Art of the Tender And Indemnity


Workshop: 8:15 9:15 a.m. Applied for 1 CE credit in WI, TX, DE & NC Whats It About? Companies named as defendants in California product liability cases are frequently not the manufacturers of the products at issue. Plaintiffs' attorneys are increasingly reaching beyond manufacturers to pursue distributors, suppliers, wholesalers and retailers for their role in the chain of commerce relating to allegedly defective products. In addition, the alleged injuries in these cases can involve extended latency periods. As a result, the length of time between exposure to an allegedly defective product and filing of a claim can span many years. It is not uncommon for companies to undergo changes in ownership or corporate structure during this time frame. This 1-hour course will provide an overview of California law as it relates to contractual and equitable indemnity, distinguishing between these types of indemnity and identifying the requirements under the law for tendering an insured's defense under both theories. The course will emphasize practical advice for both tendering claims and responding to tenders. Finally, the course will address good faith settlement determinations in California, including their effect on indemnity rights and California procedure for seeking and objecting to such determinations. Workshop Instructors: Mary Watson Fisher - Walsworth Franklin Bevins & McCall, LLP Mary Watson Fisher is the managing partner of the firm's Orange County Office. She supervises a diverse practice of forty-five attorneys and co-manages the firm's four offices. During her six year tenure as co-managing partner, Mary has overseen the firm's growth to nearly 80 attorneys. Mary concentrates her law practice in employment law, travel litigation and business litigation. With extensive experience in representing employers in litigation, she also advises employers on how to best avoid future litigation in employment matters. In addition, she handles premises liability and personal injury matters for travel agencies, tour operators and cruise lines, and defends corporate clients in breach of contract claims and partnership disputes. What The Tweet!: Emerging Issues In The Use And Collection Of Social Media Evidence
Workshop: 9:30 11:00 a.m. Applied for 2 CE credits in WI, TX, DE & NC Whats It About? Like it or not, the use of social media continues to grow exponentially and this method of communicating with friends, colleagues and acquaintances is here to stay. Employers are struggling to come to grips with the impact that increased social media use can have on their businesses while the courts are addressing the privacy claims that are being raised by employees as the lines between work and home time continue to blur. At the same time, savvy claims handlers and litigators are learning that these often candid and unfiltered postings can be a gold mine in defending against a wide variety of claims. This seminar explores the types of evidence than can be gleaned from social media sites and the legal and ethical challenges associated with obtaining and using this evidence. The course will also discuss a number of recent court decisions that have provided some guidance in this emerging area and provide practical advice and tips for claims handlers to effectively use social media evidence to resolve claims. Workshop Instructors: Laurie E. Sherwood - Walsworth Franklin Bevins & McCall, LLP Laurie Sherwood is a partner in WFBM's San Francisco office. Her practice focuses on employment, construction defect, general liability/premises work, travel and tour operator, toxic tort, and public entity litigation. Throughout her career, Laurie has successfully represented municipalities, corporations, manufacturers, distributors, and general contractors/subcontractors in multiple-party and complex litigation. Laurie has also been involved in several trials and has handled numerous mediations involving these types of claims. Her successes include summary judgments, favorable settlements, and obtaining dismissals in a variety of litigation matters. Laurie frequently gives presentations in various areas including employment practices, construction litigation, and toxic exposure. After spending nine wonderful and challenging years as a high school teacher and vice-principal, Laurie sought a new challenge and career. Born and raised in Southern California, she ventured north for law school and now resides in Vallejo, the gateway to the Napa Valley. Over the years, Laurie chaired a local Commission and served as a CASA (Court appointed Special Advocates) volunteer. Currently, she serves on the LMU Alumni Board of Directors and the Sever College of Science and Engineering Executive Committee. Sage R. Knauft - Walsworth Franklin Bevins & McCall, LLP Sage R. Knauft is a partner in WFBM's Orange County general litigation department. His practice areas include business litigation, employment law, construction law, products liability, premises liability, and public entity litigation. Throughout his career, he has successfully represented a wide variety of clients, including private companies and individuals, municipalities, manufacturers, distributors, contractors and subcontractors in complex and multi-party litigation. Sage has been involved in several trials and arbitrations and has successfully negotiated numerous favorable settlements for his clients. In addition to his litigation practice, Sage frequently gives lectures and presentations in various employment law and construction law topics. Defense of Religious Institutions


Workshop: 11:15 12:15 a.m. Applied for 1 CE credit in WI, TX, DE & NC Whats It About? Emerging trends in litigation against religious institutions and clergy, including the recent Supreme Court opinion applying the First Amendment in a clergy employment discrimination claim, Hosanna Tabor v. EEOC. Trends in other significant types of lawsuits will also be reviewed, including claims based on allegedly tortious treatment of members and claims based on alleged misconduct of clergy. Workshop Instructor: Terry M. Womac - Phillips, Akers & Womac. P.C. Mr. Womac is a shareholder in the firm of Phillips, Akers & Womac, P.C. The firm is a litigation boutique serving many areas of Texas, and engaged in the representation of clients in multiple areas of civil litigation. Admitted to the Texas bar in 1976, Mr. Womac is also admitted to practice before the U. S. District Court, Southern, Northern, Eastern and Western Districts of Texas; U. S. Court of Appeals, Fifth Circuit; and the United States Supreme Court. Mr. Womac speaks and writes for numerous continuing legal education seminars, including Professional Education Systems, Inc. 1:15 2:15 p.m. Speaker: J.P. Wieske, Legislative Liaison/Public Information Officer Mr. Wieske was appointed Legislative Liaison/Public Information Officer in October 2011. His duties include supervision of the legislative and public information and communications functions in the agency. Mr. Wieske brings 18 years of experience in working in the insurance industry, particularly in dealing with health insurance issues. Prior to his appointment, Mr. Wieske served as the Executive Director of the Council of Affordable Health Insurance. He joined the Council in 2003 as the Director of State Affairs. The Council is a research and advocacy association of insurance carriers that is active in individual, small group, health savings accounts, and senior markets. In this capacity, J.P. has led the Council's state advocacy efforts and regularly testified before state legislatures across the country. He has also co-authored several publications related to timely health insurance issues. Prior to his work with the Council, Mr. Wieske was the Senior Government Affairs Specialist of a Wisconsin-based insurer. He has a Bachelor of Science degree in Economics and Political Science from Carroll College.

Will include an explanation of the various insurance and loss control methods that are available to help a victim when they have suffered from a breach of data. Speaker: Corey Dunbar, Assistant Vice President - Market Development Manager The Hartford Steam Boiler Inspection and Insurance Company Corey graduated from the University of Delaware in 1992 with a Bachelors Degree in Economics. He has been with HSB for the past twenty years. His career has included roles in underwriting, sales, marketing and client management. In his current role as Market Development Manager, Corey provides market consulting and creates product training solutions for HSB customers throughout the country. He is one of HSBs national keynote speakers for Equipment Breakdown, Data Compromise, Identity Recovery, Business Income and Employment Practices Liability. Corey resides in Macungie, Pennsylvania.

Identity Theft - It Can Happen To You


Workshop: 3:15 4:15 p.m. Speaker: Captain Greg Hagenbucher of the Wausau Police Department Captain Hagenbucher is a Captain with the Wausau Police Department Investigative Division. Employed at the Wausau Police Department for about 28 years. He has an Associate Degree in Police Science, and Bachelors Degree in Public Administration. He is a Graduate of the Federal Bureau of Investigation (FBI) National Academy. He was the Wausau Noon Optimist, Officer of the Year, in 2000. He was nominated Wisconsin Attorney General Executive Officer of the Year, in 2000. He designed and implemented a program forming a partnership between the local police and the Department of Corrections. He wrote an article on the program that was published worldwide in the FBI Law Enforcement Bulletin, 2003. Currently an instructor in interview and interrogation skills and statement analysis. He was a member of the Olympic Security Team in Atlanta, GA, in 1996. Vice President of the Midwest Gang Investigator Association, Wisconsin Chapter, present. Former Field training officer, Co-Director of multi-jurisdictional federal drug/gang task force, an Advisory Board Member: Salvation Army, Marathon County Restorative Justice, Crime Stoppers, and Marathon County Sexual Assault Awareness team.
