SRC noted the contents of the letters received from NCTE, HQ.

Important letters from NCTE Head quarters. NOTIFICATION of NCTE, New Delhi dated.01.07.2008 regarding first amendment to NCTE Regulations dated.10.12.2007 Appellate Authority Orders Monitoring of Recognised institutions

The SRC noted the first amendment of NCTE regulation and decided to consider and pass orders on all the pending applications before 31st August, 2008 as per the said regulation.

SRC perused all the orders of appellate authority and decided to implement the directions contained in the respective orders.

The SRC discussed the matter of monitoring of the institutions which been already granted recognition by SRC. The Committee opined that few institutions after obtaining recognition from NCTE are not maintaining the norms and standards as stipulated by NCTE from time to time. Complaints are also being received on defaults committed by the institutions by State Governments of Karnataka and Tamilnadu. The SRC decided to initiate steps in this regard and issue circular to all recognized institutions on the following:1. Transparent procedures and strict adherence to norms are being followed in grant of approval for new institutions/courses. Any good institution seeking to provide quality teacher education, by fulfilling NCTE

norms in letter and spirit would get a fair and positive response. No one needs to fall prey to power brokers indulging in foul and unethical means. 2. All those institutions which have obtained Recognition as per Regulation 2002 and functioning in temporary /rented premises shall have to move to their own permanent building/campuses ( in Pucca, RCC- roofed structures) as per NCTE norms before completion of 3 years from the date of issuance of recognition order, failing which admissions to the next academic session (2009-2010) onwards would be disallowed with no further notice. 3. It has been decided to undertake continuous monitoring of the functioning of the institutions. As part of this process, the institutions would be visited from time to time (including surprise visits) and necessary follow-up action would be taken against erring institutions. 4. The respective affiliating authorities/universities, at their end, are also being requested to monitor the functioning of the teacher education institutions, through their local inspection commissions; follow up action will be taken by the university as well as NCTE. 5. All the institutions are immediately required to launch their web-sites and keep updating their web-sites on regular basis. The web-site should contain, among others, the updated faculty particulars ( with their photographs) at any point in time. Institutions showing false particulars, for e.g. claiming on roll any non-existent faculty or a particular faculty member being shown simultaneously in more than one institutional web-site, would attract immediate punitive action. Such of those erring faculty members who are found to be party to such unethical / illegal practices would also be liable for permanent disqualification and other criminal action. ( A few such cases have been already detected and proceeded with). 6. The application which are complete in all aspects and meeting the requirements of Regulations and norms & standards of NCTE, to be disposed before 31.08.2008 for the Academic year 2008-09. As per Gazette notification Dt.01.07.2008. Further, SRC decided to issue a Press Note also through Press Information Bureau of all the states under the jurisdiction of SRC.

Insisting of Absolute Lease deed from institutions

The SRC discussed the matter of documents pertaining to the land submitted by many institutions which have made applications under Regulations 2002 and Regulations 2005. The majority of the institutions have submitted Lease Deed/Lease Agreement for 30 years or above registered in the Sub-Registrar Office. Whereas, the Lease documents submitted contains the condition of revocability of the lease within 30 years subject to a few clauses. If the lease deed is revoked within 30 years, there will be a threat to the very existence/continuation of the institution, students, staff etc. and the existence of institution itself will be lost. In order to ensure perpetuity of an educational institution and in order to preclude the lingering uncertainity faced by the stakeholders of ongoing programmes at any point in time, it is decided that there should be legally valid Absolute Lease Deed for this building. The Absolute Lease Deed should be UNCONDITIONAL in nature and IRREVOCABLE until the lease period of 30 years or above is completed. Hence, SRC decided to issue notice to all the institutions which are running in the leased land/building to modify their respective lease document to ABSOLUTE LEASE DEED which should be UNCONDITIONAL and IRREVOCABLE IN NATURE until the lease period of 30 or above as the case may be. All the institutions under the category should adhere to this condition and submit revised lease deed documents duly registered on or before 31st December, 2008, failing which action will be taken under Section 17 of NCTE Act to withdraw the NCTE approval and in any case, admissions from the next academic session(2009-10) would be stopped, without any further notice.
