EXPLANATORY NOTE

I.

DECLARATION OF POLICY: The Constitution of the Prime Movers Society is hereby subjected into a REVISION consistent with the Constitutional Provision, cited at ARTICLE IX, SECTION 1, stating that any member/affiliate may suggest for an amendment provided that he/she must pass a written letter stating the suggested amendment and her/his purpose of amending the Constitution. Thus, the Proponent of the said agenda seeks to bring a large number of amendments to the said Constitution and it is already deemed that a large number of amendments mean that the concept of the Constitution shall be completely changed. Provided, that the Proponent only seeks to resolve the disputes caused by the flaws of the current Constitution and as well as to advance its development for the Organization having additional substance and more detailed to be strategically progressive in establishing order to its structure and its mode of operation.

II.

DEVELOPMENTS: The Highlights of the Revision shall be the following: A. Distinction of the Constitution and the By-Laws In order for the Organization to be progressive its internal structure must be both comprehensive and strategic and such internal structure refers to its legal reference. The Constitution must contain the most vital provisions that must be at all times observed while on the other hand the By-Laws must contain the supplemental provisions to ensure that the main concept of the Constitution shall be implemented. Thus, it is proposed that instead of having only a Constitution, it is deemed necessary to acknowledge the importance of the distinction of the vital and supplemental provisions and it is proposed that ByLaws must be enacted separately from the Constitution.

B. Preamble The Preamble of the Constitution herein provides the concept of the organization and it is proposed for it to be subjected to modification emphasizing the exercise for the right to self-organization and the role of the organization for the advancement of the Social Work Profession. C. Official Location The Location of the Organization shall be stated herein that it is at the designated office for school-based organizations in the School of Humanities and not directly located in the KASAMA/SSC-SoH Office in order for the Constitution to be consistent to all policies and regulations of the University Administration in case the Office of School-based Organization of the School of Humanities would be relocated. D. The Vision-Mission It is important that Vision-mission must be enacted in order for the Organization to have a fixed goal upon the implementation of its objectives thus it is proposed that a Vision-mission shall be provided to the Constitution. The Vision-mission shall embody the aspiration, the main objective, and principles of the Organization. E. Membership In this Revision, the different types of membership were clarified whether Regular, Affiliate, or Honorary Alumni. It is also clarified herein that membership shall be renewed annually. It is further clarified that registration shall take place on the first semester and if there is a need for another registration during the respective term it shall be decided upon the Executive Committee. Provided, that the Proponent included certain provisions on the termination of membership in order for the organization to maintain a good standing of efficient and dedicated members and personnel.

F. Rights and Duties of Members The Rights and Duties of Members are herein proposed to be separated into two articles in order to avoid confusion as well as to specify clearly the rights and duties of a member. Rights of Members shall specifically pertain to the Right to Information, Participation, Suffrage, and to vie for a position in the Executive Committee while the Duties shall pertain to the Duty to abide, uphold, and defend the Constitution and By-Laws, to participate in the operations of the organization, to respect and abide in the decisions of the Organization which are consistent with existing rules and regulations. To make himself/herself available and willing to respond to the needs of the Organization, to exert his/her utmost to develop his/her potentials for general welfare and development, and to serve as a role model as representative and asset of the organization. G. Qualification of Candidates To ensure that all potential candidates are free from any hindrances to vie for an office, it is hereby stated that they must comply with requisites for officership in consistency with existing rules and regulations of the University upon filling their candidacies. H. Organizational Structure In this Revision, it is proposed that there will be three branches existing in the Organization for the purpose of checks and balances. The Executive Committee shall serve as the Executive Branch, Legislative Powers shall be vested in the Assembly of Members, Judicial Powers shall be vested on the Vice President and Year level Representatives which shall serve as a Judiciary Council and in cases that one of the members of the Judiciary Council is involved in a case, it shall be forwarded to the Student Court of KASAMA/SSC. It is also included that there shall be an Associate Secretary and Two (2) additional Business Managers for the purpose simultaneously working out its operations considering their vital role in the development of the organization.

I. Meetings In this revision, it recognized and adapted parliamentary rules and procedures in all its meetings to maintain order for all its transactions. J. Accountability of Officers In this revision, the mechanism of filling complaints was provided. K. Upholding the Constitution and By-Laws The Constitution and By-Laws as the supreme law of the Organization must be properly observed and a duly provided Oath of Office and an Oath of Membership shall be required to affirm allegiance to the Organization. L. General Provision A General Provision shall be enacted for the Emblem that will resemble the organization especially in showing its importance as well as the meaning of its content and its relationship to the Organization as a whole. M. Separability Clause This is to ensure that if ever provisions in this Constitution shall be declared invalid, the remainder not affected shall remain valid and effective. N. Repealing Clause This is to ensure that all statutes and other promulgations hereby that are not consistent with Constitution and By-Laws are deemed superseded and/or repealed. O. Transitory Provisions This is to ensure that upon the revision of the Constitution, an immediate plan of action shall take place for its full implementation. It is also included that the next election of Officers shall be made on the 8th Saturday of the 1st Semester in the next school year.

P. Election This provision ensures that the manner of handling of elections shall be properly done. It includes the creation of an Election Committee, the standard date of every Election, and the mechanism of the Elections as well as addressing complaints concerning the Elections. Q. Tenure of Office It was included in this revision, that the year level representatives shall resume their position in accordance to their respective year levels until the proclamation of the next year level representative. R. The Adviser and his/her Functions The purpose of this provision is to make the incumbent officers and members aware about the functions of the Adviser as well as specifying the relevance of the Adviser in the Organization. S. Standing Committees In order to ensure that the organization is maximizing and is utilizing all its resources, Standing Committees shall be enacted will shall be the official arm of the organization in all its operations. III. RATIONALLE: The Constitution is hereby subjected into a Revision for the following reasons: 1) The Proponent believes that it is proper to provide complete details instead of using abbreviations in order to alleviate if not eradicate unnecessary discrepancies in the interpretation of the Constitution and By-laws; 2) The Revision is more comprehensive and substantial to the members of the organization; 3) The Revision is strategically formulated for the betterment of the organization by providing specific and tangible promulgations guiding the operation of the aforementioned organization;

4) The Revision alleviates if not eliminates disputes from confusing or unavailable provisions; and 5) The Revision is more efficient and realistic consistent with the emerging trends and innovations of this decade pertaining with provisions affecting the mode of operation of the organization. IV. PRAYER : The Proponent of the Revision seeks that the duly promulgated Authorities to give consideration in acknowledging the good intentions as well as the improvements the Revision may cause to the organization, provided that such Revision was subjected into consultation into credible professionals from different fields to ensure its efficiency and stability. Therefore, the Proponent hereby request that this Revision shall be brought into proper analysis and understanding before any deliberation will take place for its approval and that the said duly promulgated Authorities to determine its advantage over the former without prejudice and any personal implication for the said Revision. The immediate approval of this Revision is earnestly sought.
