A well functionning internal market for


road haulage
The objective of Mrs Bulc, Commissioner for
Transport, is to ensure that the same rules
apply
to
alland
that
they
are
better
implemented. (EP- 5 May 2015)
The European commission has embarked on a
review of social legislation in the sector. The
Commissions aim is to simplify and clarify the
current legislations (linked to the REFIT
programme).

The highly mobile workers

In terms of social rules, road haulage has been


treated so far as any other sectors instead of
being regarded as a specific one.
FNTR and CONFTRASPORTO asked the European
Commission to introduce specific rules to clarify
first the cross-boarder social security coverage.

Problems to be addressed

Issues exist with foreign drivers employed to carry


out domestic transport in breach of existing social
legislation.
Illegal employment and barriers to establishment
must be tackled. FNTR and BGL ask for a right
balance between freedom to provide services and
freedom of establishment.
There are also illegal practices with vehicles below
3.5 tonnes. Rules on cabotage must be applied.

Problems to be addressed
Clarification is needed on regulation 561/2006
about driving and rest time. Notably, because of
the different treatment by the Member States of
the issue on weekly rest in cabin.
Uneven playing field exists in implementation and
enforcement practices.
The questions on road safety, on environmental
performance must also be taken into account.
