LOVE WINS: IS THE

PHILIPPINES
READY?
Itom, Blissy Natalie S.

INTRODUCTION
Beauty in Diversity
Diversity in a sense that renders
equality being the paramount plea of
every nation; wherein it is the rationale
of every mankind that embraces the
thought that differences as well as
change will always be inevitable.
Love knows No boundaries

Realism in Conventional Culture

Culture does not make people but
rather people define culture, policies
and decide what is moral or not.

Complexity in the attainment for equality

Philippines is a country that was honed
from the conservativeness of morals,
intricate yet sensitive development of culture
but a promising country that through its
people would be left with a dilemma of either
to conserve the status quo or openly adapt
and embrace change in tradition, morals and
policies.

Importance of the Study

This paper seeks to examine the readiness of
the country founded and refined by conventional
culture, tradition, righteous morals as well as
upright public policies to clinch into the new
sphere of idealism that adapts the acceptance of
homosexuals to enter and contract marriage in
which this country has manifestly solidify its
conservativeness in contracting into marriage
only between a man and a woman.

MARRIAGE, FAMILY AND

SOCIETY
History affects the present provision
History recalls that family law in the
Philippines is entrenched in different
philosophies, customs and traditions
embodied in the Spanish Civil Code which
became effective in 1889. Centuries unfold
that indeed the drafting of the provisions of
the present family code is mantled and
influenced by an indelible mark of
conservative colonizers.

Marriage as an inviolable social

institution
Article XV, Section 2, 1987 Consitution

Philippines

Procreation: the feasibility between

homosexual and heterosexual marriages
The importance of the exclusivity of the
parties
In this regard, limitation of the parties is
institutionalized to provide realization of the
purpose of family. The society awaits the
marvel of procreation for the belief that this
is the aspect that fuels the succeeding
generation.

The Logic of Procreation

The logic of procreation and the
embodiment of its essence entail the
purpose of protecting mankind from
extinction. This is what the drafters of
the family law would like to show that
marriage through procreating can be
an aspect of realization in founding a
family.

Other aspects of the importance of

marriage:
Domestic Partnership
Personal Economic and Financial
Stability
Traditional definition of marriage is
subjective

MILESTONE OF IMPOSSIBILITY

society is the birth of various aspects
and recognitions of the components
of humanity.

with the passage of a law that would
allow same sex couple to wed
Overwhelming 7 out of 10 believe
that the right to marry should not be
extended to those who are not
heterosexual
Reliogiosity-fueled traditional beliefs

GENDER EQUALITY:
A MATTER OF RIGHT?
US Supreme Courts decision in
legalizing same sex marriage in their
country
1987 Philippine Constitution : Equal
Protection Clause
The claim for the same recognition to
Filipino homosexuals

Actual case or controversy :

Philippine Setting
Leniency of the notion: same sex
relationship is not prohibited by law
A violation of the right to privacy and
liberty then why they are not free to
marry
