The Professional Regulatory Board on Real

Estate Service (PRBRES) invited formally


organized stakeholders in the Philippine
Real Estate Industry to attend on April 28,
2010 the
APO Organization Meeting
with all the members of the Professional
Regulatory Board on Real Estate Service
(PRBRES) present seating en banc, at the
Ballroom 1 (GF) of the Hyatt Hotel &
Casino, 1588 Pedro Gil St. cor. M. H. Del
Pilar St., Malate, Manila.

In response, the distinguished Incumbent


Presidents, and/or Chairmen of the Board,
and/or Members of the Board of
Directors/Trustees and/or Officers of twentyfive (25) national associations and national
organizations which comprise more than
seventy-five percent (75%) of the
stakeholders in the Philippine Real Estate
Industry heeded the invitation to the APO
Organization Meeting by the Professional
Regulatory Board on Real Estate Service
(PRBRES) and attended the 28 April 2010
meeting.

Upon the suggestion of the honourable members of


the Professional Regulatory Board on Real Estate
Service (PRBRES) seating en banc, the distinguished
participants approved and adopted the style name

Philippine Institute of Real Estate


Service
Practitioners (PhilRES) Incorporated
as the name of the Accredited and Integrated
Professional Organization (AIPO) that shall be formed.

After some lengthy discussion and debate, upon


parliamentary query by Mr. Enrico Melchor G. Sevilla
(IPREC President 2010) directed at the honourable
members of the Professional Regulatory Board on
Real Estate Service (PRBRES),
whether the distinguished ladies and gentlemen
then present at the APO Organization Meeting could
form themselves as a Convenors Group for the sole
purpose of establishing the contemplated Accredited
and Integrated Professional Organization (AIPO) as
required by Section 34 Article IV of R. A. 9646,
the Honorable Members of the Professional
Regulatory Board on Real Estate Service (PRBRES)
seating en banc, unanimously responded to the
parliamentary query by Mr. Enrico Melchor G. Sevilla
in the affirmative.

After some further discussions, upon joint motion


by Mr. Enrico Melchor G. Sevilla (IPREC President
2010) and Mr. Moises Canayon (NAR Phils. President
2010), the distinguished ladies and gentlemen then
present at the APO Organization Meeting,
approved by majority vote the formation of a 25man Convenors Group that shall spearhead and
undertake the formation of the Accredited and
Integrated Professional Organization (AIPO)
pursuant to the provisions of Republic Act No. 9646
(Real Estate Service Act of the Philippines) and
Professional Regulation Commission Resolution No.
2004-178 Series of 2004.

Upon motion from the floor by Mr. Julius G. Topacio


(REBAP Chairman of the Board 2010), the
Professional Regulatory Board on Real Estate
Service (PRBRES) seating en banc, unanimously
approved and ratified the collective action for the
formation of a 25-man Convenors Group that shall
spearhead and undertake the formation of the
Accredited and Integrated Professional Organization
(AIPO) pursuant to the provisions of Republic Act
No. 9646 (Real Estate Service Act of the Philippines)
and Professional Regulation Commission Resolution
No. 2004-178 Series of 2004.

The Professional Regulatory Board on Real Estate


Service (PRBRES) seating en banc, thereafter declared
a recess in the formal proceedings to enable the
formation of a 25-man Convenors Group from among
the distinguished Incumbent Presidents, and/or
Chairmen of the Board, and/or Members of the Board
of Directors/Trustees and/or Officers of twenty-five (25)
national associations and national organizations which
comprise more than seventy-five percent (75%) of the
stakeholders in the Philippine Real Estate Industry then
present that shall spearhead and undertake the
formation of the Accredited and Integrated Professional
Organization (AIPO) pursuant to the provisions of
Republic Act No. 9646 (Real Estate Service Act of the
Philippines) and Professional Regulation Commission
Resolution No. 2004-178 Series of 2004.

Nominations for the members that shall


compose the Convenors Group were held
immediately and the following distinguished
ladies and gentlemen were democratically
voted thru viva voce nominations and elections
as the members of the Convenors Group and
agreed that the Convenors Group would meet
again on 06 May 6, 2010 to formally organize
themselves as a juridical entity for the sole
purpose of establishing an association that shall
spearhead and undertake to petition the
Professional Regulatory Board on Real Estate
Service (PRBRES) to be recognized and be
appointed as the Accredited and Integrated
Professional Organization (AIPO) pursuant to
the provisions of Republic Act No. 9646 (Real
Estate Service Act of the Philippines) and PRC
Res. No. 2004-178 Series of 2004.

On May 6, 2010 the Convenors Group met at the


CREBA National Office to formally organize themselves
and form a juridical entity to be known as the

Philippine Institute of Real Estate Service


Practitioners (PhilRES) Incorporated
for the sole purpose of forming an integrated
Association of Real Estate Service Practitioners
consisting of licensed real estate consultants, licensed
real estate appraisers, licensed real estate brokers and
accredited real estate salespersons (as kindred
members) and thereafter formally apply and petition the
Professional Regulatory Board on Real Estate Service
(PRBRES) and the Professional Regulation Commission
as an Accredited and Integrated Professional
Organization (AIPO) as required by Sec. 34 Art. IV
RA9646 for the real estate service.

Subsequently, with other real estate industry


notable personalities in attendance aside from the
original Convenors Group, the distinguished
ladies and gentlemen of the Convenors Group
met and organized themselves on 6 May 2010.
Viva voce nominations were made and elections for
various Trustee and Officer positions were held via
secret ballot and distinguished ladies and
gentlemen of various and diverse associations or
organizations were elected to be the founding
incorporators and trustees of PhilRES.

On May 13, 2010 the collectively and democratically


elected Founding Incorporators, Trustees and
Officers of PhilRES formally met and
collectively acted (a) in their moral duty and
obligation to perform to the best of their abilities,
their functions and capacities (b) in the best interest
of their respective organizations, members and of
the entire real estate profession, and (c) in exercise
of their individual and collective constitutional
rights guaranteed under Section 8 Article III of the
1987 Constitution of the Republic of the Philippines
and executed the Articles of Incorporation and By
Laws with the Hon. Rodolfo G. Valencia principal
author of R. A. 9646 acting as principal witness in
the execution of the historic document.

Practitioners (PhilRES) Incorporated
was filed with the Securities and Exchange
Commission on 17 May 2010 and was duly
approved and registered on 19 May 2010 as a
non-stock, non-profit professional association
with SEC Registration No. CN201007483 .

On 20 May 2010 PhilRES formally filed for the


recognition and accreditation by the Professional
Regulatory Board on Real Estate Service (PRBRES) as
the
Accredited
and
Integrated
Professional
Organization (AIPO) for the real estate service
pursuant to the provisions of Republic Act No. 9646
(Real Estate Service Act of the Philippines), its
Implementing Rules and Regulations, and Professional
Regulation Commission Resolution No. 2004-178
Series of 2004.
Other petitioners who filed for recognition and
accreditation as the AIPO for the real estate service
profession include the Federation of Real Estate
Service
Associations
(FRESA)
and
REBAP,
Incorporated.

The Federation of Real Estate Service Associations


(FRESA) was only a de facto entity at the time of
its application to be recognized as the AIPO for
the real estate service and at the time of its
appointment as the Interim AIPO for the real
estate service on 23 November 2009. This was a
clear violation of the provisions of PRC Res. 2004178 as its Articles of Incorporation was only
approved by the SEC only on 17 June 2010.
The Founding Member Associations of FRESA are,
PAREB, REBAP, NREA, IPREA, PARA, PARCS and
NARPhil.

On 25 May 2010, the Committee on Accredited


Professional Organization of the Professional
Regulatory Board on Real Estate Service
(PRBRES) chaired by the Hon. Bansan C. Choa,
submitted its Report / Recommendation to the
Chairman of the Professional Regulatory Board on
Real Estate Service (PRBRES) and submitted to
the Office of the Secretary, Professional
Regulation Commission on 02 June 2010

On November 26, 2010 PhilRES submitted its


restated and URGENT PETITION to the
Professional Regulatory Board of Real Estate
Service (PRBRES) to lift the order of
deferment imposed upon PhilRES on the basis
of FULL COMPLIANCE by PhilRES to the
Recommendations of of the Committee on
Accredited Professional Organization chaired
by Hon. Bansan C. Choa.

On November 29, 2010 after the Mass Oath Taking of the


First Real Estate Service Practitioners of the Philippines
held at the Manila Hotel, many newly licensed real
estate service practitioners formed the First Assembly of
Licensed Real Estate Service Practitioners of the
Philippines in the exercise of their constitutional right to
form associations and subsequently held their own
nominations and elections for the purpose of setting-up
a professional organization.
However, due to a pre-conditional requirement to seek
the prior indorsement of PRBRES and PRC before the SEC
can accept new AICs and Amendments of any AICs and
By Laws of Real Estate Service juridical entities as per a
MOA between SEC and the PRC, the First Assembly of
Licensed Real Estate Service Practitioners of the
Philippines failed to set-up its own professional
organization.

On January 20, 2011 the First Assembly of Licensed


Real Estate Service Practitioners of the Philippines
submitted its formal petition to PhilRES requesting
that it be recognized, absorbed and assimilated into
PhilRES en toto as regular members and at the
same time petitioning that new elections be held to
reorganize the National Board of Trustees of PhilRES
pursuant to its publicly declared policies to Act as a
Transitory Caretaker Board of Trustees until such
time that the First Regular National Convention,
Nomination and Elections of ALL licensed real estate
practitioners can be held in September 2011.

The PhilRES Transitory Caretaker National Board of


Trustees finding the petition of the First Assembly of
Licensed Real Estate Service Practitioners of the
Philippines to be in order, meritorious and in keeping
with its corporate principles to protect and serve the
interests of the real estate industry at large, approved
unanimously to recognize, absorb and assimilate into
PhilRES en toto all its members and call for a
reorganization of the National Board of Trustees of
PhilRES to be held on January 26, 2011 to be held at
the Phaltra National Office, 139 Matahimik, UP Village,
Q. C. pursuant to its publicly declared policies to Act
as a Transitory Caretaker Board of Trustees until such
time that the First Regular National Convention,
Nomination and Elections of ALL licensed real estate
practitioners be held in September 2011.

On January 26, 2011 PhilRES held a Special


Meeting and Elections at 139 Matahimik, UP
Village, Q. C. to reorganize its National Board of
Trustees in view of the approved Board Resolution
in response to the petition of the First Assembly
of Licensed Real Estate Service Practitioners of
the Philippines and elected the following National
Trustees and Officers of PhilRES and Act as a
Transitory Caretaker Board of Trustees until such
time that the First Regular National Convention,
Nomination and Elections of ALL licensed real
estate practitioners be held in September 2011.

On January 28, 2011 the Professional


Regulatory Board of Real Estate
Service (PRBRES) officially commenced
to process PhilRES petition to be
accredited as the AIPO for the real
estate service under the PRC.

Official representatives of both PhilRES and

FRESA verbally agreed to and forged A


Gentlemans Agreement to respect and
recognize the PRBRES choice to officially
recommend to the Professional Regulation
Commission to be recognized and accredited
as the AIPO for the real estate service under
the PRC.
As sincere and respectable professionals, this
bound PhilRES and all of FRESAs founding
member associations to honor and uphold
all commitments and agreements entered
into the Gentlemans Agreement.

On August 5, 2011 the Professional


Regulatory Board of Real Estate Service
(PRBRES) officially recommended to the
Professional Regulation Commission
PhilRES petition to be recognized and
accredited as the AIPO for the real estate
service under the PRC.

On October 21, 2011 the Professional


Regulation Commission officially approved the
recommendation of the Professional Regulatory
Board of Real Estate Service (PRBRES) for the
recognition of and accreditation of the
Philippine Institute of Real Estate Service
Practitioners (PhilRES) Incorporated to be
accredited as the Accredited and Integrated
Professional Organization (AIPO) for the real
estate service pursuant to PRC Resolution No.
19 Series of 2011.
PRC Resolution No. 19 Series of 2011 was
published on November 14, 2011 in the Official
Gazette and became effective fifteen (15)
calendar days after its publication.

PhilRES first submitted its original
application for accreditation on 20 May
2010.

On 29 November 2014, PhilRES accreditation as the


AIPO for the real estate service expired pursuant to
the provisions of PRC Res. 2004-178.
Prior to the expiration of its accreditation as the
AIPO for the real estate service, PhilRES dutifully
submitted its petition and application for renewal as
the AIPO for the real estate service in compliance to
the provisions of PRC Res. 2004-178.
In the absence of any TRO or injunction or final
judgement for its dis-accreditation as the AIPO for
the real estate service, PhilRES and its general
membership collectively expects the ministerial and
automatic renewal of its official status as the AIPO
for the real estate service in compliance to the
provisions of PRC Res. 2004-178.

To date, PhilRES boasts of a membership base of


more than 9,850, Fully Law Compliant (RA 8981
compliant and RA9646 compliant) paid members
in Good Standing spread over more than 52 Local
Chapters nationwide.
The collective primordial legal rights and
interests
of all PhilRES Members In Good Standing
are fully protected
under the laws of the Republic of the
Philippines.

AFFIRMATIVE DECLARATION
of
FULL COMPLIANCE & CAPABILITY

PhilRES respectfully manifests and humbly


submit that it is indubitably, generally and
essentially representative of the real
estate industry and has already fully
complied with all the necessary
requirements to be recognized and
accredited as an Accredited and Integrated
Professional Organization (AIPO) as
required by and pursuant to all applicable
existing Laws, Implementing Rules and
Regulations and PRC Resolutions.

The steps and procedures that PhilRES has


undertaken to be recognized and accredited
as the sole Accredited and Integrated
Professional Organization (AIPO) representing
ALL the real estate professionals under the
supervision and control of the Professional
Regulatory Board of Real Estate Service
Board (PRBRES) and the Professional
Regulation Commission (PRC) are consistent
with prevailing law and jurisprudence.

PhilRES possesses the national


organizational structure, capabilities and
roster of very respected, esteemed,
capable and eminent leaders to
successfully function and operate as the
sole Accredited Integrated Professional
Organization for the Real Estate Service
Practitioners of the Philippines.
