March 20, 2012 Dear Twitter Legal: Re: Twitter receipt of legal process - Jeffrey Rae New York Criminal Court Docket No. 2011SN121777 Yesterday, March 19, 2012, this case was adjourned (suspended) on the motion of the District Attorney's Office, with the consent of the Defendant, for six months, at which time it will be dismissed and sealed, unless by that time at some point the New York County District Attorney successfully moves to re-open the case. This has the same effect as granting our motion to quash the subpoena duces tecum for Mr. Rae's Twitter records, unless the New York County District Attorney (1) brings a successful motion to re-open the case during that time; AND (2) the Court then denies our still-pending motion to quash that subpoena. If either of those events should occur, we will promptly notify you. This means that you must continue to withhold Mr. Rae's Twitter records and not comply with the New York County District Attorney's subpoena duces tecum. Unless or until the New York County District Attorney successfully moves to re-open the case, the subpoena for those records is not in force and the New York County District Attorney cannot take any legal action with regard to that subpoena. Accordingly, our objection to the release of any of Mr. Rae's Twitter records is still in force, and you must not release any of his records or information to the New York County District Attorney.
