Application for Increase in Tuition Fee and


other School Fees
(Regional Memo No. 25 s. 2011 and
Regional Memo No. 241 s. 2011

1. Applications for increase in tuition and


other fees shall be filed within directly in
the Regional Office or at the Division
Office not later than February 28 of the
year proceding the school year to which
the proposed increase shall be collected.
No application filed after this date shall be
accepted. Division Office shall forward to
the Regional Office application filed
therein within three (3) days from receipt.

2. For this purpose, every school intending


to increase its tuition fee for the
succeeding school year is advised to
conduct consultation with the concerned
parents and teachers associations within
the month of January.
3. Applications not supported by the
following documents shall not be acted
upon and deemed disapproved.

Required Documents

1. Letter of advised to the Regional Director


signed by the School Head, indicating among
others the school intention to comply with
the provision of DepEd Order No. 88 s.
2010 and RA 6728 on the proposed
increase;
2. Statement under oath of the itemized
current rates of tuition and other charges
and the corresponding itemized proposed
changes thereon, as well as the new fees or
charges proposed to be imposed, the
increase in percentage, and other proposed
allocation of the incremental proceeds;

3. Audited financial statement showing


the financial status of the school in the
preceding year;

4. Copy of the latest income tax return


stamped received by the BIR;

5. Certificate/ Statement under oath

signed by the school head that:


5.1 a prior consultation on the proposed
increase
was conducted with the duly
organized
parents and teachers association,
and faculty
5.2 the authorized representatives of the
associations;
said
associations were furnished a copy
of the
audited financial statement of the
school, the
same with the copy attached to the

70% of the proceeds of the proposed


increase shall be allocated for payment of
salaries or increase in salaries,
wages,
allowances and other benefits of teaching
and
non-teaching
personnel
except
administrators who are principal stock
holders of the school that 20% shall go to the
improvement or modernization of buildings,
equipment,
libraries,
laboratories,
gymnasium and other facilities and payment
of other cost of operations;

5.4 the school head is aware that failure to


comply with the
foregoing requirements
shall forfeit the right of the school to
increase its tuition fee or collect the same;
and
5.5 the increase of tuition / other fees
previously collected went to the payment of
salary increase, wages, allowances and
other benefits of teaching and non-teaching
personnel except administrators who are
principal stock holders of the school that
20% thereof was used for the improvement
or modernization of
buildings, equipment, libraries, laboratories,
gymnasium and other facilities and to
payment of other cost of operation.

date of meeting, objections made by the
organizations
and
counter
proposals
offered and other information;
List of attendees with their addresses and

consultation duly acknowledged by the
concerned organizations, and pictures or
video during the consultation; and
9. Latest payroll.

APPLICATIONS FOR PERMIT OR RECOGNITION


OF
PRIVATE SCHOOLS IN BASIC EDUCATION

Regulations for Private Schools in Basic Education)

PROCESSING OF APPLICATIONS FOR PERMIT


OR RECOGNITION OF PRIVATE SCHOOLS IN
1. Pursuant
to DepEd Order No. 11 s 2010 and
BASIC
EDUCATION
No. 141 s 2011 otherwise known as the 2011

Manual of Regulations for Private Schools in


Basic Education, the period from submission of
application to the issuance of permit outlined in
the attached schedule shall be strictly
observed. A permit shall be issued prior to the
school year preceding the start of the school
year when the new school or new course / year

2. The Division Offices are hereby authorized to

receive applications for authority to operate a


new school or course / year level, by existing
schools, within the period within which to
submit such application. Applications shall be
officially received by the Records Section of the
Division. No application submitted outside the
period specified in the attached schedule shall
be accepted for processing.

3. Upon submission of the application the


Division
Office
shall
assess
the
documentary requirements to determine
the completeness / compliance to the
requirements set forth under Section 30 of
the Manual particularly on Feasibility Study
and its supporting documents.

4. Pursuant to Section 30.1 of the Manual, failure to


submit the Feasibility Study to support the application
for permit shall be a ground for the outright
disapproval of the application. Accordingly, the
Division Office shall immediately inform. In writing,
the applicant school of the outright disapproval citing
this clear provision of the Manual.
5. If the documentary requirements are complete, the
Division Office shall conduct ocular inspection to
validate the information provided by the applicant
school and determine whether it complies with the
standard.
Upon
compliance
with
both
the
documentary requirements and the standards set by
the Department, the Division Office shall forward the
application together with its recommendation. Only
application of schools which are compliant to the
requirements shall be forwarded to the Regional
Office not later than January 30, preceding the

10. If the proposed school is located within
a subdivision, the applicant school shall
submit a written authority from the
Homeowners Association.

rules and regulations shall be required and


made part of the file, for reference.
12. Applications for renewal of permit shall
be filed on or before January 30, supported
by the same requirements.
13. It is reminded that pursuant to the
Manual, a private school which has not been
granted government recognition after more
than five renewal permits may be subject of
closure.

14. Applications for recognition shall be filed


directly with the Regional Office on or before
February 1st preceding the opening of the
school year in which the recognition is
intended.
15. Schools shall post copies of their
permit / recognition on bulletin board
located inside their campus.
16. Immediate and wide dissemination of
this Memorandum for information and
adherence is desired.

The Department of Education, National


Capital Region (DepEd-NCR) and the
undersigned School owners unto the
Honorable Secretary, petition for the
amendment of Section 29, of the of the
2010 Revised Manual of Regulations for
Private Schools in Basic Education

Whereas the specific provision of the 2010


Revised Manual of Regulations for Private
Schools in Basic Education embodied in DepEd
Order
No. 88,29.
s 2010
states: and Recognition.
Section
Permit
Government authority which may be issued for the
operation of private schools in basic education
shall be of two kinds: a) permit and b) recognition.
A permit for each year level or course shall be
effective for a period of one school year. The
permit issued to a school is valid only for a specific
educational program and, while issued on a school
year basis shall remain valid until formally
revoked by the Department. On the other hand,
government recognition for each year evel or
course shall be for an indefinite period provided
that the requirements of law, rules and standards
will be satisfied.

WHEREAS, Section 30 of the 2010 Revised

Manual of Regulations for Private Schools in


Basic Education as amended by DepEd Order
No. 11, s. 2011, reads:

Section 30. Requirements for


Issuance of Permit. Application for the
authority to open a new school, or
operate a new course/year level by
existing pre-elementary, elementary and
secondary schools, shall be submitted to
the Regional Office, or subject to the
authority of the Regional Director, to the
Division Office on or before August 30
preceding the start of the school year
when the new school or new course/year
level is supposed to operate.

The
Regional
Office
shall
assess
the
completeness of the documentary requirements
attached to the subject application. The
applicant school shall be informed in writing of
the deficiencies noted, if any, not later than
September 30 of the same year the said
application was filed. The school shall be allowed
to complete the deficiencies not later than
October 31 of the same year.

If all the documentary requirements are


complete or the school has already complied,
the Regional Office shall conduct ocular
inspection and evaluation of the applicant
schools
compliance
with
the
minimum
standards set for the program applied for, not

After inspection and evaluation, the


applicant school shall be officially informed
of the deficiencies noted, if any, not later
than December 15 of the same year the
subject application was filed and shall be
given until January 31 of the following year
to correct the same. Thereafter, the
Regional Office shall re-evaluate and
validate compliance with the requirements.
If the applicant school complies with all the
requirements, the subject authority shall
be issued not later than February 28 of the
following year the said application was
filed. Otherwise, written disapproval shall
be issued within the same period.

WHEREAS, The Department of Education,


National Capital Region (DepEd NCR), at
present receives large number of
applications to operate new schools or for
renewal of Government Permit.

4. WHEREAS, at present, both the


Elementary and Secondary Divisions of this
Office lack manpower due to the
retirements as well as transfer of most of
the Education Program Supervisors, to
accommodate and process the influx of
such applications.

WHEREAS, there is the pressing need


to lessen the workloads of the
Education Program Supervisors to
allow them to focus and to devote
more quality time in attending to the
urgent concerns of the public schools
in their area of supervision and to
perform their core functions in public
schools.

WHEREAS, DepEd Order No. 11 sets forth


cut-off dates on the submission of
applications and on the specific periods in
which the Office concerned has to act on the
applications. Notwithstanding the specific
periods, the education supervisors fail to
follow the same because of the bulk of
applications. To act promptly on the
applications would mean jeopardizing their
duties and responsibilities to the public
schools they supervise.

amended and shall read as:

That pending the issuance of amendment, DepEdNCR be given authority to suspend the issuance of
permits or declare a moratorium for issuance of
permit to new schools within five (5) years.

That specific distance of schools within NCR be fixed


by the Department.
