Enacted on 17th may 2000 India is 12th nation in the world to adopt this law

Based on Model Law on e-commerce adopted by UNCITRAL


Provides legal recognition to data exchange carried out by any means of electronic communication

Comprises of laws related to cyber crimes electronic and digital signatures Intellectual property data protection and privacy

Objectives of this law facilitate electronic filing of documents, to accord legal inviolability to all means of electronic data communication and the accepted contracts by the electronic means. Extends to whole India Also applies if offense committed outside India by person from any nationality IT law forces to make amendments in following acts Indian Penal code 1862 Indian evidence act 1872 The bankers book evidence act 1891 Reserve bank of India act 1934

Digital Signature
Mathematical scheme for demonstrating the authenticity of digital message or document.

Passwords, pin numbers and biometric signatures


Eg: ATM card holder- cash withdrawal pin number Types - public and private keys

Section 3 - Digital Signatures


Any subscriber may authenticate an electronic record by affixing his digital signatures Authentication of electronic record shall be affected by use of asymmetric crypto system and hash function

Electronic Documents
Information that requires electronic device to display, interpret and process Laws require information communicated on paper or writing Electronic documents are not mentioned in these laws Section 4 - Legal recognition of electronic records

Information or any matter shall be in writing or type written or printed form, shall be deemed to have satisfied if such information is made available in electronic form accessible so as to be usable for a subsequent reference

Section 66(A) - Sending of offensive or false messages Section 66(B) - Dishonestly receiving stolen communication device or computer resource

Section 66(C) - Dishonestly using someone elses electronic signature password or unique identification feature
Section 66(E) - Acts like hiding cameras in hotel rooms and changing rooms Section 66(F) - It applies to people who uses cyberspace to threaten the unity, integrity, security and sovereignty of India.

Misuse of IT Act
Henna Bakshi - booked for posting abusive comments on Chandigarh traffic police's Facebook page Sunil Vishwakarma was detained by Palghar police for allegdly posting anti-Raj Thackeray remarks on his Facebook page West Bengal police arrested a Jadavpur University professor for allegedly spreading "antiMamata Banerjee" cartoons on the internet Ravi Srinivasan was arrested for tweeting "Got reports that Karti Chidambaram had amassed more wealth than Vadra Shaheen Dhada and Renu Srinivasan were arrested after Shaheen criticised the November 18 shutdown for Shiv Sena chief Bal Thackeray's funeral and Renu "liked" the Facebook post
