NOTICE TO VACATE

Bigmac Ari Choudhuri 60 Arthur St. Missoula, Montana 39421 TO TENANT(S) AND ALL OTHERS IN POSSESSION OF THE PREMISES LOCATED AT: 60 Arthur St., Missoula, Montana 39421 PLEASE TAKE NOTICE that you have violated the following term(s) in your lease and/or rental agreement dated September 20, 2011: Section 2 Paragraph 2. Tenants have received five noise complaints from multiple neighbors within a 2 month period. PLEASE TAKE FURTHER NOTICE that within FOURTEEN (14) days after service of this notice, you are hereby required to perform the aforesaid covenant(s) OR quit the subject premises, move out, and deliver up possession of the same to Peter L. Jackson. Failure to perform aforesaid covenant(s) OR vacate the premises WITHIN FOURTEEN (14) days as required by this notice will result in forfeiture of the lease and/or rental agreement and will institute legal proceedings against you to recover rent, damages and possession of said premises. THIS IS INTENDED AS A FOURTEEN (14) DAY NOTICE FOR NON-COMPLIANCE. THIS NOTICE IS IN ACCORDANCE WITH MONTANA CODE ANNOTATED 70-24442(1)(d). NOTE: If I mailed this letter to you, you may add 3 days to the date of mailing before you start counting the days in the notice period given above. For example, if I mailed a letter giving you a 3day notice on April 2, you would not have to move out until April 8 (April 2 + 3 days mailing = April 5 + 3 days notice = April 8). If I hand-delivered this letter to you, start counting the days in the notice period on the day after you received the letter. For example, if I hand-delivered a letter giving you a 3-day notice on April 2, you would not have to move out until April 5. LANDLORD RESERVES ALL THE RIGHTS AND REMEDIES PROVIDED UNDER THE RENTAL AGREEMENT AND UNDER APPLICABLE LAWS OF THE STATE OF MONTANA INCLUDING BUT NOT LIMITED TO DAMAGES FOR UNPAID RENT OR PROPERTY AND NOTHING IN THIS NOTICE MAY BE CONSTRUED AS A WAIVER OF SUCH RIGHTS AND REMEDIES.
