JUDGE REMOVES ERIC MANCH FROM CASE, ATTORNEY NOW FACES STATE BAR CHARGES
On April 09, 2012, after several acrimonious court hearings, Tucson City Court Judge Thomas Berning removed attorney Eric Manch as counsel for Tucson Political Activist Roy Warden in a criminal case raising the following constitutional issue: Do Tucson City Court Judges have the legal authority to suspend the right to speech and assembly, without a hearing, as a condition of release from custody? Today Warden announced he will file a complaint against Manch with the Arizona State Bar on June 11, 2012, charging the attorney with negligence, failure to adequately research the facts, and failure to meet court deadlines. Eric Manch was so ill prepared and so dilatory in discharging his duties to me that the states attorney, William Mills, saw fit to bring Manchs lack of professionalism and competence to the attention of the Arizona Appellate Court, Warden said. Since his first arrest on April 11, 2006 for burning a Mexican Flag in Armory Park, Warden has faced 12 criminal prosecutions, and has been represented by an equal amount of court appointed attorneys. Most court appointed attorneys Ive met are hard working, decent, men and women, who, under difficult circumstances, take on the occasional court appointment and do the best they can, says Warden. Eric Manch is the exception. He has no private practice to speak of. People in need of legal services do not seek him out. In fact, his entire practice seems to be court appointments. I checked over in federal court; there hes been appointed in nearly a hundred and fifty

cases. Warden contends that attorneys like Manch have become a vital part of what he calls, the industry of open borders and illegal immigration. These are the hacks, the marginal guys who couldnt make a living without the court appointments they get consequent to the extraordinary amount of cases that now pass through the system. Moreover; Warden says that lawyers like Manch, who depend upon government appointments for their entire livelihood, become loyal to the interests of government rather than the interests of clients theyre appointed to defend. Guys like Eric Manch are hired to sweep the effluent through the justice system, to plead people out, to make the system look good, not to make waves or represent the accused, said Warden. Warden has a case now pending in U.S. District, Court contending that, ever since the Riot in Armory Park in 2006, high level Tucson City employees, including former Police Chief Richard Miranda, the city manager, the city attorney, and city court judges who issue orders they know to be unconstitutional, have worked together to silence his speech regarding Tucson City Open Border Policy and the unlawful entry of millions of impoverished Mexicans across the Arizona border. Eric Manch refused to present this evidence to the court. This is the first time an attorney appointed to represent me failed to present the facts, Warden said.
