewith theDrugFreeWorkplaceActandRegulations. Employeesshallreporttoworkontimeandinappropriatementalandphysicalconditionforwork. c.Employeesshallnotparticipateintheunlawfulmanufacture,distribution,dispensation,possession,or useofacontrolledsubstanceonCountypremisesorwhileconductingCountybusinessoffCounty premises. d.TheCountyrecognizesdrugdependencyasanillnessandamajorhealthproblem.TheCountyalso recognizesdrugabuseasapotentialhealth,safetyandsecurityproblem.Employeesneedinghelpin dealingwithsuchproblemsareencouragedtousetheCounty'sEmployeeAssistanceProgramand healthinsuranceplans,ifeligible.Conscientiouseffortstoseeksuchhelpwillnotjeopardizeany employee'sjob,andwillnotbeusedasgroundsfordisciplinaryaction. I.PoliticalActivities 1.EmployeesshallnotengageinanycampaignactivitywhileonCountytime. 2.Employeesshallnotberequiredtocontributecash,gifts,gratuities,timeoranythingelseofvalueto politicalactivitiesortotheelectioncampaignofanyelectedofficialorpoliticalcandidate. Candidatesshallnotsolicitcontributions,directlyorthroughadesignee,ofcash,inkindcontributions, ortimefromtheiremployeesexceptassuchsolicitationsmayoccuraspartofamassmailing,email,or similarbroadbasedcampaignstrategy. J.Safety Employeesshallfollowproperoperatingproceduresdesignedtopreventinjuriesintheworkplace. Unsafeconditionsorbehaviorencounteredintheworkplaceshallbereportedtothesupervisor. K.PersonalProperty TheCountyisnotresponsibleforreplacinganylost,stolenordamagedpersonalproperty. L.InternalSearches TheCountyreservestherighttoconductinternalinvestigationsforpurposesrelatingtosecurity, misconduct,auditing,orretrievalofCountyproperty.Uponitsdiscretion,theCountymay,atanytime,
