On 6/6/12 at about 1355 hours, I was in the area between the library and the muni building, 1777 Broadway, city and county of Boulder, CO. Another officer (Officer Perry) and I were checking on loud transients in the area. As I was getting into my patrol car to clear from the previous call , I heard the primary dispatch channel air that there was an indecent exposure at my location and was sending other officers. The suspect was described as a white male with no shirt,fish net stockings and a slip/ skirt. I had just seen a man in that area that was wearing a teal blue skirt, black fishnet stockings and a black tank cotton tshirt. I went to contact that man. He was standing near a bench about 7 cars from where I was parked. I asked him if he had anything under the skirt and he told me no. I gathered his name and DOB, but he had no positive identification on his person. He stated his name was Derek Thor Apodaca 4/4/1985. He had an odor of an alcoholic beverage on his breath. He stated that when he was dancing in the park and noticed the top of his pubic hairs were showing from the top, so he put a tank shirt on and pulled his skirt lower to cover his lower area so that it appeared longer. He said that he was dancing with some girls in the area, but he never exposed himself. Another officer came to cover me, and I went to talk to the victims. A second officer came while I was talking to the 3 victims. I spoke to three city of Boulder employees at 1777 Broadway who were coming back to work from their lunch break on 6/6/12 at 1350 hours. They noticed a man wearing a slip and he was wearing no shirt. They stated that he wasn't wearing anything underneath his skirt. He put on a pair of black fish net stockings and when he did that he showed his penis to them. All three of the employees said the man appeared to lift his skirt up on purpose and show his penis to them trying to shock them. Victim Sharon Danson told me that she was shocked, frustrated and intimated by the man. Victim Debbie Stringham told me that she felt shock. Victim Calder Grey told me that he was he was frustrated and upset that this man would show himself. They will be given a victim's right's pamphlet via inner-office mail. BPD advocates were advised. Sharon Danson was able to identify Derek Apodaca as the person who showed his penis to them. She stated she could see him from her office and officers were in contact with him. Derek had a pair of shorts that we asked him to put on from his property. When he put on his shorts over his tights, he showed his uncircumcised penis in my direction. I told him to be more discreet. Derek was taken to jail by me. Officer Perry took Derek's back pack and put it into property. It's at BPD under the same case number. Per the sergeant on duty, I charged 3 charges of indecent exposure. Status- Cleared arrest.

Apodaca was contacted for "flashing" people. Apodaca was wearing fish-net stockings and a very short skirt. I asked if he had anything else he could put on over the skirt. He advised he had clothing in the black back pack. I brought over the indicated back pack and asked if he had any weapons,drugs, or alcohol in the bag. He advised he did not. I opened the main compartment and took a pair of shorts from the bag and gave them to him to put on. Ofc Barcklow obtained victim information. The party was taken to Ofc Barcklow's squad car. She requested that I book the items into Property and Evidence for safekeeping. Items inventoried at the police department. OK to release all items to owner.

Sue, Thank you for coming by earlier today to handle our situation. I wanted to get you a statement before I get busy and forget. We were coming back to work and drove into the parking lot. It was Debbie Stringham, Calder Grey and myself. We ended up driving around a little to find a spot before parking. Debbie and Calder had seen the young man at this time. When we did park, we got out and started walking up the sidewalk. As we were walking, we saw the young man in what appeared to be a woman's slip (very short) and some sort of fishnet type of panty hose. As we were walking he lifted the front of the "slip" to adjust his pantyhose. This is when he showed that he had no clothes on under the "slip". As we continued to walk into the muni building, he approached us and asked for a cigarette. Debbie said she doesn't smoke. When we got into the building, I noticed it was approximately 1:50 pm. I had checked the time to see how long we had been at lunch. It was shortly after that the police were called. Thank you, Sharon Danson
