Copyright and Usage Copyright of all works associated with this assignment shall be owned exclusively by the Photographer Upon full payment the Photographer licenses the Client to use the photos returned (henceforth PHOTOS) in the following ways: adjusting for print, printing, duplicating, sharing and publishing to the web in perpetuity The Client may not, without consent from the Photographer, sell or use for commercial purposes any of the PHOTOS, nor can they grant these rights to a third party Retainer and Payment The Client must pay a retainer fee (page 1) of $300 to reserve a date; this fee counts toward the total fee agreed upon The retainer fee is non-refundable except as is described in (5) and (6) below The balance of the fee (including that for any additional hours) must be paid on the wedding date Additional Hours and Per Hour Rate The Photographer will reserve and be available for two hours following the session end time (page 1) If the Client and Photographer mutually agree to hours of service outside of the session start and end time (page 1) this will be paid according to the rate for additional hours (page 1) Client Responsibilities The Client should schedule in at least hour, preferably before attendees arrive, for the Photographer to capture details of the venue(s) The Client is responsible for gathering people for group shots, pointing out 'important people' and is recommended to assign someone on the date to assist the Photographer in these ways The Client is responsible for announcing and enforcing their policy regarding other photographers shooting during the wedding The Client must provide to the Photographer, at least two full weeks prior to the wedding, a list of images important to the Client ('shot list'), and any information relevant to logistics for the day of the wedding (phone numbers, addresses) The Client must provide to the Photographer an amount of time he deems sufficient to accomplish the goals as set out by the Client Photographer Responsibilities (i) The Photographer must return to the Client photos that are of a quality similar to those on his website (ii) The Photographer must return a significant number of the photos requested by the Client ('shot list') **Exclusion to (i),(ii): The Photographer cannot be held responsible for failure to meet these if he is prevented from doing so because of: conditions or rules of the venue, guest interference / non-co-operation, or the Client's failure to meet their responsibilities as set forth in (4.) If the Photographer fails to fulfill his obligations due to his own error, equipment failure, illness or data loss he will reduce the total fee (including the retainer fee) to an amount commensurate with the quantity and quality of work returned to the Client The maximum liability for the Photographer is the returning of all fees The Photographer must complete work in accordance with that described in products and services included for the fee (page 1) The Photographer must return the PHOTOS to the Client within 1 month of the wedding date Right of Withdrawal / Re-negotiation If there are substantial changes to details pertaining to the wedding (including but not limited to a change of venue, a change of the date or timeline, a significant increase in the number of guests) the Photographer reserves the right to either attempt to re-negotiate the contract with the Client or to withdraw his services if an agreement cannot be reached. If there are substantial changes to details (as described above) and the Photographer opts to withdraw his services, the retainer fee will be returned at his discretion Any changes to this agreement must be made in writing and approved by both the Client and the Photographer
