ARTICLE I: NAME AND LOCATION

Section 1: Name The name of this Association shall be the NATIONAL COUNCIL OF BUILDING DESIGNER CERTIFICATION (here-in-after referred to as the Council, or as NCBDC).
A. The Council shall develop and adopt a logo design signifying the name National Council of Building Designer Certification. Such logo to be used on all official advertising, letterheads and other documents.

Section 2: Location Offices of the National Headquarters shall be located in a state as determined by the Council. It shall be incorporated as a nonprofit corporation in the state, or states, as designated by the Council.
ARTICLE II: OBJECTIVES

Section 1: The objectives of the Council shall be: A. To write, publish, administer and maintain an exam designed to test the applicants ability to meet the minimum requirements required of certification, as established by the Council. B. To delineate the minimum professional qualifications and performance standards for Certification as a Professional Building Designer, here-in-after referred to as a Certified Professional Building Designer (CPBD).
ARTICLE III: CERTIFICATION

Section 1: Requirements (amended 7/9/1998) A. An individual who regardless of the registration or licensing requirement of their state or country of residence: 1. Has been engaged in the professional practice of building design for at least six (6) years, and: 2. Devotes fifty (50) percent, or more, of their working time to the profession of building design, and not more than three (3) years of the required six (6) year requirement shall consist of training or courses relating to architecture or structural engineering in accredited universities, colleges, vocational or correspondence schools, or employment and on-thejob training, under the supervision of a Professional Building Designer, architect or professional engineer. 3. Determination of actual time credits to be allowed shall be the responsibility of the Board of Examiners Executive Committee. 4. Applicant must submit three letters of recommendation from a builder, building official, Certified Professional Building Designer, architect or engineer along with three sets of separate working drawings for projects the applicant personally prepared and that meet the minimum plan standards as established by the Council, along with the completed application and appropriate fees. Section 2: Privileges A. Upon certification, may use the NCBDC Seal to certify plans and documents completed by them or under their direct supervision. B. Upon certification, may use CPBD as a part of their title.

C. Upon certification, may be entitled to any other privileges as might be provided from time to time by the Council.

Section 3: Seal and Certificate (amended 7/9/1998) A. The Council shall design and adopt a seal and certificate that may be issued to all building designers awarded certification. 1. No CPBD shall affix their seal to any document or drawing they did not prepare, or was not prepared under their supervision, and in compliance with the rules and regulations of the National Council of Building Designer Certification. 2. Replacement of lost, stolen or damaged certificates and seals shall be issued upon payment of a fee established by the Council. B. The Council shall develop and execute a Seal and Certificate Agreement with each certified building designer who receives a seal and certificate. Such agreement shall acknowledge ownership and guarantee return of the seal and certificate should termination of certification be initiated. Section 4: Termination of Certification A. When it appears to be in the best interest of the Certification Program, the certification of any individual may be terminated by a two-thirds vote of the Council. B. Termination of certification is automatic, when reason is non-payment of annual renewal fee. C. The certification of an individual will be terminated should they fail to maintain the continuing education credits as specified in the Book of rules. Section 5: Re-certification A. Previous CPBDs who are eligible for re-certification shall pay a re-certification fee and petition for recertification in accordance with the Book of Rules. Section 6: Reciprocity and Transfer (amended 7/9/1998) Waiver of the certification examination may be granted by the Board of Examiners to any applicant who can offer appropriate documentation of having received licensing as an architect or civil or structural engineer within the United States or its Territories, or other such criteria that is deemed appropriate and equivalent to such licensing. Section 7: Retirement Status (amended 1/13/00) A. Requirements: 1. Any member who, having reached the time in their life whereby their participation in the practice of building design is minimal and for all practical purposes can be considered retired; upon request may change their status to that of retired CPBD 2. Shall not be counted for quotas for representation on the Council. 3. Shall not be required to submit continuing education credits. B. Privileges 1. May retain all rights and privileges for the certification when retiring in good standing. 2. May be entitled to other privileges as might be provided from time to time by the Council as established by the Book of Rules.
ARTICLE IV: GOVERNMENT

Section 1: Districts A. In accordance with the by laws, the Council is required to establish districts to define the number on the Board of Examiners, which will be defined in the Book of Rules.

B. There shall be two Examiners from each district.

Section 2: Affiliate Associations A. The Council may enter into agreements with states, associations or other entities with similar professional interests, to administer the certification exam for their program.
1. Such affiliations must be approved by a majority vote of the Council.

Section 3: Council Representatives A. The Board of Examiners shall notify the Certified Professional Building Designers in each state where there exists three (3), or more, practicing Certified Professional Building Designers that representation on the Council shall be determined as follows. 1. Affiliated associations, or other entities, shall appoint one representative to represent their constituents on the Council. 2. Where there are active state societies of AIBD, the state society may appoint, or elect, a CPBD to serve on the Council. 3. Where a state society does not exist, the AIBD President shall appoint, from the AIBD membership, one CPBD to serve on the Council. 4. In addition to the AIBD members, the Council President shall appoint from non affiliated members one representative to serve on the Council. B. Council members shall serve a minimum term of one (1) year Section 4: Board of Examiners A. The Council shall elect from its representatives a Board of Examiners. B. The Board of Examiners shall consist of two Examiners from each district, elected for terms of three years, and may succeed themselves. Examiners shall also agree to extend their terms of membership on the Council to at least equal their terms as Examiners. C. Any examiner, after having served at least one complete term, may be called on by the Council to serve in the same capacities as are the of the currently serving examiners. (amended 8/00) Section 5: Council Officers The Council shall elect, from the Board of Examiners, a President, Vice President and a Secretary/Treasurer. The term of office shall be for one (1) year.

A. President: The President shall chair the Board of Examiners and the Council and shall direct the
business and affairs of the Board and Council. The President shall preside at all meetings of the Board of Examiners and the Council and shall have the authority to appoint its members to execute the tasks of the Board and the Council. B. Vice-President: The Vice-President shall preside in the absence of the President; perform the duties and execute the powers of the President in succession; and perform such other duties as may be prescribed. C. Secretary/Treasurer: The Secretary/ Treasurer shall perform such duties as are usually performed by secretary/treasurers of such associations or programs.

Section 6: Examiners Responsibilities A. Within their Districts, the members of the Board of Examiners shall be responsible for: 1. Scheduling and administering examinations in accordance with the By Laws 2. Recruiting and training local proctors 3. Promoting to the public and the profession the concept and reasons for certification 4. Acting as public spokespersons for the NCBDC

Section 7: Procedures Manual A. The Board of Examiners shall cause to have written and produced a Manual that describes, in detail, the procedures for administering the examination. B. The Procedures Manual shall be reviewed once each year and revised and/or updated as necessary. Section 8: Meetings (amended 2/8/2001) A. The Council meetings shall be held twice annually. The Board of Examiners shall determine the time and place of such meetings. The purpose of this meeting shall be to: 1. Elect members to the Board of Examiners in accordance with the by laws. 2. Conduct such other business as determined by the president of the Board of Examiners. B. A quorum of a simple majority of current Council representatives, or by proxy, before business involving policy changes, election of officers, or rules changes of the Council can be conducted. Business complying with prevailing rules, bylaws, or policy may be conducted by a simple majority of those Council representatives present at a legally convened meeting of the Council. C. There shall be a meeting of the Board of Examiners to be held in conjunction with the annual meeting of the Council. 1. Additional meetings of the Board shall take place when called for by the president. 2. There shall be a quorum of a simple majority of current Board members in attendance or by proxy before any business of the Board can be conducted, including elections.

D. Only items of business that have been announced on the agenda may be presented for a vote at the meeting. 1. Any new material introduced at the meeting, regarding issues posted to the agenda, will cause the voting to be postponed to a later date. 2. Any new business presented at the meeting may not be voted on at the Council meeting. It must be presented, along with all related material(s), by postal mail, or e-mail at a later date, or at the next meeting, to be voted on.
Section 9: Budgets A. It shall be the responsibility of the Board of Examiners to approve a minimum annual budget for the coming fiscal year. This budget shall be approved by the Council at the annual meeting. B. The budget, in addition to establishing anticipated income and expenses, shall review the fees as established in the Book of Rules, determine their adequacy and adjust them as deemed appropriate.
ARTICLE V: EXAMINATION

Section 1: Exam Application Procedures A. All non-affiliate applicants for testing must submit a completed application form along with all-pertinent documents and fees. The Board of Examiners shall review the application and all documents and may either approve the application, reject the application, or return it as incomplete. B. All Affiliate applicants must submit all required fees, a completed application along with proof of affiliate membership in good standing and document that they meet the requirements for certification as required by these by laws. Section 2: Supplemental State Requirement A. State governments who might require certification for their licensing requirement, CPBDs who are organized into groups or who are a part of an affiliated organization, may submit to the Board of Examiners additional requirements for certification within their individual program.

B. States submitting a supplemental requirement to be reviewed by the Board of examiners shall send copies (one for each Examiner and one to be kept on permanent file) of the complete requirement, in all its versions. Should the requirement be in an exam form, they must also submit the correct answers and signify what should constitute a passing grade. C. The State must also submit documentation substantiating the unique issue(s) requiring a separate state requirement. D. The Board of Examiners shall review each supplemental requirement to insure that it is in compliance with the requirements of the by laws and that it is within the guidelines and goals of the certification procedure as stipulated by the Council. E. Once approved, no changes may be made to the supplemental requirement without written authorization by the Board of Examiners. F. It shall be the states responsibility to verify to the Council that an applicant has successfully completed the supplemental requirement. Certification will not be awarded until that state societys secretary receives written notice. ARTICLE VI: GOOD OF THE COUNCIL

Section 1: Continuing Education (amended 1/15/2005) A. The Council shall adopt a Continued Education and Re-Certification Policy. B. Failure to validate Continued Education and Re-Certification as prescribed by the policy shall result in loss of-certification in accordance with the by laws. Section 2: Disciplinary Action A. All disciplinary action is to be initiated by the Board of Examiners and presented to the Council for judgment. It shall be the responsibility of the Board to review, investigate and make a recommendation on all complaints brought against any CPBD. 1. Complaints that involve any code of ethics shall be submitted to the Ethics Committee for review and recommended action. Should the complaint be against a member of an affiliated association, the grievance committee of that association shall be appraised of all information and resulting action regarding the complaint. The Ethics Committee shall submit its recommendation to the Council. 2. All other complaints and recommended action shall be submitted to the council for judgment by the Board of Examiners. B. In the event a CPBD is de-certified, the Board of Examiners shall be responsible for causing the retrieval of the issued seal and certificate as stipulated by the Seal and Certificate Agreement. C. Except in the case of automatic de-certification as stipulated in the by laws, the Board of Examiners may recommend other forms of discipline to the Council, including fines, letters of reprimand, suspension, probation or other such action as might be deemed appropriate. D. The Council is not mandated to follow the recommendations of the Board. A two-thirds affirmative vote by the Council shall be required for action involving loss of certification, a simple majority for other actions.

Section 3: Appeals 1. Disciplinary Actions Any action involving any Certified Professional Building Designer by any committee may be appealed to the Board of Examiners. Any action involving any Certified Professional Building Designer by the Board of Examiners may be appealed to the full Council. All decisions of the Council shall be final. 2. Examination Scores Any applicant who fails any portion of the examination may appeal their score to the Board of Examiners. If the Board of Examiners upholds the score, the applicant may appeal to the Council. All decisions of the Council shall be final. 3. Appeals 1. Appeals must be in writing to the Board Secretary, fully describing the circumstances and reasons for appeal and must be submitted within sixty (60) days of the action that caused the appeal. 2. All appeals shall be heard at the next regularly scheduled meeting of the Board of Examiners, or Council, following receipt of the appeal.
ARTICLE VII: COUNCIL TRADITION

Section 1: Certified Professional Building Designer Certificate A. The CPBD certificate, as represented by the CPBD CERTIFICATE DESIGN exhibit, may only be displayed by Certified Professional Building Designers in good standing and in an approved manner. Section 2: Certified Professional Building Designer Seal A. The CPBD stamp, as represented by the CPBD SEAL DESIGN exhibit, may only be used by Certified Professional Building Designers in good standing and in an approved manner. Section 3: National Council of Building Designer Certification Logo A. The NCBDC logo, as represented by the NCBDC LOGO exhibit may only be used by Certified Professional Building Designers in good standing and in an approved manner.
ARTICLE VIII: BY LAWS

Section 1: Certification and Inspection of By Laws The original, or a copy, of these By Laws as amended or otherwise altered to date, certified by the President, shall be open to inspection by any member of the Council. The Board shall cause to be published from time to time, these By Laws, a copy of which shall be provided to all CPBDs upon request. Section 2: Amendments (amended 7/9/1998) These by laws may be amended at any regular meeting of the Council, or by mail ballots which are received within 30 days of the post mark of the notice of such proposed changes, by a two-thirds affirmative vote. Whenever a new By Law or an amendment is adopted it shall be copied in an Official Book of By Laws in the appropriate place. If any By Law is repealed, the fact of the repeal with the date on which the repeal was enacted shall be so noted in the book and all other parts affected by the change shall also be changed.

Section 3: Ballot Voting A. Form of the ballot. Ballots shall be printed for distribution at the proper time as might be designated by the Council Officers. Each question to be voted on appears on the ballot with a list of the possible answers beside blank spaces, so the voter can check the answer he/she desires. Two or more questions may be listed on the same sheet, provided that each is marked in such a way that there can be no confusion. B. Non-secret ballots. If the vote is not to be secret, the following items should be sent to each qualified voter: 1. a printed ballot containing a space for the voters signature, to ensure against votes being cast by other than legal voters, together with full instructions for markings and returning by the required date: and 2. a specially recognizable, self-addressed, return envelope with the name and address of the person designated to receive the marked ballot. C. Secret ballot. If the vote is to be secret, an inner return envelope, with a space for the voters signature placed on its face instead of on the ballot, should be sent to the voter with the ballot, in addition to the self-addressed outer envelope described above. The ballot sent to the voter should be pre-folded a sufficient number of times so that when returned marked and refolded in the same manner and sealed in the inner envelope, there will be no chance of accidental observance of the members vote by the teller who removes the ballot from the inner envelope. In the procedure by which the tellers remove the ballots from the inner envelopes, each envelope and ballot is handled in the following manner: 1. the signature on the envelope is checked against the list of qualified voters; 2. the voter is checked off on the list as having voted; and 3. the envelope is opened and the ballot is removed and placed, still folded into a receptacle. When all inner envelopes have thus been processed, the ballots are taken from the receptacle and counted. Section 4: Parliamentary Authority Roberts Rules of Order (Newly Revised) Latest Edition, shall govern as the official parliamentary authority in all matters of procedure not otherwise covered in these By Laws.

B. Examination Fee:

Rule 102: Fee Invoicing (amended 1/15/2005) A. Annual Renewal fee invoicing from the Council shall be posted to a CPBD no later than Forty-five (45) days before the payment due date. This shall determine the due date. B. Thirty (30) days past due date shall determine the grace period. A CPBD may make an annual renewal payment after this time, but will also be required to pay a $10.00 late fee. Rule 103: Prorating Fees (amended 1/15/2005) A. Applicants who pass their certification examination during the third fiscal quarter shall have their next fiscal year annual fees prorated to fifty percent (50%). B. Applicants who pass their certification examination during the fourth fiscal quarter shall be in good standing through the following fiscal year. Rule 104: Waiver of Fees (amended 1/15/2005) Fees may only be waived if:
A. A two-thirds affirmative vote of the Council approves a requested waiver. A hardship has been applied for and granted by a simple majority vote of the Council.

SECTION II: DISTRICTS

Rule 201: Districts A. Northwest District shall consist of the following states: Alaska, Idaho, Montana, Oregon, Washington and Wyoming. B. Southwest District shall consist of the following states: Arizona, California, Hawaii, Nevada and Utah; all U.S. Territories in the Pacific Ocean. C. North Central District shall consist of the following states: North Dakota, South Dakota, Iowa, Illinois, Indiana, Michigan, Minnesota, Nebraska, and Wisconsin. D. South Central District shall consist of the following states: Arkansas, Colorado, Kansas, Louisiana, Missouri, New Mexico, Oklahoma and Texas. E. Northeast District shall consist of the following states: Connecticut, Delaware, Kentucky, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Ohio, Pennsylvania, Rhode Island, Vermont, Virginia and West Virginia. F. Southeast District shall consist of the following states: Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina and Tennessee; all U.S. Territories in the Atlantic and Caribbean Oceans.
SECTION III: ADMINISTRATION

Rule 302: Expense Reimbursement A. Legitimate expenses incurred by any member of the Council, Board or anyone acting at their directive, while conducting the business of the Council, shall be reimbursable by the treasurer of NCBDC upon receipt of written authorization by the President

1. Legitimate expenses include reasonable expenses, airfare and hotel expenses for two nights.
An initial maximum of $45.00 per day has been established, and will periodically be reviewed, for reasonable expenses, which include, but are not limited to, meals, parking and shuttle. (amended 11/96) 2. All reimbursable expenses must be authorized prior to incurring either by confirmation by the Board, or as authorized within the Examiners Procedure Manual, or other document approved by the Council. 3. All requests for expense reimbursement shall be submitted in writing (including copies of all receipts and/or invoices) to the Board within ninety (90) days of the incurred expense.

Rule 303: Record Keeping A. All records of Council business shall be kept in accordance with good business practice and/or as prescribed by applicable state or federal law. B. Copies of completed examinations shall be kept as follows: 1. Those portions of the examination that are passed by the examinee shall be destroyed forty five(45) days following the grading of the exam by the examiner responsible for its administration. 2. Those portions of the examination that are not passed shall be kept for a period of sixty (60) days after the examinee is notified of their results, and then destroyed. A. All exam applicants shall be notified, prior to sitting for the exam that they will have sixty (60) days after official written notice of their results has been sent to them to appeal those results. (See Rule 309 for appeal process.) B. In the event of an appeal, those portions of the exam that are being appealed shall be kept until such appeal has been heard and decided. After such decision, the exams shall be destroyed. C. The results of all examinations shall be recorded in a permanent file that shall be kept in perpetuity.

D. A confidential file shall be kept for each building designer awarded certification. Such file shall contain the CPBDs examination results and any other pertinent information as might be determined by the Board of Examiners. 1. This file shall be kept active so long as the designer is certified. 2. This file shall be kept for a period of five (5) years after certification should such certification be terminated. It shall be reactivated if the designers certification is reinstated in accordance with the by laws and these Book of Rules. SECTION IV: EXAMINATIONS

Rule 401: Dates and Locations (amended 8/00) A. It shall be the responsibility of the board of Examiners to insure that the exam is scheduled to be given at least one time each year in each district. B. The examination shall also be given in any geographical area whenever seven (7) four (4) or more applicants have applied to take the examination. (amended 6/8/01) C. The Board of Examiners may also schedule the examination for less than seven (7) four (4) applicants whenever it can be demonstrated that the expense of administering the exam will not exceed the application fees received from the applicants. (amended 6/8/01) D. The examination may be administered by special arrangement with the examiner, and NCBDC. E. The Board of Examiners shall be responsible for determining (or approving) the city where each examination is to be given. 1. The Examiner closest to that city shall be responsible for securing a site suitable to giving the examination. 2. The site shall be quiet and have adequate accommodations and space for the number of applicants scheduled to take the exam. 3. The cost of the site (if any) shall be approved by the Treasurer, their designated Officer, and Staff in advance and must be within the approved budget. F. A 90 day advance written notification to the NCBDC office is required to schedule an exam. Notices should include exam date, City, State, address, examiner name and number. The NCBDC office will then notify surrounding non-certified Professional Building Designers of the impending exam. (amended 11/96) G. A 60 day confirmed registration is required by exam applicants. Under no circumstances will applicants be accepted less that 30 prior to the exam. Applicants will be sent, by the NCBDC office, confirmation of the exam date, time, place and examiner, upon approval of application.(amended 11/96) Rule 402: Exam Administration A. Examinations shall be administered under the direct supervision of a member of the Board of Examiners. B. All Exams shall be scored by the Examiner administering the Exam. Results should be mailed or faxed immediately to NCBDC, whereby formal notification of the results will be forwarded to the examinee. (amended 11/96) C. The Board of Examiners may appoint, in each district, as many exam proctors as it deems necessary to assist in administering the exam. 1. Exam proctors shall be under the direct supervision of the Examiner closest to the scheduled exam. 2. All exam proctors must be Certified Professional Building Designers. 3. All exam proctors must have been thoroughly trained and have a copy of the Procedures Manual. 4. Exam proctors may be utilized to administer retakes of failed Exam portions, without direct supervision of an Examiner.

Rule 403: Re-examinations A. Any applicant who fails to pass any portion of the exam shall be entitled to re-take that portion of the exam at a later date. There shall be no limitation on the number of times an examinee may retake any exam portion. B. The Board of Examiners shall insure that the re-take examination is offered within four (4) months of the previous exam at a location convenient to the process. C. Any applicant who fails to pass all portions of the examination within five years of having taken the initial exam must re-take the entire examination in order to become certified. Rule 404: Completion Requirements A. The minimum requirement for a passing score shall be by obtaining 70%, or more, correct answers on all examinations. Rule 405: Reinstatement of Certification (amended 1/15/2005) A. All formerly Certified Professional Building Designers with three (3) years or less of termination who are eligible to reinstate their certification, may do so by submitting a written petition to the Board of Examiners stating their desire to become re-certified and providing proof that reinstatement and past due annual renewal fees, including late fees, have been paid. In addition, the Board, shall require the petitioner to submit proof of (8) CE hours of Continued Education for each year of de-certification or three (3) sets of separate working drawings, prepared within 9 months of reinstatement /re-certification, for projects the applicant personally prepared and that meet the minimum plan standards as established by the Council. A CPBD with more than three (3) years of termination must follow the same procedures as required for a new applicant. B. The Board shall submit the petition for reinstatement along with recommendations to the Council. The petition shall be granted by a majority of votes of the Council present at a regularly scheduled meeting. Rule 406: Examination Applications (amended 6/8/01)

A. The Board of Examiners shall cause to have published an examination application that shall provide the applicant with adequate information to submit a complete application. B. The completed application and examination fee is to be sent to NCBDC headquarters where it will be processed and the funds deposited in NCBDCs account. The headquarters staff shall notify the Board of Examiners of the application within 10 days of having received the application. C. The staff shall send, to the applicant a confirmation letter along with study guides and materials deemed necessary by the Board of Examiners. The applicant shall also be notified of the next scheduled examination date and location.
Rule 407: Alternating Examinations A. The Board of Examiners shall create a minimum of three complete examinations that shall be designed to avoid familiarity with the material. B. The Board shall adopt a procedure to insure that examinees do not re-take the same exam. Rule 408: Examination Revisions and Updates A. The Board of Examiners shall undertake a review of the complete examination each three-year period to insure that it adequately reflects the building design profession and the goals of the Council. B. The Board of Examiners shall create a public policy that encourages Certified Professional Building Designers to submit, for review and approval, exam questions that might be incorporated into the examination.

SECTION V: RULES

Rule 501: Certification and Inspection A. The latest edition, or a copy of the Book of Rules, as amended and certified by the secretary, shall be open to inspection by any Certified Professional Building Designer. B. The Board of Examiners shall cause these rules to be published, and a copy of which shall be provided all Certified Professional Building Designers. Rule 502: Amendments and Review (amended 7/9/1998) A. The Book of Rules may be amended, by mail ballot, of the Council by a simple majority affirmative vote received within thirty (30) days, or at any regular meeting of the Council by a simple majority affirmative vote. B. Whenever a rule is adopted, amended or repealed, the change shall be copied in the official Book of Rules in its appropriate place, along with the date of action. C. The secretary shall cause an annual review and update of the Book of Rules to be completed prior to the following annual meeting of the Council,
SECTION VI: STANDING COMMITTEES

Rule 601: Committee Compositions A. When a committee contains more than one member, the geographic composition of the committee members should be distributed between the Examiner Districts, unless deemed to be impractical. B. The president of the Board of Examiners shall be responsible for appointing committee members and shall be an ex-officio member of all committees in a non-voting capacity. The same prerogative afforded members of the committee shall apply to the ex-officio member. a. Nominating Committee 1) The immediate past president of the Board of Examiners shall be the nominating committee chair for the following term. 2) The president shall appoint a minimum of two additional Council members to the committee. 3) The committee report and recommendations shall be forwarded to the president no later than 24 hours prior to the Councils annual meeting and election of officers. b. Certification Committee 1) The Council shall maintain a Certification Committee consisting of three Council Members 2) The committee shall be responsible for promoting to the public as well as the profession the concept of certification. 3) The committee shall be responsible for reviewing and making recommendations for revising and updating the certification process. c. Education Committee 1) The Council shall maintain an Education Committee consisting of three Council members. 2) The committee shall be charged with the promotion, or production, of educational workshops and seminars that would be beneficial to the building design profession. 3) The committees shall be responsible for the maintenance and enforcement of the Councils continuing education policy, requirements and guidelines. d. Ethics Committee 1) The Council shall maintain an Ethics Committee consisting of three members of the Council.

Building Designers Code of Ethics as it applies to Certified Professional Building Designers in accordance with this Book of Rules. 3) The committee shall formulate, produce and review advertising guidelines for CPBDs every three years. SECTION VII: CONTINUED EDUCATION AND RE-CERTIFICATION (added 1/15/2005)

Rule 701: Continued Education A. All Certified Professional Building Designers are required a minimum of eight (8) continuing education (CE) hours each fiscal year starting with the first renewal date of certification. 1. Applicants who pass their certification examination during the third fiscal quarter shall have their required CE hours reduced to fifty percent (50%). 2. Applicants who pass their certification examination during the fourth fiscal quarter shall not be required CE hours the following fiscal year. 3. The fulfillment of this requirement shall be necessary to maintain certification. 4 CE hours do not carry over from year to year. CE hours submitted to the NCBDC shall always be posted to past due year(s) first. 5. CE hours cannot be earned by duplication of tests, events, courses, etc., that has previously been take/submitted. 6. Approval of an individuals CE hours shall be made at the discretion of the Educational Committee after review, and after verification of submitted CE form(s) and proof of participation. 7. Reporting of CE hours shall be submitted to the NCBDC on a completed NCBDC CE form with proof of participation / attendance. CE hours shall be submitted at the same time with the annual renewal fee. Any grace periods and past due dates that apply to the annual renewal fee shall also apply to the CE reporting. 8. Submission of fraudulent CE hours by either individuals or affiliate organization on behalf of an individual will be subject to disciplinary action by the Board of Examiners.
B. CE hours shall be based on, but not limited to, the following guidelines 1. Classroom credit from accredited universities, colleges, vocational or technical training institutions (or equivalent contract through a correspondence course), in courses relating to architecture, design, engineering, business or related skills; 2. Educational, building codes or career-related self-improvement seminars and workshops; AIBD national or society presented seminar or event, AIA approved CE courses or any code-related course, 3. Three (3) CE hours for the first year, and one (1) hour for subsequent years service on planning commissions, local government, architectural/design control committees, etc. 4. Three (3) CE hours for writing and publishing in any media an article related to the profession of building design. 5. Three (3) CE hours for developing and presenting an educational workshop seminar. Submit seminar documentation for review. 6. Three (3) CE hours for teaching a 12-hour (or more) building design related course or for hiring/teaching an intern for a three (3) month period, or more. 7. One (1) CE hours per year for an accepted entry in the annual AIBD national design competition, regardless of the number of entries submitted. 8. Architectural tours or documented architectural travels. Adequate documentation must be submitted for review and evaluation. 13

9. Two (2) CE hours per project for participation in either design or construction of charitable projects, e.g. Habitat for Humanity.

Rule 702: Re-Certification A. In lieu of submitting Continued Education hours annually, Certified Professional Building Designers may elect to apply for re-certification every third fiscal year starting with the first renewal date of certification. 1. A request for re-certification shall be submitted to the NCBDC on a completed NCBDC recertification application along with the reinstatement /re-certification fee and three (3) sets of separate working drawings, prepared within 9 months of re-certification, for projects the applicant personally prepared and that meet the minimum plan standards as established by the Council. 2. The fulfillment of this requirement shall be necessary to maintain certification. 3. Approval of an individuals re-certification shall be made at the discretion of the Continued Education Committee after review, payment and after verification of continued adherence to the minimum plan standards as established by the Council. 4. Re-certification shall be applied for at the same time with that fiscal years annual renewal fee. Any grace periods and past due dates that apply to the annual renewal fee shall also apply to re-certification.
