Same-sex marriage opponents claimed
on Tuesday that they have collected
enough signatures to place the issue
before Maryland voters in November.
Derek McCoy, executive director of
the Maryland Marriage Alliance, said
during a Tuesday news conference
outside the Maryland Secretary of States
ofce in Annapolis that his organization
submitted 113,000 signatures. They
have yet to be certied, but the group
submitted more than double the 55,736
signatures necessary to place the states
marriage equality law on the ballot.
The Maryland Marriage Alliance
hopes to collect 150,000 signatures by
the June 30 deadline.

Did lack of money or

In the week leading up to the May 8

banning same-sex marriage and civil
unions, ofcials with the campaign
opposing the amendment said they
believed they had a shot at defeating it.

Gray enjoys LGBT
support amid controversy
Mayor Vincent Gray continues to enjoy
LGBT support amid the ongoing federal
investigation into his 2010 mayoral
campaign that threatens to overshadow
his administration.
He has proven with actions that
our issues are a priority under his
administration, said transgender activist
Ruby Corado.
She spoke with the Blade a week after
former Gray aides Howard Brooks and
Thomas Gore pleaded guilty to federal
charges that stem from allegations
over the use of campaign funds to pay
Sulaimon Brown to verbally attack then-
Mayor Adrian Fenty ahead of the 2010
Democratic primary. Gray has not publicly
commented on the guilty pleas or the
ongoing investigation, but he received
a warm reception at D.C. Black Prides
opening reception on Friday night.
Jeffrey Richardson, director of the
Mayors Ofce of GLBT Affairs, declined
to specically comment to the Blade on
the allegations. He stressed the response
to concerns over public safety, the
development of employment initiatives
for transgender Washingtonians and the
implementation of diversity trainings in
District government are proof of what he
described as the administrations continued
commitment to the citys LGBT residents.
I hope the community remains aware
of so much of the work that has happened
over the last year from the mayors ofce,
said Richardson. Our focus has not
shifted in any way, shape or form.
The Gertrude Stein Democratic Club
endorsed Gray in the 2010 Democratic
primary, while the Gay and Lesbian
Activists Alliance gave the former D.C.
Council chair an 8.5 out of 10 rating.
We worked really hard to promote his
campaign, said Corado. He was good
on his word. When Fenty was in ofce, we
did the same thing. And when he went
into ofce it was hard to talk to him.
Gay Democratic activist Lane Hudson,
who backed Fenty in 2006, helped
Gray raise money from LGBT donors.
He further applauded the mayor for
nominating transgender activists Earline
Budd and Alexandra Beninda to the D.C.
Commission on Human Rights in April.
He has a lifelong commitment on LGBT
equality, going back at least to trailblazing
the fair treatment of transgender youth
when he was executive director of
Covenant House, said Hudson. There is
no danger of his legacy on LGBT issues.
While Gray supporters are quick to
point out that they feel he is the most
LGBT-friendly mayor in the citys history,
they continue to await the outcome of the
investigation.
The mayor is doing a great job running
the District, said gay Democratic activist
Peter Rosenstein, who endorsed Gray
in 2010. I am amazed at the stupidity of
what was done in the campaign, but am
waiting for the U.S. Attorney to nish his
investigation before I am willing to think
that the mayor himself was involved.
Anyone proven to be guilty, and that
would include the mayor if he is, should
be punished.
Corado added she remains worried
about whether Grays successor would
respond as well to LGBT Washingtonians
concerns if he were to leave ofce.
As members of the LGBT community,
I hope that we continue to support the
mayor, she said.

STAFF REPORTS
Activists to launch hate
crime reporting project
Anti-violence activists have begun to
lay the groundwork for a project they
maintain will provide a more accurate
count of the number of anti-LGBT hate
crimes and incidents of domestic violence
among same-sex couples in Washington.
The initiative would allow victims to
report attacks to service providers without
going through the Metropolitan Police
Department. Gays and Lesbians Opposing
Violence, the D.C. Trans Coalition, the
Rainbow Response Coalition and other
member groups would enter information
about crime victims, the location in which
their assailants attacked them and other
demographic information into a database.
GLOV Vice Chair Hassan Naveed told
the Blade that the project remains in the
preliminary planning stages. Rainbow
Response Coalition Treasurer Paul Ashton
said that the coalition hopes to send its
initial data to the National Coalition of
Anti-Violence Programs at the end of the
year. NCAVP would then use it in its 2012
report that it will release in 2013.
This would mark the rst time that the
agency would include District-specic
data on LGBT bias-motivated crimes
and domestic violence among same-sex
couples in its annual publication.
We can actually capture in our
community what it looks like and determine
who is a survivor of a hate crime, who is
a survivor of intimate-partner violence,
said Ashton. It really gives us the legs
to advocate for policy changes as well as
money to ensure service providers are
trained properly to handle hate crimes and
domestic violence cases in our community.
MPD statistics show that there were 12
reported bias-related crimes based on
sexual orientation from January through
April, compared to two that were based
on gender identity and expression.
The agency indicated that there were
43 reported bias-related crimes based on
sexual orientation in 2011, compared to 35
in 2010 and 30 in 2009. MPD statistics show
that there were 11 bias-related crimes
based on gender identity and expression
in the District in 2011, compared to 10 in
2010 and ve in 2009.
Naveed was quick to applaud what he
described as MPDs improved outreach to
immigrants and LGBT Washingtonians. He
said he always encourages victims to report
hate crimes to the police, but he stressed
that many victims of anti-LGBT bias attacks
remain afraid to come forward to the police
because of their immigration status or
previous experiences with law enforcement.
MPD spokesperson Gwendolyn Crump
responded to the reporting initiative late
on Tuesday.
We welcome input from community
organizations, which can be a valuable
source for information about people who
have not reported information to the
police, she told the Blade. However,
it must be understood that Department
gures are based on reported incidents
that meet legal denitions of both a
crime and a crime that was specically
motivated by a legally dened bias.
More importantly, we would caution that
we cannot help victims or protect the
community if people do not make a report
to the police. We urge anyone who has
been a victim of crime or a hate crime to
report it to police. Individuals who believe
they have been the victim of a hate crime
can contact police in a number of ways,
including calling 911, reaching out to
the relevant liaison ofce or an ofcer
working in their neighborhood, or leaving
a message on the Hate Crime Hotline.

Accused of soliciting sex,
ring gun into car
By LOU CHIBBARO JR.
lchibbaro@washblade.com
An off-duty D.C. police ofcer who was
arrested last August for allegedly ring his
service revolver into a car in which three
transgender women and two male friends
were seated was ordered held in jail last
week while he awaits trial.
During a court status hearing on May 24,
D.C. Superior Court Judge Ann OReagan
Keary denied a request by attorneys
representing Ofcer Kenneth D. Furr that
he be released or that the conditions of
his bond be changed.
A trial has been scheduled to begin
Oct. 15.
Furr, a 21-year veteran of the police
force, has been held without bond since
the time of his arrest on Aug. 26, 2011,
on a charge of assault with a dangerous
weapon. A D.C. police arrest afdavit says
witnesses saw Furr climb on the hood of
a stopped car occupied by ve people
near First and Pierce Streets, N.W., and
re several shots at the occupants through
the windshield.
Two of the women and one of the men
in the car suffered non-life threatening
gunshot wounds in the incident, the
afdavit says. Police and the prosecutor
in the case said later that the three could
easily have been killed in the shooting.
On March 7, a D.C. Superior Court
Grand Jury handed down a nine-count
indictment against Furr, which includes
six counts of assault with a dangerous
weapon, one count of assault with intent
to kill while armed, and two counts of
solicitation for prostitution.
The afdavit says the incident began
when Furr allegedly solicited one of the
women for sex at a nearby CVS drugstore
and became angry when she refused
the offer. During the incident her male
friend intervened on her behalf. Furr later
threatened the male friend with a gun
when the two crossed paths outside the
store, according to the afdavit.
The male friend and the other victims
followed Furr in their car as Furr drove
away from the store, saying they wanted
to get his license number and report
him to police, the afdavit says. It says
Furr stopped his car and pulled out his
gun when he noticed the other car was
following him. The car driven by the male
friend of the trans women then crashed
into Furrs car after the driver ducked for
cover when he saw Furr brandishing the
gun, says the afdavit.
It says Furr responded by climbing on
the hood of the car occupied by the ve
victims and began ring his gun through
the windshield. Police initially charged
Furr with driving while intoxicated, saying
they determined his blood alcohol level
was above the legal limit. Authorities later
dropped that charge.
At an earlier hearing, Furrs attorney
said Furr was acting in self-defense, saying
he feared for his own safety after noticing
that the individuals with whom he got into
a verbal altercation at the drugstore were
stalking him in their car.
Although the police afdavit says Furr
solicited one of the two trans women
for sex at the start of the incident, the
indictment charges him with having
invited, enticed, offered, persuaded, and
agreed with [the two women] to engage
in prostitution
Transgender activists who know the two
trans victims have said the women were
not engaging in prostitution and that Furr
approached at least one of them for a
sexual encounter.
The incident outraged LGBT activists,
who said it came at a time when
transgender women had been victims
of assaults and violent hate crimes in a
number of previous incidents.
This indicates that the prosecutors
are getting serious about our (LGBT
community) complaints or that a
reasonable plea agreement was refused,
said transgender activist Jeri Hughes in
commenting on the grand jury charge
against Furr of assault with intent to kill
while armed.

Historic Northwest D.C.
property fetches $725,000
By LOU CHIBBARO JR.
lchibbaro@washblade.com
The estate of the late gay rights leader
Frank Kameny has sold Kamenys house at
5020 Cathedral Ave., N.W., for $725,000
without the services of a Realtor, according
to estate attorney Glen Ackerman.
Ackerman said the settlement for the
sale of the house took place May 25. He
declined to identify or provide information
about the buyer other than that he or she
is a private individual who likely plans to
live in the house, which is located in the
citys upscale Palisades neighborhood.
In March 2009, the D.C. Historic
Preservation Review Board designated the
house as an historic landmark, marking
the rst time a gay-related site had been
approved for landmark status in the nations
capital. Shortly after Kamenys death in
October 2011, the U.S. Park Service listed
the house on the federal governments
National Register of Historic Places.
The Rainbow History Project, a local
LGBT group that submitted the successful
application to obtain the landmark
designation from the D.C. government,
said that beginning in the 1960s, the house
became an ofce and center for carrying
out Kamenys widely recognized role as a
local founder and national pioneer of the
modern gay rights movement.
Historians consider him a landmark
gure in articulating and achieving gay
civil rights in federal employment, criminal
law, security clearances cases, and in
reversing the medical communitys views
on homosexuality, the Rainbow History
Project said in its application for the
historic designation.
Mark Meinke, a Rainbow History
Project ofcial, and Charles Francis, co-
founder of the Kameny Papers Project,
which arranged for the purchase of most
of Kamenys historic papers and their
donation to the Library of Congress prior
to Kamenys death, had expressed interest
in converting Kamenys house into an LGBT
history center or possible museum. Both
talked about this prior to Kamenys death.
But Meinke told the Blade this week
that no serious effort emerged to move
ahead with such a proposal.
It was more of a pipe dream, said Meinke.
Under the citys and federal
governments historic designation, the
new owner of the house is prohibited from
demolishing it or making major external
changes. Under D.C. regulations, some
external change could be made upon
approval by the city.
Ackerman said the publicity surrounding
Kamenys death and the subsequent
tributes and memorial services recognizing
him as a nationally acclaimed civil rights
leader prompted potential buyers of the
house to approach the estate. Ackerman
said the house was not listed for sale on
normal real estate listing services.
The new owner of the Kameny house,
like the owners of all real estate, will be
identied in public city records. As of
Monday, the sales transaction had not
been published in the online site of the
D.C. Recorder of Deeds, which keeps real
property ownership records.
In his will, Kameny designated Timothy
Clark, his friend and housemate of 19
years, as the beneciary of his house,
car and all other property other than his
papers, which he bequeathed to the
Library of Congress.
Ackerman said the probate process for
the estate has yet to be completed.

Gay groups le marriage lawsuits in Illinois
Lambda Legal and the American Civil Liberties Union on Wednesday led
lawsuits on behalf of 16 same-sex couples who seek to marry in Illinois.

Patrick here. A civil union doesnt reect what we mean to each other.
The lawsuit comes roughly a year after the states civil unions law that Gov. Pat

rights for same-sex couples after President Barack Obama publicly backed the
issue during an ABC News interview.

Anti-gay federal law
said to violate equal
protection rights
By CHRIS JOHNSON
cjohnson@washblade.com
Another federal court has ruled against
Section 3 of the Defense of Marriage
Act in a California case challenging the
constitutionality of the law as well as a
portion of the federal tax code.
The U.S. District Court for the Northern
District of California last week declared
the laws unconstitutional because they
preclude plaintiffs from allowing their
partners whether in a union of marriage
or a domestic partnership from
participating in a long-term care insurance
program maintained by the California
Public Employees Retirement System, or
CalPERS. The decision was signed by U.S.
District Judge Claudia Wilken.
The Court nds that 3 of the DOMA
violates the equal protection rights of Plaintiff
same-sex spouses, and subparagraph (C) of
7702B(f) violates the equal protection rights
of Plaintiff registered domestic partners,
Wilken writes. Therefore, both provisions
are constitutionally invalid to the extent that
they exclude Plaintiff same-sex spouses and
registered domestic partners from enrollment
in the CalPERS long-term care plan.
The class-action lawsuit, known as
Dragovich v. Department of the Treasury,
was led against both federal and state
defendants because they precluded
California public employees from taking
part in CALPERS. The San Francisco-
based Legal Aid SocietyEmployment
Law Center led the case along with Zelle
Hofmann Voelbel & Mason LLP.
The decision by Wilken, who was
appointed in 1993 by former President
Clinton, enjoins both federal and state
ofcials from blocking these workers from
participating in these programs. However,
a stay could be granted if an appeal is led.
DOMA, a 1996 law that bars federal
recognition of same-sex marriage, applies
to CalPERS because the law regulates
state-sponsored long-term care plans.
But Title 26 U.S.C. 7702B(f), also
enacted in 1996 as part of the Health
Insurance Portability and Accountability
Act, or HIPAA, was also struck down
because it has language excluding
same-sex partners from the program.
That portion of the law aims to provide
favorable federal tax treatment to
participants in state-maintained long-term
care insurance plans for state employees
like CalPERS.
Michael Dragovich, the lead plaintiff in
the case and a nurse specializing in liver
transplants at the University of California,
San Francisco, praised the decision for
allowing him and his partner to participate
fully in CalPERS, which he joined as a state
employee in 1997.
Ive been in a committed relationship
with my partner for more than 30 years,
Dragovich said. I am so pleased that our
relationship will now be treated equally
to the committed relationships of my
heterosexual co-workers.
Elizabeth Kristen, senior staff attorney
for the Legal Aid SocietyEmployment
Law Center and director of its gender
equity program, said the decision upholds
fairness under the law.
Lesbian and gay couples are entitled
to fair and equal treatment from the
federal government, Kristen said.
Judge Wilkens ruling ensures that
both same-sex spouses and registered
domestic partners will be treated fairly
with respect to the CalPERS long term
care insurance program.
In the determination that DOMA
is unconstitutional, Wilkens brings
up examples of statements made by
members of Congress in 1996 suggesting
an anti-gay animus, including an attempt
to overturn D.C.s domestic partnership
law in the early 1990s.
Congress discussed registered
domestic partnership laws prior to and
during 1996, when the statutes challenged
here were passed, Wilken writes. These
discussions occurred after the District
of Columbia passed, in April 1992, the
Health Care Benets Expansion Act,
which established a domestic partnership
registry in that jurisdiction. Congress
reacted to the new law by barring any local
or federal funding to implement, enforce
or administer the registry.
Douglas Nejaime, whos gay and a
law professor at Loyola University, said
the decision is noteworthy because it
strikes down both DOMA and separately
nds excluding California registered
domestic partners under the long-term
care insurance regulations violates
constitutional equal protection principles.
The other interesting thing here is
that the case implicates the relationship
between state programs and federal
regulation in a way that will continue
to arise and produce issues not simply
regarding marriage recognition for same-
sex couples but recognition of non-marital
same-sex relationships that are treated as
spousal relationships under state law,
NeJaime said.

Log Cabin asks him
to back LGBT
workplace protections
By MICHAEL K. LAVERS
mlavers@washblade.com
Former Massachusetts Gov. Mitt
Romney on Tuesday clinched the
Republican presidential nomination with
his win in the Texas GOP primary.
The Associated Press reported that
Romney surpassed the 1,144 delegate
threshold by winning 105 delegates in the
Lone Star state.
I am honored that Americans across
the country have given their support
to my candidacy and I am humbled to
have won enough delegates to become
the Republican Partys 2012 presidential
nominee, he said in a statement posted
on his campaign website. Our party has
come together with the goal of putting
the failures of the last three and a half
years behind us. I have no illusions about
the difculties of the task before us. But
whatever challenges lie ahead, we will
settle for nothing less than getting America
back on the path to full employment and
prosperity. On Nov. 6, I am condent that
we will unite as a country and begin the
hard work of fullling the American promise
and restoring our country to greatness.
The Texas contest caps off a contentious
Republican primary season during which
Romney often clashed with his GOP
challengers.
Romney repeatedly expressed support
for a federal constitutional amendment that
would dene marriage as between a man
and a woman. National Organization for
Marriage President Brian Brown endorsed
Romney because of what he described as his
commitment to the nation to take specic
actions as president to preserve and protect
marriage as the union of one man and one
woman. Romney has previously said that
he opposes anti-gay discrimination, but
activists have consistently criticized the
former Massachusetts governor for what
they perceive are inconsistent positions on
Dont Ask, Dont Tell, the Employment
Non-Discrimination Act and other LGBT-
specic measures and issues.
The Romney campaign in late April
tapped gay former Bush administration
ofcial Richard Grenell as its national
security spokesperson. He resigned last
month after his appointment sparked
outrage among social conservatives.
During the primaries, Gov. Romney
distinguished himself as the best in a eld
of worsts on issues of equality for LGBT
Americans, Human Rights Campaign
spokesperson Fred Sainz told the Blade.
Now that hes clinched his partys
nomination, we hope that hell give careful
reconsideration to the most basic issues of
equality that he previously opposed.
Jimmy LaSalvia, executive director
of GOProud, welcomed Romneys
presumptive nomination.
All Americans including gay
Americans will now decide if we are
willing to continue to hope for change,
or we will vote to elect Mitt Romney, a
proven leader who can bring America
back, he said.
R. Clarke Cooper, executive director
of Log Cabin Republicans, had a slightly
more tepid reaction.
Mitt Romney now has the votes to clinch
the Republican nomination this August, he
told the Blade. If the Romney campaign
wants to make clear that the Republican
candidate believes in a society where
Americans are judged solely on their ability
to perform, now is the time to prove it by
showing unambiguous support for federal
protections from workplace discrimination.
Cooper further noted that 66 percent of
registered GOP voters now support these
legal provisions.
If Mitt Romney were to stand up
tomorrow and declare that no American
should ever fear for their job because of
who they are, it would be a win for all of us,
including the candidate himself, he said.
but a Public Policy Polling survey last week
found that 57 percent of Marylanders
would vote for the same-sex marriage
law that Gov. Martin OMalley signed in
March. The same PPP poll found that 55
percent of the states black voters back
marriage rights for same-sex couples.
The Baltimore-based National
Association for the Advancement of
Colored People announced its support
of nuptials for gays and lesbians during
its National Board of Directors quarterly
meeting in Miami on May 19.
Given the low bar for petitioning a law to
the ballot in Maryland, weve always expected
same-sex marriage opponents to meet that
threshold and then someup to their stated
target of 150,000, said Josh Levin, campaign
director for Marylanders for Marriage Equality.
But dont confuse meeting the legal
requirement with intensity or measure of
support. Its clear those opposed to marriage
equality are losing ground.
Maryland Del. Heather Mizeur
(D-Montgomery County) echoed Levin.
Weve always been planning to ght a
referendum ght, she told the Blade as
she discussed the likely referendum. We
know when this comes to referendum
were going to win. Public opinion is
continuing to evolve rapidly and support
is on our side.
The Public Policy Polling survey found
that 55 percent of the states African
Americans would vote for the law,
compared to 36 percent who said they
would oppose it. PPP pollster Tom Jensen
noted that support for the statute among
black Marylanders has increased nearly 20
percent since March.
The poll further noted that 57 percent
of Maryland voters would support the
law if the referendum makes the ballot.
A previous PPP survey commissioned by
Marylanders for Marriage Equality in March
found that 52 percent of state voters would
back the same-sex marriage law.
Things are moving in Maryland, said
Levin. Were approaching a supermajority
who want to uphold the states new marriage
law. The message of stronger families
and basic fairness is resonating, and were
condent Maryland will be the rst state to
win a ballot measure on marriage.
This poll comes just weeks after
President Obama publicly backed
marriage equality during an interview with
ABC News.
An ABC News/Washington Post poll
last week indicated that the presidents
support of marriage rights for same-sex
couples has already had a signicant
impact on public opinion among African
Americans on the issue 59 percent
of black respondents said they support
nuptials for gays and lesbians. This gure
is an 18-point increase from polls that
had been taken before Obama publicly
backed the issue.
The presidents backing of marriage
equality has added to our momentum
and his being on the November ballot also
helps us, said Levin. Younger voters,
who are overwhelmingly supportive,
are much more likely to turn out in a
presidential year.
Bishop Harry Jackson of Hope Christian
Church in Beltsville is among those
who continue to oppose the same-sex
marriage law.
Voters need to know whether they have
a friend or an enemy to an institution
that God has ordained, Jackson said of
Obamas support on the issue during a
news conference last week. Some of us
have taken his statements as a declaration
of political war against the venerable
institution of marriage.
I am encouraged by this polling data
that shows that while Maryland was the
eighth state to pass marriage equality, if
all those votes were cast today, Maryland
would become the rst state to protect
the freedom to marry at the ballot box,
Del. Mary Washington (D-Baltimore City)
told the Blade.
She added that the passage of the state
constitutional amendment that dened
marriage as between a man and a woman
in North Carolina last month proved that
referendum opponents must not let their
guard down.
The sad story of North Carolina is that
the ood of resources in terms of money and
people from across the country came too
late, said Washington. We must remember
that the opposition is seeing the same
number and so it is critical that we secure
early and ongoing support from Marylanders
and all those from across the country who
would share in this victory in November.
OMalley spokesperson Raquel Guillory
shared a similar view.
There is still more work that needs
to be done, she told the Blade. We
never take anything for granted but these
numbers clearly show that momentum is
growing and more Marylanders support
marriage equality and religious freedom.

House version of defense
measure included
conscience protection
By CHRIS JOHNSON
cjohnson@washblade.com
A Senate panel has completed work
on major defense budget reauthorization
legislation while leaving out anti-gay
provisions found in the House version of
the bill.
The Senate Armed Services Committee
didnt include anti-gay language found in
House legislation as part of its markup of
the scal year 2013 defense authorization
bill. The 26-member Democratic-
controlled committee, chaired by Sen. Carl
Levin (D-Mich.), on Thursday completed
work on the $631 billion legislation, which
authorizes funding for military programs
and troop pay.
The House version of the legislation,
approved by the Republican-controlled
lower chamber last week by a vote of 299-
120, contains a conscience protection
allowing service members to harass
their gay colleagues and chaplains not
to minister to them. Another provision
in the bill prohibits same-sex marriage
ceremonies on military bases. The
provisions were adopted by the House
Armed Services Committee.
Aubrey Sarvis, executive director of the
Servicemembers Legal Defense Network,
praised the Senate committee for leaving
out the anti-gay provisions in its plan for
the defense budget.
SLDN and our allies have been working
on Capitol Hill this year to encourage the
Senate Armed Services Committee to
pass a common-sense defense spending
bill that does not seek to turn the clock
back on the progress we have made in this
rst year of implementation of Dont Ask,
Dont Tell repeal, Sarvis said.
Provided the full Senate doesnt adopt
the anti-gay provisions when the bill comes
up for a oor vote a likely outcome in
the Democratic-controlled Senate
House and Senate lawmakers will have to
hammer out the differences over the anti-
gay language as well as other issues during
a conference committee later this year.
Similar anti-gay language was included
last year in the previous House version
of the defense authorization bill. The
language was ultimately removed in
conference committee before each
chamber voted again to approve the nal
version of the legislation.
Its unclear whether the Senate version
of the legislation also contains a repeal of
Article 125 of the Uniform Code of Military
Justice, which bans sodomy for straight and
gay service members. That language was
included in last years version of the Senate
legislation, but taken out in conference
committee. Advocates at the time of this
posting said it was unlikely the Senate bill
included a repeal of the sodomy ban this
time around, but werent certain.
Senate dumps anti-gay language from bill
Accuse president of
declaring political war
By CHRIS JOHNSON
cjohnson@washblade.com
Anti-gay activists took to Capitol Hill
last week to speak out against LGBT rights
as they condemned President Obamas
recent endorsement of marriage equality.
Bishop Harry Jackson, senior pastor of
the Hope Christian Church and among the
leaders in the ght against the legalization
of same-sex marriage in D.C. and
Maryland, led a news conference, which
was sponsored by the anti-gay Family
Research Council.
Obamas endorsement of same-
sex marriage was a particular point of
consternation for Jackson, who wondered
aloud whether Obama intended to employ
the bully pulpit of the presidency to
absolutely erase the image of biblical
marriage from the face of the earth.
Voters need to know whether they have
a friend or an enemy to an institution
that God has ordained, Jackson said.
Some of us have taken his statements as
a declaration of political war against the
venerable institution of marriage.
Jackson drew attention to a letter that
he said social conservative leaders sent to
President Obama expressing their disapproval
of his support for same-sex marriage as well as
his other work in LGBT advocacy.
The undersigned pastors and Christian
leaders write to raise serious concerns
over your recent declaration of support
for same-sex marriage, the letter
states. This declaration follows a long
trail of actions by your administration that
subvert the law of the land as well as the
good of society. From permitting open
homosexuality behavior in Armed Forces,
to opposing state marriage amendments,
to refusing to defend the federal Defense
of Marriage Act, to giving taxpayer-funded
marriage benets to same-sex couples,
you have undermined the spirit if not the
letter of the DOMA law.
A White House spokesperson didnt
immediately respond to a request for
comment on the letter.
Jackson asserted the presidents
support for same-sex marriage was
particularly troublesome for racial minority
communities, whom he contended held
the view that marriage is between one
man and one woman.
What was most concerning about
the presidents comments was it seemed
to be a slap in the face of black clergy,
Jackson said. They seem to say I know
that you hold these views, and that in the
marriage amendment battle in the great
State of California, 70 percent voted for
marriage, while nearly 95 percent voted
for President Obama. Given those
kinds of statistics, it seemed and felt to
some of us who happened to be African-
American; it felt like an insult, or a gauntlet
was laid down.
But numbers that Jackson cited from
California in 2008 have been debunked
by studies of the exit polls on which they
are based, and a new poll suggests that
a growing number of black Americans
support same-sex marriage in the wake
of President Obamas announcement.
A Washington Post/ABC News poll
published on Wednesday found that 59
percent of African Americans now support
same-sex marriage, with 65 percent
approving of President Obamas position.
Jackson threatened political
consequences for Obama as a result of
his announcement in support of same-sex
marriage and said hed continue to oppose
same-sex marriage, eliciting applause from
participants at the news conference.
As part of efforts to protest Obamas
support for same-sex marriage, Jackson
called on churches to participate in a 40-
day fast; asked church leaders to read
a statement on Fathers Day afrming
marriage as one man, one woman; and
called on voters across racial groups and
religious denominations to cast their votes
based on moral conscience whether they
identify as Democrat or Republican.
Tony Perkins, the Family Research Councils
president, also spoke at the news conference
and argued that LGBT advocates have to
win same-sex marriage through legislative
or court action because they cant achieve it
through a vote of the populace.
The president has said that hes OK
with states dening marriage as a union
of a man and a woman, Perkins said.
I guess thats pretty good, since the 32
states that have voted, have voted in favor
of traditional marriage. If you can do the
math, thats more than half the states.

in discussing the information released by
the opposition campaign to bloggers.
How could they be 21 points off?
Ofcials with the Coalition to Protect All
North Carolina Families, which operated the
campaign opposing Amendment One, said
the numbers they cited were from the polling
rm Public Policy Polling, which showed
support for the amendment down to 55
percent in the week before the election.
There were a lot of polls, and they
were all across the map, said Stuart
Campbell, executive director of the
statewide LGBT advocacy group Equality
North Carolina and a member of the
opposition campaigns seven-member
Steering Committee.
We actually had internal polling back
in January that showed close to 70 percent
around 67 to 68 percent in favor, he
said. So we actually do believe we moved
it anywhere between seven and 10 points.
In addition to Equality North Carolina,
the organizations represented on the
Steering Committee, whom ofcials said
made all key decisions for the campaign,
included the Human Rights Campaign; the
ACLU of North Carolina; Faith In America;
Replacements, Ltd., a gay-owned
company that sells upscale dinnerware;
Self-Help, an LGBT supportive credit union
based in North Carolina; and Southerners
on New Ground (SONG), a North Carolina
group that promotes progressive causes.
In late December or early January the
Steering Committee retained the Los
Angeles-based Armour Grifn Media
Group to produce the campaign TV ads.
Ofcials said the campaign retained the
company months before they learned
that Chad Grifn, one of the two principal
partners in the rm, was to be selected
as the new HRC president. Campaign
nance records show the campaign paid
the company $66,000 for its media work
as of May 11, the close of the most recent
campaign nance reporting period.
Campbell and campaign co-chair Alex
Miller said the campaign built important
alliances with progressive groups, LGBT
supportive churches and religious leaders,
and leaders of the African-American
community that would benet the LGBT
community for years to come.
One of the most important
developments, Campbell and Miller
said, was the decision by the NAACP of
North Carolina to come out against the
amendment. Under the leadership of
Rev. William Barber II, the states NAACP
president, the historic black civil rights
organization activated its chapters in
counties across the state to speak out
against the amendment.
Barber told the Blade that he believes a
majority of black North Carolinians voted
against the amendment despite claims by
some media outlets that polls showed a
majority of blacks favored the ballot measure.
Ray Warren, a former North Carolina
circuit court judge whos familiar with the
states voting trends and demographics,
said a review of the vote in most parts
of the state showed that all of the states
large cities and urban areas voted against
the amendment. In what he called a
dramatic contrast, all of the rural counties
and nearly all of the suburbs outside city
boundaries voted for the amendment.
Ninety-two of the states 100 counties
voted for the amendment. Each of the
eight counties voting against it included
cities or urban-oriented towns with
universities within their boundaries.
According to Warren, in a development
rarely seen in the state, black and white
voters appeared to vote alike, with majority
white and majority black precincts voting
for the amendment in rural and suburban
areas. In cities and urban centers, majority
black and majority white precincts voted
against the amendment, Warren said.

Debate over
campaign message
Some LGBT supportive observers
wanted to know whether the message
projected by the campaign opposing the
amendment in TV ads and other media
amounted to the best means possible to
persuade voters to reject the amendment.
Marriage equality supporter Brent
Childers, executive director of the North
Carolina-based group Faith in America,
which challenges what Childers calls the
misuse of religion to deny rights to
LGBT people, said the campaign could
have been more effective in challenging
and refuting religious arguments used to
support Amendment One.
Still others, including North Carolina
lesbian activist Mandy Carter, joined
Spaulding in expressing concern that the
opposition campaign mostly de-gayed
its messages in TV ads by stressing the
harms the amendment would have on
straight unmarried couples.
Campaign ofcials dispute these
claims, saying the campaign aggressively
embraced its support for marriage
equality for gays and projected that
message through many campaign venues,
including online videos as well as TV ads.
The campaign recruited a lesbian
mother to appear in one of the three
TV ads aired shortly before the election.
Campaign ofcials told the media in a
press release that the woman and her
same-sex partner rely on the partners
employee health insurance to provide
coverage for their daughter.
But in the TV ad the woman isnt
identied as a lesbian. While driving a car
with her child sitting next to her she says
Amendment One would likely result in the
loss of her daughters health insurance.
[Its] because were not married, she
says in the ad, referring to her partner. The
partners gender isnt mentioned.
If youre watching it on television theres
no way to know, Spaulding said, referring
to the womans sexual orientation.
Campaign ofcials said they believe
the ad was effective in showing how
the amendment would have serious
consequences for unmarried couples, gay
or straight, and it likely persuaded some
voters to oppose the amendment.
In a series of interviews, pollsters,
campaign ofcials, political analysts
afliated with North Carolina universities,
representatives of LGBT advocacy groups,
and LGBT supportive straight allies
provided the Blade with a wide range of
opinions addressing these questions.
Most agreed, however, that private
polls commissioned for the campaign as
well as polls conducted by other pollsters
showed that a solid majority of North
Carolinians oppose same-sex marriage
on religious grounds. They noted that the
same polls showed that a campaign and
vote framed only around the question of
whether gays should be allowed to marry
would result in a certain defeat for the pro-
marriage equality side.
Leaders of the Coalition to Protect All
North Carolina Families said they chose
an evidence-based approach of using
the best possible research from privately
commissioned polls to develop the
message they ultimately used.
That message focused on how
Amendment One goes far beyond
banning same-sex marriage and, among
other things, would ban civil unions for
gay and straight couples. It could also
lead to a wide range of harmful effects on
all unmarried couples, gay and straight,
and their children, the group stressed in
its messaging campaign.
Advocates of this approach noted that
an existing law in North Carolina already
prohibited same-sex marriage and that
an amendment to the state constitution
doing the same thing was unnecessary.
Supporters of the amendment disputed
that assertion, saying a constitutional
amendment was needed to prevent a court
from overturning the states existing law
banning same-sex marriage. They noted
that gay rights advocates had already
led at least one lawsuit challenging the
existing gay marriage statute.
Political observers noted that after
blocking a constitutional ban on same-sex
marriage for years under Democratic Party
leadership, the state legislature approved
a proposal to place the issue before the
voters in 2011 after Republicans gained
control of the legislature for the rst time
in decades in the 2010 election.
Over the strong objections of many
Democrats and some Republicans,
supporters of the amendment worded it
in a way that expanded its scope beyond
just marriage.
Amendment One states, Marriage
between one man and one woman is the
only domestic legal union that shall be
valid or recognized in this State.
The amendment adds, This section does
not prohibit a private party from entering
into contracts with another private party;
nor does this section prohibit courts from

adjudicating the rights of private parties
pursuant to such contracts.
Legal experts in the state have said the
amendments denition of marriage as the
only domestic legal union would place
in jeopardy rights and benets currently
being offered to gay or straight unmarried
couples, such as domestic partner
benets offered by private companies or
local governmental entities like cities and
towns, including health insurance benets
and hospital visitation rights.
The Coalition to Protect All North
Carolina Families cited legal experts
who said safeguards against domestic
violence might also be jeopardized by
the amendment, with the possibility that
a court could no longer issue a legal stay
away order for a partner accused of
physically abusing the other partner if the
couple were not married.
We saw that all these terrible things
could happen, said Stuart Campbell,
executive director of the state LGBT
advocacy group Equality North Carolina
and a member of the Steering Committee
of the campaign opposing the amendment.
Supporters of the amendment, led by the
state group Vote for North Carolina Marriage
and the anti-gay National Organization for
Marriage, said claims that the amendment
would impact health insurance benets,
domestic violence protections or child
custody rights were unfounded.
Campbell said the Coalition to Protect All
North Carolina Families Steering Committee
initially hired the LGBT supportive polling
rm Greenberg Quinlan Rosner Research
headed by pollster Anna Greenberg. In an
effort to get a second opinion, the Steering
committee a short time later retained
Lake Research Partners, another LGBT
supportive campaign research rm headed
by pollster Celinda Lake. Both rms have
long-established records of helping to win
elections for mostly Democratic candidates
and progressive causes.
Lake was the pollster in the 2006
campaign opposing a proposed same-sex
marriage ban in Arizona that was defeated
by voters, the only such ballot measure
to lose in more than 30 states across the
country that voted on such a measure.
Observers said the measure lost in Arizona
because most voters disagreed with the
additional restrictions it would place on
unmarried couples, similar to the harms
cited by opponents of Amendment One
in North Carolina.
Two years later, Arizona voters
approved a same-sex marriage ban that
didnt include the additional restrictions
on unmarried couples.
Lake told the Blade that the North
Carolina campaign stressed the harms
Amendment One would cause to gay
and straight unmarried couples, including
the children of such couples, but it was
not modeled directly after the Arizona
campaign since the two states have different
voter demographics and political traditions.
Lake said her early polling in North
Carolina conducted to test different
messages clearly found that a message
of the potential harm Amendment One
would cause for unmarried couples, gay
and straight, children of these couples, and
women threatened by domestic violence
resonated with many voters. Among other
things, a signicant number of voters who
planned to vote for Amendment One
changed their position and stated in her poll
that they would vote against it after learning
about the amendments impact beyond
banning same-sex marriage, Lake said.
Lake described as historic the North
Carolina campaigns use of a TV ad
asserting that Amendment One would
harm children, saying it represented
the rst time a campaign opposing a
ballot measure seeking to ban same-sex
marriage has argued that such a proposal
would harm children.
She noted that in all previous campaigns,
supporters of anti-gay ballot measures
argued that same-sex marriage would be
harmful to children. In North Carolina, the
campaign against the amendment turned
the tables on the anti-marriage equality
forces, opening the way for this game-
changing strategy in future battles
against ballot measures seeking to ban
same-sex marriage, Lake said.
When asked why Amendment One passed
by a 61 percent to 39 percent margin despite
the use of the unintended consequences
and harm to children strategy, Lake and
others working with her on the campaign
cited the campaigns lack of sufcient funds
to pay for more TV ads and their inability to
begin airing the ads sooner.
Jeremy Kennedy, the campaign
manager hired by the coalition Steering
Committee to carry out the committees
game plan, said more than 60 percent of
the $2.8 million raised by the campaign
came in during the last few weeks leading
up to the May 8 election.
The three TV ads the campaign used
didnt begin airing until the states early
voting had already started about 15 days
prior to Election Day.
I was surprised that the opposition
campaign didnt get on the air sooner,
said Wake Forest University political
science professor John Dinan, who said he
followed the campaigns for and against
the amendment.
To move voters you need to put on TV
ads much sooner, he said.
Kennedy said that in the last few weeks
of the campaign, donors began to respond
when some outside polls, including those
conducted by the rm Public Policy
Polling, showed the projected vote for the
amendment dropping to about 55 percent.
If we all had our way and we had
early money we would have done several
months of TV, Kennedy said.
Kennedy, 34, is a native of Texas
who moved to D.C. in 2007 to work on
the presidential campaign of Hillary
Clinton. After Clinton dropped out of the
presidential race following the primary
season in 2008, Kennedy took a job
with the Human Rights Campaigns eld
department in Washington.
In 2010 he moved to Maine to work
on the gubernatorial primary campaign
of Democrat Elizabeth Libby Mitchell,
who won the primary but lost the general
election to Republican Gov. Paul Lepage.
Following that campaign, Kennedy went
to work as a state eld director for the
Maine Democratic Party.
He next went to Rhode Island to work
on the legislative effort in the state to pass
a same-sex marriage law. The legislature
changed course and approved a civil
unions bill rather than a marriage law.
Shortly after returning to Maine, which
he considers his home state, Kennedy
was recruited to North Carolina last
December, where the Coalition to Protect
All North Carolina Families hired him as
campaign manager to work for the defeat
of Amendment One.
One source familiar with the campaign
said the Steering Committee awarded
Kennedy a $5,000 bonus near the end of
the campaign. Another source expressed
concern that money for the bonus
would have been better used to pay for
additional media ads.
Campbell declined to conrm the
amount of the bonus, saying it was a
personnel matter that would not be
appropriate to discuss publicly. However,
he added, It was not such a large amount
that it would make a difference in the
media campaign.
I have nothing but good things to say
about Jeremy, Campbell said. I think he
did an excellent job. He ran the campaign
that we hired him to run.
HRC spokesperson Fred Sainz agreed
with Campbells assessment of Kennedy.
In everyones estimation including ours
Jeremy Kennedy is a superstar! Sainz said
in an email to the Blade. This campaign
brought together a diverse coalition that
left behind an infrastructure in North
Carolina upon which we can build upon for
progressive politics and gay rights.
Sainz said that while the loss was a
big disappointment, ballot measures
banning same-sex marriage passed in
the other Southern states by an average
of 75 percent in past years. He said
the 61 percent to 39 percent margin of
approval of a gay marriage ban in North
Carolina shows amazing progress among
Southerners and Americans in general on
the issue of marriage equality.
Approval by voters in Virginia of a state
constitutional ban on gay marriage in 2006
by a margin of 57 percent marked the only
Southern state with support for such an
amendment at a lower percentage than
North Carolina. Florida passed such an
amendment with a margin of 62 percent in
2008. South Carolina approved a marriage
ban amendment by a 78 percent margin
of approval in 2006.
Campbell and campaign co-chair
Miller said reports by some critics that
the campaign ended with a signicant
surplus and that the campaign chose not
to distribute yard signs to urge voters to
defeat the amendment were not true.
The campaign distributed as many as
15,000 yard signs opposing Amendment
One in mostly urban areas throughout the
state, campaign ofcials said.
Miller said that the campaigns nance
report led on May 21 showing a $92,317
surplus was based on incomplete data.
Bills for media-related expenses and other
expenditures had yet to be paid at the
time of the reports ling deadline. He said
nal expenses would be shown in a nal,
end-of-the-year report to be led with the
election board.
We were pretty much down to the
last penny, he said of the campaigns
spending.
Mood is grim
A 17-page memo that Greenberg sent
to the campaign Steering Committee on
Dec. 6, 2011, a copy of which the Blade
obtained, says her polling found that a
signicant number of voters were inclined
to change their vote from yes to no
on the amendment after they learned of
the potential harmful impact it would have,
including its prohibition against civil unions
and overall harmful effects on children.
Greenberg noted in her memo that
many voters who opposed same-sex
marriage did not object to civil unions for
gay or straight couples.

PFLAG mom to be parades grand marshal
June Horner was selected unanimously by the Baltimore Pride Parade
Committee to be this years parade grand marshal.
June Horner has been to every single Baltimore Pride parade, Donald Young,
committee chair told the Blade. Her outstanding work in PFLAG and her belief
that every human being should be treated equally and based on character, not
on sexual orientation were the reasons June was selected. In response, Horner
said, I am pleased beyond measure or words to be chosen for this honor. The
parade takes place on June 16.
Horner, from Sykesville, Md., started a PFLAG chapter in Baltimore in 1985 but
the interest level on the part of city parents dropped off a year later. She became
a founding member of the Howard County chapter and has served on its steering
committee since 1994. Last year she helped form a chapter in her home area of
Westminster-Carroll County where she believed such a support, education and
advocacy group is needed.
In 1984, upon learning that her youngest son Mark was gay, she embarked on a
mission to ght discrimination.
I felt I simply had no choice other than jump in and try to get involved to tell
the world as best I could within whatever limited capacities I might have, that
good people are being misunderstood and hurt and this has got to stop, she
said. And this has been my passion and my purpose for over 25 years now and
counting.
Always adorned with pro-equality and PFLAG buttons and T-shirts, Horner has
marched in numerous parades from D.C. to New York as well as San Francisco.
Often, she along with her husband Graham, holds up a sign that reads, Our Kids
are Fine Just the Way They Are.
Marriage opponents to hold symposium
The Baldwin, Md.,-based Upper Cross Roads Baptist Church and its Cross
Roads Bible Institute placed a half-page ad in the Baltimore Sun to announce
a symposium in the fall titled The Collapse of Evangelical ChristianityGay
Marriage and the War on Objective Truth.
The ad states that with the legitimization of gay marriage legal and social
as an accepted institution, Evangelical Christianity is engaged in the greatest
struggle in the history of the church. It also denounces the portrayal and
acceptance of gay marriage as a civil rights movement as the work of Satan and
characterizes it as theological nonsense.
It goes on to say, Gay marriage, in the end, necessarily seeks to destroy all that
Western civilization has defended over the centuries and the Christians greatest
treasure: the Word of God.
Caps players join You Can Play project
There may not be a professional hockey team in Baltimore but many here
adopted the Washington Capitals as their own. And LGBT Baltimoreans can
celebrate the fact that two Caps forwards, Mike Knuble and Matt Hendricks,
joined an expanding list of National Hockey League players many of them
stars in the You Can Play project.
Patrick Burke, a scout for the Philadelphia Flyers; Brian Kitts, a former marketing
ofcial for the Colorado Avalanche; and Glen Witman, founder and president of
Gforcesports.org formed a project called You Can Play. Launched earlier this year,
the project uses video testimonials from a growing cadre of current players in the
National Hockey League, You Can Plays primary goal is to change the mindset
that controls locker rooms today and make the environment safer for a gay pro
athlete to be out not just in hockey but all sports pro and amateur. The
theme is, If you can play, you can play.
Burkes brother Brendan was a collegiate goaltender and manager of the
Miami (Ohio) University hockey team who came out as gay in November 2009 and
received an enormous outpouring of support. Their father, Brian, is the general
manager of the Toronto Maple Leafs. Tragically, Brendan was killed in a car
accident two months later.
We share a platform with a number of projects goals of erasing intolerance
and promoting equality, including programs founded by other athletes, Brian
Kitts told the Blade. For more information, visit youcanplayproject.org.

Isolated anti-development
old guard fated to
political extinction
Rising above vast portions of D.C. are the
long necks and swiveling heads of dinosaurs.
Well, not exactly.
The scores of vertical behemoths are ac-
tually the again ubiquitous steel construction
cranes punctuating the citys skyline. They rep-
resent the renewed and accelerating develop-
ment underway across the District resulting
from high demand for residential housing and
the associated amenities necessary to serve a
diversifying population.
More than that, they are evocative of the
endangered relevancy of small unrepresenta-
tive citizens groups, many an Advisory Neigh-
borhood Commission (ANC) member and
ad hoc gaggles of objectors to progress who
have long ruled the land. These prominent
structures also serve as totems signifying de-
velopment intensive areas where naysayers
are viewed as hostile by inhabitants.
Threatened with declining inuence and
vastly outnumbered by those desiring nothing
less than their sudden disappearance, they
have become reduced to thrashing about like
a vulnerable species. As any anthropologist
will attest, creatures facing extinction often ex-
hibit desperate behavior.
Evidence of this last-gasp resistance to
their citywide evolutionary demise has in
recent days emerged in two high-prole
neighborhoods.
Bug-eyed astonishment was the prevailing
reaction last week to the news announced by
Dupont-Logan-U Street neighborhood blog
Borderstan that the more than seven-year ig-
nominious battle by notorious gang of ve or
more license protest groups against popular
neighborhood restaurant Hanks Oyster Bar
had suddenly reignited. Bitter protracted li-
censing objections against prominent local
chef-owner Jamie Leeds highly regarded es-
tablishment adjacent to 17th and Q streets de-
layed both its eventual opening in May 2005
and subsequent expansion last year.
A technical ruling by the D.C. Court of Ap-
peals on May 17 involving city regulatory lan-
guage so poorly written as to be confusing
requires Alcoholic Beverage Control (ABC)
Board review of its prior decision to termi-
nate, after four years as allowed by law, a so-
called Voluntary Agreement between the
business and a group of only six protesting
residents. The included restrictions on oper-
ating hours, having allowed the restaurant to
open without ongoing delay threatening the
nancial viability of the business, truncated al-
coholic beverage service earlier than allowed
by law both inside the restaurant and on the
outdoor dining area by two hours and
three hours, respectively.
Termination of these restrictions took the
ABC Board seven months to decide and
was predicated on the evaluation that lifting
them would not adversely affect the neigh-
borhood. They must now revisit their 2010
decision. While perhaps likely that the out-
come may be unchanged, Hanks is again
subjected to adjudication hearings prior to
awaiting a new ruling.
Ironically, Voluntary Agreement amend-
ment and termination is expected to become
a time-consuming regulatory activity for ABC
personnel as more establishments pursue
release from license restrictions. Most liquor
licenses come up for renewal in 2013 and a
substantial number will seek relief espe-
cially from restricted operating hours, many
merely pro forma and disallowing extended
holiday bar hours included in the new city bud-
get effective Oct. 1.
The anticipated volume of venues seeking
revision to restrictions partly results from prior
regulatory practice denying standard hear-
ings, instead forcing applicants into endless
mediation causing businesses to settle out of
necessity. A dysfunctional and unfair system
is largely responsible. Recent improvements
provide only relatively expeditious resolution
without substantive policy reform.
Nearby, more regulatory ridiculousness is
underway. Two weeks ago, in the 14th and U
streets area, a disgruntled few with a long his-
tory instigating licensing protests formed yet
another citizens group. These interventionists
have carved out an eligibility area for likemind-
ed membership within only six blocks.
The tiny nascent group is almost exclu-
sively focused on pushing an area-wide
liquor license moratorium and protesting
new applications for restaurants and bars
scheduled to open in the dynamic develop-
ment zone. All beneath a bevy of construc-
tion cranes foretelling an inux of residents
to a locale already experiencing insufcient
hospitality capacity.
It appears this isolated clique is pursuing
a last stand attempt to impose their will
against overwhelming neighborhood opposi-
tion. Already, 700 have signed a petition op-
posing the groups efforts.
Future anthropological scrutiny will of-
fer scant decipherability as to what spawned
elected ofcials to permit an inhospitable
out-of-balance business environment to fester
unabated. Thwarting a sustenance sustain-
ing ecology providing economic vitality will
manifest historys harshest assessment of their
primitive reign.
In a time of dinosaurs.

The political calculus
of choosing a candidate
for president
In a front-page article for the Washing-
ton Blade, Chris Johnson asked whether
Log Cabin Republicans would endorse
Mitt Romney for president. As of this writ-
ing, Log Cabin hasnt endorsed Romney.
Representing more than one million gay
and lesbian Republicans, Log Cabin will en-
dorse (or not) after reaching a consensus of
the national board of directors, the national
staff and chapter leaders.
We local chapters endorse in local
rather than national races. That said, as in-
dividual members of Log Cabin, well dis-
cuss whether Log Cabin should endorse
Romney. Johnson overlooked the calculus
behind a presidential endorsement.
Log Cabin members differ with the
Republican Party on some issues, particu-
larly marriage equality. We also, however,
strongly disagree with liberals, particularly
on scal matters and foreign policy thus
we are Republicans, despite some LGBT
censure. Gay rights are important to us, but
the good of our nation requires individuals
to consider many issues when voting. For
Log Cabin, with its unique role in both the
Republican Party and the LGBT community,
other factors complicate an endorsement.
Think of endorsements as chess moves:
should Log Cabin try the neutrality gam-
bit or the endorsement strategy? As in
chess, we need to anticipate the moves
of other pieces on the board: the Rom-
ney campaign, LGBT Americans, the press
corps, the Religious Right, etc. With that in
mind, lets examine the implications of two
moves, neutrality or endorsement. (Despite
the fevered dreams of some activists, Log
Cabin wont endorse the Democrat.)
Neutrality would send the message that
Romneys positions the NOM pledge,
primarily are so far against Log Cabins
mission that we believe it is in the best in-
terest of both gays and Republicans not to
offer our formal support. Log Cabin advo-
cates for a stronger, more inclusive GOP
based on the idea that anti-gay politics are
destructive to our party and our country.
Neutrality is a position not taken lightly, but
is possible.
The gay case against Romney parallels
the conservative case against him. Conser-
vatives have long been leery of Romneys
ideological exibility. In 1994, Romney
claimed to be a better advocate for gay
rights than Ted Kennedy; he was a socially
moderate candidate for governor in 2002.
When running for ofce in Massachusetts,
pro-gay positions made sense. When they
became problematic, Romney became a
critic of gay rights. Log Cabin is well aware
of his devolution.
Ironically, Romneys journey partially
tracks Barack Obamas shifting stances on
marriage. As a state senator in 1996, Barack
Obama was on record in favor of marriage
equality, but as president he rst opposed
it, and then he waited until after anti-mar-
riage equality amendments passed before
supporting it again. It might be that Repub-
licans, let alone gay people, would be bet-
ter served without Romneys unpredictable
principles in the White House indeed,
many Republicans voted for Santorum for
that reason. Further, if Romney fails to earn
the Log Cabin endorsement and loses, it
will be a warning to future hard right con-
servatives: being anti-gay loses.
Johnson and others seemed to suggest
that the LGBT community would see a re-
jection of Romney as an act that would earn
Log Cabin respect. Given the disdain that
continues to be heaped on gay conserva-
tives after the withheld Bush endorsement
in 2004, we question whether any respect
would be forthcoming.
Neutralitys danger, which liberal gays
overlook, is that if Romney becomes
president without any major gay organi-
zations backing, then Log Cabin and the
gay community have checkmated them-
selves. After the groups neutrality in 2004,
Log Cabins reputation within the GOP
suffered, and gay people had no ofcial
line of communication with the White
House. We might have headed off some
anti-gay policies if the Bush administration
had been inclined to listen to gay voices.
Maintaining those lines of communication
is central to Log Cabins work for our com-
munity, and the endorsement decision is
part of that process.
Should the election of 2012 be close, the
Log Cabin endorsement will matter. Know-
ing that his presidency depended in part
on gay voters and independents who could
be swayed with a Log Cabin endorsement,
Romney and his staff will be more likely to
continue conversations with Log Cabin. But
they will listen only if Log Cabin endorsed.
Elephants will never forget which side Log
Cabin chooses.
Theres precedent for endorsing a can-
didate whose record is mixed. The Hu-
man Rights Campaign endorsed Obamas
reelection long before he grudgingly en-
dorsed gay marriage (safely after North Car-
olinas ghastly Amendment One passed),
despite his anemic effort on Dont Ask,
Dont Tell repeal, and notwithstanding a
broken promise on employment nondis-
crimination for federal contractors. Log
Cabin isnt going follow HRCs lead and de-
cide too soon; we prefer to see what Mitt
Romney will offer. Log Cabin is trying to
anticipate moves in a complicated game.
Ultimately, the organization will make
the decision we feel best represents the
interests of the LGBT Americans who of-
ten vote conservative. This includes people
like Richard Grenell, who recently wrote in
the Wall Street Journal: Like many voters,
I rarely agree with a candidates every po-
sition. I can support Mr. Romney for presi-
dent but not agree with all of his stated pol-
icies. I can be proud of President Obamas
personal support for gay marriage and still
take exception to his dismal national-se-
curity and economic records. Grenell has
made his decision, while other Log Cabin
Republicans or the national organization
may choose differently.
To endorse or stay neutral? Either could
be a path to victory for gay conservatives
and independents this November.
Enables spouses to end one
chapter, begin another
Once again the ability for same-sex
couples to divorce makes the news. Last
week, the Maryland Court of Appeal held
that two women married in California
could divorce in Maryland, thus establish-
ing that Maryland will recognize marriag-
es between same-sex couples married
outside of Maryland. This week, a new
statute going into effect in the District of
Columbia allows couples that have been
married in the District to divorce in the
District if the couple is unable to divorce
because both of them live in jurisdictions
where their marriage is not recognized.
The District, like all almost all jurisdic-
tions, has a residency requirement for cou-
ples to be eligible to divorce here. This law
creates an exception to that requirement
so that couples who both live where their
marriage is not recognized, but were mar-
ried in D.C., will be able to divorce here.
Since the District has no residency require-
ment to get married here, many couples
have come from around the country to
marry here, but, like opposite-sex couples,
50 percent of those marriages will break up.
Until now, for those couples who both
live in states that do not recognize our
marriages, it has been impossible to di-
vorce without one member of the couple
moving to a jurisdiction that does. Now,
there is a rebuttable presumption in this
new law that any state with laws prohibit-
ing our marriages will not allow same-sex
couples to divorce in that state. So, for
example, Virginia certainly qualies. So
does North Carolina. But, because of the
decision in Port v. Cowan last week, we
can denitely take Maryland off that list.
However, given other legal require-
ments for jurisdiction, couples seeking
such a divorce in D.C. are best advised to
negotiate an agreement covering any is-
sues arising out of their marriage, such as
division of marital property, award of ali-
mony and spousal support, child custody,
support, and visitation, if there are chil-
dren of the marriage. Most couples that
seek a divorce settle these issues before
a divorce is actually granted in any case.
These agreements usually take the form
of a voluntary separation and property set-
tlement agreement that is submitted to the
Court with the request for divorce. In order
to be divorced in the District the couple
must have been separated for at least six
months with no marital relations, and in this
instance the separation must be mutual
and voluntary. In an uncontested divorce,
the couple les a complaint and answer at
the same time and tells the Court that they
have resolved all issues from their marriage.
A 10-minute hearing is usually scheduled
within about six weeks, and only one party
has to appear.
After the divorce is granted, all juris-
dictions should recognize it for all pur-
poses, although I never underestimate
the power of homophobia to affect our
legal rights. Although not perfect, the
new D.C. statute is a very important de-
velopment allowing some married cou-
ples to end a chapter in their lives and
move forward to the next.

When Philadelphia attorney Brian Sims
set his sights on a seat in Pennsylvanias
storied state House last September, the
odds were stacked against him: Not only
would he be a political newcomer, but
he also was running as an openly gay
man in the same state that once elected
virulently homophobic former U.S. Sen.
Rick Santorum.
Seven months later, however, he
won his primary race to represent the
182nd District in the state House of
Representatives, part of a mini trend of
recent gay-supportive political changes
that have some wondering if a progressive
wave isnt starting to emerge in the
Keystone State.
Supporters of the idea point to
Sims, who is running unopposed in
the November election, as well as to
24-year-old gay Harrisburg Treasurer
John Campbell, who is helping the states
capital city cope with its much publicized
bankruptcy. Meanwhile, a state LGBT
Equality Caucus is active, and members of
the House State Government Committee
recently killed efforts to amend the
constitution to ban same-sex marriage.
Campbell, a college student who
hopes to use tax reform to free Harrisburg
from a $300 million debt pileup, believes
Sims election could signal more positive
change to come.
All states that have passed a marriage
equality bill have previously elected an
openly gay legislator, Campbell said,
adding that having an out gay man in the
state House would go far to personalize
the issue of LGBT rights. It really helps
our argument that we are people too.

When Chris Delucchi was diagnosed with breast cancer in the summer of 2009,
she started with the traditional route of treatment she had a lumpectomy
and started chemotherapy.
But while chemo is no picnic for anyone, Delucchi found the treatments
especially toxic. Against her doctors wishes, she turned to a non-traditional,
diet-based approach.
My body just didnt resonate with the high toxicity so I started researching
natural approaches and even found a woman whod tried it who had the exact
same kind of cancer I had, the 46-year-old Portland native says. I did a lot with
juices, wheat grass, a plant-based diet, changing stress levels, having vitamin C
IVs and that sort of thing I dont go out and preach that everybody should
take this approach, but it worked for me and I just had a sense that it would.
She got a clean bill of health in December.
Delucchi will speak more about her experience at a storytelling event Tuesday
at Woolly Mammoth Theatre hosted by Philips Healthcare and the Moth
(themoth.org) to raise breast cancer awareness. Shell be joined by two other
breast cancer survivors for the 7:30 p.m. event. Those interested in attending
should e-mail t.nguyen@togorun.net for details.

sales assistant at the Washington Post where she worked for about three years.
She owns two communications/marketing companies, Delucchi Plus and Blue
Bug Digital, and lives in Cleveland Park. Delucchi enjoys travel, spas, skiing,

Lesbian drama explores
tumultuous relationship
set in Baltimore
By PATRICK FOLLIARD
At last weekends D.C.-area debut
of writer/director Ira Kips new play
SheBaltimore, the scene was set
for a ght, possibly to the death. The
productions spare set suggested a boxing
ring. There were the standard chairs in
opposite corners, but instead of ropes,
the ring was fenced by crime scene tape.
Set in Baltimore, Kips hour-long theater
piece explores domestic violence within
the LGBT community. It focuses on Linay
(also Kip in a nuanced performance) and
her girlfriend Ebone (nicely underplayed
by Nicole McManus). They have their
good times, but when things go wrong
between them, they go toxically wrong,
resulting in beatings and emergency
room visits. Interestingly the playwright
(who declines to state her own sexual
orientation) has somewhat blurred the
lines regarding blame: Yes, its Ebone who
busts her lovers lip, but then again theres
Linays explosive temper. And when Ebone
makes a move to exit what she realizes is
an unsalvageable relationship, its Linay
who pleads with her to stay.
Before coming to D.C., SheBaltimore
premiered in Amsterdam and then
played in Baltimore. In celebration of
D.C. Black Pride, the Blade sponsored
the productions two-night run at the
Warehouse over Memorial Day weekend.
And despite some problems beyond the
productions control loud music blared
from Warehouses neighbor, the New York
Avenue Beach Bar; and Kip was called
upon rather last minute to understudy for
the actor slated to play Linay the May
25th performance was a success.
Kip is a gifted playwright. She seamlessly
shifts from lyrical prose to raw dialogue.
The plays vignette-like scenes can stand
alone, but when strung together theyre
more powerful, taking the audience deep
into what denes the couples disturbing
relationship sexual attraction, beatings,
affection, frustration, anger, drug abuse
its all there. Additionally, Linay and Ebone
come with baggage. Both women are
regrettably estranged from their families
largely due to their sexuality.
The productions ve-member cast was
made up of gay, straight and bisexual black
women. As the narrator, Sherry Richardson
intermittently relayed domestic violence
crimes ripped from the local Baltimore
nightly news. Heather Smith played a
dismissive intake nurse with a bad attitude.
While supplying comic relief, the character
also searingly represents the systems
insensitivity and lack of training. And Nia
Johnson was appealing as Angel, Linays
emotional port in the storm.
A post-show discussion on the plays
theme featuring the cast was led by
production assistant Bakari Jones.
Kip is Caribbean-born. She has lived in
the Netherlands but now calls New York
City home. Her play is partly an indictment
of Americas reluctance to understand gay
peoples lives more fully and its inability
to properly respond to LGBT mental
and physical health issues in relation to
domestic abuse. SheBaltimore puts
the spotlight on important but not widely
discussed topics.

Busy gay singer
makes time for
Trevor benet in D.C.
By JULIETTE EBNER
Matt Zarley will be in D.C. for Paint
the Town for Trevor, the third annual
D.C. Pride fundraiser event for the Trevor
Project at Town (2009 8th St., N.W.) on
June 6 at 6:30 p.m.
Zarley has been involved with the Trevor
Project for about six years. His cover of
Pat Benetars 1984 hit We Belong was
inspired by his work with the organization.
I think [bullying] has always been a
problem, were just more aware of it now,
and I think that theyve been instrumental
in really bringing it to the forefront of
the mainstream, Zarley says of the
organization. What I was really attracted
to was the work that they do and what they
stand for. I just think its really invaluable.
Zarley, a beefy openly gay dance/
inspirational singer based in Los Angeles,
has enjoyed recent fame in a series of
video singles that show off his sense
of humor. Last years WTF was full of
cheeky humor and elaborate design work.
Current single/video Trust Me imagines
him as a U.S. presidential candidate
trapped in a gay sex scandal.
His family started the Zarley Family
Foundation to lend their support to causes
that they, as individuals and collectively
as a family, are passionate about and the
foundation has previously given money to
the Trevor Project.
The foundation has also given money
to the Starkey Hearing Foundation, Casa
Pacica, Boys Town, the Boys & Girls Club
and Broadway Cares.
Zarley sort of grew up in the show
business world, debuting on Broadway in
A Chorus Line while still a teenager. He
has also appeared in Cats, Kiss of the
Spider Woman, Chicago, Joseph and
the Amazing Technicolor Dreamcoat and
The Whos Tommy.
Zarley will also be closing the Broadway
Bares Beach Burlesque show with his latest
single at Fire Island on Saturday. For more
information, visit broadwaybares.com.
I think its important for all of us to support
one another. Its such a niche market and I
think the more we support one another and
reach out ... the more well become a main
stream commodity, Zarley says. I think we
need to embrace each other.
Zarley is in the midst of a busy summer.
Hell also be appearing at various Prides
including San Deigo, Vegas and Reno as
well as Chicagos Market Days, an event
hes always wanted to be a part of.
Zarley has also appeared on television
in Disneys Cinderella, Annie,
Geppetto and Fame. He can also be
heard on the NBCs musical Smash.
He has worked with artists such as
Chaka Khan, Josh Groban, Reba McIntire
and more. His debut album, Debut, was
released in 2002. His sophomore album,
Here I Am had its title track chosen as a
top 20 nalist in the 2008 American Idol
songwriter competition. His latest album,
Change Begins With Me was released
last summer.
In 2002, Zarley was the rst openly
gay bachelor to be named in People
Magazines Hottest Bachelors issue.
People always ask me, Do you feel like
youre taking a risk? Zarley says about
being an openly gay artist. It is what it is
and we are who we are.
Tickets to Paint the Town range
from $50 to $150 and can be purchased
online at thetrevorproject.org. The
Trevor Project is a national organization
providing crisis intervention and suicide
prevention services to LGBT youth. For
more information on Zarley, visit his ofcial
website mattzarley.com.

Jack Rose Dining
Saloon complements
its bounteous liquor
offerings with great food
By JONATHAN HOWARD
A few weeks ago Taste of Pride had
its monthly featured special event
at Jack Rose Dining Saloon (2007 18
th
Street, N.W.). Since Id never been there,
I jumped at the opportunity to try it and
with 10 percent of the sales from the
evening going to Capital Pride, it was a
great time to do so.
D.C. natives Bill Thomas, Stephen King
and Michael Hartzer created Jack Rose
Dining Saloon. The restaurant is made up
of three distinctive spaces. The rst oor
contains an expansive marble-topped bar
along the wall and an elegantly appointed
dining room. The second oor has a private
dining lounge and a casual open-air terrace
that has a separate menu of items from a
barbecue pit. We had reservations to eat in
the rst oor Dining Saloon.
Once seated, our waitress greeted us,
presented us with the whiskey bible, then
the drink and food menus. She asked if we
had any questions. My friend and I gazed
at each other, panic in our eyes, and asked
if she could come back. The bible is the
size of a wine list at an upscale restaurant.
We were going to tackle it at some point
during the night, but we decided to put it
off for the moment. We quickly decided on
mixed drinks. I chose the Jack Rose, which is
Lairds banded apple brandy, grenadine and
lime. It was a refreshing and delicious way
to start the meal. For an appetizer we chose
the Braised Local Pork Belly with salted
radish, herb puree and spiced broth. When
it arrived, you could smell the herbs in the
puree. As we ate it, we discovered that the
pork melted in your mouth. There was just a
touch of heat in the puree.
Once we had nished our appetizer we
let our eyes wander around the full dining
saloon. Pride volunteers and supporters
lled the dining room with boisterous
conversation and positive energy. Beyond
the diners was a truly breathtaking room.
We tried to imagine this space as a former
boxing gym, but with three walls covered
with the close to 1,400 selections from the
whiskey bible, it seemed impossible. The
bottles reached toward the ceiling and
bartenders needed to use the equivalent
of a library ladder to reach the top shelf.
The room itself was outtted with dark
mahogany chairs, wooden tables and warm
leather booths. As you admire the bottles,
your eyes are drawn up to the beautiful
pressed-tin ceiling. Overall, the dining
saloon had a bright, warm and airy feel.
Our meals arrived and I dove right into
my rack of lamb with jalapeno, rutabaga,
okra and mint relish with a pomegranate
and port reduction. My dining partner
ripped into his pork chop special, wrapped
in sausage and puff pastry. We exchanged
a few bites of each others dishes and were
pleased with what we tasted. The jalapeno
and pomegranate combination that
attracted me to the lamb complemented
the juicy tender deep pink meat perfectly.
The pork chop dinner was complex, but
the avors melded together quite well.
The time had arrived. As we nished our
meals it was not only time for dessert but
also to select one of the bottles from the
surrounding walls. I had never had scotch
before, which I sheepishly admitted this to
the waitress. I was greeted with a broad smile
and she readily suggested two options. We
decided to try each of them; a 1-ounce pour
was $6. The Balvenie Doublewood was light
but full of avor; the Auchentoshan triple
wood was full bodied and the stronger avor
seemed more well rounded and purposeful.
Both scotches stood alone as a great way
to end the meal. However, we opted to
pair them with dessert. The vanilla potted
crme brulee was a cane sugar brulee with
blackberry compote. The bread pudding
was paired with Clementine sorbet. Both
desserts were delicious.
Jack Rose Dining Saloon offers a
variety of options for diners. You can opt
for a drink, enjoy some snacks from the
barbecue on the porch, or enjoy a full meal
in the dining saloon. Jack Rose served up
an excellent evening and provided us with
a great new experience.

Spray tans with
DHA safe alternatives
to sun exposure
May is National Skin Cancer Awareness
month, dedicated to increasing awareness
for prevention, early detection and
treatment of skin cancer. But I already
know what youre thinking I dont want
to look pasty white!
So what are the alternatives to sun
exposure and skin cancer? How can you
get that healthy glow without the risk of
skin cancer or ruining your skin? Sunless
spray-on tanning is your best bet and
is a practical alternative to sunbathing.
Airbrushing Hollywood-style is popping
up everywhere, but is it safe?
Applied correctly and carefully, most
sunless spray-on tanning products
containing Dihydroxyacetone, DHA are
safe. For the purposes of this article I am
referring strictly to spray-on tanning and
in particular hand-held airbrushing and
not sun tanning lotions and creams, which
may contain additional chemicals.
I was rst exposed to a sunless
tanning product almost 20 years ago and
I came out looking like a Sunkist orange,
not pretty. And I was at one time a spray-
on tan devotee and was also airbrushed,
but never really thought the results looked
authentic. Not to mention my trepidation
when inhaling the unknown chemicals,
staining my clothing and having orange
palms. While I wont mention the brand
of equipment I was using it was the more
typical stand-up booth style and while
updated, it still exists today.
So how have these techniques evolved
over the past couple decades? I discovered
a new spray-on tanning salon that specializes
in airbrushing that opened recently on the
U Street corridor between 16th and 17th
Street, NW. Fit To Be Tan, ttobetan.com
has joined the ranks of a strip of businesses
that is dedicated to helping you look and
feel your best. From VIDA Fitness, AURA
Spa and Bang Hair Salon to Caramel
clothing, your options are many. And now
makeup and spray-on tanning has been
added to the repertoire of image-conscious
businesses located all in one area.
Interior designer Paul Corrie, also
known as the famous local Peaches from
the Dupont Social Club, and his husband,
Steve Ewens, opened Fit to be Tan in
February. Corrie, an avid spray tanner for
17 years, after his own skin cancer scare,
decided to turn his passion for this sun
tanning alternative into a business. The
agship shop is in Arlington. The Dupont
location also offers professional makeup
services by renowned makeup specialist
Jaime Vasquez. The technicians go through
extensive training and all necessary
standardized precautions are used.
The average cost of a single tan is
around $50 with package discounts
available. While this may seem like a hefty
price to pay, think of the risk and cost
involved in treating skin cancer.
Most reputable sunless spray-on
tanning businesses are using DHA,
which was accidentally discovered by
the Germans in the late 1920s when it
spilled on the skin and produced a brown
color. DHA was approved by the FDA in
the early 1970s as a safe cosmetic color
additive approved for topical external use
only. Today DHA is used worldwide. Its a
simple sugar (glycerin) derived from the
sugar cane plant. This colorless chemical
interacts with the amino acids in dead skin
cells to produce a brown color change.
And since these dead skin cells are
sloughed off continually, the color change
generally lasts ve to seven days. DHA is
not absorbed through the skin and into
the body and has no known toxicity.

Young Iowa man writes
moving memoir of
having lesbian parents
For author Zach Wahls, family has a
familiar meaning to which many can relate,
but his normal is slightly different as he
explains in his new book, My Two Moms.
From the moment he was conceived,
Zach Wahls was a member of an unusual
family.
His mother, Terry, was an unmarried internal
medicine physician at a Wisconsin hospital
when she decided she was ready for children.
But rst, she had to convince IVF doctors to
do the procedure because they said they did
not do illegitimate children.
A few years later, she had the procedure
again with the same donor and gave her
son a biological sister because a family
was what Terry always wanted. It was icing
on the cake when Terry met Jackie and
they fell in love.
For most of his early childhood, Zach
Wahls didnt think much about the fact
that he had two moms. It was no big deal
to other kids, so it was no big deal to him.
When the family moved to Iowa to live
closer to Terrys mother, though, Wahls
encountered teasing and bullying.
But his mothers had raised him with good
values and they instilled a sense of character
in their son. They taught him that boys and
girls are equal but different and that there is
no better gender. They showed him that the
world is rarely black and white. He learned
that words can hurt, and so can being told
you have no rights.
From his Short Mom, he learned
the meaning of commitment and loyalty.
His Tall Mom taught him cheerfulness.
And when Zach Wahls was asked to
testify in front of the Iowa House Judiciary
Committee, both moms lessons of
bravery were evident.
Looking for a book that will warm your
heart and make you proud of young men
like this? My Two Moms will do the trick.
But while the book is endearing, it can be
a choppy read. Wahls (with Bruce Littleeld)
bounces from thought to thought in this
memoir, giving us half a story here, half
there, and something completely different
in between. Thats appealing, in an eager-
puppy sort of way, but this literary spill
makes a mess sometimes.
Still, Wahls main message boldly holds
this book together and overcomes the
chaos to shine through. Love is love is
love, he shows his readers, and gender
doesnt make any difference. Gender is
not what makes a family.
In his book, Wahls asks, in many ways,
Whats the big deal? and I think the
answer lies in his story. If youve been
asking the same question, look for My
Two Moms and pick it up.
Terri Schlichenmeyer has been reading since she was 3
years old. She lives in Wisconsin with two dogs and 12,000
books. Reach her at bookwormsez@yahoo.com.

Sims said LGBT supporters are making
their presence known in the state. He
pointed to widespread support among
Pennsylvanians for a measure to add
LGBT-friendly language to the state
human relations act.
The legislation, House Bill 300, has
stalled several times in committee.
Ive spent years traveling the state
talking about LGBT rights and one of the
things I like to tell people is the state is
not as conservative as people think it is,
said Sims, adding that the states failure
to pass LGBT-inclusive hate crimes and
anti-bullying measures isnt necessarily
reective of constituent sentiment.
Sims, former board president of Equality
Pennsylvania, is poised to become the
states rst openly gay legislator. He has
a background of working with attorneys,
legislators and community organizations
on issues ranging from gender and pay
inequity to environmental regulation. And
though he didnt make LGBT issues a
campaign lynchpin, he plans to continue
including LGBT matters alongside
corporate income tax reform and other
key issues as he moves forward, he said.
He said such matters increasingly
reect the interests and spirit of the state.
The state is progressing we are
growing stronger by the minute, he said.
I dont necessarily know that our current
laws and political structure really do reect
how forward-thinking the people in the
state are.
Opinions of Pennsylvanias progress are
as diverse as its record supporting gay and
lesbian residents. The state has historically
been a maverick on some fronts, among
them the establishment of a state Council
for Sexual Minorities in the mid 70s, and the
recent passage of the states 28th local LGBT-
inclusive non-discrimination ordinance.
And in Philadelphia, home to whats
considered the nations oldest operating
gay bookstore in Giovannis Room, a
vibrant LGBT community thrives, according
to Mark Segal, who has spent 37 years
chronicling the communitys ups and downs
as founder of Philadelphia Gay News.
Society is moving at a brisk pace
toward equality and I think this is
happening everywhere. But you also
have to look at history. Philadelphia is, in
many ways, the birthplace of the LGBT
movement, he said, citing the citys 47-
year history of gay Fourth of July marches
as an example.
But weak spots remain. For one, those
local LGBT-inclusive non-discrimination
ordinances are the result of lawmakers
failure to pass state-level legislation, and
are essentially, local attempts to patch up
gaps in state law.
And even as President Obama announced
his support for same-sex marriage,
Pennsylvania Sen. Bob Casey (D) has remained
conspicuously quiet on the issue.
[Pennsylvanians] reputation in general
is one of being pretty safely in the middle,
and what that means is sometimes theyre
progressive, and sometimes theyre not,
said Ted Martin, executive director of
Equality Pennsylvania. Its a place that
doesnt want to rush out too far nor does
it like to be in the end.
The head of the states main LGBT
advocacy group said he believes
Pennsylvania is growing more progressive,
just very slowly.
He pointed to recent polls showing up
to 51 percent of state residents support
same-sex marriage and said lawmakers
he encounters no longer insist they dont
have any gays in their district.
Are we turning a corner, are we taking
some steps forward? I like to think so,
he said. Were certainly starting to have
a conversation we never had and thats a
good thing.
That conversation comes at a sensitive
moment in regional LGBT politics.
Surrounded by states passing LGBT-
friendly measures, Pennsylvania has
increasingly become an ideological
island, a fact that could have a damaging
economic impact, some say.

Relationships centered
around real estate can
be complicated
By DAVID BEDIZ
A real estate transaction is just as
much a human exchange as a business
transaction complete with emotions,
potentially discordant personalities, con-
stant dialogue and a high stakes nancial
investment. It can be easily complicated
by misunderstandings and can have seri-
ous long-term nancial implications.
So its extremely helpful to have an
agent represent you as a buyer. A buyers
agent is a professional who ensures your
needs are being met, that your rights
have not been ignored and that your pur-
chase is made with as much disclosure as
possible. Their commission is paid by the
sellers, but at times their role is to repre-
sent the position most at odds with those
of the seller.
Sometimes, their efforts to work on
behalf of the buyer may even end up
canceling the whole transaction. Without
the help of a buyers agent, many buy-
ers would purchase homes for too much
money, without enough insight as to the
propertys condition and could even lose
their earnest money deposits due to their
inability to close the deal on their own.
When working with an agent, though,
its important to observe some etiquette
ground rules. Your agent will work best
with you if there is a balance between the
two of you based on respect. If you dont
show your agent the respect you would
appreciate for yourself, his or her motiva-
tion to work as hard as possible for you
may be undermined. Some of these easy
ground rules are as follows:
Remember your agent is a human
being. Humans are capable of amazing
accomplishments, but they are also capa-
ble of mistakes. Dont hold it against an
agent if he or she makes a small honest
error, unless its one that costs you a lot
of money. Forgetting to return a casual
email is an honest error, but missing a
deadline to cancel a contract is a biggie.
Also remember that humans need to
eat, sleep and have a life aside from real
estate. Unless you have previous arrange-
ments with your agent, or unless its truly
urgent, try not to call your agent before 9
a.m. or after 9 p.m. Dont fault your agent
for taking a weekend off every now and
then, or taking a vacation, even when
youre in the middle of a transaction. Just
make sure your agent lines up a support
system for you while he or she is away so
you arent completely on your own.
Dont cheat on your agent. Agents
work long hours without the guarantee
of a paycheck and often without even
the guarantee of your business. Its only
fair, then, that you stay committed to an
agent who has already worked hard for
you. When you choose to engage an
agent in your home search, sign an agen-
cy relationship agreement, even if its for
a short duration. That gives your agent
the condence that you will give him or
her a fair shot at keeping your business
long-term and will encourage the agent
to work hard on your behalf. Extend the
agreement term when youre condent
that your agent and you are a good t,
and in the meantime, dont ask other
agents to work on your behalf. Techni-
cally, you should only call your agent with
questions about any property, too.
If it doesnt work, it doesnt work.
Nobody should be expected to get mar-
ried on the rst date, so if youve worked
with an agent exclusively for long enough
to know it wont work, its OK to say good-
bye. Just make sure you honor the terms
of your agency relationship, and if you
want out early, just ask nicely to be re-
leased. If things get hairy, call your agents
ofce manager to discuss your options.
Agents need to have more than one
client to survive. Unless youre buying
an embassy, its unlikely the commission
from your paycheck would be able to
sustain your agents livelihood on its own.
Be understanding when your agent cant
accommodate your schedule every now
and then due to other client obligations
and try to be exible with times that work
for you. Most agents work such that they
may be called at a moments notice for a
showing, even after hours and on week-
ends. Every now and then they may have
another client when you wish to see a
property, so be patient if the plan must
be postponed or be willing to get up
early or take a lunch break the next day
for a viewing, rather than seeing it one
evening earlier.
These ground rules may make it seem
like you should be completely accom-
modating if your agent makes mistakes,
wont show you property and doesnt
have time for you in general. On the con-
trary, it is simply a reminder that if these
things happen every now and then, they
should not be deal breakers.
You have rightful expectations as well,
and if ever you are working with an agent
who is less professional and more lazy, you
should feel no compunction asking to can-
cel your arrangement and moving on. Ul-
timately, your standing in the transaction
should be beneted by the role of your
agent, but if its not, its OK to cut the cord.
