________________. I. RECITALS A. On or about October 9, 2009, a decree of divorce was entered between ____________ (Respondent) and ____________ (Petitioner). B. Pursuant to paragraph 18 of the decree of divorce, ____________was required to pay attorneys fees. C. Inasmuch as ____________was the attorney representing ____________at the time of the divorce, Respondent was obligated to pay attorneys fees to ____________. D. An outstanding balance of $4,312.99 for attorneys fees Is due and owing to ____________. E. On or about February of 2012, a judgment was entered in favor of Richard ____________ for attorneys fees due and owing by ____________. F. The parties desire to enter into this Settlement Agreement in order to provide for certain payments in full settlement and discharge of all claims which are or might become the subject of a Complaint, upon the terms and conditions set forth herein. II. AGREEMENT The parties hereto agree as follows: 1. Agreement to pay: ____________agrees to make monthly payments of $400, which shall be paid by the 15th day of each month. ____________recognizes that ____________has already commenced payments, having made the first payment of $400 on February 6, 2012. 2. Agreement to file stay of judgment: In consideration of ____________agreement to make the payments called for herein, ____________agrees to file a stay of the judgment for attorneys fees. 3. 4. Entire Agreement and Successors in Interest: This Settlement Agreement contains the entire agreement between the Plaintiff and the Defendant with regard to the matters set forth herein. 5. Representation of Comprehension of Document: In entering into this Settlement Agreement, the Plaintiff represents that it has relied upon the legal advice of its attorneys, who are the attorneys of its own choice and that the terms of this Settlement Agreement have been completely read and explained to it by its attorneys, and that those terms are fully understood and voluntarily accepted by it. 6. Governing Law: This Settlement Agreement shall be construed and interpreted in accordance with the laws of the State of Utah. 7. Additional Documents: All parties agree to cooperate fully and execute any and all supplementary documents and to take all additional actions which may be necessary or appropriate to give full force and effect to the basic terms and intent of this Settlement Agreement. 8.
